These technologies can produce tremendous insights and benefits. But they can also invade privacy, perpetuate bias, and otherwise injure people and society. To use these technologies successfully, organizations need to implement them responsibly and ethically. The question is: how to do this? Thus statements are thought of as possessing a truth–value just insofar as we possess some adequate proof–procedure or some means of finding them out through empirical or other methods of enquiry. Norris offers a range of arguments against this anti–realist position and brings out its convergence with various postmodernist lines of thought. Through a running commentary on Derrida’s work in relation to these developments he shows how deconstruction has been misconstrued by sociologists, cultural critics and educational theorists whose understanding has often been based on a limited acquaintance with the primary texts. Above all Norris calls for a renewed engagement with the philosophic discourse of modernity and a willingness to challenge postmodern scepticism and value–relativism in a spirit of open–minded critical debate. This paper takes an ontological approach to the subject of promising. Setting aside the typical concern over promissory obligations, I draw on recent work from the field of social ontology and develop a promissory schema that characterizes the functional role the practice of promising plays in our lives. This schema, put in terms of one agent’s voluntary and intentional attempts to provide another agent with a specific kind of assurance, helps explain what we are doing when we make a promise, (...) and what we desire when we ask that a promise be made. The promissory schema is explanatorily beneficial as it can help us understand why certain actions may be interpreted as promises, thereby reminding us that we need to be sensitive to the ways our actions can give rise to expectations in others. Should the truth-value of statements be thought of as epistemically constrained or as determined by objective factors that stand quite apart from our best knowledge, evidence, or powers of conceptual grasp? The anti-realist/realist debate turns ultimately on this disagreement. My article takes its lead from a famous pronouncement by US Defense Secretary Donald Rumsfield to the effect that there are ‘known knowns’, i.e. ‘things that we know we know’; ‘known unknowns’, or ‘things we know we do not know’; and lastly, (...) ‘unknown unknowns’, ‘things we don’t know we don’t know’. Whether Rumsfeld was talking gobbledegook, making some acute logical points, or just pulling the wool with regard to Iraq’s disputed weapons capability is matter for debate. Still, his remarks may be useful for clarifying certain fundamental issues about knowledge and truth, especially in the context of assertions - by anti-realist philosophers such as Michael Dummett - that truth cannot possibly transcend our best powers of proof or ascertainment. On the other hand such scruples may have just the opposite (obfuscating) effect when we are faced with a complex and case-specific question, such as whether or not Iraq truly possessed weapons of mass destruction. My article contends that a wide range of reliably knowledge-conducive procedures, while indeed they fall short of absolute, indubitable truth, nonetheless offer grounds for arriving at a reasoned assessment of the evidence and for not consigning statements of the Dummettian ‘disputed class’ to a limbo of ultimate undecidability. What follows is a vibrant exchange among Paola Marrati, Andrew Norris, Jörg Volbers, Cary Wolfe and Thomas Dumm addressing the question whether, in the contemporary political context, Cavell’s skepticism and his Emersonian perfectionism amount to a politics at all.

How does the human animal who thinks and loves relate to criminal justice? This essay takes up the idea of a moral psychology of guilt promoted by Bernard Williams and Herbert Morris. Against modern liberal society’s ‘peculiar’ legal morality of voluntary responsibility, it pursues Morris’s ethical account of guilt as involving atonement and identification with others. Thinking of guilt in line with Morris, and linking it with the idea of moral psychology, takes the essay to Freud’s metapsychology in Civilization and (...) Its Discontents. Two conflicting routes to guilt are noted in Freud, one involving internalisation of external anger to suppress destructive instincts, the other loving identification with others in the process of self-formation. This second route is developed through the psychoanalytic thought of Hans Loewald and Jonathan Lear. Following Loewald, the moral psychology of self-formation makes loving identification with others the root of responsibility, guilt and atonement. Following Lear, the moral psychology of guilt developed on these lines renders psychoanalysis part of a broadly understood philosophical project following Aristotelian and Socratic principles. Underlying Morris’s account of guilt is the possibility of ‘prospective identification’, understood as the moral and psychological ground of guilt and reconciliation. This is the rational core of criminal justice, which maintains an uneasy relationship with law’s ‘peculiar’ morality. (shrink)

The Italian philosopher Giorgio Agamben is having an increasingly significant impact on Anglo-American political theory. His most prominent intervention to date is the powerful reassessment of sovereignty and the politics of life and death laid out in his multivolume _Homo Sacer_ project. Agamben argues that in both the modern world and the ancient, politics inevitably involves a sovereign decision that bans some individuals from the political and human communities. For Agamben, the Nazi concentration camps—in which some inmates are reduced to (...) a form of living death—are not a political aberration but instead the place where this essential political decision about life most clearly reveals itself. Engaging specifically with _Homo Sacer_, the essays in this collection draw out and contend with the wide-ranging implications of Agamben’s radical and controversial interpretation of modern political life. The Bush administration's response to the terrorist attacks of September 11, 2001, has been uniformly hostile to this notion, and it has instead promoted a jingoistic politics of self‐assertion by an America largely identified with the executive branch of its government. This is doubly disturbing, as the executive branch has sought to free itself from international law, multinational commitments, and domestic judicial regulation, even (...) as it has sought to validate itself by demonizing its enemies. This essay draws out the disturbing echoes here of Carl Schmitt's work of the 1920s, in particular of Schmitt's conception of the sovereign as the ungrounded ground of the law and the political as the site of mortal conflict between friend and enemy. The essay argues that Schmitt's position in the twenties, for all of its evident problems, is superior to that of Bush, Wolfowitz, and Ashcroft in at least two senses: Schmitt condemns the idea of waging war for profit and recognizes that such wars will often be disguised as moral crusades waged against the “inhuman”; and he acknowledges that claiming to fight a war for humanity denies one's enemies their humanity, leaving them open to torture and even extermination. Metaphysicians go on busily doing metaphysical thinking all over the world, and apparently with a modicum of self-assurance that they are not talking nonsense or pursuing an illusory will-of-the-wisp. Yet other philosophers of empirical, analytical, phenomenological, or other turns of mind seem to have more and more difficulty in understanding just how metaphysicians give meaning and positive content to the vast abstract concepts by which they seek to describe and explain the entire spectrum of reality extending far beyond present or (...) perhaps even possible human experience. Since there is no way of gaining direct insight into dimensions of reality beyond human experience, and since in order to be applied to the whole range of reality these concepts must abstract from purely human experience, it is hard for them to see—and it is a serious problem in itself—how these all-embracing terms can be anything more than empty, formal, verbal symbols or conceptual constructions, with no positive existential content describing reality itself across its whole spectrum. Even the metaphysician himself, though when left alone he may have a sure sense of how to do metaphysical thinking fruitfully, when questioned to explain and justify what he is doing, and is convinced is worth doing, can feel embarrassed and struck dumb as to how to articulate and justify the principles behind the procedures he is following. We show in this paper that some expressions indicating source of evidence are part of propositional content and are best analyzed as special kind of epistemic modal. Our evidence comes from the Japanese evidential system. We consider six evidentials in Japanese, showing that they can be embedded in conditionals and under modals and that their properties with respect to modal subordination are similar to those of ordinary modals. We show that these facts are difficult for existing theories of evidentials, which (...) assign evidentials necessarily widest scope, to explain. We then provide an analysis using a logical system designed to account for evidential reasoning; this logic is the first developed system of probabilistic dynamic predicate logic. This analysis is shown to account for the data we provide that is problematic for other theories. (shrink)

Daniel Dennett once invited us to consider super-Martians who were highly advanced scientifically yet lacked all intentional concepts. They spoke the language of austere physics and were capable of perceiving and describing the world at the micro-level. If such beings could accurately report happenings in their environment, make predictions, and generally live out their lives wholly within the scientific image, what would they be missing, Dennett wondered, by virtue of lacking intentional concepts? Norris Clarke's metaphysics of the universe as a journey rests on six major positions: the unrestricted dynamism of the mind, the primacy of the act of existence, the participation structure of reality, and the person, considered as both the starting point of philosophy and the source of the categories needed for a flexible contemporary metaphysics. Reflecting on his conscious life and the universe around him, the finite person mounts by a two-fold path to its Infinite source, who, though (...) immutable in His natural being, is mutable in the intentional being of His personal knowledge and love. The personal God is the efficient cause from whom the universe comes and the final cause to whom it returns.Less optimistic than Norris Clarke, John Caputo wonders about his metaphysics of the person. In a hermeneutical interpretation of the human face, the person through whom Being "sounds" discloses an ambiguous Being that both reveals and conceals itself. Far from grounding a casual ascent to God, hermeneutical phenomenology allows us no more than the right to interpret the world and its transcendent source through our own free decision.Although impressed by Norris Clarke's attempt to introduce mutability into God, Lewis Ford still finds Clarke's Thomistic God unacceptable. As a Whiteheadian, he proposes in place of Thomas' God, whose perfection consists in static unity, a God whose perfection consists in a never-ending process of unification. John Smith argues against the traditional dichotomy made between the ontological and cosmological arguments. Rather than opposed methods of proving God's existence, they should be taken as complementary journeys to the divine presence which discloses itself, although diversely, in the soul and in the world. There are parallels between Smith's historical study of two arguments and Clarke's two-fold path to God. Yet Smith is critical of Thomas' cosmological journey to God and does not share Clarke's confidence in its validity. Significant studies in their own right, the three essays as a group challenge Clarke's whole metaphysics of the universe as a journey. This book was written with a view to sorting our some of the muddles and misreadings - especially misreadings of Kant - that have charaterized recent postmodernist and post-structuralist thought. For these issues have a relevance, as Norris argues, far beyond the academic enclaves of philosophy, literary theory, and cultural criticism. Thus he makes large claims for the importance of getting Kant right on the relation between epistemology, ethics and aesthetics; for pursuing the Kantian question 'What is Enlightenment?' as (...) raised in Foucault's late essays; or again, for recalling William Empson's spirited attempt to reassert the values of reason and truth against the orthodox 'lit crit' wisdom of his time. These are specialized concerns. But for better or worse it has been largely in the context of 'theory'- that capacious though ill-defined genre- that such issues have received their most scrutiny over the past two decades. As its title suggests, The Truth About Postmodernism disputes a good deal of what currently passes for advance theoretical wisdom. Above all it mounts a challenge to those fashionable doctrines - variants of the 'end-of-ideology' theme - that assimilate truth to some existing range of language-games, discourses, or in-place consensus beliefs. Norris's book will be welcomed for its clarity of style, its depth of philosophical engagement, and its refusal to endorse the more facile varieties of present-day textualist thought. It will also serve as a timely reminder that the 'politics of theory' cannot be practised in safe isolation from the politics of activist social concern. (shrink)

This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

My aim in this chapter is to push back against the tendency to emphasize Mill’s break from Bentham rather than his debt to him. Mill made important advances on Bentham’s views, but I believe there remains a shared core to their thinking—over and above their commitment to the principle of utility itself—that has been underappreciated. Essentially, I believe that the structure of Mill’s utilitarian thought owes a great debt to Bentham even if he filled in that structure with a richer (...) conception of human nature and developed it in more liberal directions. This commonality is revealed, in particular, in Mill’s own institutional designs and practical reform proposals in Considerations on Representative Government and related writings. If this is right, then the tendency of interpreters to highlight their differences rather than their similarities has been to the detriment of both Mill and Bentham scholarship, and so to our understanding of the rise of liberal utilitarianism. The first section draws on previous work to set out a position on human love as the basis for an understanding of guilt and the ‘moral grammar’ of justice. The second section considers Martha Nussbaum’s claim (...) in Anger and Forgiveness that the idea of transition should be prioritized at the cost of a moral transactional analysis that would engage the moral grammar of blame, guilt, responsibility, apology and forgiveness. The latter is seen as potentially obstructing the transition to a better world.
