Michael Oakeshott (1901-1990) was one of the leading British philosophers of the twentieth century. He has been influential particularly as a political philosopher, but his work reflects a range of philosophical interests that have more gradually come to be appreciated. In this volume a broad group of scholars offers a comprehensive overview of Oakeshott's philosophy, including his moral and political philosophy, his philosophy of history, science and aesthetics, and his views on the role of education. Among the subjects of his books and essays are philosophies of history, science, and aesthetics. 2 A close look at these writings exposes a different Oakeshott, not a conservative defender of the importance of practice and tradition but a radical thinker familiar with the trends of his own time and deeply influenced by them.Among those philosophies aesthetics is perhaps the most obscure one. Indeed, the significance of aesthetics for Oakeshott is readily recognized by commentators. His thought is often portrayed as having a strong aesthetic dimension. Thus, the influence of the Renaissance and Romanticism on his worldview is emphasized, he is sometimes compared with European existentialists, and one commentator even described his life as "poetic, not prosaic." 3 But, there [End Page 717] are relatively few studies outlining the development of Oakeshott's aesthetic theory. 4 These are usually found in short chapters in general surveys of Oakeshott's philosophy. Thus, W. H. Greenleaf analyzes Oakeshott's theory of aesthetics in the context of the idealistic tradition exemplified by Hegel, Croce, and Collingwood; Robert Grant discusses and rejects what he sees as the deceptive parallels between Oakeshott and the Bloomsbury group, and Andrew Sullivan argues that an aesthetic dimension is present in Oakeshott's concepts of practice and politics. 5Reasons for this neglect may lie in the fact that Oakeshott wrote little about aesthetics and that he was very ambiguous in his views on the character of this form of human experience. He formulated his views on science and history relatively early and never departed from them afterwards. These are first presented in the philosophical treatise Experience and Its Modes (1933).By contrast, it took him a long time to elaborate a coherent theory of aesthetics. It appears only in the essay "The Voice of Poetry in the Conversation of Mankind," first published in 1959. This theory, however, occupies a central place in Oakeshott's mature philosophy as he radically defends "poetry" as one of the independent worldviews which constitute the character of modern experience. The purpose of this paper is to present the development of Oakeshott's view of the autonomy of aesthetic experience within its intellectual context.Oakeshott's interest in art is visible in his early publications in which he tends to recognize the independent character of aesthetic experience. He makes clear the attitude towards art he is defending in his first student article which discusses the character of Shylock in Shakespeare's drama. Oakeshott is attracted by Shakespeare's ability to describe a villain as a character and by his capacity for sympathy for a personality, some of whose traits he may have loathed. It is often assumed that European thought contained several conceptually distinct and equally influential notions of liberty. The article challenges this perception, arguing that European history was dominated by one concept of liberty. It attempts to show that the tendency to dismiss the idea of one concept of liberty is premature. Such an attitude is caused either by misplaced interpretations of ancient texts, by exaggerated historicism, or by an anachronistic reading of early modern political thought. Jacob Talmon and Michael Oakeshott represent two opposite tendencies in the anti-totalitarian world view. Both thinkers share many central features of this broad intellectual trend, such as the equation between the Soviet and Nazi regimes, Anglophilia and the rejection of the utopian quest. Yet this basic agreement should not distract us from significant differences in attitude and temperament. Talmon, like most other critics of totalitarianism, was strongly affected by the atmosphere of a profound intellectual and political crisis in Europe, and (...) he regarded the danger of totalitarianism to be an inherent aspect of modernity itself. His liberalism was that of ‘fear’. By contrast, for Oakeshott, who believed in the strength of liberal, and specifically British, civilisation, totalitarianism was merely a child of resentment, a parasitic force with no positive message of its own. He thus displayed a greater measure of confidence in the fortunes of liberal modernity. (shrink)

This article argues that Oakeshott's theory of freedom possesses a greater degree of coherence than is often perceived. Freedom in Oakeshott's philosophy may be defined as `recognized contingency', combining the notions of a genuine choice of action and of an agent's awareness of having such a choice. Oakeshott employs his notion of freedom in two different contexts. One is the context in which freedom is understood as a concept distinguishing what is conceived as `human' from what is conceived as `non-human'. (...) The other context is that of membership in societies, which under certain circumstances can be characterized either by the presence or the lack of freedom. The article argues that, while at first glance Oakeshott's ideas look counter-intuitive, at a deeper level this understanding of freedom is akin to that prevalent in the consciousness of modern liberal societies. The significance of the German philosopher and social thinker, Georg Simmel, is only now being recognised by intellectual historians. Through penetrating readings of Simmel's thought, taken as a series of reflections on the essence of modernity and modern civilisation, Efraim Podoksik places his ideas within the context of intellectual life in Germany, and especially Berlin, under the Kaiserreich. Modernity, characterised by the growing differentiation and fragmentation of culture and society, was a fundamental issue during Simmel's life, underpinning central intellectual (...) debates in Imperial Germany. Simmel's thought is depicted here as an attempt at transforming the complexity of these debates into a coherent worldview that can serve as an effective guide to understanding their main parameters. Paying particular attention to the genealogy and usage of the concepts of Bildung, culture and civilisation in Germany, this study offers contextual analyses of Simmel's philosophies of culture, society, art, religion and the feminine, as well as his interpretations of Dante, Kant, Nietzsche, Schopenhauer, Goethe and Rembrandt. The article suggests that Simmel’s thought should be interpreted as a coherent series of continuous attempts to solve philosophically the dilemmas entailed in the German ideal of Bildung. By analysing Simmel’s three short essays on Italian cities, and by placing them in the context of both his own intellectual development and the intellectual context of his time, the article will show how ideas expressed in these essays reflect this basic character of Simmel’s thought. In other words, far from being independent (...) momentary images, Simmel’s essays on Italian cities reflect his concern with whether and how culture in general, and works of art in particular, may help modern personality reconcile itself with the world. Elizabeth Corey suggests that in order to understand Michael Oakeshott's worldview one should pay special attention to two subjects, religion and aesthetics, and analyze the connection between these two realms and the idea of practical life in general and of politics in particular. Her book provides a sympathetic but also critical conversation with Oakeshott's ideas, ultimately offering us a coherent picture of the place of the religious, poetical, and political in the totality of his thought. Corey persuasively shows that the (...) major ideas of the mature Oakeshott originated in his earlier religious convictions and that his philosophy of aesthetics, contrary to what his critics claimed, fit nicely in the general framework of his thought. Two ideas lie at the heart of Oakeshott’s philosophy: the notion of the inherent plurality of modern experience and the notion of a modern state as a purposeless civil association. These ideas signify Oakeshott’s rejection of the intellectual tradition of British Idealism by which he was influenced in his twenties. The breaking point was the publication of Experience and its Modes, although, with regard to social philosophy, the process of the abandonment of holistic Idealism lasted longer and was completed only (...) with the publication of On Human Conduct. The main difference between Oakeshott and other British Idealists lies in his radical rejection of methodological holism. It is suggested that this rejection might be an outcome of influences of continental philosophical traditions, and that Oakeshott’s philosophy is especially indebted to the ideas of the fragmentation of experience prevalent in Central European Idealism, and particularly in neo-Kantianism. The paper argues that modern political life faces a seemingly irresolvable contradiction. On the one hand, a moral judgement in politics can refer only to the consequences of any policy. On the other hand, in modern society no consequences can be reasonably predicted at the moment a decision is taken. This renders political life unbearable from the moral point of view, because almost any political decision is likely subject to failure in the future. The solution to this dilemma is to (...) understand modern politics as a contract of fallibility, according to which citizens agree to withhold their moral judgements, as long as others do not act as if they assume their own infallibility. The adoption of such a theory might remove the sense of inescapable failure from ethically inclined political actors and emancipate our political discourse from irrational moralistic absolutism. In addition, the contract of fallibility can serve as the most economical justification of modern representative democracy. (shrink)

We have identified a sample of 53 societies outside of the classical Himalayan and Marquesean area that permit polyandrous unions. Our goal is to broadly describe the demographic, social, marital, and economic characteristics of these societies and to evaluate some hypotheses of the causes of polyandry. We demonstrate that although polyandry is rare it is not as rare as commonly believed, is found worldwide, and is most common in egalitarian societies. We also argue that polyandry likely existed during early human (...) history and should be examined from an evolutionary perspective. Our analysis reveals that it may be a predictable response to a high operational sex ratio favoring males and may also be a response to high rates of male mortality and, possibly, male absenteeism. Other factors may contribute, but our within-polyandry sample limits analysis. (shrink)

The aim of this study is to explore how nurses perceive patient participations of patients over 75 years old undergoing hemodialysis treatment in dialysis units, and of their next of kin. Ten nurses told stories about what happened in the dialysis units. These stories were analyzed with critical discourse analysis. Three discursive practices are found: (1) the nurses’ power and control; (2) sharing power with the patient; and (3) transferring power to the next of kin. The first and the predominant (...) discursive practice can be explained with an ideology of paternalism, in which the nurses used biomedical explanations and the ethical principle of benefice to justify their actions. The second can be explained with an ideology of participation, in which the nurses used ethical narratives as a way to let the patients participate in the treatment. The third seemed to involve autonomous decision-making and the ethical principle of autonomy for the next of kin in the difficult end-of-life decisions. (shrink)

Because factory-farmed meat production inflicts gratuitous suffering upon animals and wreaks havoc on the environment, there are morally compelling reasons to become vegetarian. Yet industrial plant agriculture causes the death of many field animals, and this leads some to question whether consumers ought to get some of their protein from certain kinds of non factory-farmed meat. Donald Bruckner, for instance, boldly argues that the harm principle implies an obligation to collect and consume roadkill and that strict vegetarianism is thus immoral. (...) But this argument works only if the following claims are true: all humans have access to roadkill, roadkill would go to waste if those who happen upon it don’t themselves consume it, it’s impossible to harvest vegetables without killing animals, the animals who are killed in plant production are all-things-considered harmed by crop farming, and the best arguments for vegetarianism all endorse the harm principle. As I will argue in this paper, each claim is deeply problematic. Consequently, in most cases, humans ought to strictly eat plants and save the roadkill for cats. (shrink)

An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

In recent discussions, it has been argued that a theory of animal rights is at odds with a liberal abortion policy. In response, Francione (1995) argues that the principles used in the animal rights discourse do not have implications for the abortion debate. I challenge Francione’s conclusion by illustrating that his own framework of animal rights, supplemented by a relational account of moral obligation, can address the moral issue of abortion. I first demonstrate that Francione’s animal rights position, which grounds (...) moral consideration in sentience, is committed to the claim that a sentient fetus has a right to life. I then illustrate that a fully developed account of animal rights that recognizes the special obligations humans have to assist animals when we cause them to be dependent and vulnerable through our voluntary actions or omissions is committed to the following: a woman also has a special obligation to assist a sentient fetus when she causes it to be dependent and vulnerable through her voluntary actions or omissions. From these considerations, it will become evident that a fully developed and consistent animal rights ethic does in fact have implications for the abortion discussion. (shrink)

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value.. This grounded study investigated the negotiation of authorship by faculty members, graduate student mentors, and their undergraduate protégés in undergraduate research experiences at a private research university in the northeastern United States. Semi-structured interviews using complementary scripts were conducted separately with 42 participants over a 3 year period to probe their knowledge and understanding of responsible authorship and publication practices and learn how faculty and students entered into authorship decision-making intended to lead to the publication of peer-reviewed technical papers. Herein (...) the theoretical model for the negotiation of authorship developed through the analysis of these interviews is reported. The model identifies critical causal and intervening conditions responsible for the coping strategies faculty and students employ, which, in our study, appear to often produce unfortunate consequences for all involved. The undergraduate student researchers and their graduate student mentors interviewed in this study exhibited a limited understanding of authorship and the requirements for authorship in their research groups. The power differential between faculty and students, the students’ limited epistemic development, the busy-ness of the faculty, and the faculty’s failure to prioritize authorship have been identified as key factors inhibiting both undergraduate and graduate students from developing a deeper understanding of responsible authorship and publication practices. Implications for graduate education and undergraduate research are discussed, and strategies for helping all students to develop a deeper understanding of authorship are identified. (shrink)

The abilities to attribute an action to its proper agent and to understand its meaning when it is produced by someone else are basic aspects of human social communication. Several psychiatric syndromes, such as schizophrenia, seem to lead to a dysfunction of the awareness of one’s own action as well as of recognition of actions performed by other. Such syndromes offer a framework for studying the determinants of agency, the ability to correctly attribute actions to their veridical source. Thirty normal (...) subjects and 30 schizophrenic patients with and without hallucinations and/or delusional experiences were required to execute simple finger and wrist movements, without direct visual control of their hand. The image of either their own hand or an alien hand executing the same or a different movement was presented on a TV-screen in real time. The task for the subjects was to discriminate whether the hand presented on the screen was their own or not. Hallucinating and deluded schizophrenic patients were more impaired in discriminating their own hand from the alien one than the non-hallucinating ones, and tended to misattribute the alien hand to themselves. Results are discussed according to a model of action control. A tentative description of the mechanisms leading to action consciousness is proposed. (shrink)

A collection of Essays over the last 20 years, exploring different dimensions of the philosophical debate on "subjecthood" and "subjectivity" in Modernity, as it was framed by the "Controversy on the subject" from the 1960's, and showing how it is now continued in a "controversy on the Universal.".

Recent discussions in the just war literature suggest that soldiers have a duty to assume certain risks in order to protect the lives of all innocent civilians. I challenge this principle of risk by arguing that it is justified neither as a principle that guides the conduct of combat soldiers, nor as a principle that guides commanders in the US military. I demonstrate that the principle of risk fails on the first account because it requires soldiers both to violate their (...) strict duty of obedience and loyalty and to exceed their special obligations to protect their fellow comrades, the state, the state's constituents and other protected civilians. I then illustrate that the principle of risk fails on the second account since it conflicts with the commander's primary obligation to protect and promote the welfare and lives of his or her soldiers. I conclude by arguing that we cannot reasonably expect soldiers and commanders to adhere to the principle of risk until there is a radical, institutional-level transformation of militaristic goals, values, strategies, policies, warrior codes and expectations of service members in the US Armed Forces.
