Après la Seconde Guerre mondiale et la chute du mur de Berlin, nous avons cru à la victoire définitive de notre vision du monde, caractérisée par l'individualisme libéral, le cosmopolitisme et la démocratie des droits de l'homme. Mais depuis le tournant du siècle, plusieurs cultures mondiales s'opposent clairement et fermement aux principes occidentaux considérés jusque-là comme universels. La démocratie est décriée ou dégradée, et l'autocratie nommément défendue, en Chine et à Singapour, dans certains pays musulmans, en Russie. En outre, apparaissent (...) au sein même de l'Occident des gouvernements dits populistes ou illibéraux, opposés au libéralisme et à l'individualisme postmodernes. Ce débat conflictuel déployé tant sur le plan occidental que sur le plan mondial traduit un nouvel assaut de la vision du monde traditionnelle, holiste, face à la vision progressiste et individualiste. Des deux côtés fleurissent les excès. En Occident, l'humanisme classique transformé en humanitarisme. En face, des cultures parfois devenues des idéologisations de leurs traditions. Le scientifique ne doit pas se contenter de decrire et de mesurer des faits. Son but eat d'essayer de les relier et de construire des théories qui (...) tentent de nous faire comprendre le “reel”, objet de ses recherches.Cependant, la nature du matériel biologique — c'est-à-dire les espèces vivantes et les catégories qu'on y a reconnues, classe ou ordre par exemple — est si complexe qua la biologie actuelle est fort loin encore Wavoir réalisé une synthèse qui ressemble, méme très approximativement, à la classification de Mendéleiev pour les éléments chimiques.Malgré cette complexité, les biologques ont réussi à construire la th6orie du fait de l'evolution et ils proposent aujourd'hui une théorie explicative de cette évolution qui, bien qua critiquée, est incontestablement bien étayee. Nous allons essayer de définir la structure des grandes théories biologiques; ensuite nous analyserons sommairement quelques-unes des critiques qui sont adressees aux theories de l'évolution.Considering the publication in French version of Michael Denton's book, Evolution : A Theory in crisis , in which he critizes the synthetical theory of the biological evolution, we thought it useful to point out the main errors of argumentation contained in that book by first referring to the characteristics of general biological theories.In biology, there exist elementary theories - such as that dealing with the extinction of giant Reptiles - and general theories - such as the chromosomic theory of heredity and the explanatory theory of evolution. The latter generally consist of a group of elementary theories imbricated so that they form a whole like a jig-saw puzzle. An example is provided by the synthetic theory of evolution that can be defined in 20 propositions divided into two categories : the propositions relating to the naturalists' observations - which correspond to descriptive concepts - and those relating to the data of the population genetics - which correspond to explanatory concepts . The general scheme of the theory is formed by a network of relations between the descriptive concepts and the explanatory concepts. There also exist other theories in general biology supported by thousands of minor facts which only together can be of proof of validity. These theories are quite reliable and cannot be questioned by facts still to be explained. Questioning can only happen if they are confronted to well-established data in nearly equal numbers.In his work, Denton does not deny the phenomenon of biological evolution, but he criticizes the syntheticians' ideas by emphasizing that no great evolutive changes can be accounted for by the complex mechanism of random mutations and selection. He goes back to a typological concept of the zoological classification in some way similar to that of Vialleton's. However, Denton agrees with the phenomenon of the biological evolution and accepts the existence of "saltations" among the great zoological groups. The arguments used by Denton merely show that he is not conversant with the complexity of sciences particularly in comparative anatomy and zoology, the teaching of which is being somehow neglected today.By giving as an example the structure of the aortic arches in Amphibians and by a summary of the variations of those structures and the evolution of the blood-circulation in Vertebrates, we proved that the typological argument is of no value. As a matter of fact, a study of the now living beings clearly shows the gradual transition - e.g. a transition by a very large number of feasible stages - from the Lower Vertebrates to the Higher Vertebrates. In particular, there have been several attempts at double circulation and there still exist many species in which the blood of the double circulation is mixed. It seems therefore obvious that the double circulation has been achieved, stage by stage, with many intermediate schemes; we are inclined, therefore, to conclude that this succession of small transformations was produced by a huge mechanism of selected small mutations.Our present-day biological knowledge includes a number of examples large enough to consider the “argument of the impossible” used by Denton is due to inadequate fossil data and not to any mysterious mechanism such as macromutations. Let us say again that the typological structures seem to occur only when the data of comparative anatomy and zoology are over-simplified. (shrink)

Existen múltiples maneras de aproximarse al transhumanismo e intentar comprenderlo, una de ellas es desde sus raíces filosóficas. La filósofa francesa Chantal Delsol, en su estudio sobre la sociedad contemporánea, presenta al prometeísmo –entendido como el intento de dominio del hombre sobre la naturaleza a través de la técnica– como una nota característica de nuestro tiempo. Dentro de su análisis, Delsol explica que el prometeísmo moderno, fruto de la Ilustración, se encontraría ahora en una forma pervertida en la (...) actual modernidad tardía –es decir, desde mediados del siglo XX en adelante– y eso estaría manifiesto tanto en el totalitarismo del siglo pasado como en el transhumanismo del siglo XXI. Este prometeísmo pervertido estaría expresado de manera clara en la idea de que “todo es posible” para el ser humano a través de la técnica, especialmente la creación del hombre nuevo. De esta manera, la filósofa francesa nos presenta una raíz filosófica común entre el totalitarismo y el transhumanismo como manifestaciones del período tardío-moderno. We then underscore the relations between those concepts. And we try thereafter to define as best we can the role of chance in the great evolutionary facts : chance and the laws of evolution, chance according to Kimura, chance and apparent finality, chance and human freedom. Les différents contributeurs auxquels nous avons fait appel sont tous des spécialistes de la philosophe, de plusieurs nationalités, et les plus éminents y figurent. Les responsables des Cahiers Simone Weil y sont naturellement bien représentés. Les aspects divers de la pensée de Simone Weil ont été ordonnés de façon à commencer par le coeur (...) – la philosophie – pour aller ensuite à la morale puis à la politique et à l'histoire, et enfin à l'approfondissement religieux et mystique. Les derniers chapitres insistent sur quelques perspectives plus particulières. La religion, qui a irrigué la culture occidentale pendant deux mille ans, perd son influence sur tous les plans. La chrétienté ne se retire pas seule, mais avec elle ses fruits sécularisés, qui constituaient une architecture signifiante. Quel est le destin de notre représentation du monde à forée de cet effacement? Certains désignent le relativisme, voire le nihilisme. qui s'instaurent dans l'oubli des référents fondateurs. Ce livre veut montrer que le nihilisme n'est qu'une brève transition, que le relativisme reflète une (...) apparence. L'époque présente atteste plutôt la réinstauration de modes d'être et de pensée comparables à ceux qui précédèrent l'Occident chrétien et à ceux qui se déploient partout hors l'Occident chrétien : des sagesses et des paganismes, déjà à l'ouvre sous la texture déchirée de nos anciennes convictions. transcendantes ou immanentes. Ces sagesses se nourrissent de renoncement, lequel forme aujourd'hui l'essentielle disposition de notre esprit. Renoncement à la quête de la vérité, renoncement au progrès, à la royauté de l'homme, à la liberté personnelle. Les conséquences en sont, par un lent processus, le remplacement du vrai par le bien, des dogmes par vies mythe, du temps fléché par un retour au temps circulaire, du monothéisme par le paganisme ou le panthéisme, de l'humanisme de liberté par un humanisme de protection, de la démocratie par le consensus, de la ferveur par le lâcher prise. C'est une métamorphose radicale, et ce renoncement est un retournement, non seulement de nos pensées, mais aussi de nos modes d'être et de nos institutions. Après une histoire de deux mille ans, sous de multiples signes réapparaît l'appel à une résignation sereine dont les hommes sans Dieu n'ont jamais cessé de rêver. (shrink)

La mayoría de esos países (Polonia, Hungría, República Checa, Eslovaquia) están afectados pero, en esos mismos países, abundan los partidos extremistas, además de los que están en el poder. En Eslovaquia, hay varios partidos nacionalistas, algunos de ellos muy radicales. En Hungría, el partido Jobbik deja a Orban por moderado. El fenómeno es amplio y profundo. In The Unlearned Lessons of the Twentieth Century , the sequel to Icarus Fallen, published by ISI Books in 2003, Chantal Delsol maintains that the age in which we live—late modernity—calls into question most of the truths and beliefs bequeathed to us from the past. Yet it clings to a central belief in the dignity of the human person, the cornerstone of the doctrine of universal human rights to which even secular Westerners still cling. At the same time, the (...) process of dehumanization so evident in the ideologies and totalitarianism of the twentieth century remains at work. Delsol charges that it is not enough to proclaim human rights as a sort of incantation but that, rather, one must understand what sort of being the human person is if humans are to be genuinely respected. In other words, if the philosophy of human rights is to form the basis of Western culture, it must rest on a truer understanding of the human person than that which is taught—both explicitly and implicitly—in the contemporary West. Michel Villey a consacré toute sa carrière universitaire à démontrer la fécondité de la définition philosophie du droit que nous ont léguée les jurisconsultes romains. Pour Villey, comprendre " le droit comme un partage " c'est saisir toute la richesse de l'esprit du droit romain. Le droit est bien plus que l'ensemble des règles juridiques posées par l'Etat ou l'ensemble des précédents judiciaires décidés par le Juge. Le droit est partage ; il est cette attribution de biens et de charges (...) que le Législateur ou le Juge découvrent. Le droit n'est pas un pouvoir qui dit, sans nuance, ce qui doit être des rapports juridiques entre citoyens. Le droit n'est pas extérieur aux relations humaines, il est dans la relation entre les hommes. Le droit unit pour " bien vivre ensemble " mettant ainsi fin à ce qui désunit. Plus que la décision d'une autorité formellement compétente, le droit ancré dans la réalité des choses, est une recherche intellectuelle. Prendre au sérieux l'intelligence des juristes signifie leur permettre de comprendre ce qu'il y a de juste dans les rapports sociaux. A l'heure où les pays de l'Union européenne peinent à se mettre d'accord sur le contenu juridique de la Constitution européenne, il paraît essentiel de revenir à la pensée de Michel Villey et à travers elle, redécouvrir la dimension historique commune à tous les systèmes juridiques européens. Dans son incomplétude même, l'enfant dépeint la vérité humaine, à commencer par ce sentiment d'abandon appelant sans cesse le sens, la raison et l'espoir. L'enfant désigne notre destin. Il raconte une (...) déréliction vécue, mais altière parce que constamment portée par l'amour. II raconte en même temps, dans les tribulations de son grandissement, l'aventure la plus risquée et la moins vaine qu'il nous soit donné de connaître ; et à ce titre, parce que à la fois tellement exposée et tellement décisive, l'entreprise qui a le plus besoin d'un ancrage et d'un enracinement. We have identified a sample of 53 societies outside of the classical Himalayan and Marquesean area that permit polyandrous unions. Our goal is to broadly describe the demographic, social, marital, and economic characteristics of these societies and to evaluate some hypotheses of the causes of polyandry. We demonstrate that although polyandry is rare it is not as rare as commonly believed, is found worldwide, and is most common in egalitarian societies. We also argue that polyandry likely existed during early human (...) history and should be examined from an evolutionary perspective. Our analysis reveals that it may be a predictable response to a high operational sex ratio favoring males and may also be a response to high rates of male mortality and, possibly, male absenteeism. Other factors may contribute, but our within-polyandry sample limits analysis. (shrink)

The aim of this study is to explore how nurses perceive patient participations of patients over 75 years old undergoing hemodialysis treatment in dialysis units, and of their next of kin. Ten nurses told stories about what happened in the dialysis units. These stories were analyzed with critical discourse analysis. Three discursive practices are found: (1) the nurses’ power and control; (2) sharing power with the patient; and (3) transferring power to the next of kin. The first and the predominant (...) discursive practice can be explained with an ideology of paternalism, in which the nurses used biomedical explanations and the ethical principle of benefice to justify their actions. The second can be explained with an ideology of participation, in which the nurses used ethical narratives as a way to let the patients participate in the treatment. The third seemed to involve autonomous decision-making and the ethical principle of autonomy for the next of kin in the difficult end-of-life decisions. (shrink)

Because factory-farmed meat production inflicts gratuitous suffering upon animals and wreaks havoc on the environment, there are morally compelling reasons to become vegetarian. Yet industrial plant agriculture causes the death of many field animals, and this leads some to question whether consumers ought to get some of their protein from certain kinds of non factory-farmed meat. Donald Bruckner, for instance, boldly argues that the harm principle implies an obligation to collect and consume roadkill and that strict vegetarianism is thus immoral. (...) But this argument works only if the following claims are true: all humans have access to roadkill, roadkill would go to waste if those who happen upon it don’t themselves consume it, it’s impossible to harvest vegetables without killing animals, the animals who are killed in plant production are all-things-considered harmed by crop farming, and the best arguments for vegetarianism all endorse the harm principle. As I will argue in this paper, each claim is deeply problematic. Consequently, in most cases, humans ought to strictly eat plants and save the roadkill for cats. (shrink)

This chapter introduces and defends a pragmatist model of aesthetic disagreement that avoids many of the philosophical puzzles generated by the traditional, semantic, approach. Mainstream philosophical inquiry into aesthetic disagreement begins with a rather innocuous assumption: to understand what’s going on we must first explain what disputants are saying, which involves identifying the meaning of the relevant expressions or determining how aesthetic claims could be true. However, this task brings with it a new host of semantic and epistemic puzzles and (...) fails to vindicate the central role aesthetic disagreements occupy in our aesthetic lives more generally. Further, it isn’t clear how settling the meaning of aesthetic expressions bears on everyday aesthetic disagreements. Paying attention to what we do in an aesthetic disagreement will give us a better chance at identifying what matters for determining what we say. (shrink)

An adequate theory of rights ought to forbid the harming of animals to promote trivial interests of humans, as is often done in the animal-user industries. But what should the rights view say about situations in which harming some animals is necessary to prevent intolerable injustices to other animals? I develop an account of respectful treatment on which, under certain conditions, it’s justified to intentionally harm some individuals to prevent serious harm to others. This can be compatible with recognizing the (...) inherent value of the ones who are harmed. My theory has important implications for contemporary moral issues in nonhuman animal ethics, such as the development of cultured meat and animal research. (shrink)

In recent discussions, it has been argued that a theory of animal rights is at odds with a liberal abortion policy. In response, Francione (1995) argues that the principles used in the animal rights discourse do not have implications for the abortion debate. I challenge Francione’s conclusion by illustrating that his own framework of animal rights, supplemented by a relational account of moral obligation, can address the moral issue of abortion. I first demonstrate that Francione’s animal rights position, which grounds (...) moral consideration in sentience, is committed to the claim that a sentient fetus has a right to life. I then illustrate that a fully developed account of animal rights that recognizes the special obligations humans have to assist animals when we cause them to be dependent and vulnerable through our voluntary actions or omissions is committed to the following: a woman also has a special obligation to assist a sentient fetus when she causes it to be dependent and vulnerable through her voluntary actions or omissions. From these considerations, it will become evident that a fully developed and consistent animal rights ethic does in fact have implications for the abortion discussion. (shrink)

In The Case for Animal Rights, Tom Regan argues that although all subjects-of-a-life have equal inherent value, there are often differences in the value of lives. According to Regan, lives that have the highest value are lives which have more possible sources of satisfaction. Regan claims that the highest source of satisfaction, which is available to only rational beings, is the satisfaction associated with thinking impartially about moral choices. Since rational beings can bring impartial reasons to bear on decision making, (...) Regan maintains that they have an additional possible source of satisfaction that nonrational beings do not have and, consequently, the lives of rational beings turn out to have greater value..
