Although international law grants a distinct juristic personality to indigenous peoples, this subjecthood is premised on a hierarchical reading of ethnicity and indigeneity. Through illustrations of Adivasi experiences in India, this article interrogates the prejudices of the global juridical discourse that are reproduced by the domestic jurisdiction, exposing the voyeuristic performance of legality in constructing indigenousness.

The concept of truth serves in logic not only as an instrument but also as an object of study. Eubulides of Miletus (fl. fourth century BCE), a Megarian logician, discovered the paradox known as ‘the Liar,’ and, ever since his discovery, logicians down the ages ‐ Aristotle and Chrysippus, John Buridan and William Heytesbury, and Alfred Tarski and Saul Kripke, to mention just a few ‐ have tried to understand the puzzling behavior of the concept of truth.

In this paper, I draw attention to various doctrines common to different Vedāntic traditions. In particular, I pay close attention to the doctrine of beginningless _karman_. I also note that this doctrine seems to stand in tension with Leibnizian Cosmological Arguments (LCAs) and Kalām Cosmological Arguments (KCAs). This tension arises because defenders of these arguments argue that an infinite causal regress or an actual infinite cannot be physically instantiated and because the doctrine of beginningless _karman_ seems to imply that such (...) a regress or actual infinite can be physically instantiated. I address this tension by showing that not all interpretations of beginningless _karman_ involve an infinite causal regress or an actual infinite. I close this paper by highlighting a few features that Vedāntic traditions have that make them more resistant to some objections to LCAs and KCAs. (shrink)

ABSTRACT The paper examines the ethical conception of the most well‐known and much discussed Hindu text, the Bhagavad Gītā, in the context of the Western distinction between duty ethics and virtue ethics. Most of the materials published on the Gītā make much of its conception of duty; however, there is no systematic investigation of the notion of virtue in the Gītā. The paper begins with a discussion of the fundamental characteristics of virtue ethics, before undertaking a discussion of the conceptions (...) of duty and virtue in the Gītā. The paper clearly demonstrates that (1) both duty and virtue coexist in the Gītā, and (2) the Gītā accords virtue an important place. (shrink)

Although quantum mechanics can accurately predict the probability distribution of outcomes in an ensemble of identical systems, it cannot predict the result of an individual system. All the local and global hidden variable theories attempting to explain individual behavior have been proved invalid by experiments (violation of Bell’s inequality) and theory. As an alternative, Schrodinger and others have hypothesized existence of free will in every particle which causes randomness in individual results. However, these free will theories have failed to quantitatively (...) explain the quantum mechanical results. In this paper, we take the clue from quantum biology to get the explanation of quantum mechanical distribution. Recently it was reported that mutations (which are quantum processes) in DNA of E. coli bacteria instead of being random were biased in a direction such that the chance of survival of the bacteria is increased. Extrapolating it, we assume that all the particles including inanimate fundamental particles have a will and that is biased to satisfy the collective goals of the ensemble. Using this postulate, we mathematically derive the correct spin probability distribution without using quantum mechanical formalism (operators and Born’s rule) and exactly reproduce the quantum mechanical spin correlation in entangled pairs. Using our concept, we also mathematically derive the form of quantum mechanical wave function of free particle which is conventionally a postulate of quantum mechanics. Thus, we prove that the origin of quantum mechanical results lies in the will (or consciousness) of the objects biased by the collective goal of ensemble or universe. This biasing by the group on individuals can be called as “coherence” which directly represents the extent of life present in the ensemble. So, we can say that life originates out of establishment of coherence in a group of inanimate particles. (shrink)

Samatavilasa, The Radiant Sameness, shows the way of finding our fallen condition itself as redemptive. We are not merely to accept our pain and our mortal condition but to live these and become these. In becoming that pain lies our bliss, in living our mortality immortality. That alone is the highest bliss and absolute, that alone is salvation the final, this our becoming one with our mortal and absolutely tragic lot. That is what the state of samata, sameness, is. Only (...) that man is a mukta, a liberated soul, who can look alike on Maya and Brahman, on reality and appearance, on bondage and liberation, on life and death, on misery and joy. Not that there is an actual state called the state of liberation, an actual bliss that is absolute and highest, for terms like absolute and highest turn out to be relative, and, therefore, mis-leading. Hypostati-zation of samata would not work, for all hypo-statization is rooted in our narcissistic passion. Yet Samatavilasa would not, in actual fact does not, encourage us to look alike on these opposites constitutive of our mortal being as long as we fight a desperate fight against our inevitable and destined fate, fate the mortal; a stern discipline we have to undergo before we can even think of samata, sameness, not to speak of living it. For, not before dying unto himself can a man look alike on these dualities, the stuff our mortal life and being are made of. (shrink)

The Born’s rule to interpret the square of wave function as the probability to get a specific value in measurement has been accepted as a postulate in foundations of quantum mechanics. Although there have been so many attempts at deriving this rule theoretically using different approaches such as frequency operator approach, many-world theory, Bayesian probability and envariance, literature shows that arguments in each of these methods are circular. In view of absence of a convincing theoretical proof, recently some researchers have (...) carried out experiments to validate the rule up-to maximum possible accuracy using multi-order interference (Sinha et al, Science, 329, 418 [2010]). But, a convincing analytical proof of Born’s rule will make us understand the basic process responsible for exact square dependency of probability on wave function. In this paper, by generalizing the method of calculating probability in common experience into quantum mechanics, we prove the Born’s rule for statistical interpretation of wave function. (shrink)

A vibrant example of living literature, the Bhagavata Purana is a versatile Hindu sacred text written in Sanskrit verse. Finding its present form by the tenth century C.E., the work inspired several major north Indian devotional (bhakti) traditions as well as schools of dance and drama, and continues to permeate popular Hindu art and ritual in both India and the diaspora. Introducing the Bhagavata Purana's key themes while also examining its extensive influence on Hindu thought and practice, this collection conducts (...) the first multidimensional reading of the entire text. Each essay focuses on a key theme of the Bhagavata Purana and its subsequent presence in Hindu theology, performing arts, ritual recitation, and commentary. The authors consider the relationship between the sacred text and the divine image, the text's metaphysical and cosmological underpinnings, its shaping of Indian culture, and its ongoing relevance to contemporary Indian concerns. Dirac’s relativistic theory of electron generally results in two possible solutions, one with positive energy and other with negative energy. Although positive energy solutions accurately represented particles such as electrons, interpretation of negative energy solution became very much controversial in the last century. By assuming the vacuum to be completely filled with a sea of negative energy electrons, Dirac tried to avoid natural transition of electron from positive to negative energy state using Pauli’s exclusion principle. However, many scientists like Bohr (...) objected to the idea of sea of electrons as it indicates infinite density of charge and electric field and consequently infinite energy. In addition, till date, there is no experimental evidence of a particle whose total energy (kinetic plus rest) is negative. In an alternative approach, Feynman, in quantum field theory, proposed that particles with negative energy are actually positive energy particles running backwards in time. This was mathematically consistent since quantum mechanical energy operator contains time in denominator and the negative sign of energy can be absorbed in it. However, concept of negative time is logically inconsistent since in this case, effect happens before the cause. To avoid above contradictions, in this paper, we try to reformulate the Dirac’s theory of electron so that neither energy needs to be negative nor the time is required to be negative. Still, in this new formulation, two different possible solutions exist for particles and antiparticles (electrons and positrons). (shrink)

This article uses critical discourse analysis to examine how the higher COVID-19 infection rates among South Asians in general, and Punjabis more specifically, have been represented by conservative politicians and their representatives as a consequence of cultural and religious practices. Two counter-narratives are discussed. The first substitutes the negative image of the Sikh Punjabi Canadian community with a celebratory and positive view of Sikh humanitarianism and community service. The second attributes the high numbers to class attributes such as precarious jobs, (...) poverty-level wages, employment insecurity, lack of sick days, over-crowded housing, racism and lack of access to healthcare. We argue that the conservative explanation as well as the first counter-narrative reveal continuities in culturalist understandings of South Asian immigrants, albeit in slightly different ways. The second counter-narrative represents a discursive resistance by advancing a structural analysis of health and disease in immigrant communities. (shrink)

It Studies The Historical Progression Of Aesthetics Both Indian And Western Since Ancient Times, Focussing On The Landmarks In The Course Of Its Development And Theories On Art, Beauty And Related Concepts.

In classical electrodynamics, electromagnetic effects are calculated from solution of wave equation formed by combination of four Maxwell’s equations. However, along with retarded solution, this wave equation admits advanced solution in which case the effect happens before the cause. So, to preserve causality in natural events, the retarded solution is intentionally chosen and the advance part is just ignored. But, an equation or method cannot be called fundamental if it admits a wrong result (that violates principle of causality) in addition (...) to the correct result. Since it is the Maxwell’s form of equations that gives birth to this acausal advanced potential, we rewrite these equations in a different form using the recent theory of reaction at a distance (Biswaranjan Dikshit, Physics essays, 24(1), 4-9, 2011) so that the process of calculation does not generate any advanced effects. Thus, the long-standing causality problem in electrodynamics is solved. (shrink)

General relativity is the exact theory of gravity which has been experimentally found to be correct with extremely high accuracy. One of the most surprising predictions of the general theory is that time runs slow in a gravitational field. Its proof formally comes from Schwarzschild metric which is a solution of Einstein field equation for a spherically symmetric mass. However, as Einstein field equation is too complex, attempts have been made earlier to derive gravitational time dilation by direct use of (...) principle of equivalence and special theory of relativity. But, this objective has been accomplished partially till date as the resulting expression agrees with the exact expression only upto first order. In this paper, by using principle of equivalence and special relativity, we present a thought experiment which helps us to derive an expression that exactly matches with the expression for gravitational time delay. The basic idea of quantum mechanics is that the property of any system can be in a state of superposition of various possibilities. This state of superposition is also known as wave function and it evolves linearly with time in a deterministic way in accordance with the Schrodinger equation. However, when a measurement is carried out on the system to determine the value of that property, the system instantaneously transforms to one of the eigen states and thus we get only (...) a single value as outcome of the measurement. Quantum measurement problem seeks to find the cause and exact mechanism governing this transformation. In an attempt to solve the above problem, in this paper, we will first define what the wave function represents in real world and will identify the root cause behind the stochastic nature of events. Then, we will develop a model to explain the mechanism of collapse of the quantum mechanical wave function in response to a measurement. In the process of development of model, we will explain Schrodinger cat paradox and will show how Born’s rule for probability becomes a natural consequence of measurement process. (shrink)

In this paper I intend to present a preliminary account of the development and sources of aesthetic perception and cuhural identity of the people of Nepal. The paper consists mainly of two sections. In the first section I have tried to explore our country's topographical, sociocultural, historical and religious perspectives which provided the background scenario and basis for the development of the emerged cultural and aesthetic picture. The second section tries to show how the aesthetic sense finds an expression in (...) Nepalese cultural identity. At the very outset, I would hke to submit to this august gathering that the views expressed in this regard are based on my own personal experience and observations, and that they need to be confirmed with further studies in this field. Some criticisms are offered of Barwise and Etchemendy's theory of truth, the principal one being that it violates a feature of truth called “supervenience”.

Many companies are now targeting the sizeable segment of consumers in Bottom-of-the-pyramid (BoP) markets with new products to specifically address their needs. As mainstream consumers become aware of these initiatives, their views on what products may be construed as appropriate for BoP marketplaces, may influence their attitudes towards the companies engaging in BoP activities. We propose that when the mainstream consumers are culturally distant from the BoP consumers, they have less favourable attitudes towards a company marketing a hedonic product to (...) BoP consumers, compared to a utilitarian one. However, when the mainstream consumers are culturally closer to the BoP consumers, they are less likely to react negatively to a company’s marketing of a hedonic product compared to a utilitarian one. We theorize that these differences in evaluation are based on the mainstream consumers’ expectations regarding the products a company would/should target towards BoP consumers. We also examine two company characteristics (country-of-origin and profit orientation) as contingency factors affecting the attitudes of culturally close mainstream consumers towards companies engaging in BoP practices. Across two studies, we find support for our hypotheses. This research adds to a new stream of scholarship that theorizes about the permissible consumption mindset of mainstream consumers. The research also provides guidance to marketing managers and communication experts to help build favourable company attitudes and minimize any mainstream negativity towards a company’s marketing initiatives in the BoP domain. The editorial introduces issue 21.1 of Technoetic Arts via a critical reflection on the artificial intelligence hype (AI hype) that emerged in 2022. Tracing the history of the critique of Large Language Models, the editorial underscores that there are substantial ethical challenges related to bias in the training data, copyright issues, as well as ecological challeges which the technology industry has consistently downplayed over the years. -/- The editorial highlights the distinction between the current AI technology’s reliance on extensive pre-existing (...) human-generated data for pattern recognition and the performative process inherent in art practice. Patterns of creative output can be replicated without a thorough understanding of underlying concepts. In contrast, the performative process of art practice, as explored through the conceptual frameworks of creativity by Noam Chomsky, Charles Sanders Peirce, and Roger T. Ames and with reference to an earlier publication of the editorial’s author, creates concepts and continually ‘strives to extend itself towards the unknown.’ -/- Following this introductory section, the editorial provides an overview of the ten articles featured in this issue of Technoetic Arts. The first four texts engage with emerging technologies from various perspectives in art and design. The subsequent six articles, part of a special section titled 'Perspectives from Chandigarh,' reflect a quest for meaningful existence within colonial, patriarchal, and biopolitical structures that frame everyday practices of exclusion and oppression. This is a philological and critical analysis of two crucial philosophical concepts, viz., reaso and experienceâ. The study shows that, though there is no word in Sanskrit which may be taken as equivalent of Western reason and thought, such terms as tarka, yukti, nyaya, anumana, buddhi, etc., clearly capture parts or aspects of what is meant by reason and thought (Denken). Moreover, it is misleading to trans- late sruti as revelation. Construing sruti as revelation surreptitiously imports a Semitic theological concept (...) into the Vedic tradition. The case of experience is more promising because we have such Sanskrit words as anubhava or anubhuti that do translate into experience. However, experience in Western thought has acquired many shades of meaning, and the study determines in what sense the Indian anubhava captures the Western experience. Finally, the book demonstrates that Indian philosophy provides an account of the cognitive process that begins with perception and culminates in wisdom (highest experience). This whole process may be called reason, at both ends of which we can talk of experience, which places experience not in an external opposition to reason, but rather as something that belongs to it internally. Thus, the modern Western opposition between reason and experience collapses and the two toge-ther yield an integrated process of acquisition, validation, and practical application of knowledge. North American psychiatric literature describes the current method of psychiatric diagnostic assessment as "phenomenological"; however, it is unclear what phenomenology 1 means in this context. This paper investigates the meaning and impact of some of the major philosophical and psychiatric definitions of phenomenology on contemporary psychiatric assessment. Employing a comparative analysis of selected definitions of phenomenology, this paper argues that North American psychiatric assessment does not reflect any of these definitions of phenomenology. Instead, within the context of psychiatric assessment, phenomenology (...) has taken on an idiosyncratic, clinical meaning of signs and symptoms. However, this does not mean that phenomenology has had no impact on North American psychiatry. This paper contends that phenomenology has made contributions to psychiatry, particularly in the area of psychotherapy and especially in self-psychological psychotherapy. The importance of the concept of empathy within psychotherapy is evidence of the continuing influence of philosophical phenomenology on psychiatry. This paper concludes that phenomenology can provide an important complementary perspective to the dominant methods of North American psychiatric practice. (shrink)

We are grateful to Professor Robert Koons for his excellent, and generous, review (henceforth KR) of our book The Revision Theory of Truth (henceforth RTT). Koons provides in KR a welcome guide to our RTT, and he puts forward objections that deserve serious consideration. In this note we shall respond only to his principal objection.' This objection, which is developed on pp. 625 — 628 of KR, calls into question our main thesis. As we argue below, however, the objection is (...) not successful. We should forewarn the reader that this note is not self-contained. It presupposes familiarity with RTT (primarily, Chapter 4) and with KR. The main thesis of RTT is that truth is a circular concept. We argued that the Tarski biconditionals, read as partial definitions, constitute an intensionally adequate definition of truth. In this article, I propose to take up the concept and physical space of a photographic 'darkroom' located in Stone Town, Zanzibar, to explore a set of images from the Capital Art Studio (1930-present) collection produced by Ranchhod Oza (1907-93), and inherited by his son Rohit Oza (1950-). I employ a concept of darkness to read this visual archive differently and propose multiple 'other lives' for a set of images. First, by bringing this African photography collection to light, I am (...) taking it out of the 'dark rooms' of history in one sense and exposing it for interpretation. Second, I focus my lens on the Oza physical darkroom located in the back of the studio on Kenyatta Road in Stone Town, where photographs of a range of Zanzibari persons were both developed and printed and that open up the darkroom as a place of photographic complexity and sensorium, and not just mechanical reproduction. Third, I develop darkness as a form of beauty in certain images of sky, water and skin from this archive that showcase Zanzibar's position as an Indian Ocean island and port city whilst under rule by the Omani Sultanate (1698-1964) and British Protectorate (1890-1963). Fourth, I conceptualise the Zanzibar Revolution of 1964 as a time of visual darkness, which temporarily restricted photographic practices operating in Stone Town under the new Afro-Shirazi political party. Throughout my analysis, I use a framing of 'darkness' to interrogate photography as an aesthetic practice deeply immersed in materialities and metaphors of dark and light, black and white, and as integral to Zanzibar's oceanic islandness. Gupta and L. Rex Kay Keywords: behavior, empathy, human science, methodology, natural science, phenomenology. WE ARE GRATEFUL to the journal for prviding the opportunity for exchange and discussion of some of the themes raised in our paper, "The impact of phenomenology on North American psychiatric assessment" and we are (...) pleased to be able to reply to the two excellent commentaries by McMillan and Morley. Both McMillan and Morley question the prospect of employing phenomenology and its methods in psychiatric assessment, and in psychiatric practice more generally. McMillan questions the utility of such a step, and Morley is pessimistic about its feasibility. We shall address each author's concerns in turn.Initially, let us restate the aims of our paper to contextualize our arguments and those made in the commentaries. First, we sought an understanding of what is meant by North American psychiatrists, working within the DSM framework, when they refer to the phenomenological approach to psychiatric assessment. To elucidate this meaning, we compared the contemporary North American usage to a small number of definitions of phenomenology, particularly those definitions that were, and are now, applied to clinical psychiatric work. Contrary to McMillan's suggestion, we did not intend to state definitively what should or should not count as phenomenological, but rather to compare North American psychiatric assessment to what typically has counted as phenomenological. Second, we sought to examine phenomenology's influence on North American psychiatric practice, particularly psychotherapy.Morley argues that such influences usually exemplify the inappropriate appending of phenomenology to psychiatric practice rather than true integration of different paradigms. Although we do not disagree with this general contention, we will argue that the deployment of phenomenological methods in psychiatric assessment is a necessary first step toward the kind of integration he proposes.McMillan makes two related but unintegrated points. First, he argues that objective, behavioral data are phenomenological, according to his broad definition of the term. Second, he proposes that, if the behavioral and the phenomenological are different, we are better off staying with the behavioral when it comes to psychiatric nosology. Let us consider these two points in succession.McMillan seeks to broaden Jasper's definition of phenomenology to include objective observations [End Page 93] as phenomenological. To this end, he distinguishes methods from aims. He summarizes Jasper's definition of phenomenology as "an empirical method for investigating 'individual psychic experience (p 55)" and claims that this is a statement of aim or objectives. He then urges us to "consider the merits of different phenomenological methodologies in terms of their success in achieving this objective" whether or not they utilize "all the methods" of phenomenology. This is much like saying that if we treat waving one's hand as a method for greeting someone, we are then free to treat the objective of the wave as one of greeting someone, and then say that anything that serves as a greeting is, by definition, a "wave." Whatever else McMillan's objective observations are, he has not convinced us that they are phenomenological, anymore than we are likely to convince you that a kiss on the lips is really just a wave.Nonetheless, it is worthwhile seeing what McMillan does with this argument. He tells us that we can "read the first-person experience from behavior in a fairly accurate and informative way." He uses the example of a father gazing at his young child and notes that it is not unreasonable to infer that he is experiencing loving and nurturing feelings. It is, indeed, not unreasonable to draw such an inference. But it is far more reasonable to infer that the father is experiencing a cacophony of feelings, including, but not limited to, love, concern, anxiety, pride, envy, hope, and sadness (Stern 1995, 18-58). If we are able to distinguish which of these feelings is dominant at any given moment—which we are—and if we are also able to track subtle shifts in such feelings... (shrink)

New York based Families For Freedom is among a handful of organizations that directly organize deportees and their families. Analyzing the organization’s resignification of criminalized men of color as caregivers, I argue that current deportation policies and practices reorganize care work and kinship while tying gender and sexuality to national belonging. These policies and practices severely compromise the ability of migrant communities to socially reproduce themselves. Furthermore, the convergence of criminalization and immigration enforcement renders the kinship ties of deportable men (...) illegible, and justifies their separation from their loved ones. Since FFF publicly supports men with criminal convictions, it reveals that its members become targets of deportation precisely because they do not and cannot conform to heteronormative prescriptions. Business ethics is understood in a comprehensive and differentiated sense, as in recent years it has evolved under the influence of globalization. The present book examines inclusive growth, which includes more than just poverty alleviation and seeks to address the problem of equity through the enhancement of opportunities for all parties. This conforms to the fundamental task of business ethics, which is to enhance the ethical quality of decision-making and actions taken at all levels of business, id est, at the (...) personal (micro-), organizational (meso-), and systemic (macro-) levels and thus extending the narrow notion of business ethics as a niche for managers with good intentions. In the real world of competition and coordination, various situations produce various tradeoffs that the three pillars of the economy - Business, Government and Society - have to pursue for their survival and sustenance. In this book, we look into many such case studies in which the strength of one component leads to a benefit for one of the other components and a detriment for the other, thus causing an imbalance between the three pillars. After discussing the corporate scenario in India in brief, the author has put forward a model called Action By Objectives as the basis of the harmonization approach. Drawing inspiration from the ethical aspects of Buddhism, Sufism, Sikhism and Vedanta in this context, he suggests an abhyasa yoga menu for refining samskaras and reaching the ultimate level of positive, inspiring leadership. After discussing the corporate scenario in India in brief, the author has put forward a model called Action By Objectives as the basis of the harmonization approach. Drawing inspiration from the ethical aspects of Buddhism, Sufism, Sikhism and Vedanta in this context, he suggests an abhyasa yoga menu for refining samskaras and reaching the ultimate level of positive, inspiring leadership. Knowledge management hinges upon the presumption that workers within an organization possess knowledge that can be converted into concrete business improvements if the information is harvested and disseminated to others to whom it could be of use. True knowledge management must involve capturing the internal knowledge generated by a firm—its best thinking on products, customers, competitors and processes—and sharing it. Insofar as organizations are concerned, postmodernists argue that one view that has been in appropriately privileged is that of the organization (...) rather than the process of organizing. They draw our attention to the link between individual and collective identity. If there is a link between individual identity and how that individual behaves, there may also a link between collective identity and organizational action, for which a study on discourse ethics is essential. After considering the implications of knowledge management and the actual situation and work culture where the knowledge workers are in action, this paper raises and explores the questions wherein lies our individual identity and what its functional relation ship with the collective identity is. It has been envisaged in this article that through principles-driven cross-functional teams and innovative organizational mechanisms, sharing and conviction building need to be facilitated in modern organizations phasing out bureaucratic approaches and hierarchical power domination.
