To show that discrimination against the terminally ill is a real and worrisome phenomenon Reed presents four examples1. Here, I focus on the final two: right-to-try and right-to-die laws. I argue that they are not instances of discrimination, because they grant rights. Reed appears to have overlooked that rights differ from obligations in ways that leave his argumentation unsuccessful. According to the most prominent theory of rights, rights function to protect the personal interests of their holders.2 For that reason, strengthening (...) rights implies weakening discrimination. Granting women the right to vote by itself meant that they were being less discriminated against. Rights also fail to meet standardly accepted definitions of discrimination. As Reed explains, for discrimination to occur, it is necessary that a significant disadvantage is imposed on a socially salient group. Policies can impose disadvantages by being obligations. While rights sometimes enable disadvantages, they never impose them. More precisely, rights may entitle their holders to subject themselves to disadvantages. The right to try entitles the terminally ill to subject themselves to harms caused by investigational drugs. The right to die entitles the terminally ill to voluntarily subject themselves to the deprivation of life. Contrast this with a policy that requires the terminally ill to take investigational drugs. The essay examines Anselm’s De libertate arbitrii and De casu diaboli, arguing that the points made about the will and free choice are mirrored in the questions and struggles of the student interlocutor in the dialogues. In contrast to Plato and Aristotle, who want to bring us to see that virtue is the path to happiness, Anselm wants to show that we have free choice and are responsible for not choosing rightly (i.e., choosing justice for its own sake), and that (...) human beings are autonomous but also finite and flawed. For this kind of learning, not just reasoning but insight and self-examination are required, a process reflected in the very human will, willfulness, and weakness of the student as he engages with his teacher. Public, private, non-profit and for-profit nursing education enterprises in the U.S. are competing with one another in a newly complex and volatile educational landscape, placing academic leaders into situations fraught with moral, ethical and legal compromise with few precedents for guidance. This case study provides a richly contextualized narrative exploration of ethical and legal challenges to one leader’s moral courage, a fictionalized exploration drawn from multiple sources over time, to form a composite that is nonetheless firmly rooted in the complexity (...) and competitiveness characteristic of nursing education today. Our purpose is three-fold: 1) to direct the reader to moral and ethical questions that require thoughtful discourse and analysis among current and future academic nursing leaders; 2) to raise the issue of the need for regulations and oversight that reflect the changing realities of today’s increasingly complex and competitive educational arena; and 3) to encourage nursing education leaders to share additional cases that resonate for them, and in so doing, to expand the wellspring of ideas from which we can all draw in becoming more effective and morally courageous leaders. Public accounting firms can build integrity within their organizations through early detection of fraud. One way to reduce and detect fraud is to encourage whistleblowing as a prosocial behavior. We explore the impact of mentoring on intention to report fraud. A survey with 120 responses from the US public accountants suggests that quality mentoring relationships, a common feature in the profession, and caring ethical climate positively relate to internal reporting of fraud. Two intermediate variables, trust and affective commitment, mediate these (...) effects. Mentor-relationship quality also increases perceptions of caring ethical climate. The study contributes to two bodies of research by finding extended benefits from mentoring, beyond those typically discussed in academic literature; and identifying a previously unexplored firm intervention capable of positively influencing prosocial behavior and combating fraud. This essay focuses on three interpretations of Aquinas influenced by Continental philosophy, those of John Caputo, Jean-Luc Marion, and John Milbank/Catherine Pickstock. The essay considers the well-worn question, whether Aquinas is an onto-theologian in Heidegger’s sense, but looks more broadly at the point of contact common to these interpretations: Aquinas’s relationship to modernity.As Continental thought has put into question the nature of philosophy through a critical look at modern philosophy—questioning its self-representation as progress and characterizing the present as post-modern—Aquinas is (...) of interest to Continental thought in his anti-modernity. Inspired by the report, Reimagining our Futures Together. A New Social Contract for Education, which warns that humanity and planet Earth are under threat, but acknowledges that education has the power to bring about profound change, this article makes the case for giving careful consideration both to Paul Ricœur’s reflections on humanity and human capacities, and to his comments on “true education” and the educational value of poetic thought. To get a sense of where scientific-technological civilization is headed, it draws (...) on the work of Allen Buchanan and Dominique Janicaud. It then examines Ricœur’s account of the essential characteristics of education and his thoughts on the roles of families and teachers. It argues that Ricœur’s proposal for the cultivation of an “ethical consciousness” offers greater protection for humanity in an uncertain future than Janicaud and Buchanan’s proposals for “ethical vigilance” and rules-based protective measures. This paper takes meals, rather than food itself, as its focus. Meals incorporate the project of nutrition into human life, but it is a contingent matter that we nourish ourselves in this way. This paper defends the importance of meals as meaning-makers and contrasts them with art in that regard. Meals and art represent interestingly different extremes with respect to how needs for meaning are met. Artworks ask for coordination of experience, understanding and appreciation: the meaning of art is to (...) be experienced. John Rist's What Is a Person? is a scholarly, rich, and trenchant study of the history of the concept of personhood in Western thought. However, its sharp critique of modern and postmodern accounts of personhood, though thought-provoking, also uses jarringly polemical language, which further undermines the book's flawed overall argument. The first section, "Constructing the Mainline Tradition," carefully mines ancient and medieval sources, tracing with nuance and complexity the different threads in the notion of person. The threads are religious, philosophical, (...) legal, and literary, and the philosophical sources are multiple. Should we aspire to aesthetic consistency? Two kinds of aesthetic consistency are considered, following Ted Cohen’s discussion of consistency in personal aesthetics: consistency of aesthetic reasons and coherence of aesthetic personality. Neither of these kinds of consistency seems like something to aspire to, possibly because we cannot do so – if we are not typically reasoning at the level of aesthetic response that is envisaged – or because consistent, coherent responsiveness does not seem like a worthwhile aesthetic goal. A third (...) kind of consistency is defended, at the level of reflection on the desirable functions of art. We can try to be consistent about broadly ethical principles, showing our commitments as to the goods that art should provide in a life or to a society. These very broad principles do not make direct or clear aesthetic contact with individual artworks, so we cannot straightforwardly apply them as evaluative principles. But we can be consistent in trying to link the very specific achievements of works with these reflective values. (shrink)

Reasoning about ulterior motives was investigated among children ages 6–10 years (total N = 119). In each of two studies, participants were told about children who offered gifts to peers who needed help. Each giver chose to present a gift in either a public setting, which is consistent with having an ulterior motive to enhance one's reputation, or in a private setting, which is not consistent with having an ulterior motive. In each study, the 6- to 7-year olds showed no (...) evidence of understanding that the public givers might have ulterior motives, but the 8- to 10-year olds rated the private givers more favorably. In , the older children were more likely than the younger children to refer to impression management when explaining their judgments of the givers. The younger children who mentioned impression management did so to justify a preference for public givers (e.g., by explaining that public givers are nicer because more of their peers will know that they are nice). Results from suggest that developmental change in children's reasoning about intentions and social outcomes contributes to their understanding of ulterior motives. (shrink)

Kit Fine and Gideon Rosen propose to define constitutive essence in terms of ground-theoretic notions and some form of consequential essence. But we think that the Fine–Rosen proposal is a mistake. On the Fine–Rosen proposal, constitutive essence ends up including properties that, on the central notion of essence, are necessary but not essential. This is because consequential essence is closed under logical consequence, and the ability of logical consequence to add properties to an object’s consequential essence outstrips the ability of (...) ground-theoretic notions, as used in the Fine–Rosen proposal, to take those properties out. This book draws on transpersonal anthropology and psychology in order to explore mild altered states of consciousness (ASCs) experienced in everyday life. While research into consciousness and particularly ASCs is growing, this book focuses on a neglected area: ‘everyday’ experiences of ASCs. Opening with an up-to-date overview of the development of the study of ASCs, the author presents an in-depth empirical exploration and mapping of mild ASCs. Dr Sheppard examines original research conducted in a range of religious and secular contexts (...) with participants who were engaged in activities including prayer, sport, nature conservation, music and musical instrument making, and TV viewing. The author takes a novel phenomenological approach to the analysis of ASCs, emphasising the subjective experience. The book explores the healing potential of such mild ASCs; the everyday fantasy reality of the interior landscape; and discusses the problem of validity, and belief in the study of ASCs. Hartry Field’s epistemological challenge to the mathematical platonist is often cast as an improvement on Paul Benacerraf’s original epistemological challenge. I disagree. While Field’s challenge is more difficult for the platonist to address than Benacerraf’s, I argue that this is because Field’s version is a special case of what I call the ‘sociological challenge’. The sociological challenge applies equally to platonists and fictionalists, and addressing it requires a serious examination of mathematical practice. I argue that the non-sociological part of Field’s (...) challenge amounts to a minor reformulation of Benacerraf’s original challenge. So, I contend, Field’s challenge is not an improvement on Benacerraf’s. What is new to Field’s challenge is as much a problem for the fictionalist as it is for the platonist. (shrink)

Of those who have tried to establish the connection between hermeneutics and phenomenology, two stand out: Martin Heidegger and Paul Ricoeur. In Being and Time, Heidegger famously declared that phenomenology is a hermeneutic, though not in the sense of an epistemological theory of interpretation. In From Text to Action, Ricoeur set out to show how it is possible for hermeneutics and phenomenology to have a relationship of “mutual belonging”. This chapter examines four programmatic statements on the relationship: two versions offered (...) by Heidegger in the 1920s and two versions offered by Ricoeur, one in the late 1960s and the other in the mid‐1980s. Attention is drawn both to the evolution of Heidegger's and Ricoeur's thinking on the subject and to the ways in which the various accounts differ from one another. (shrink)

This paper explores labour negotiations between nurses and government in the public health sector in Australia between 1996 and 2005. During this period, industrial negotiations between nurses and government in the public health sector moved from centralized wage determinations to agreements made at the level of the enterprise through the Workplace Relations Act 1996. Simultaneously, public sector nurses reported increased work intensification, a result of new public management strategies. This led to the Australian Nursing Federation negotiating enterprise agreements that included (...) the introduction of highly specified workload algorithms in an attempt to de‐intensify nurses’ labour. The irony of this strategy is that these calculations and tools operate as both a human resource mechanism for maximizing productivity as well as an industrial relations tool for reducing work intensification. Working relationships between practice nurses and general practitioners in Australia: a critical analysisThis research set out to explore shared care between practice nurses and general practitioners in South Australia. Nine practice nurses (PNs), two nurse practitioners and 10 general practitioners (GPs) were interviewed in urban and rural practices in order to build up a picture of how GPs and PNs worked together. The interviews showed that shared care was not a reality, although practice nurses were very busy, enjoyed their work (...) and were no longer performing as receptionists doing a little nursing on the side, but as highly skilled nurses. Questions that emerged included whether or not practice nurses are specialists or generalists; their relationship to nurse practitioners; the extent to which the doctor–nurse game explains the relationship between practice nurses and general practitioners; and the potential for expanding the practice nurse role.
