No existing normative decision theory adequately handles risk. Expected Utility Theory is overly restrictive in prohibiting a range of reasonable preferences. And theories designed to accommodate such preferences (for example, Buchak's (2013) Risk‐Weighted Expected Utility Theory) violate the Betweenness axiom, which requires that you are indifferent to randomizing over two options between which you are already indifferent. Betweenness has been overlooked by philosophers, and we argue that it is a compelling normative constraint. Furthermore, neither Expected nor Risk‐Weighted Expected Utility Theory (...) allow for stakes‐sensitive risk‐attitudes—they require that risk matters in the same way whether you are gambling for loose change or millions of dollars. We provide a novel normative interpretation of Weighted‐Linear Utility Theory that solves all of these problems. (shrink)

There are striking structural similarities between Freud's ego and Kant's transcendental unity of apperception, which for Kant grounds our use of ‘I’ in ‘I think’. There are also striking similarities between Freud's superego and Kant's account of the mental structure that grounds our use of ‘I’ in the moral ‘I ought to’. The paper explores these similarities on three main points: the conflict of motivations internal to the mind, the relation between discursive and pre‐discursive representation of moral motivation, and the (...) unconscious character of moral motivation. The suggestion is that Freud offers resources for a naturalized account of just those features of our moral motivation that, according to Kant, seem to make it least amenable to a naturalistic explanation. How much of a revision of Kant's analysis of moral justification is thereby entailed is beyond the purview of the paper. (shrink)

What potential can be found in the work of Deleuze and Guattari for critical legal scholarship? The authors argue that their work can be deployed to re-think ‘critique’ by directly addressing the place and role of the ‘critic’. It is argued that the continued commitment to a stance of ‘resistance’ in CLS is underpinned by never-ending dualisms which, if not confronted and replaced, can only make CLS ever more redundant. The authors ask: ‘what is critique beyond the dualism of power (...) and resistance, of state and nomad?’ This question arises from a belief that critique is still capable of being effective, but only if there is the courage to experiment, and to think creatively. In this sense, the ‘exhaustion’ of critique is framed as an opportunity to re-think and re-engage with the politics of law. The paper diagrams, through image and film, a critical thought: the potential of the artisan. Film is utilised not as representation, nor as illustration, but as a thinking mind in its own right, through which questions relating to the state, political action, and creative thinking can be framed. Such a re-framing is essential, it is argued, for an engagement with the emergence of societies of control. (shrink)

This paper takes a recently published text and, in examining it closely, argues that it exemplifies trends within feminist scholarship in law, which might be characterised asestablishing a form of orthodoxy. The paper explores some of the ways in which thiso rthodoxy is constructed and presented, and argues that it is characterised by a commitment both to `grand theory' and Hegelian dialectics. The adoption of this model of work seems to offer a chance to hold together the triangular figure of (...) women/theory/law reform. The paper will argue that, whilst this model is clearly a valid choice, and attractive to feminist scholars in the promise it seems to hold, the model is not to be presumed but rather should be examined and considered in terms of its potential for feminist scholarship. Both within its own terms, and as part of the construction of an orthodoxy, the paper will argue that it is in fact problematic and that feminist scholarship would be better served by seeking an alternative theoretical model. An alternative is suggested, using the work of Deleuze, but it is acknowledged that this will require the acceptance of a very different theoretical configuration from that suggested by the triangular model of women/theory/lawreform. Of the many ethical corporate marketing practices, many firms use corporate social responsibility (CSR) communication to enhance their corporate image. Yet, consumers, overwhelmed by these more or less well-founded CSR claims, often have trouble identifying truly responsible firms. This confusion encourages ‘greenwashing’ and may make CSR initiatives less effective. On the basis of attribution theory, this study investigates the role of independent sustainability ratings on consumers’ responses to companies’ CSR communication. Experimental results indicate the negative effect of a poor sustainability (...) rating for corporate brand evaluations in the case of CSR communication, because consumers infer less intrinsic motives by the brand. Sustainability ratings thus could act to deter ‘greenwashing’ and encourage virtuous firms to persevere in their CSR practices. (shrink)

Because of its imperfections and its incompleteness it laid down the program to be followed for the next few decades of my life." Thus wrote C. G. Jung about his most famous and influential work, the one that marked the beginning of his divergence from the psychoanalytic school of Freud. In this book Jung explores the fantasy system of Frank Miller, the young American woman whose account (...) of her poetic and vivid mental images helped lead him to his redefinition of libido while encouraging his explorations in mythology. Published in 1912 as Wandlungen und Symbole der Libido, this is a key text for the study of the formation of Jung's ideas and for understanding his personal and psychological condition during this crucial time. Miller's fantasies, with their mythological implications, supported Jung's notion that libido is not primarily sexual energy, as Freud had described it, but rather psychic energy in general, which springs from the unconscious and appears in consciousness as symbols. Jung shows how libido organizes itself as a metaphorical "hero," who first battles for deliverance from the "mother," the symbol of the unconscious, in order to become conscious, then returns to the unconscious for renewal. Jung's analytical commentary on these fantasies is a complex study of symbolic parallels derived from mythology, religion, ethnology, art, literature, and psychiatry, and foreshadows his fundamental concept of the collective unconscious and its contents, the archetypes. Drawing on social exchange theory, this study examines a mechanism, namely organizational social capital, through which self-sacrificial leadership is related to two types of employee behaviours: organizational citizenship behaviours and counterproductive behaviours. The results of two different studies in Egypt showed that self-sacrificial leadership is positively related to OSC which, in turn, is positively related to OCBs and negatively related to CPBs. Overall, the findings suggest that self-sacrificial leaders are more likely to achieve desirable employee behaviours through improving the quality (...) of social relationships among employees. In this post‐sequencing era, geneticists can focus on functional genomics on a much larger scale than ever before. One goal is the discovery and elucidation of the intricate genetic networks that co‐ordinate transcriptional activation in different regulatory circuitries. High‐throughput gene expression measurement using DNA arrays has thus become routine strategy. This approach, however, does not directly identify gene loci that belong to the same regulatory group; e.g., those that are bound by a common (set of) transcription factor(s). Working in yeast, (...) two groups have recently published an elegant method that could circumvent this problem, by combining chromatin immunoprecipitation and DNA microarrays.(1,2) The method is likely to provide a powerful tool for the dissection of global regulatory networks in eukaryotic cells. Hegel's Science of Logic has received less attention than his Phenomenology of Spirit, but Hegel himself took it to be his highest philosophical achievement and the backbone of his system. The present book focuses on this most difficult of Hegel’s published works. Thanks to their work, doctors today can cure diseases, lessen pain, replace unhealthy limbs or organs, and help infertile couples have children. Doctors can even keep seriously ill people alive against all odds. But not everyone is enamored with advances in medicine. They question whether it is appropriate to prolong life in all cases, or believe that (...) certain treatments have been developed unethically. Surveys were conducted at two metta meditation retreats in order to examine the psychological effects of metta meditation. Participants were invited to complete the survey at the beginning of the retreat, at the end of the retreat, and two weeks after the end of the retreat. Participants completed the same scales at each time phase, which included measures of happiness, compassionate love, revenge and avoidance motivation, gratitude, and a depression, anxiety and stress scale. Significant increases were found in happiness and (...) compassionate love, reductions in avoidance and revenge, and reductions on the depression, anxiety and stress subscales. (shrink)

Drawing on the work of Paul Virilio, this paper addresses changes in the architectural and legal topography of the urban landscape through an examination of regulatory patterns, which increasingly intensify governance through, and as, ‘control’. Such regulation is ambivalent in that it cuts across many traditionally discrete regimes of power melding them into new forms with new effects; as a consequence it is no longer sufficient to think in terms of such distinctions as private/public, civil/criminal, and so on. This paper (...) argues that a concern with patterns of enclosure and privatisation in our urban centres must now be placed within the context of changes in architectural practice and technology, which the authors term ‘open architecture’, and the embedding of governance through partnership, which give particular emphasis to the use of dematerialised and diffused modes of control. The paper utilises Virilio’s history and image of the fortress, which he tracks from a material form to a dematerialised form, to envisage these developments and to provide the foundation for an understanding of the importance of the development of practices of surveillance into, what the authors term, ‘total registration’ as a feature and function of governance through ‘control’. Up to the present, there have not been any specific norms regarding medically assisted human reproduction in Romanian legislation. Due to this situation the general legislation regarding medical assistance, the Penal and Civil law and the provisions of the Code of Deontology of the Romanian College of Physicians are applied to the field of medically assisted human reproduction. By analysing the ethical and legal conflicts regarding medically assisted human reproduction in Romania, some characteristics cannot be set apart because they derive (...) from religious, cultural and socio-economic aspects. In this article the authors identify the development stages of medically assisted human reproduction in Romania, beginning from these characteristics and insisting upon the failure of the legal system in this specific field. The authors consider that the law regarding medically assisted human reproduction cannot be effective because it did not take into account the ethical and cultural aspects that might appear. Furthermore, in this framework of the legal process, no public debate involving the representatives of civil society was undertaken although the Council of Europe Oviedo Convention approved by our country according to law no. 17/2001 stipulated exactly this working method. This paper explores some key texts of Virginia Woolf in the context of Deleuzian concepts. Using a close reading style, it shows how the prose poetry in Mrs Dalloway engages a complex interplay of repetition and difference, resulting in a remarkably similar model of the three syntheses of time as Deleuze understands them. It subsequently explores Woolf's technical processes in a key passage from To the Lighthouse, showing how the prose-poetic technique systematically undoes the structures of logical fact and rationality (...) inscribed in both language and everyday speech to an extremely precise level. L’objectif de cette communication est d’aborder la question des revues scientifiques du point de vue des chercheurs : dans quelle mesure le système de publication est-il contraignant pour l’activité scientifique et à quel point lui est-il, dans le même temps, indispensable ?\nL’empreinte du système de publication sur l’activité des chercheurs peut s’observer au moins à\ntrois niveaux. Tout d’abord, dès leur apparition, les publications scientifiques ont été le lieu de la mise en place d’une « technologie littéraire », d’une standardisation progressive (...) du mode de présentation des\nrésultats de la recherche, participant ainsi de manière essentielle au processus de légitimation\ndes savoirs scientifiques. Parallèlement, mais sur un plan plus général, le développement d’un\nmarché de l’édition scientifique a contribué à l’organisation de la sphère scientifique en spécialités\net en disciplines, avec leurs frontières et leurs propres normes. Enfin, que ce soit lors de leurs\néchanges, dans le cadre de leurs collaborations mais aussi pour l’évaluation de leurs travaux, les\npublications sont fortement impliquées dans la pratique quotidienne des scientifiques.
