While protection of autonomy is crucial to the practice of medicine, there is the persistent risk of a disconnect between the notion of self-determination and the need for a socially responsible medical system. An example of unbridled autonomy is the preferential use of costly medications without an appreciation of the impact of using these more expensive drugs on the resource pool of others. In the USA, costly medications of questionable incremental benefit are frequently prescribed with the complicity of both doctors (...) and patients. Limiting self-determination in medication choices via an appreciation of the principle of justice reaches a better moral balance, while at the same time acknowledging the goals of doing good and avoiding harm in patient care. The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

Explanation is the name for both the process we use to answer questions raised by observed ambiguities and for the conclusion we offer others. This divergence hints at the many conflicting approaches used to create our contemporary understanding of explanation. Modes of Explanation is the first book in decades to attempt to bring these conflicting approaches together and to offer a compelling narrative to explore how those conflicts can converge. In May 2013, fifty philosophers of science, cognitive scientists, systems scientists, (...) cyberneticists, semioticians, and humanities scholars gathered for three full days of debate. These scholars - including the contributors to this volume - compared insights into a variety of conceptions of explanation and their associated worldviews. Through examples such as the creationism/evolution debate, this volume illustrates the major issues regarding explanation through the dual lenses of scientific realism and pragmatic constructivism. Purpose: To determine the relative value that patients place on consent for procedures in the emergency department (ED) and to define a set of procedures that fall in the realm of implied consent. Methods: A questionnaire was administered to a convenience sample 134 of 174 patients who were seen in the ED of a Midwestern teaching hospital. The questionnaire asked how much time they believed was necessary to give consent for various procedures. Procedures ranged from simple (venipuncture) to complex (procedural (...) sedation). Results: Participants valued a simple blood draw at a low mean of 1.02 minutes of extra time and a lumbar puncture at a high mean of 7.78 minutes. Of all participants 52% and 48% noted a time-value of ?0? time on blood draw and intravenous line starts, respectively, indicating that they desire no additional consent for these procedures. Conclusion: Defining a set of ED procedures covered under implied consent will be difficult because many patients value formal consent for even the simplest procedure. (shrink)

While Plantinga has famously argued that acceptance of neo-Darwinian theory commits one to the rejection of naturalism, Plantinga’s argument is vulnerable to an objection developed by Evan Fales. Not only does Fales’ objection undermine Plantinga’s original argument, it establishes a general challenge which any attempt to revitalize Plantinga’s argument must overcome. After briefly laying out the contours of this challenge, we attempt to meet it by arguing that because a purely naturalistic account of our etiology cannot explain the correlation between (...) our preference for simplicity and simplicity’s ability to serve as a veridical method of theory selection, the scientific realist is committed to the rejection of naturalism. When one thinks—knows, believes, imagines—that something is the case, one’s thought has a topic: it is about something, towards which one’s mind is directed. What is the logic of thought, so understood? This book begins to explore the idea that, to answer the question, we should take topics seriously. It proposes a hyperintensional account of the propositional contents of thought, arguing that these are individuated not only by the set of possible worlds at which they are true, but also by (...) their topic: what they are about. The book then builds epistemic, doxastic, probabilistic, and conditional logics based on this view. The patient we call Danny was a mildly mentally retarded male in his mid-thirties who adamantly refused kidney dialysis when it was offered as the only therapeutic option for his progressive kidney failure. It was uncertain how fully Danny understood the implications of his refusal. To complicate the case still further, several “advocates” emerged to speak on Danny's behalf — each with a somewhat different interpretation of the situation and different sets of value presuppositions and ethical principles to apply to (...) the choice. We chronicle the development of this situation through a series of scenes; and in each scene we also attempt to clarify the ethical and medico-legal issues involved at that point. Danny was finally permitted to make this decision for himself — though more by default than by an agreement by all parties to honor his autonomy. Our hope is that this presentation will lead to further discussion and clarification of these important issues. (shrink)

We need to understand the impossible. Francesco Berto and Mark Jago start by considering what the concepts of meaning, information, knowledge, belief, fiction, conditionality, and counterfactual supposition have in common. They are all concepts which divide the world up more finely than logic does. Logically equivalent sentences may carry different meanings and information and may differ in how they're believed. Fictions can be inconsistent yet meaningful. We can suppose impossible things without collapsing into total incoherence. This book discusses the metaphysics of impossible worlds and applies the concept to a range of central topics and open issues in logic, semantics, and philosophy. It considers problems in the logic of knowledge, the meaning of alternative logics, models of imagination and mental simulation, the theory of information, truth in fiction, the meaning of conditional statements, and reasoning about the impossible. Behaviourism is the view that preferences, beliefs, and other mental states in social-scientific theories are nothing but constructs re-describing people's behaviour. Mentalism is the view that they capture real phenomena, on a par with the unobservables in science, such as electrons and electromagnetic fields. While behaviourism has gone out of fashion in psychology, it remains influential in economics, especially in ‘revealed preference’ theory. We defend mentalism in economics, construed as a positive science, and show that it fits best scientific practice. (...) Pets are truly great companions. Some individuals feel that owning a pet can help them prepare for a growing family by giving them a taste of what it would be like to have children. This study also looks into the psychological well-being and life experiences of LGBT fur parents. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) With the presence of fur babies, participants had the ease to overcome stressful events, especially the ones that affect their (...) mental health. With these, they have the desire to take care of their fur babies under all circumstances because they see their fur babies as family members. Fur babies are excellent sources of motivation, confidence, and happiness for fur parents. They are treated as family members because they contribute to the mental and emotional aspects of fur parents. Moreover, the majority of respondents valued their pets far more than their actual family members, however, some didn't spend as much time with their relatives and friends. This study comes to the conclusion that a stronger bond with one's dog was also linked to higher anxiety about being unloved and rejected by family members and people surrounding us, which was linked to a heavier impact on one's psychological well-being. In reality, fur parents, especially LGBT parents, offer their fur babies a lot of love and attention compared to other things. (shrink)

The debate over risk-related standards of decisional capacity remains one of the most important and unresolved challenges to our understanding of the demands of informed consent. On one hand, risk-related standards benefit from significant intuitive support. On the other hand, risk-related standards appear to be committed to asymmetrical capacity—a conceptual incoherence. This latter objection can be avoided by holding that risk-related standards are the result of evidential considerations introduced by (i) the reasonable person standard and (ii) the standing assumption that (...) patients have capacity. This evidential approach to justifying risk-related standards of capacity avoids the most significant challenges faced by extant views while grounding risk-related standards in two fairly uncontroversial views in biomedical ethics. We propose a new account of indicative conditionals, giving acceptability and logical closure conditions for them. We start from Adams’ Thesis: the claim that the acceptability of a simple indicative equals the corresponding conditional probability. The Thesis is widely endorsed, but arguably false and refuted by empirical research. To fix it, we submit, we need a relevance constraint: we accept a simple conditional 'If φ, then ψ' to the extent that (i) the conditional probability p(ψ|φ) is high, provided that (ii) (...) φ is relevant for ψ. How (i) should work is well-understood. It is (ii) that holds the key to improve our understanding of conditionals. Our account has (i) a probabilistic component, using Popper functions; (ii) a relevance component, given via an algebraic structure of topics or subject matters. We present a probabilistic logic for simple indicatives, and argue that its (in)validities are both theoretically desirable and in line with empirical results on how people reason with conditionals. I present a formal theory of the logic and aboutness of imagination. Aboutness is understood as the relation between meaningful items and what they concern, as per Yablo and Fine’s works on the notion. Imagination is understood as per Chalmers’ positive conceivability: the intentional state of a subject who conceives that p by imagining a situation—a configuration of objects and properties—verifying p. So far aboutness theory has been developed mainly for linguistic representation, but it is natural to extend it to (...) intentional states. The proposed framework combines a modal semantics with a mereology of contents: imagination operators are understood as variably strict quantifiers over worlds with a content-preservation constraint. While copious quantities of ink have been spilled on the topic of autonomy in the context of health care, little has been written about autonomy in relation to intellectual disability. After presenting the received account of capacity, we argue that it cannot account for the moral permissibility of limiting an individual with intellectual disability’s access to diet soda. In cases of preventative medicine and intellectual disability, the philosophical motivation for the received account of capacity is incompatible with the actions it (...) recommends. We consider and reject several potential solutions; then, drawing on applied behavior analysis and the phenomenon of automatic reinforcement, we propose our own solution. We introduce a “reason-based” framework for explaining and predicting individual choices. It captures the idea that a decision-maker focuses on some but not all properties of the options and chooses an option whose motivationally salient properties he/she most prefers. Reason-based explanations allow us to distinguish between two kinds of context-dependent choice: the motivationally salient properties may (i) vary across choice contexts, and (ii) include not only “intrinsic” properties of the options, but also “context-related” properties. Our framework can accommodate boundedly rational (...) and sophisticatedly rational choice. Since properties can be recombined in new ways, it also offers resources for predicting choices in unobserved contexts. (shrink)

This paper focuses on a hypothetical case that represents an intervention request familiar to those who work with individuals with intellectual disability. Stacy has autism and moderate intellectual disability. Her parents have requested treatment for her hand flapping. Stacy is not competent to make her own treatment decisions; proxy consent is required. There are three primary justifications for proxy consent: the right to an open future, substituted judgment, and the best interest standard. The right to an open future justifies proxy (...) consent on the assumption of future autonomy whereas substituted judgment justifies proxy consent via reference to past autonomy. Neither applies. Stacy has not been, nor will she be, competent to make her own treatment decisions. The best interest standard justifies proxy consent on the grounds of beneficence. It is unlikely that hand flapping harms Stacy. None of the three primary means of justifying proxy consent apply to Stacy’s case. (shrink)

Unification was originally introduced in automated deduction and term rewriting, but has recently also found applications in other fields. In this article, we give a survey of the results on unification obtained in two closely related, yet different, application areas of unification: description logics and modal logics.

The first introductory textbook on description logics, relevant to computer science, knowledge representation and the semantic web.

On the basis of the characterization of autonomy set out by Beauchamp and Childress in Principles of Biomedical Ethics, we first explore some of the parameters along which autonomy may vary in degree through a series of hypothetical examples drawn from various settings; and, second and in more detail, we examine how the range of autonomy is affected through informed consent to various medical diagnostic tests. Our conclusions are (1) that there are significant implications for patient autonomy inherent in new (...) and forthcoming diagnostic modalities, and (2) that attention should be paid to these implications in formulating policies for both clinical practice and research. We close with (a) some specific policy recommendations for clinical practice and research, and (b) some metaphysical speculations raised by our explorations. (shrink)

Which rules for aggregating judgments on logically connected propositions are manipulable and which not? In this paper, we introduce a preference-free concept of non-manipulability and contrast it with a preference-theoretic concept of strategy-proofness. We characterize all non-manipulable and all strategy-proof judgment aggregation rules and prove an impossibility theorem similar to the Gibbard--Satterthwaite theorem. We also discuss weaker forms of non-manipulability and strategy-proofness. Comparing two frequently discussed aggregation rules, we show that “conclusion-based voting” is less vulnerable to manipulation than “premise-based voting”, (...) which is strategy-proof only for “reason-oriented” individuals. Surprisingly, for “outcome-oriented” individuals, the two rules are strategically equivalent, generating identical judgments in equilibrium. Our results introduce game-theoretic considerations into judgment aggregation and have implications for debates on deliberative democracy. (shrink)

It was his work that set Husserl on to the road of phenomenology and intentionality, that inspired Meinong's theory of the object which influenced Bertrand Russell, and the entire Polish school of philosophy. ^Descriptive Psychology presents a series of lectures given by Brentano in 1887; they were the culmination of his work, and the clearest statement of his mature thought. It was this later period which (...) proved to be so important in the work of his student, Husserl. This is the first English translation of his work. This paper outlines the development and implementation of a new course in Engineering Ethics at the University of Tennessee. This is a three-semester-hour course and is jointly taught by an engineering professor and a philosophy professor. While traditional pedagogical techniques such as case studies, position papers, and classroom discussions are used, additional activities such as developing a code of ethics and student-developed scenarios are employed to encourage critical thinking. Among the topics addressed in the course are engineering as a profession (...) and its role in society; ethical successes and failures; risk, safety, and the environment; professional responsibilities; credit and intellectual property; and international concerns. Public reason as a political ideal aims to reconcile reasonable disagreement; however, is public reason itself the object of reasonable disagreement? Jonathan Quong, David Estlund, Andrew Lister, and some other philosophers maintain that public reason is beyond reasonable disagreement. I argue this view is untenable. In addition, I consider briefly whether or not two main versions of the public reason principle, namely, the consensus version and the convergence version, need to satisfy their own requirements. Citizens' competence for democratic self‐government must be judged by their ability to perform the typical functions of modern citizenship, rather than by their scores on surveys of political information—which are flawed in a variety of important respects. The role requirements for effective citizenship have changed throughout American history because government has grown vastly in size, complexity, and the range of functions that it performs. Effective use of citizens’ political talents therefore requires limiting public surveillance and advice to broad overview aspects, (...) rather than to micro‐management. Citizens perform these more limited functions adequately, demonstrating that government by the people remains viable under modern conditions. (shrink)

The recent success of Foldit in determining the structure of the Mason-Pfizer monkey virus (M-PMV) retroviral protease is suggestive of the power-solving potential of internet-facilitated game-like crowdsourcing. This research model is highly novel, however, and thus, deserves careful consideration of potential ethical issues. In this paper, we will demonstrate that the crowdsourcing model of research has the potential to cause harm to participants, manipulates the participant into continued participation, and uses participants as experimental subjects. We conclude that protocols relying on (...) this model require institutional review board (IRB) scrutiny. (shrink)

Much of contemporary political philosophy revolves around debates over perfectionism, which is the view that the state may, or should, promote valuable conceptions of the good life and discourage conceptions that are worthless or bad. Collis Tahzib has recently proposed a unique theory of perfectionism. I examine two central aspects of his theory: the amalgamation of public reason and perfectionism, and the employment of the Rawlsian lexical priority. I argue that Tahzib’s idea of perfectionist public reason has certain serious problems. (...) Additionally, Tahzib, like many other perfectionists, has neglected that many excellences are at once personal and civic. I sketch a perfectionist account of civic virtue, with the hope of opening up space for defending and justifying perfectionism. (shrink)

The widely discussed "discursive dilemma" shows that majority voting in a group of individuals on logically connected propositions may produce irrational collective judgments. We generalize majority voting by considering quota rules, which accept each proposition if and only if the number of individuals accepting it exceeds a given threshold, where different thresholds may be used for different propositions. After characterizing quota rules, we prove necessary and sufficient conditions on the required thresholds for various collective rationality requirements. We also consider sequential (...) quota rules, which ensure collective rationality by adjudicating propositions sequentially and letting earlier judgments constrain later ones. Sequential rules may be path-dependent and strategically manipulable. We characterize path-independence and prove its essential equivalence to strategy-proofness. Our results shed light on the rationality of simple-, super-, and sub-majoritarian decision-making. (shrink)
