Zusammenfassung Die parallele Untersuchung der historischen Quellen zum oligarchischen Teilstaat von Eleusis nach dem Sturz der Dreißig legt nahe, dass der Vertrag unter anderem die Ordnung in Eigentumsfragen wiederherstellen sollte, nachdem die Häuser der zuvor ermordeten Eleusinier von Athenern willkürlich in Besitz genommen worden waren. Während bisherige Interpretationen der entsprechenden Klausel von der Annahme ausgehen, dass viele Eleusiner gezwungen waren, ihre Häuser zu verlassen, wird argumentiert, dass sie das Recht behielten, weiter in Eleusis zu wohnen. Das eingeführte Vermittlungsverfahren wird als (...) ein Indiz interpretiert, dass auch diese Maßnahme als Verhandlung mit dem Ziel der Versöhnung eingeführt wurde. (shrink)

Several features of this compact passage have puzzled scholars ever since the discovery of the Aristotelian Constitution of the Athenians a century ago. First, did the Athenian Assembly really deliberate on all these disparate matters in the chief meeting of the sixth prytany, and if so, why? Second, why did it limit complaints against sycophants to a total of six divided equally between citizens and metics? Since the answers we give to these questions are fundamental to our understanding of basic (...) Athenian institutions, they deserve careful consideration. This paper will argue that the Assembly did deliberate on these matters at the same meeting and indeed that this was natural, since they are all symbolic, as well as practical, instruments for controlling behaviour inimical to the demos' interests. It will also suggest that the limitation on probolai against citizen and metic sycophants was introduced to safeguard against the sort of abuse of the label ‘sycophant’ that took place under the regime of the Thirty, and that the measures described in Ath. Pol. 43.5 were, therefore, most likely linked together in the early years of the restored democracy. (shrink)

Unlike the Senate of Republican Rome, this essay argues that councils were not the dominant or governing power in Greek oligarchies. Together with powerful officials and other powerful individuals, citizen assemblies mainly governed oligarchies, but admission to oligarchic assemblies was restricted by wealth. Before Solon, did the Areopagos Council govern oligarchic Athens? The principal source for this claim, [Arist.] Ath. Pol. 2-8, at least assigns the early Areopagos a broad judicial competence. Where did Ath. Pol.’s notion come from, and what (...) is it worth? Although ‘some people’ or ‘most people’ believed that Solon established the Areopagos Council, Ath. Pol. rejected that notion, possibly because along with others, Ath. Pol. and Aristotle thought that Solon founded Athens’ democracy, while for fourth century conservatives the early Areopagos was non-democratic. In part the competence of Ath. Pol.’s pre-Solonian Areopagos derives from and expanded its Solonian competence in Ath. Pol. 8.4, so that for Ath. Pol. democratic Solon will have reduced the Areopagos’ powers. In part it derives from fourth century conservative propaganda. This evidence is inadequate to claim that the Areopagos Council governed oligarchic Athens. (shrink)

The ‘bigger and stronger men’, μείζους καὶ βίαν ἀμείνονες, also have cause to thank him. For if anyone else had had this office, ‘he would not have restrained thedemos, nor would he have stopped, before’, etc. Plutarch introduces the lines in almost the same words.V. 7 is difficult. Bergk and others construe: ‘until, having stirred up (...) the milk, he had taken the cream’. There are two objections to this. Firstly, the word order would involve an interlacing of main and participial clauses which Greek normally eschews. Bergk claims that Solon is peculiar in the freedom of his hyperbaton, but the examples he quotes are not of this type and are very much easier. Secondly, the sense: ‘it is not usual to stir up milk when it is wanted to skim off cream’. Linforth recognised the force of this argument, and concluded, in the truth of the ancient evidence, that πῑαρ refers to butter. (shrink)

He pleads, however, that, since he killed Eratosthenes after catching him in the act of adultery with his own wife, this was a case of (...) justified homicide. At the same time, he denies a charge of the prosecution that he had killed Eratosthenes for reasons unrelated to the adultery. The speech was delivered before a court of fifty-one judges especially set up to judge such cases, as is attested elsewhere:T1Arist. Ath. Pol. 57.3: ‘If…a person admits that he has killed someone but claims that he had a right to do so, as, for instance, when he has surprised an adulterer in the act,… then the trial takes place in the Delphinion’. Jacoby's influential opinion that the Atthidographers were part of the political discourse of the fourth century has been the subject of revision in recent years. His critics have argued that the genre of Atthidography is primarily antiquarian and that to look for partisan political attitudes in the Atthides is a mistake. An examination of the work of Kleidemos, however, reveals a coherent presentation of the Athenian past designed to vindicate the democratic constitution and to demonstrate the close connection between the (...) democracy and Athens' naval power. This emerges most clearly in Kleidemos's treatment of three important democratic heroes: Theseus, Kleisthenes, and Themistokles. By the fourth century, Theseus had already emerged as the most popular Athenian hero. His accomplishments were modeled in part on the deeds of Herakles and were recorded in vase painting and relief sculpture, and on the walls of the Stoa Poikile. Kleidemos presented a distinctive account of Theseus, emphasizing his role in founding the Athenian navy in preparation for the expedition to Krete. Kleidemos portrayed him as a leader capable of defending Athens and making peace with Athens' enemies, first the Kretans and later the Amazons. This is a king in the tradition of Euripides' Theseus in the Suppliants, the ruler of a free and democratic city. The connection between democratic leadership, Athenian might, and the naval power of Athens is also underscored in Kleidemos's handling of Kleisthenes. Again, the information provided by Kleidemos is distinctive, inasmuch as he reports that it was Kleisthenes who was responsible for the system of naukrariai, which he likens to the symmories of the fourth century. Unlike the version of the Ath. Pol., which imagines the Kleisthenic demes replacing the Solonian naukrariai, Kleidemos saw the demes and naukrariai as complementary divisions, the former organizing the state's resources for the upkeep of the navy, and the latter establishing the political basis for the democracy. Themistokles is also given unique treatment. Kleidemos records the anecdote according to which Themistokles was responsible for the Battle of Salamis because he found sufficient money to man the ships when the generals had run out of funds and had ordered the abandonment of the city. He used the disappearance of the gorgoneion of the statue of Athena as an excuse to ransack the baggage of the Athenians and collect enough wealth to pay the fleet. The story is as tendentious as the account in the Ath. Pol., which gives the credit to the Areopagos. Both versions demonstrate how Athens' past had become a battleground in the political debates of the mid-fourth century. Unlike the epitaphios logos with its emphasis on the eternal and unchanging glory of Athens, the "Atthis" of Kleidemos attempted to prove that the greatness of Athens rested historically on three foundations: the heroes of the democracy, the democratic constitution, and the navy. Dignity is a fundamental concept, but its meaning is not clear. This paper attempts to clarify the term by analysing and reconnecting two meanings of dignity: humanitas and dignitas. Humanitas refers to citizen values that protect individuals as equal to one another. Dignitas refers to aesthetic values embedded in genres of sociality that relate to differences between people. The paper explores these values by way of an empirical ethical analysis of practices of washing psychiatric patients in nursing care. Nurses legitimate (...) the washing of reluctant patients with reference to dignity. The analysis shows the intertwinement of humanitas and dignitas that gives dignity its fundamental meaning. Discussing the workings of technology in care as aesthetic rather than as ethical or epistemological interventions focusses on how technologies engage in and change relations between those involved. Such an aesthetic study opens up a repertoire to address values that are abundant in care, but are as yet hardly theorized. Kamphof studies the problem that sensor technology reveals things about the elderly patients without the patients being aware of this. I suggest improvement of these relations may be considered in aesthetic (...) terms, for instance by developing the affective quality of people’s technological relationships. (shrink)

This book discusses the ethical dimension of the interpretation of texts and events. Its purpose is not to address the neutrality or ideological biases of interpreters, but rather to discuss the underlying issue of the intervention of interpreters into the process of interpretation. The author calls this intervention the "ethical" aspect of interpretation and argues that interpreters are neither neutral nor necessarily activists. He examines three models of interpretation, all of which recognize the role that interpreters play in the process (...) of interpretation. In these models, the question of the truth or validity of interpretation is dependent upon the attitude of interpreters. These three models are: (1) the principle of charity in interpretation in the two different versions defended by Hans-Georg Gadamer and Donald Davidson; (2) the production of truth, as developed by Paul Ricoeur and Michel Foucault; and (3) the regulative principle in interpretation as formal validity claims-as presented by Karl-Otto Apel and Jürgen Habermas-and as benevolence or love as an epistemic virtue-as defended by Friedrich Schlegel and Friedrich Schleiermacher. The critical discussion of these three models, which brings to the fore the different manners in which interpreters intervene in the process of interpretation as persons, lays the foundations for an ethics of interpretation. The Ethics of Interpretation will be of interest to scholars and advanced students working in hermeneutics, 19th- and 20th-century philosophy, literary theory, and cultural theory. (shrink)

In this highly accessible book, a distinguished philosopher says current focus on the brain conceals the real powers of the mind. Edward Pols revisits one of the basic topics of philosophy: what is the distinction between mind and body and what is the relation between them? He disagrees fundamentally with the many contemporary philosophers who concentrate on the findings of neurophysiology and cognitive science and so look only to the brain for the causes and explanation of mind. Pols concedes the (...) importance of such scientific studies but maintains that they focus on the infrastructure of mind and ignore the momentous difference between the infrastructure and mind itself. Pols calls upon the reader to attend to mind itself as a concrete and experientially available reality. This kind of attention, he argues persuasively, reveals mind to be at once causally dependent on the brain and causally effective on the physical processes of the brain and the world. Pols also examines the hierarchical view of mind and causality first proposed by Plato and Aristotle, the supersession of that view by the received scientific doctrine of causality, and the mistaken denial of the power of the mind to know an independent reality—a denial that resulted from the philosophical doctrines about knowing developed in the era that began with Descartes and ended with Kant. Many contemporary thinkers of the Anthropocene, who attempt to articulate a non-modern and relational ontology, all too readily dismiss critical theory inherited from the Frankfurt School for being anthropocentric, failing to acknowledge certain basic similarities. Instead, this article argues that the scaffolding of Anthropocene thinking—the recognition of the origins of the contemporary condition of ‘loss of world’ and the hope of ‘living on in the ruins’—share much with earlier critical theorists’ recognition that the Holocaust necessitated a fundamental break with the (...) past. In reading these two sets of literatures together, we suggest we can get a better grasp of the stakes involved in the contemporary crisis of critique, and in the speculative framings enabling alternative futures to come into being. I intend to share my thoughts in three parts: to recall some of the great contemporary philosophers of religion and culture; to indicate a new vision of the culture that was born at the Second Vatican Council; focus on some issues in the field of faith and culture on our common path to the third millennium.

I argue that the romantic notion of “understanding better,” as the ideal of interpretation according to Schleiermacher and Schlegel, is not a “meliorative” understanding, retrospectively situating the work in a broader conceptual or historical context and thus surpassing what the original author meant. The qualification “better” is ethical insofar as it indicates a future-oriented task of responding for the authors and contributing to the continued life of their work. What guides interpreters in such an ethical task is benevolence or love, (...) both toward the object of interpretation—the work—and the author of the work. Love is a hermeneutic imperative that has two sides: first, interpretation “augments” the work or brings it to its “second power;” and, second, interpreters need to put themselves in a certain attitude of non-understanding so that the work will not be constricted in pre-established categories and, instead, susceptible to challenge interpreters. Science and technology studies concerned with the study of lay influence on the sciences usually analyze either the political or the normative epistemological consequences of lay interference. Here I frame the relation between patients, knowledge, and the sciences by opening up the question: How can we articulate the knowledge that patients develop and use in their daily lives and make it transferable and useful to others, or, `turn it into science’? Elsewhere, patient knowledge is analyzed either as essentially different from (...) or similar to medical knowledge. The category of experiential knowledge is vague and is used to encompass many types of experience, whereas the knowledge of the `expert patient’ may be assumed to have the shape of up-to-date medical information. This paper shows through a case study of people with severe lung disease that patient knowledge can be understood as a form of practical knowledge that patients use to translate medical and technical knowledge into something useful to their daily life with disease. Patients coordinate this with homegrown know-how and advice from fellow patients, weighing different values - of which `taking good care of one’s body’ is but one - that may conflict in a specific situation. These practices result in sets of techniques that may be made useful to others. The paper argues for two alternatives to state-of-the-art medical research to turn patient knowledge into science: ethnographies of knowledge practices and the collection and making accessible of techniques. After a contrast of the the prima facie complexity of the causality of the rational agent with the received scientific doctrine of causality, it is noticed that the prima facie causal authority of rational action belongs to a macroscopic domain in which all science and philosophy takes place and in which the formal/telic nature of that causality must be taken for granted. Any philosophical justification or philosophical criticism of the status of that macroscopic arena must therefore take place within that (...) same arena. It is then argued that a justification of the ontological status of that arena is possible by an exploitation of the reflexive resource of the rational awareness we exercise within that arena. It is claimed that this resource can be fairly described as the justification of our direct knowing of real beings/entities other than the knower and that such realistic knowing is at the same time an exemplary mode of causality having a complexity that is both formal/telic and hierarchical . In short, the rational agent is also a direct knower, and direct knowing requires a sense of "cause' more complex than the received scientific doctrine of causality provides. 2012 APA, all rights reserved). This paper describes the approach of empirical ethics, a form of ethics that integrates non-positivist ethnographic empirical research and philosophy. Empirical ethics as it is discussed here builds on the ‘empirical turn’ in epistemology. It radicalizes the relational approach that care ethics introduced to think about care between people by drawing in relations between people and technologies as things people relate to. Empirical ethics studies care practices by analysing their intra-normativity, or the ways of living together the actors within these (...) practices strive for or bring about as good practices. Different from care ethics, what care is and if it is good is not defined beforehand. A care practice may be contested by comparing it to alternative practices with different notions of good care. By contrasting practices as different ways of living together that are normatively oriented, suggestions for the best possible care may be argued for. Whether these suggestions will actually be put to practice is, however, again a relational question; new actors need to re-localize suggestions, to make them work in new practices and fit them in with local intra-normativities with their particular routines, material infrastructures, know-how and strivings. Eleven years after Kosovo’s unilateral declaration of independence, Spain’s position vis-à-vis Kosovo has not only not varied, but it has become stronger, turning Madrid into the leader of the Kosovo non recognizers club within the EU. This paper analyses Kosovo-Spain relations in the last eleven years. More specifically, the paper examines the reasons behind the non-recognition of Kosovo and the approach of the Spanish governments toward Kosovo’s statehood. This is followed by a thorough analysis on how Kosovo’s path for self-determination (...) played a major role in Catalonia’s quest for independence in 2017. The empirical research demonstrates that Spain’s main reason not to recognise Kosovo is based on the country’s internal dynamics; namely, Catalonia and the Basque country. Likewise, the paper argues that the Spanish governments throughout the last eleven years have created an analogy between Kosovo and Catalonia; not in their political statements, but in their political decisions, by worsening the almost inexistent diplomatic relations with Kosovo, when the Catalan path for independence was at its highest peak. By the same token, the paper reveals that this position was enhanced and driven by Catalan separatism, that continuously used Kosovo’s unilateral declaration of independence as a model to further their own path for self-determination. The data provided and analysed in this paper as well as the statements made are based on desk research and seven semi-structured interviews conducted in Prishtina, Brussels, Madrid and Barcelona in 2018.
