The continuing existence and operation of the traditional law of Aboriginal and Torres Strait Islander peoples has – relatively recently – been explicitly acknowledged in Australian law. In emerging case law on the subject, the High Court of Australia has confirmed the common law recognition of the survival of Indigenous Australian law. However, in determining what it is that is recognized by the common law – in interpreting Indigenous Australian ‘traditional laws and customs’ – the High Court has disregarded the (...) knowledge reposed in those with authority or expertise in Indigenous Australian law, relying instead upon concepts and assumptions from the jurisprudence of English legal philosopher, HLA Hart. The influence of Hart’s theory in the Australian High Court’s interpretation of Indigenous Australian ‘traditional laws and customs’ is problematic, because it contains an obvious pre-legal–legal dualism reminiscent of the ‘state of nature’ – ‘civil society’ mechanism that was instrumental in the application of terra nullius to Australia. At the heart of The Concept of Law lies the notion of progression from a ‘primitive community’ with only primary rules, to an advanced legal system with a combination of both primary and secondary rules. In this article, I investigate how Indigenous Australians are positioned in relation to Hart’s pre-legal–legal dualism. I examine the ‘primitive’, pre-legal society in The Concept of Law, and its counterpart, the advanced legal system, to analyze the position of Indigenous Australian societies and law in Hart’s scheme. Finally, I analyze the construction of the dualism and consider its impact on the High Court’s interpretation of Indigenous Australian ‘traditional laws and customs’. (shrink)

Adoption of technology in agriculture can significantly reorganize production and relationships amongst humans, animals, technology, and the natural environment. However, the adoption of agricultural technology is not homogenous, and diversity in integration leads to a diversity of outcomes and impacts. In this study, we examine the adoption of automated milking systems in small and midsize dairy farms in the US Midwest, the Netherlands, and Denmark. In contrast to technological determinism, we find significant variation amongst adopters in the implementation of AMS (...) and corresponding variation in outcomes. Adopters have significant discretion in determining the use of AMS, which leads to a diversity of possible outcomes for family and non-family labor, human–cow relationships, animal welfare, the environment, and financial resiliency. Adoption and implementation are shaped by both structural factors, such as debt load and labor market variation, and by farmers’ individual personality traits and values, such as a willingness to release control to technology. Rather than uniform adoption and impacts of technology, we highlight the importance of context, the co-constitution of technology and users, and the diversity of technology adoption and its associated impacts. A project on teaching business ethics at The Wharton School concluded that ethics should be directly incorporated into key MBA courses and taught by the core business faculty. The project team, comprised of students, ethics faculty and functional business faculty, designed a model program for integrating ethics. The project was funded by the Exxon Education Foundation.The program originates with a general introduction designed to familiarize students with literature and concepts pertaining to professional and business ethics and corporate social responsibility. Cross-cultural studies have revealed broad quantitative associations between subsistence practice and demographic parameters for preindustrial populations. One explanation is that variationin the availability of suitable weaning foods influenced the frequency and duration of breastfeeding and thus the length of interbirth intervals and the probability of child survival (the “weaning food availability” hypothesis). We examine the available data on weaning age variation in preindustrial populations and report results of a cross-cultural test of the predictions that weaning occurred earlier in agricultural and (...) pastoral populations because dairy and cereal production increased the availability of easily digestible, nutrientrich foods appropriate for weaning. We found that, contrary to predictions, supplementation with liquid foods other than breast milk was delayed in agricultural populations relative to less agriculturally dependent ones and complementary feeding with solid foods was delayed in pastoral populations relative to those less dependent on herding. Although the duration of breastfeeding was longer in populations dependent on hunting, there was no qualitative evidence that such populations lacked foods appropriate for weaning. The patterns observed suggest that the relationships between demography and subsistence observed among preindustrial societies cannot be explained by the “weaning food availability” hypothesis. We discuss the implications for understanding the mechanisms underlying prehistoric human demography, subsistence shifts, allocation to parenting and mating effort, and the evolutionary implications of tradeoffs between diet and disease. Previous research has demonstrated that ratings of the perceived pleasantness and quality of odors can be modulated by auditory stimuli presented at around the same time. Here, we extend these results by assessing whether the hedonic congruence between odor and sound stimuli can modulate the perception of odor intensity, pleasantness, and quality in untrained participants. Unexpectedly, our results reveal that broadband white noise, which was rated as unpleasant in a follow-up experiment, actually had a more pronounced effect on participants’ odor (...) ratings than either the consonant or dissonant musical selections. In particular, participants rated the six smells used as being less pleasant and less sweet when they happened to be listening to white noise, as compared to any one of the other music conditions. What is more, these results also add evidence to support the existence of a close relationship between an odor’s hedonic character and the perception of odor quality. So, for example, independent of the sound condition, pleasant odors were rated as sweeter, less dry, and brighter than the unpleasant odors. These results are discussed in terms of their implications for the understanding of crossmodal correspondences between olfactory and auditory stimuli. (shrink)

La obtención de alimentos sanos y seguros requiere de técnicas de conservación inocuas para el consumidor y para el me­dio ambiente, entre las que se destaca la bioconservación. A su ca­tálogo de compuestos naturales o microorganismos, utilizados de forma habitual, la bioconservación ha incorporado recientemente los bacteriófagos y las proteínas fágicas con actividad lítica. La utilización de fagos y endolisinas en el biocontrol ofrece importantes ventajas frente a otros sistemas de conserva­ción tradicionales. Entre dichas ventajas destacan su inocuidad, especificidad y (...) versatilidad. Por otra parte, la acuciante necesidad de reducir el uso de antibióticos en la cadena alimentaria ha impul­sado la investigación basada en estos antimicrobianos con el fin de aplicarlos en producción primaria. Sin embargo, y a pesar de la gran eficacia ya demostrada en múltiples sectores, la falta de legislación de la Unión Europea sobre el uso de bacteriófa­gos junto con la necesidad de ser aceptados por los consumidores, son factores que están afectando negativamente a su implantación como bioconservantes. En este contexto, este artículo recoge los últimos resultados relacionados con este tipo de antimicrobianos en la industria agro-alimentaria, y resume los puntos clave para entender las posibilidades reales de su aplicación ante los nuevos requisitos asociados con una producción sostenible tanto desde una perspectiva económica como ambiental. How do researchers and/or practitioners know when change efforts are bringing about significant transformation? Here we draw on a theory of change put forward by the feminist economic geographers, Julie Graham and Katherine Gibson. Proposing “a postcapitalist politics” that builds on possibility rather than probability, they direct theoretical attention and community engaged action research to recognizing and supporting non-capitalist economic practices and sensibilities that already exist despite the dominance of capitalism that keeps them hidden and ignored and to understanding the (...) “reluctant subject” of change efforts. We enter into a conversation with their theory of change by inferring criteria for assessing significance and using those criteria in dialogue with two social movements we have researched: the feminist movement in Bogotá in the 1970s and 1980s and the contemporary local food movement in North Carolina. Lessons from these movements, in turn, help refine the criteria. Gibson-Graham are unusual – and consequently resonant with cultural-historical activity theory and related social practice theories of identity – in that they bring into dialogue theorists of the political and those interested in embodiment and the micro-politics of everyday life enabling both to better understand and support conditions for positive social and economic transformation. Ethnic minority status and female gender convey a risk for suicidal behavior, yet research of suicidality of ethnic minority female immigrants is scarce. The authors of this article conducted qualitative interviews with 15 young women in the Netherlands, who either had attempted suicide or contemplated suicide, and analyzed these in a narrative psychology tradition. Suicidality was associated with despair and frustration over the violation of the women’s personal autonomy and self-integrity regarding strategic life choices. Autonomy restrictions and violations followed two (...) patterns, which are interconnected with four criteria regarding the capacity for autonomy. Findings are discussed with referral to Durkheim and feminist theories of autonomy. (shrink)

The current research is based on Senninger’s Learning Zone Model applied to the tourists’ comfort zone. This model was created in 2000 and it proved to be useful in many applied areas: Psychology, Sociology, Marketing and Management. This modes is a behavioral one and shows how a person can justify his action based on previous tested experiences or dares to step beyond in fear, learn or growth zone. Our research is extending the existent area of expertise to tourism. We aimed (...) at exploring whether the tourists’ apprehension toward choosing their next destination from a comfort zone perspective or rather from the other zones’ perspectives such as fear, learning or growth. To meet this purpose we conducted a mixed method: firstly a qualitative one, an in-depth interview based on Delphi method with 10 tourism specialists and secondly an online survey on 208 Generation Z tourists. The interviews were meant to help developing a 20 items scale to measure from which of the 4 zones are the respondents making the choice of the future travel destination. Our conclusions show that Gen Z tourists display behaviors that can be associated with learning or growth zones rather than the comfort zone. This is relevant when choosing the next travel destination, because our findings could bring about a new approach to promoting tourist destinations as part of various products. As a result, a large range of managerial tools can better adapt the promotion messages to the target market from a new psychological perspective. (shrink)

Ofrecemos un análisis de los aspectos ontoepistemológicos de los debates actuales sobre el cuerpo sexogenerizado en Argentina. Con herramientas teóricas de la fenomenología feminista, la epistemología feminista y los nuevos materialismos feministas analizamos, por un lado, la manera en que el Estado argentino comprende el cuerpo sexogenerizado y, por el otro, una serie de afirmaciones en los discursos transexcluyentes que conflictúan estas discusiones. Buscamos despejar el terreno conceptual del debate feminista para determinar qué posturas nos permiten avanzar y cuáles nos (...) hacen retroceder. Concluimos que, mientras que las nociones en la ley de identidad de género están amparadas por el conocimiento feminista actual, los discursos transexcluyentes que cuestionan su contenido representan un marco de comprensión ontoepistemológico patriarcal. El presente artículo pretende dar cuenta de cómo el pensamiento de Slavoj Žižek posibilita el diagnóstico, la comprensión y la interpretación de nuevas o diversas formas de confrontación de algunas de las crisis más importantes de este tiempo, para lo cual esta investigación partió del estudio del concepto de crisis en el pensamiento del filósofo esloveno y de la descripción breve de algunos hechos que podrían considerarse como críticos o verdaderas crisis de este tiempo. Posteriormente se realizó un análisis de (...) la teoría del acontecimiento desarrollada por Žižek en varias de sus obras, para finalizar con algunas recomendaciones y reflexiones en torno a la forma en que el pensamiento de dicho autor posibilita tanto una nueva comprensión de las crisis, como la construcción de alternativas y focos de atención que constituyan, en sí mismos, nuevas formas de confrontación de ellos. El método empleado para realizar el abordaje así propuesto fue el hermenéutico, el instrumento fue el estudio bibliográfico y la técnica de análisis de información fue el análisis del discurso. Simulation – imagining future events – plays a role in decision-making. In Conviction Narrative Theory, people's emotional responses to their simulations inform their choices. Yet imagining one possible future also increases its plausibility and accessibility relative to other futures. We propose that the act of simulation, in addition to affective evaluation, drives people to choose in accordance with their simulations.

The formation of the human being is a fundamental subject in Saint Augustine’s thinking. In his first works references to liberal arts are highlighted, and the dialogue form appears as a privileged vehicle of the educative process. In De Ordine, Saint Augustine represents a clear example of the interest and the appropriation of dialogue as a philosophical exercise, which has the double purpose of taking his listeners to the truth and to introduce the reader to the same dynamic.

This study investigated potential risk factors (coping, perfectionism and self-regulation) for substantial injuries in contemporary dance students using a prospective cohort design, as high-quality studies focusing on mental risk factors for dance injuries are lacking. Student characteristics (age, sex, BMI, educational program and history of injury) and psychological constructs (coping, perfectionism and self-regulation) were assessed using the Performing artist and Athlete Health Monitor (PAHM), a web-based system. Substantial injuries were measured with the Oslo Sports Trauma Research Center (OSTRC) Questionnaire on (...) Health Problems and recorded on a monthly basis as part of the PAHM system. Univariate and multivariate logistic regression analyses were conducted to test the associations between potential risk factors (i.e. student characteristics and psychological constructs) and substantial injuries. 99 students were included in the analyses. During the academic year 2016-2017, 48 students (48.5%) reported at least one substantial injury. Of all factors included, coping skills (OR: 0.91; 95% CI: 0.84–0.98), age (OR: 0.67; 95% CI: 0.46–0.98) and BMI (OR: 1.38; 95% CI: 1.05–1.80) were identified as significant risk factors in the multivariate analysis. The model explained 24% of the variance in the substantial injury group. Further prospective research into mental risk factors for dance injuries with larger samples sizes is needed to develop preventive strategies. Yet, dance schools could consider including coping skills training as part of injury prevention programs and, perhaps, providing special attention to younger dancers and those with a higher BMI through transitional programs to assist them in managing the stress they experience throughout their (academic) career. ABSTRACT The main objective of this article is to make evident the relationship between expressivity and performativity trying to reveal the continuities, tensions and ruptures concerning the ways of understanding the sexed body in Merleau-Ponty's Phenomenology of Perception and the poststructuralist perspective of Judith Butler. On the one hand, the body as a sexual being is approached to demonstrate how the critiques to the anonymous body and the preexistence of the operative locus made by feminism do not fully grasp the (...) ideas of the French philosopher. On the other hand, the notions of expressivity and performativity are approached to reveal the displacement from theatricality to dramatization. RESUMEN El objetivo central de este artículo es evidenciar la relación entre expresividad y performatividad, tratando de revelar las continuidades, tensiones y rupturas entre la manera de comprender el cuerpo sexuado desde la Fenomenología de la Percepción de Merleau-Ponty y la perspectiva postestructuralista de Judith Butler. En primer lugar, se efectúa una aproximación al cuerpo como ser sexuado para demostrar cómo las críticas elaboradas desde el feminismo sobre el cuerpo anónimo y la preexistencia de un locus operativo no comprenden plenamente la propuesta del filósofo francés. En segundo lugar, se abordarán las nociones de expresividad y performatividad, para revelar el desplazamiento de la teatralidad a la dramatización. (shrink)

Este artigo baseia-se na ideia de que em qualquer tipo de diálogo os interlocutores estão marcados pela sua própria cultura/identidade. E também assim é no caso do diálogo inter-religioso. A cultura/identidade é o contexto existencial básico a partir do qual as pessoas entendem, questionam e interpretam as suas vidas, pelo que não pode ser ignorado. A necessidade de trabalhar no desenvolvimento das competências interculturais e na sensibilidade cultural surge como um ponto de partida fundamental para avançar neste tipo de diálogo. (...) This article is based on the idea that in any kind of dialogue the partners are marked by their own culture/identity. This is also the case of inter-religious dialogue. Culture/identity is the basic existential context from which people understand, raise questions and interpret their lives, can't be ignored. There is a need to work on developing cultural sensitivity and intercultural competencies as a fundamental starting point to advance in this type of dialogue. (shrink)

By gathering essays that exemplify the new thinking about matter and processes of materialization, this important collection shows how scholars are reworking older materialist traditions, contemporary theoretical debates, and advances in scientific knowledge to address pressing ethical and political challenges. The continuities they discern include a posthumanist conception of matter as lively or exhibiting agency, and a reengagement with both the material realities of everyday life and broader geopolitical and socioeconomic structures. Coole and Frost argue that contemporary economic, environmental, geopolitical, and technological developments demand new accounts of nature, agency, and social and political relationships; modes of inquiry that privilege consciousness and subjectivity are not adequate to the task. New materialist philosophies are needed to do justice to the complexities of twenty-first-century biopolitics and political economy, because they raise fundamental questions about the place of embodied humans in a material world and the ways that we produce, reproduce, and consume our material environment. A critical analysis of Diana Fuss's Essentially Speaking: Feminism, Nature, and Difference and Elizabeth Grosz's Sexual Subversions: Three French Feminists.

This paper investigates the acquisition of residual verb second (V2) in three corpora consisting of data from Norwegian-English bilinguals (Emma, Emily, and Sunniva) in order to determine to what extent these structures are affected by cross-linguistic influence (CLI) from Norwegian V2. The three girls exhibit three different patterns with regard to the relevant constructions. They are very target-like in their use of auxiliaries in the relevant structures. However, when it comes to do-support, Emily and Sunniva are equally target-like, while Emma (...) mainly produces non-target-like structures. These either involve the omission of do, or non-target-like movement of a lexical verb. Furthermore, Emma also allows verb movement across the subject with both lexical verbs and auxiliaries in topicalized structures, suggesting that she has overgeneralized residual V2 across verb types and clause types. Emily, on the other hand, is very target-like in structures involving residual V2 in English, but also allows auxiliaries and dummy-do to move across the subject in topicalized structures, overgeneralizing residual V2 to apply to non-subject-initial declaratives. Finally, Sunniva, is very precocious and very target-like in all the relevant structures, which may be an indication of acceleration due to CLI from Norwegian V2. We discuss these results with reference to language balance, finding that the measures available to us suggest that the differences between the children cannot straightforwardly be explained by language dominance. Instead, we suggest that these results can be accounted for by ambiguity in the English system, leaving the data open to several possible interpretations when acquired in contact with the consistent V2 system in Norwegian. This has several consequences: (i) the three girls’ parsers interpret the input differently, (ii) differences between the three children are qualitative rather than quantitative, and (iii) there has to be some mechanism that ensures that the children can ‘recover’ from these non-target-like grammars. Verbal communication leaves room for interpretative disputes. Speakers can argue about what they mean by their words and negotiate their commitments in conversation. This article examines the deniability of implicitly communicated contents and addresses the question of what makes an act of denial seem more or less plausible to the addressee. I argue that denials bring about a process of reconstruction of the context of interpretation of the speaker's utterance and I illustrate how considerations of cognitive utility are the key (...) determinant for distinguishing plausible from merely possible deniability. The cultural imagery of women is deeply ingrained in our consciousness. So deeply, in fact, that feminists see this as a fundamental threat to female autonomy because it enshrines procreative heterosexuality as well as the relations of domination and subordination between men and women. Diana Meyers' book is about this cultural imagery - and how, once it is internalized, it shapes perception, reflection, judgement, and desire. These intergral images have a deep impact not only on the individual psyche, but (...) also on the social, political, and cultural syntax of society as a whole. Meyer's argues for the necessity of crafting a dissident, empowering, and 'emancipatory counter-imagery' for women.
