Yet “many others” did not fit into those two groups, for a large contingent of bishops favorable to religious liberty nonetheless sought to undergird the juridical reasoning for the right with an ontological foundation.David L. Schindler and Nicholas Healy promote these other voices in Freedom, Truth, and Human Dignity. Indeed, they argue that the other voices—the “French” or “ontological” school comprised of bishops such as Alfred Ancel and Karol Wojtyła—provide the true key to DH’s meaning and significance. The book thus responds from the perspective of Communio theology to Murray-ite political theologies that are critical of John Paul II’s emphasis on truth as the basis for freedom. Accompanying Schindler’s and Healy’s essays are conciliar texts charting the origin and influence of this ontological school: the six conciliar drafts, the oral and written interventions of Wojtyła, and an oral intervention of Ancel. These texts, transcribed from the Acta Synodalia Sacrosancti Concilii Oecumenici Vaticani II (AS), have been translated by Patrick T. Brannon, S.J., and Michael Camacho. Also included is a side-by-side comparison of the third and sixth drafts that displays the changes made to the juridical position in response to the ontological school.Schindler’s 170-page essay, “Freedom, Truth, and Human Dignity: An Interpretation of Dignitatis Humanae on the Right to Religious Freedom,” is the heart of the work. Schindler recapitulates in a fresh way themes from his prior analyses of liberalism and Murray. In section 1, he summarizes how Wojtyła’s interventions influenced the evolution of DH such that Murray’s juridical approach became subordinated to an emphasis on truth as the foundation and telos of freedom. He conveys Wojtyła’s concern that DH not divide reason and revelation, but that reason be presented as capable of knowing that religion is “nature’s crown and summit” (50). Section 2 outlines Murray’s postconciliar objections to DH’s final version, namely, that it assumes that the American juridical approach leads to relativism and that its insistence on truth as religious liberty’s foundation undermines the universality of the right by degrading the liberty of those in error. To the first, Schindler replies (in section 3) that Murray’s juridical approach necessarily entails what Servais Pinckaers, O.P., called the “freedom of indifference,” Murray’s denials of relativism notwithstanding. Victorian poets Elizabeth Barrett (1806-1861) and Robert Browning (1812-1889) first fell in love through letters, which they began to write to each other in 1845 (Figures 1 and 2). Their growing relationship, slowly progressing from letter to first encounter and eventual secret marriage in 1846, is documented in two volumes of letters, with a plot that unfolds as warmly and compellingly as the best page-turner invented by a novelist. Both were master wordsmiths, so the beauty of their letters (...) is no surprise. MinerdAmong the various types of law discussed in St. Thomas's theological "treatise on law"—questions 90–108 of Summa theologia [ST] I-II—the classification known as the "law of nations" (ius gentium) holds an ambiguous epistemological position. Marking a kind of halfway point between the natural law and civil law, it seems to straddle both domains. In fact, in a particularly important text dedicated (...) to this topic in the ST (I-II, q. 95, a. 4), Aquinas classes the ius gentium as being closely connected to the natural law, though in a way that is somewhat derivative, not as immediately flowing from human nature (especially in its animality) as does the natural law, but also not as marked by human contingency as is human civil law.As was recently discussed in a well-documented and insightful article by Barrett H. Turner in The Thomist, there have historically been two main lines of Thomist interpretation concerning the exact character of the "law of nations." Very broadly stated, what he refers to as the "Salamancan" line, indebted to Francisco de Vitoria, "interprets Thomas's doctrine of the ius gentium as a body of universal positive institutions (that is, specifications, determinationes) added to the natural law by agreement of the human race."1 [End Page 1043] This position, which would be common for several centuries among members of the Thomist school, would locate the law of nations essentially in the domain of nearly universally adopted customs and institutions, not strictly deduced from the natural law, but rather grounded on "the quasi-political authority of the entire human race, which promulgates the ius gentium by customs whose utility for attaining the ends of the natural law under a certain set of social conditions is easily recognized by rational creatures."2Turner calls the other line of thought "Maritain's Neo-Thomist Line,"3 an outlook that would be shared with various nuances by thinkers like Jean-Marie Aubert, Yves Simon, Marie-Michel Labourdette, John Finnis, and others. Setting aside my qualms about his appellation "neo-Thomist," which does more to obscure than to illumine (for it covers a host of Thomistic figures who have significantly different views on what constitutes "Thomism"), Turner does fairly lay out the major lines of Jacques Maritain's position, which is most directly articulated in Man and the State and La loi naturelle ou loi non-écrite.4 Basing himself on his particular view of knowledge of the natural law through connaturality,5 Maritain contrasted this sort of moral cognition with that which develops in the line of conceptual articulation, thus having a different "gnoseological" character from our knowledge of the natural law, while nonetheless still sharing the same "ontological" foundation. Such conceptually articulated law would be the ius gentium.Rather than add my voice to the dialectic of the various thinkers arrayed by Turner into the two aforementioned camps, I would like to propose a slightly different approach to the "moral epistemology of the law of nations," though one that I believe lies in line with the best aspects of Maritain's approach. -/- Feminist philosophers Barrett Emerick and Audrey Yap bring theoretical arguments about personhood and moral repair into conversation with the work of activists and the experiences of incarcerated people to make the case that prisons ought to be abolished. They argue that contemporary carceral systems in the United States and Canada fail to treat people as genuine moral agents in ways that also fail victims and their larger communities. Such carceral systems are a form of what Emerick and Yap (...) call “institutionalized moral abandonment”. Instead, they argue that we should create communities of moral solidarity which open up space for wrongdoers to make up for their wrongs. -/- As part of this argument, the book directly addresses one of the paradigm cases of wrongdoing often used to justify carceral systems: rape. Carceral systems that treat perpetrators of sexual violence as irredeemable monsters both obscure the reality of sexual violence and are harmful to everyone involved. -/- As an alternative to carceral systems, Emerick and Yap argue for an orientation towards justice that is grounded in moral repair. Forty-nine members of the Oxford public took part in a controlled free-recall experiment, the first 'minimal counterintuitiveness theory' study to control concept inferential potential and participant selective-attention timing. Recall of counterintuitive ideas was compared with recall of ideas expressing necessary epistemic incongruence, analytically true ideas, and ordinary control ideas. The items expressing necessary epistemic incongruence had better recall than other items. MCI items had a mnemonic advantage over intuitive templates for participants twenty-five years and younger after a one-week delay, but (...) MCI items did not have an advantage for older participants. There was no mnemonic advantage for immediate recall of MCI items in any age group. Analyses suggest this general failure to replicate previously found mnemonic advantages may have been due to restricting the items' inferential potential. (shrink)

Decades of research conducted in Western, Educated, Industrialized, Rich, & Democratic (WEIRD) societies have led many scholars to conclude that the use of mental states in moral judgment is a human cognitive universal, perhaps an adaptive strategy for selecting optimal social partners from a large pool of candidates. However, recent work from a more diverse array of societies suggests there may be important variation in how much people rely on mental states, with people in some societies judging accidental harms just (...) as harshly as intentional ones. To explain this variation, we develop and test a novel cultural evolutionary theory proposing that the intensity of kin-based institutions will favor less attention to mental states when judging moral violations. First, to better illuminate the historical distribution of the use of intentions in moral judgment, we code and analyze anthropological observations from the Human Area Relations Files. This analysis shows that notions of strict liability—wherein the role for mental states is reduced—were common across diverse societies around the globe. Then, by expanding an existing vignette-based experimental dataset containing observations from 321 people in a diverse sample of 10 societies, we show that the intensity of a society's kin-based institutions can explain a substantial portion of the population-level variation in people's reliance on intentions in three different kinds of moral judgments. Together, these lines of evidence suggest that people's use of mental states has coevolved culturally to fit their local kin-based institutions. We suggest that although reliance on mental states has likely been a feature of moral judgment in human communities over historical and evolutionary time, the relational fluidity and weak kin ties of today's WEIRD societies position these populations' psychology at the extreme end of the global and historical spectrum. The generalizability crisis is compounded, or even partially caused, by a lack of specificity in psychological theories. Expanding the use of mechanistic models among psychologists is therefore important, but faces numerous hurdles. A cultural evolutionary approach can help guide and evaluate interventions to improve modeling efforts in psychology, such as developing standards and implementing them at the institutional level.

Human moral judgement may have evolved to maximize the individual's welfare given parochial culturally constructed moral systems. If so, then moral condemnation should be more severe when transgressions are recent and local, and should be sensitive to the pronouncements of authority figures (who are often arbiters of moral norms), as the fitness pay-offs of moral disapproval will primarily derive from the ramifications of condemning actions that occur within the immediate social arena. Correspondingly, moral transgressions should be viewed as less objectionable (...) if they occur in other places or times, or if local authorities deem them acceptable. These predictions contrast markedly with those derived from prevailing non-evolutionary perspectives on moral judgement. Both classes of theories predict purportedly species-typical patterns, yet to our knowledge, no study to date has investigated moral judgement across a diverse set of societies, including a range of small-scale communities that differ substantially from large highly urbanized nations. We tested these predictions in five small-scale societies and two large-scale societies, finding substantial evidence of moral parochialism and contextual contingency in adults' moral judgements. Results reveal an overarching pattern in which moral condemnation reflects a concern with immediate local considerations, a pattern consistent with a variety of evolutionary accounts of moral judgement. The authors of the book--each with a different background across the social sciences and humanities -- assimilate conceptual leads and empirical findings from anthropology, evolutionary biology, evolutionary sociology, neurology, primate behavioral studies, explanations of human interaction and group dynamics, and a wide range of religious scholarship to construct a deeper (...) and more powerful explanation of the origins and subsequent evolutionary development of religions than can be currently found in what is now vast literature. While explaining religion has been a central question in many disciplines for a long time, this book draws upon a much wider array of literatures to develop a robust and cross-disciplinary analysis of religion. The book remains true to its subtitle by emphasizing an array of both biological and sociocultural forms of selection dynamics that are fundamental to explaining religion as a universal institution in human societies. In addition to Darwinian selection, which can explain the biology and neurology of religion, the book outlines a set of four additional types of sociocultural natural selection that can explain fill out the explanation of why religion first emerged as an institutional system in human societies, and why it has continued to evolve over the last 200,000 years of societal evolution. These sociocultural forms of natural selection are labeled by the names of the early sociologists who first emphasized them; and these can be seen as a necessary supplement to the type of natural selection theorized by Charles Darwin. Explanations of religion that remain in the shadow cast by Darwin's great insights will, it is argued, remain narrow and incomplete when explaining a robust sociocultural phenomena like religion. This article analyzes the sex and gender identity rhetoric of members of the Intersex Society of North America, which is a self-help and advocacy group whose main goals are to stop unnecessary genital surgery in ambiguously sexed infants and make medical histories available to adult intersexuals. By examining the organization's indebtedness to feminist and gay/lesbian/transperson theory and practice, the article shows how these political movements have progressively challenged the equation of sex with gender and how intersexuality exemplifies the theoretical and (...) practical problems of identity politics. In this discussion, the author asks the question if Oakeshott’s famous depiction of a practice might be understood in relation to contemporary cognitive science, in particular connectionism (the contemporary cognitive science approach concerned with the problem of skills and skilled knowing) and in terms of the now conventional view of "normativity" in Anglo-American philosophy. The author suggests that Oakeshott meant to contrast practices to an alternative "Kantian" model of a shared tacit mental frame or set of rules. If cognitive science, (...) in its connectionist forms, allows us to give a naturalistic though nonreductive sense to his words, Oakeshott, like other philosophers who have employed the concept of tradition, expanded his discussion into a broader reconsideration of the nature of theorizing, a metaphilosophy. Numerous studies have found that selective attention affects category learning. However, previous research did not distinguish between the contribution of focusing and filtering components of selective attention. This study addresses this issue by examining how components of selective attention affect category representation. Participants first learned a rule‐plus‐similarity category structure, and then were presented with category priming followed by categorization and recognition tests. Additionally, to evaluate the involvement of focusing and filtering, we fit models with different attentional mechanisms to the data. (...) In Experiment 1, participants received rule‐based category training, with specific emphasis on a single deterministic feature (D feature). Experiment 2 added a recognition test to examine participants’ memory for features. Both experiments indicated that participants categorized items based solely on the D feature, showed greater memory for the D feature, were primed exclusively by the D feature without interference from probabilistic features (P features), and were better fit by models with focusing and at least one type of filtering mechanism. The results indicated that selective attention distorted category representation by highlighting the D feature and attenuating P features. To examine whether the distorted representation was specific to rule‐based training, Experiment 3 introduced training, emphasizing all features. Under such training, participants were no longer primed by the D feature, they remembered all features well, and they were better fit by the model assuming only focusing but no filtering process. The results coupled with modeling provide novel evidence that while both focusing and filtering contribute to category representation, filtering can also result in representational distortion. Martin Bulmer made distinguished and groundbreaking contributions to the history of sociology, particularly in his classic study of the Chicago School, which spanned the era of personal memory and archival history. His work particularly emphasized empirical research, which led him to problems relating to the Laura Spelman Rockefeller fund and its leader, Beardsley Ruml, as well as to the problematic of the relation of sociology to the social survey movement. His work on funding led to the “Fisher-Bulmer” debate, over the (...) aims of the fund, which Bulmer regarded as primarily scientific and concerned with the improvement of research, rather than political. In later years the idea of history of sociology as reparations for the neglect or exclusion of women and minority scholars was a source of controversy, which Bulmer responded to with a defence of traditional historiographic values. The idea that the technologies one uses and the work experiences one has influence cognition is old, but somewhat vague, focused on how technology induced generalisable habits of mind. Technology creates a familiar world, which changes in large and small shocks, rather than in rational steps. This kind of change, at the tacit level, has characteristics of liminality. Cognitive science provides a vocabulary for discussing this problem that connects with several different strands of social theory, and points to various ways (...) of conceptualising the effects of digitalisation. If we focus on the tacitisation of skilled performance, we can see how the familiar is created and recreated, and identify processes by which this occurs, specifically pattern recognition in a liminal or liminoid state. In the past, and in the classic anthropology of the liminal, the familiar consisted of a world of common or shared objects, and the liminal states involved sacred ones. In the digital world, the choice of experience is voluntary, and the worlds are diverse, but the effects of object-induced involuntary pattern recognition are the same: they organise and reorganise cognition at a tacit, non-discursive, level. In this reply to the commentary in the volume, some intellectual, historical, and biographical context is provided for the writings discussed. This includes a brief account of the trajectory from Sociological Explanation as Translation, and a discussion of the general problem of the substrate of social explanation and the status of social theories as ideal-typical constructions with a problematic relation to this substrate. On this basis, the themes of practices, normativity, and the problem of the meaning of reasons explanations are (...) reconsidered. An outline of a view of norms based on the notion of Jellinek of the normative power of the real is given and related to Russian developmental psychology. This extends and gives a psychological base to the pragmatic account of norms and practical normativity that runs through these texts. The chapter concludes with a discussion of social science, including the problems of the status of economic theory, the objectivity of field work and the problem of underdetermination, and the political significance of Parsons. The question of whether sociology progresses, and how, has been an issue within sociology itself. In this chapter, the reasons for this are explored. The first set relates to the status of ‘theories’ in sociology, which, despite historical aspirations to universality, are not predictive systems that generate puzzles but second-order definitions and ideal types, which abstract over intelligible world of the subjects. They can loosely be said to progress in the sense of providing new ways of framing in response to (...) generically defined concerns, such as the stability of elites, and novel social situations. The second set relates to quantitative models. Examples from causal modelling, a basic form of statistical modelling, are discussed to show how this same problem bears on them. They depend on assumptions about which correlations can be plausibly regarded as causal, and which are outside the system and can be ignored. As the social world changes, these assumptions gain or lose plausibility, and the models themselves lose applicability and predictive power. Change here amounts to providing a better fit to novel situations. But the models are purpose relative and the aims, and therefore progress, are externally defined, typically by changing normative or policy concerns. (shrink)

To simplify the relation between desire and morality, and between personal and moral good, we can imagine a world of only two people; let us call them Adam and Eve, for the sake of tradition. This gives us two types of personal good: good for Adam and good for Eve. What is good for Adam (or Eve) is what tends to realise his or her desires in general, and, where desires conflict, realises the desires that are stronger in the long-term. (...) A benevolent and omniscient observer - let's call him Snake out of perversity - could therefore draw up two plans of action, one which is good for Adam and one which is good for Eve. However, at this point, Snake must choose sides, since obviously these goods are not always compatible. It is here that Snake must evolve into a moral being, since he must find a way to choose between good-for-Adam and good-for-Eve in order to produce a general good (even though we have not really decided what the general good might involve yet). This research examines how the meaning of risk, safety, and accidents are constructed in a military context. We compare meanings of these constructs among members working for three organizations (Health and Safety Executive, Ministry of Defence, and Royal Marine Commandos) jointly responsible for planning and executing "safe" military training and maneuvres in a particular unit of the United Kingdom's Royal Marine Commandos. The discourse among these members embodies the inter-organizational collaboration over military safety, and through an analysis of this discourse (...) we situate and frame shared and contested meanings of risk, safety, and accidents within this particular community of practice. We discuss implications of these findings for theory and practice, rallying for a more contextualized understanding of what risk, safety, and accidents mean in organizational life and thus the relative nature of the standards to which organizations are expected to adhere. The economic aspects of biobanking are intertwined with the social and scientific aspects. We describe two problems that structure the discussion about the economics of biobanking and which illustrate this intertwining. First, there is a ‘sustainability problem’ about how to maintain biobanks in the long term. Second, and representing a partial response to the first problem, there is a ‘commercialisation problem’ about how to deal with the voluntary altruistic relationship between participants and biobanks, and the potential commercial relationships that a (...) biobank may form. Social scientists have argued that the commercialisation problem is inadequate as a way to construct the multiple tensions that biobanks must negotiate. We agree that the commercialisation problem is an inadequate framework; turning to alternative accounts of bioeconomy, we suggest that contemporary consideration of the economics of biobanking primarily in terms of participants and their bodily tissue may reproduce the very commodification of science that these scholars critique. We suggest that an alternative conception of the economics of biobanking beyond the logics of commodification, which may thereby allow broader questions about the social and economic conditions and consequences of biobanks to be posed. There is no unproblematic way to study things as “African”, yet an epistemologically situated approach based on concrete technological projects situated in Africa and their social and political implications offers an important account of the intersection of the Fourth Industrial Revolution and African Studies. We explore this perspective through the notion of “indiscipline” using the Square Kilometre Array radio telescope project based in South Africa as a case study through which to observe “indiscipline” as a methodological approach to technoscience at (...) work. Indiscipline helps frame the socio-technical products of astrophysics and engineering, and we present the production of ventilators for COVID-19 patients as an example of how the design of mega-science projects can become entangled with the dynamic concerns of society. Our conclusion elaborates on the politics of large technological systems, opening up a conversation on the intersection of science and society in the context of the Fourth Industrial Revolution in African settings, using the template of experiences with the SKA and the National Ventilator Project in South Africa.
