The regulatory structures underlying United States and European Union policies regarding genetically modified (GM) food and crops are fundamentally different. The US regulates GM foods and crops as end products, applying roughly the same regulatory framework that it does to non GM foods or crops. The EU, on the other hand, regulates products of agricultural biotechnology as the result of a specific production process. Accordingly, it has developed a network of rules that regulate GM foods and crops specifically. As a (...) result, US regulation of GM foods and crops is relatively permissive, whereas EU regulation is relatively restrictive. Why are genetically modified food policies in the United States and the European Union so strikingly different? In the light of the recent World Trade Organization dispute on agricultural biotechnology, it may seem that economic interests are the driving force behind policies. While they are certainly part of the picture, the issue is far more complex. This paper argues that three different elements help explain differences between US and EU GM food policies. First, an investigation of US and European policies of the 1970s and 1980s on recombinant DNA research and of events leading up to early GM food and crop regulation allows a deeper understanding of current policy. Second, scrutinizing underlying values and norms can uncover the beliefs that condition current GM food and crop policy. Third, an analysis of involved actors’ views and levels of success in influencing policy is essential to understanding US and EU policies. (shrink)

In the Transcendental Dialectic of the Critique of Pure Reason (1787), Kant argues for the impossibility of theistic arguments, namely the ontological, cosmological, and physico-theological arguments. However, his objection relies on his classification of theistic arguments, which has been criticized by analytical philosophers of religion such as Plantinga (2012) and Swinburne (2019). Therefore, this paper aims to critically investigate two problems related to this classification: the systematic criteria of its classification and the historical sufficiency of its three theistic proofs. Regarding (...) the first problem, it will be argued that it is possible to recognize a certain systematic artificiality in Kant's classification of theistic proofs, given the criticisms of Strawson (1966) and Hegel (1812, 1830), as well as the internal critique developed by the authors of this work. Regarding the second problem, it will be argued that it is possible to indicate a certain historical insufficiency in Kant's classification of the three theistic proofs, based on brief critiques focused on some classical theologians such as Anselm, Aquinas, and Al-Ghazali. Finally, once it is justified that Kant's objection depends on this possibly artificial and insufficient classification, it will be briefly indicated that Kant does not seem as justified as he intended in his objection to theistic arguments. Considering the enormous outpouring of scholarly work on Schmitt over the last two decades, the absence of an adequate treatment in English of Schmitt's concept of history and the problem of secularization is quite surprising. After all, it is Schmitt himself who claims that “all human beings who plan and attempt to unite the masses behind their plans engage in some form of philosophy of history,” such that the attempt to make sense of Schmitt's program remains incomplete without a serious (...) treatment of his philosophy of history. This article is an attempt to address this problem by means of his exchange with Hans Blumenberg who, more than any other critic of Schmitt, was privy to the political intentions behind Schmitt's metaphorical use of theology. While their discussion is extensive and wide-ranging, I focus here on their diverging philosophies of history, precisely that aspect that is most relevant to gaining a more expansive understanding of Schmitt's arguments, and indeed the relationship between political thought and historical thought. Recent trends in academic and professional legal communication worldwide have promoted significant changes to aim at operating successfully under current multilingual and multilegal contexts. The aim is to consider a kind of supranational legal discourse so as to minimize socio-cultural variants and to promote the pragmatic conditions for harmonized and ‘common sense’ legal practices without excluding potential reciprocal influences of or resistance to one hegemonic legal system upon others. In Brazil, the traditional ‘thinking like a civil lawyer’ culture still prevails (...) against a more global approach constraining the consolidation of the country’s role of major player in most global legal areas. In addition, the key tool required for achieving some sort of global legal status—Brazilian legal operators’ proficiency in legal English—has been barely considered in both academic and professional settings, particularly in legal translation. This study resorts to the linguistic anthropology concept of ‘entextualization’ to discuss the process of official translation in Brazil to render global legal genres. The comparative analysis between the original text in English and its official version in English focus on drafting consistency, the translator’s choice of some formal entextualization elements used in the process of translation and his/her authority as the entextualizing agent to legitimate text. Faith, Tsar and Fatherland is an exploration of how religious, political, and ethnic differences influenced war mobilization in Russia prior to, and during, the First World War. Through the narrative of a sacred union, the Russian Imperial government unified an otherwise divided country into one cohesive whole, fighting to protect the Fatherland. Conceiving sexuality as a sociohistorical construction, in this paper I reflect upon possible reconfigurations that neoliberalism allows, bearing in mind that it is a specific governmentality displaying a particular mode of subjectivization. The hypothesis I develop stresses that neoliberal governmentality provides new forms of living and experiencing sexuality, resignifying sexual practices to be either accepted or dismissed. Consequently, there are pleasures and sexual acts that become more tolerated, and that originate new rules. Departing from the premise that sexuality is determined (...) by pleasure and danger logics within which neoliberalism foregrounds new discourses, I aim to show the impact such new rules have on women. In these terms, the antivictim conception that some feminist sectors demand regarding sexuality, can orbit around the neoliberal discourse and hide the vindications of women who cannot choose the rejection of their victim position. Even if feminism is widely claiming for women’s reappropriation of their sexual pleasure, these demands are resignified by discourses that urge women to be responsible of themselves, leaving them defenseless in the face of the numerous hardships crossing sexuality as a whole. Reestablishing feelings of control after experiencing uncertainty has long been considered a fundamental motive for human behavior. We propose that rituals (i.e., socially stipulated, causally opaque practices) provide a means for coping with the aversive feelings associated with randomness due to the perception of a connection between ritual action and a desired outcome. Two experiments were conducted (one in Brazil [n = 40] and another in the United States [n = 94]) to evaluate how the perceived efficacy of rituals is (...) affected by feelings of randomness. In a between-subjects design, the Scramble Sentence Task was used as a priming procedure in three conditions (i.e., randomness, negativity, and neutral) and participants were then asked to rate the efficacy of rituals used for problem-solving purposes. The results demonstrate that priming randomness increased participants' perception of ritual efficacy relative to negativity and neutral conditions. Implications for increasing our understanding of the relationship between perceived control and ritualistic behavior are discussed. (shrink)

O presente artigo busca traçar um estudo político-filosófico e se dedica a articular as nuances do conceito arendtiano de ação, sobre o entendimento do agir humano dentro do espaço público. Observar as nuances e a imprevisibilidade pela qual a ação humana é expressa frente à convivência entre iguais e diferentes no espaço público é enxergar a forma com a qual as singularidades humanas e o fenômeno da revelação das identidades se tornam evidentes. Dessa maneira, o objetivo geral do presente trabalho (...) se perfaz em analisar como a dimensão política do conceito arendtiano de ação está ligada à busca da liberdade do indivíduo no espaço público. Dessa forma, busca-se entender as interações interpessoais em meio a pluralidade humana e a procura pela liberdade frente ao mundo das aparências. (shrink)

We report the results of an experiment designed to determine the effects of psychological proximity—proxied by awareness of pain and friendship—on moral reasoning. Our study tests the hypotheses that a moral agent’s emphasis on justice decreases with proximity, while his/her emphasis on care increases. Our study further examines how personality, gender, and managerial status affect the importance of care and justice in moral reasoning. We find support for the main hypotheses. We also find that care should be split into two (...) components, one related to protection and the other to the preservation of relationships. Although gender does not affect moral reasoning directly, we find that it does so indirectly via personality, controlling for age, professional status, and professional background. We do not find a significant effect of managerial status on ethics of justice, but do find that holding a managerial position has a negative impact on ethics of care. Regarding personality, we detect significant positive effects of conscientiousness on ethics of justice and of neuroticism on ethics of care. (shrink)

Physical education is often selected for applying multilingual initiatives through the use of the content and language integrated learning (CLIL) approach. However, it is still unclear whether the introduction of such approach might entail losing Physical Education’s essence and distorting its basic purposes. The aim of this study is to analyse the impact of CLIL on the Physical Education lessons. Given the purpose of this study, a mixed methodological approach based on a sequential exploratory design divided in two different phases (...) is used. We begin with an initial qualitative data collection (phase I) consisting in the analysis of interviews with 12 participants (8 teachers and 4 students). Based on its analysis, two foci are identified: social relationships and physical activity. Then, informed by the results obtained, a quantitative approach is used (phase II), differentiating these two sets of data to deepen on them. On one part, a sociometric questionnaire was applied to analyse the social relationships among CLIL students. On the other part, a quasi-experimental design (n = 49) was implemented using accelerometry to measure the MVPA of the PE sessions. Regarding physical activity, the results show that levels of MVPA are higher in the experimental group (CLIL) than in the control group showing light to the divergent viewpoints of interviewees. However, focusing on social relationships, the sociometric questionnaire results show that there were no statistical significative changes, although some signs of a slight effect on students’ relationships arise depending on their gender. Therefore, more research would be necessary to deepen on how CLIL affects in this regard. (shrink)

RESUMO: O sentimento religioso corresponde à experiência do sujeito em suas buscas por uma amorosa realização consigo mesmo, com os outros, com a natureza e com o mistério divino. Ao pensarmos no sentido formativo desse humano, interfaces da religiosidade, da psicologia e da pedagogia nos remetem aos deleites e conflitos presentes no desenvolvimento intrapessoal e relacional. Diante desse desafio, o presente artigo se propõe a refletir sobre o humano e sua formação interdisciplinar em busca de competências e habilidades para gestão (...) de conflitos interpessoais. A pesquisa, qualitativa e bibliográfica, tem bases conceituais em: Edith Stein (2002, 2003, 2004, 2005, 2007); Piaget (1977, 1994); Lévinas (2010); La Taille (1999, 2009); entre outros. Conclui-se que educação e religiosidade, em interdisciplinaridade com a Psicologia e com a Pedagogia, podem se unir no desafiador processo de resolver conflitos interpessoais. (shrink)

This paper proposes a theoretical approach to discuss the relations among reality, chemists’ interactions with it, and the resulting interpretation and representation of the acquired scientific knowledge. Taking into account that such relations are of semiotic nature, this paper aims at discussing in the light of Peirce’s theory of signs different descriptions of chemical activity and chemical education proposed by Alex Johnstone and elaborated by other science educators. In order to discuss the contributions and limitations of the proposed theoretical framework, (...) and considering its potential interest for chemical education, an example on the communication strategies for the content ‘vapour pressure’ found in twentieth-century general chemistry university textbooks is also presented. A concepção espinosista das relações entre o corpo e a mente é frequentemente apresentada como um modelo e uma referência na biologia e na neurobiologia contemporâneas, como testemunham as obras de Jean-Pierre Changeux, de Antonio Damasio ou de Henri Atlan. Apesar de suas profundas diferenças, esses pesquisadores expõem de maneira análoga três teses que fazem de Espinosa um precursor: o monismo psicofísico, a dualidade de expressão da unidade corpo/mente e a ausência de interação e de causalidade recíproca. Esse artigo se (...) interroga sobre as razões pelas quais Espinosa é convocado por esses pesquisadores para dar apoio às suas teorias e para abordar os diferentes usos da sua concepção das relações corpo/mente. Trata-se, portanto, de examinar a maneira pela qual eles apreendem sucessivamente essas três teses e de mensurar a pertinência de suas abordagens. (shrink)

Commentaries on the Guide of the Perplexed occupy a central but neglected place in the history of Jewish thought. In the first study on the subject, Igor De Souza examines this dynamic tradition in its most creative period. Rather than mere interpretation, De Souza reads commentaries as texts in their own right. At the same time, he illustrates how texts are reimagined through commentary, and repurposed for new generations of readers.

O presente estudo objetivou analisar a questão da educação feminina, enfatizando a trajetória da mulher na ampliação das oportunidades educacionais e sociais através da profissionalização do Magistério representado pelo Instituto de Educação Régis Pacheco na cidade de Jequié/BA, verificando as transformações ideológicas e sociais que ocorreram no modelo educacional do Brasil e a relação estabelecida entre mulher/educação/curso normal, em meados do Século XIX e Século XX. Abordamos a educação feminina como experiência e prática social histórica que se constitui na necessidade (...) de uma realização pessoal que permita a ascensão da mulher do espaço privado para o público através do exercício da docência. Tratamos da profissionalização do magistério enquanto oportunidade de liberdade e autonomia financeira das mulheres/professoras do Instituto de Educação Régis Pacheco e as contribuições que o processo educacional trouxe para estas professoras. Apresentamos as trajetórias de duas mulheres/professoras, reconhecendo a importância de perceber a história das mulheres através do ponto de vista de quem de fato, faz parte desse processo histórico. Partindo da idéia de que nos documentários feitos em primeira pessoa o diretor constrói uma personagem de si próprio, este artígo analisa esta “personagem” em dois documentários argentinos sobre as experiências traumáticas pós-ditadura: Papá Iván, de María Inés Roque (2000), resgata a história de seu pai Iván Roqué, morto pela ditadura militar; e Los Rubios (2003), de Albertina Carri, explora as sequelas deixadas em sua vida pelo desaparecimento seguido de morte de seus pais.

Designing Indicators for a Plural Legal World engages with the role of quantification in law, and its impact on law and development and judicial reform. It seeks to examine how different institutions shape and influence the making and use of legal indicators globally. This book sheds light on the limitations of existing quantification tools, which measure rule of law due to their lack of engagement with contexts and countries in the Global South. It offers an alternative framework for measurement, which (...) moves away from an institutional look at rule of law, to a bottom up, user centered approach that places importance on the lives that people lead, and the challenges that they face. Traduação -/- O positivismo jurídico de Kelsen é frequentemente acusado de submeter o judiciário alemão ao direito nazista. Sobretudo a insistência do autor na separação entre direito e moral foi considerada uma deficiência crucial. Rejeito essa crítica. Meu argumento consiste na afirmação de que a tese de Kelsen, da distinção entre direito e moral em duas esferas normativas próprias, refuta tal acusação, sabendo que os juristas do programa nazista almejavam a ‘unificação do direito e da moral’ com o fim de (...) expandir a autoridade e o poder do regime. Critico, entretanto, o relativismo moral de Kelsen, posição essa que o torna vulnerável às objeções pós-guerra, as quais acusavam o positivismo jurídico de insuficiente para prover a devida salvaguarda contra a perversão do direito pelos nazistas. This paper examines one of the central objections levied against neo-Aristotelian virtue ethics: the self-absorption objection. Proponents of this objection state that the main problem with neo-Aristotelian accounts of moral motivation is that they prescribe that our ultimate reason for acting virtuously is that doing so is for the sake of and/or is constitutive of our own eudaimonia. In this paper, I provide an overview of the various attempts made by neo-Aristotelian virtue ethicists to address the self-absorption objection and argue (...) that they all fall short for one reason or another. I contend that the way forward for neo-Aristotelian virtue ethicists is to reject the view that the virtuous agent ought to organize her life in a way that is ultimately good for her, and instead adopt a more expansive conception of her ultimate end, one in which no special preference is given to her own good. The aim of this article is to think about a current issue, the discourse of the Brazilian philosophical making, not worked in the content of Being and Nothingness. However, we think it is possible to bring up some of the themes discussed there, as well as Sartre's philosophical writing, to warn us about the pitfalls of this discourse, which is positioned as the opposite and better than the previous one, but which ends up reproducing what he criticizes by remaining in (...) an excluding dualism. Returning to the Sartrean perspective of thinking in terms of ambiguities, avoiding falling into both realism and idealism, balancing presence to oneself with presence to the world, seems us fundamental, even today, for a more complex discussion, which does not fall into false dilemmas. Efforts have been dedicated to the understanding of social-ecological systems, an important focus in ethnobiological studies. In particular, ethnobiological investigations have found evidence and tested hypotheses over the last 30 years on the interactions between human groups and their environments, generating the need to formulate a theory for such systems. In this article, we propose the social-ecological theory of maximization to explain the construction and functioning of these systems over time, encompassing hypotheses and evidence from previous ethnobiological studies. In proposing (...) the theory, we present definitions and two conceptual models, an environmental maximization model and a redundancy generation model. The first model seeks to address biota selection and its use by human populations. The second emphasizes how the system organizes itself from the elements that were incorporated into it. Furthermore, we provide the theoretical scenario of plant selection and use from an evolutionary perspective, which explicitly integrates the phylogenetic relationships of plants (or other living resources) and human beings.
