Standardizing consultation processes is increasingly important as clinical ethics consultation becomes more utilized in and vital to medical practice. Solid organ transplant represents a relatively nascent field replete with complex ethical issues that, while explored, have not been systematically classified. In this paper, we offer a proposed taxonomy that divides issues of resource allocation from viable solutions to the issue of organ shortage in transplant and then further distinguishes between policy and bedside level issues. We then identify all transplant related (...) ethics consults performed at the Cleveland Clinic between 2008 and 2013 in order to identify how consultants conceptually framed their consultations by the domains they ascribe to the case. We code the CC domains to those in the Core Competencies for Healthcare Consultation Ethics in order to initiate a broader conversation regarding best practices in these highly complex cases. A discussion of the ethical issues underlying living donor and recipient related consults ensues. Finally, we suggest that the ethical domains prescribed in the Core Competencies provide a strong starting ground for a common intra-disciplinary language in the realm of formal CEC. (shrink)

GoldfarbGod and fictional narrators are the only beings who are sometimes considered omniscient. God, who is sometimes regarded as not fictional, is frequently also regarded as omnipotent. Narrators, who normally seem to have no sphere of action save for conveying information to readers, particularly when they speak omnisciently in the third person, are not considered to have “power” in any way, because (...) they are supposed to function outside the story. God always speaks in the first person, and is regarded as an all-powerful agent.But what happens when the narrator gets in on the action? First-person narrators can enter the plot, speaking in the voice of personal narrative, and sometimes “know” as much or more than some third-person narrators who are supposedly “omniscient.” The positivistic “third-person omniscient” narrator of Turgenev’s Fathers and Sons, for instance, knows only what he sees, and though his omnipresence allows him to see quite a bit, he has virtually no access to the minds of the characters, as do the psychologically omniscient third-person narrators of Tolstoy or Henry James. If knowledge were thus limited in the context of a novel to observables, a first-person narrator who gets around enough could appear much like an omniscient narrator, while also appearing to present a particular point of view. Conversely, the third-person narrator’s seeming objectivity is similarly illusory. Any narrator “chooses” what information to relay, and when and how to relay it. In a sense, third-person omniscient narrators fictionally determine what counts as “the story,” creating the fictional world with their godlike voice. Some overbearing narrators, like Nikolai Chernyshevsky’s anonymous first-person narrator in What Is To Be Done, adopt not only an omniscient and objective standpoint with regard to the actions and [End Page 61] thoughts of the characters, but even presume to tell readers how to interpret the events in the novel. Therefore, all narrators have varying amounts of both knowledge and power, and in some cases they may approach, within variously circumscribed spheres of knowledge and agency, omniscience and omnipotence.In this essay, I would like to explore the range of constraints and effects of the narrator’s fictional power and knowledge. As a test case, I have chosen Mikhail Lermontov’s novel, A Hero of Our Time (Geroi nashego vremeni). Writing between 1837 and 1840, Lermontov was one of the first Russian writers to experiment with the form of the novel, influenced primarily by contemporary English, French, and German examples, as well as the classical epic, making this work, like many of the early Russian novels of the 1820s and 1830s, a jumble of narrative styles interestingly layered on each other. It is a particularly fecund work for studies of narrative subjectivity, because characters shift from narrator to narratee across a variety of genres, all in one text.A Hero of Our Time is composed of five major chapters: “Bela,” “Maksim Maksimich,” “Taman,” “Princess Mary,” and “The Fatalist,” the last three of which comprise the journal of the main character, the officer Grigory Pechorin. The “journal” chapters are preceded by a brief section, set in 1838 or 1839, sometime after Pechorin’s death, called the “Introduction to Pechorin’s Journal.” In “Bela” an unnamed traveler gathering stories in the Caucasus during the year 1837 meets an older officer, Maksim Maksimich, who tells a yarn about the Byronic adventures of Pechorin in the spring of 1833 involving his abduction of a Circassian woman after whom the chapter is named. Since the introduction and widespread adoption of chemical herbicides, “weed management” has become almost synonymous with “herbicide management.” Over-reliance on herbicides and herbicide-resistant crops has given rise to herbicide resistant weeds. Integrated weed management (IWM) identifies three strategies for weed management— biological-cultural, chemical-technological, mechanical-physical—and recommends combining all three to mitigate herbicide resistance. However, adoption of IWM has stalled, and research to understand the adoption of IWM practices has focused on single stakeholder groups, especially farmers. In contrast, decisions about weed management (...) often occur within a social ecosystem where multiple stakeholder groups co-create knowledge and practices. To more holistically investigate perceptions and decision-making related to herbicide resistant weed management, we conducted 23 in-depth interviews in combination with Q methodology with farmers and public-/private-sector agricultural professionals in the state of Georgia (U.S.). Our investigation focused on the management of an increasingly herbicide resistant weed, Palmer amaranth, which enabled broader conversations about agricultural systems, farmer livelihoods, and sustainability. Factor and thematic analyses allowed us to identify and characterize two distinct typologies: one primarily valued agronomic efficiency and relied upon chemical-technological management practices, while the other valued diversifying weed management strategies as the pathway to agronomic and economic success. Typologies diverged substantially in attitudes toward the three weed management strategies, the role of technology, and systems management generally. These two viewpoints have implications for how we understand underlying stakeholder motivations and choices around weed management strategies, both of which are crucial in promoting and supporting farmer use of diverse, ecologically-sound, weed management strategies. El propósito de este texto es abordar la problemática de las inteligencias artificiales y su incidencia en la sociedad contemporánea. Para ello, se realizan lecturas paralelas de las sociedades distópicas creadas por Isaac Asimov y Philip K. Dick. A partir de estas, se identifican algunos rasgos existentes en nuestro contexto inmediato, enfocándonos en tres ejes principales: la sociedad de vigilancia y control tecnológico, el problema de lo natural en los ciber-seres, y la visión del siglo XXI en la ciencia ficción (...) para analizar si esta es ilusoria o, por el contrario, forma parte de nuestra realidad inmediata. Todo esto con el fin de definir al género como un espejo de nuestro futuro, basándonos en la lectura de nuestro presente para interpretar los mundos posibles y el futuro como fuente de reflexión filosófica y tecnológica. En este artículo, analizaremos a grandes rasgos los elementos de la ciencia ficción de Isaac Asimov y Philip K. Dick, enfocándonos en aspectos como la naturalidad de los individuos, las sociedades de control y las líneas que separan lo humano de lo artificial como bases para la reflexión filosófica. A través de este ejercicio, examinaremos diversas obras de ambos autores, tales como El hombre bicentenario (Asimov 2019b), Satisfacción Garantizada (Asimov 2019a), La última pregunta (Asimov 2019a), ¿Sueñan los androides con ovejas eléctricas? (Dick 2017) y El hombre en el castillo (Dick 2021). El objetivo es identificar elementos que nos permitan interpretar el siglo XXI como una obra de ciencia ficción en constante desarrollo. (shrink)

Podemos encontrar historiadores que definen el sistema nobi como un sistema de esclavitud y a los nobi como esclavos, y a historiadores que prefieren definirlo como un sistema de servidumbre y a los nobi como siervos. En este artículo se expone la interpretación que el historiador estadounidense James B. Palais ofreció sobre el sistema nobi en la dinastía Joseon de Corea (...) a partir de su producción intelectual, poniendo un mayor énfasis en la interpretación ofrecida en su obra Confucian Statecraft and Korean Institutions: Yu Hyongwon and the Late Choson Dynasty, además de exponer las influencias intelectuales que motivaron esta interpretación por parte de Palais. An analysis of the sources of Wittgenstein’s picture theory — which include not only his moment of insight on reading a magazine story about the use of models in a traffic court, but also the work of Russell, Hertz, and Boltzmann — provides the basis for an exploration of Wittgenstein’s articulation of a pictorial conception of representation in his wartime notebooks and its crystallization in the Tractatus. A discussion of Wittgenstein’s later criticism of the picture theory and his notion of (...) a “philosophical picture” illustrates the fundamental reversal in his transition to his later conception of philosophy: instead of taking literal pictures as a guide to the nature of meaning, he came to regard philosophical theories as akin to expressing an aesthetic preference for a certain style of representation. Wittgenstein’s treatment of factual language in the picture theory is related to his Tractarian approach to logical form, and the role of the show/say distinction in his early conception of logic and language. Particular attention is given to the difficulties generated by the idea that the conditions for the possibility of a given domain of discourse cannot be described in language, but must be shown by the form of words in question. Infectious diseases figure prominently as (counter)examples in debates on how to conceptualize “disease.” But crucial epidemiological distinctions are often not heeded in the debate, and pathological and clinical perspectives focusing on individual patients are favored at the expense of perspectives from epidemiology focusing on populations. In clarifying epidemiological concepts, this paper highlights the distinct contributions infectious disease epidemiology can make to the conception of “disease,” and the fact that this is at least tacitly recognized by medical personnel and philosophers. Crucially, (...) infectious disease epidemiology can help elucidate how carrying and transmitting infectious, communicable entities is a disease, even if the carriers themselves are not directly affected by symptoms detrimental to them. This paper develops a theory of belief and belief ascription which retains the core of the received Propositionalist theory but which, unlike the Propositionalist theory, is compatible with both Direct Reference and Individualism about belief. The focus is on developing an alternative analysis of belief ascriptions, drawing out its implications, and applying it to some standard problems. On that analysis, ascriptions involving directly referential embedded terms are seen as roughly characterizing, but not specifying, the contents of beliefs. Psychologists debate whether mental attributes can be quantified or whether they admit only qualitative comparisons of more and less. Their disagreement is not merely terminological, for it bears upon the permissibility of various statistical techniques. This article contributes to the discussion in two stages. First it explains how temperature, which was originally a qualitative concept, came to occupy its position as an unquestionably quantitative concept (§§1–4). Specifically, it lays out the circumstances in which thermometers, which register quantitative (or cardinal) differences, (...) became distinguishable from thermoscopes, which register merely qualitative (or ordinal) differences. I argue that this distinction became possible thanks to the work of Joseph Black, ca. 1760. Second, the article contends that the model implicit in temperature’s quantitative status offers a better way for thinking about the quantitative status of mental attributes than models from measurement theory (§§5–6). Interviews focusing on the last century take a look at history from the standpoint of the ordinary people of the country.

The growing interest in Africa as well as concerns about negative deviant behaviors and ethnic structures necessitates examination of the effect of ethnic expectations on behavior of employees. In this study we leverage insight from ethnos oblige theory to propose that centralization of ethnic norms moderates the relationship between benevolence expectations and negative deviant behavior. Using a cross-sectional design and data from two countries as well as moderation and cross-cultural analytic techniques, we find support for three-way interactions where the relationship (...) between benevolence and negative deviant behavior is moderated by centralization and culture. We discuss the implications of the findings which support the dynamic perspective of management in Africa. (shrink)

Nothing can kill a promising research program in ethics more quickly than a plausible argument to the effect that it is committed to a morally repellent consequence. It is especially troubling when a theory one favors is jeopardized in this way. I have this worry about Harry Frankfurt's theory of free will, autonomous agency and moral responsibility, for there is a very plausible argument to the effect that aspects of his view commit him to a version of the late Stoic (...) thesis that acting freely is a matter of ‘making do,’ that is, of bringing oneself to be motivated to act in accordance with the feasible, so that personal liberation can be achieved by resigning and adapting oneself to necessity. In this paper I try to determine whether the theory does in fact commit Frankfurt (and adherents like me) to this result and, if so, what can be done to prevent it. (shrink)

There has been considerable recent interest in the “collective moral autonomy” thesis (CMA), that is, the notion that we can predicate moral successes, failures, and duties of collectives even if there are no comparable successes, failures, and duties among members. One reason why this position looks appealing is because the opposing individualist position seems to have what we might call an accounting problem. Individualists maintain that only individuals can be subjects of moral success, failure, or duty; however, many reasonable judgments (...) about collective actions include moral information on a scale and of a stringency that it does not seem possible to predicate even of the duties of members who have steering power in the actions of the collective. Here I offer a paradigm for thinking about responsibility judgments in organized collective cases to help individualism solve its accounting problem, and allow us to account within a strict individualist perspective for moral information that ostensibly favors CMA. This overview of the "sister arts" of the nineteenth century by younger scholars in art history, literature, and American studies presents a startling array of perspectives on the fundamental role played by images in culture and society. Drawing on the latest thinking about vision and visuality as well as on recent developments in literary theory and cultural studies, the contributors situate paintings, sculpture, monument art, and literary images within a variety of cultural contexts. The volume offers fresh and sometimes extended (...) discussions of single works as well as reevaluations of artistic and literary conventions and analyses of the economic, social, and technological forces that gave them shape and were influenced by them in turn. A wide range of figures are significantly reassessed, including the painters Charles Willson Peale, Washington Allston, Thomas Cole, George Caleb Bingham, Fitz Hugh Lane, and Mary Cassatt, and such writers as James Fenimore Cooper, Nathaniel Hawthorne, Henry David Thoreau, and William Dean Howells. One overarching theme to emerge is the development of an American national subjectivity as it interacted with the transformation of a culture dominated by religious values to one increasingly influenced by commercial imperatives. The essays probe the ways in which artists and writers responded to the changing conditions of the cultural milieu as it was mediated by such factors as class and gender, modes of perception and representation, and conflicting ideals and realities. In this paper, I develop two criticisms of L. Jonathan Cohen's influential a priori argument that human irrationality cannot be experimentally demonstrated. The first is that the argument depends crucially on the concept of a normal human but that no such concept suitable for Cohen's purposes is available. The second is that even if his argument were granted, his thesis of an unimpeachable human capacity for reasoning is not a defense of human reasoning, but rather amounts to the claim that (...) we cannot make any meaningful evaluative claims about human reasoning whatsoever. Dilthey’s moral writings have received scant attention over the years, perhaps due to his apparent tendency toward relativism. This essay offers a unified look at Dilthey’s moral writings in the context of his Kantian-styled “Critique of Historical Reason.” I present the Dilthey of the moral writings as an observer of reason in the spirit of Kant, watching practical reason devolve into error when it applies itself beyond the bounds of possible experience. Drawing on moral writings from across Dilthey’s corpus, I (...) retrace Dilthey’s argument that moral theories from Kantianism and utilitarianism to natural law theory suffer significant motivational problems because of the way they transcend the “synthesis” of moral perception. Dilthey’s argument suggests that abstract moral theory is always bound to seem unmotivating and unreal from the standpoint of lived experience, and perhaps that, to avoid this, moral philosophy should confine itself to more situated, case-specific judgments. This article, originally presented as a keynote address at the 2019 McCain conference, proposes that we must take seriously the “moral” component of moral injury. In addition to psychological treatment, wounded warriors suffering moral injury require atonement for genuine transgressions, and insight when the conduct they regard as transgression actually is not. The article defines the dimensions of moral injury as parallel to those of physical injury: pain, loss of functionality, and (in some cases) disfigurement. It then asks how atonement (...) can be achieved, turning to an unusual source for inspiration: the laws of atonement set out by the medieval Jewish philosopher Moses Maimonides. Maimonides proposes four requirements: verbal confession, repentance, reparation, and apology. The article explains their meaning in the context of contemporary wounded warriors. Finally, it argues that Judaism’s unique tradition of collective atonement offers an important model for the armed services. (shrink)

Duhem’s concept of “good sense” is central to his philosophy of science, given that it is what allows scientist to decide between competing theories. Scientists must use good sense and have intellectual and moral virtues in order to be neutral arbiters of scientific theories, especially when choosing between empirically adequate theories. I discuss the parallels in Duhem’s views to those of virtue epistemologists, who understand justified belief as that arrived at by a cognitive agent with intellectual and moral virtues, showing (...) how consideration of Duhem as a virtue epistemologist offers insights into his views, as well as providing possible answers to some puzzles about virtue epistemology. The extent to which Duhem holds that the intellectual and moral virtues of the scientist determine scientific knowledge has not been generally noticed. (shrink)
