Name any valued human trait—intelligence, wit, charm, grace, strength—and you will find an inexhaustible variety and complexity in its expression among individuals. Yet we insist that such diversity does not provide grounds for differential treatment at the most basic level. Whatever merit, blame, praise, love, or hate we receive as beings with a particular past and a particular constitution, we are always and everywhere due equal respect merely as persons. -/- But why? Most who attempt to answer this question appeal (...) to the idea that all human beings possess an intrinsic dignity and worth—grounded in our capacities, for example, to reason, reflect, or love—that raises us up in the order of nature. Andrea Sangiovanni rejects this predominant view and offers a radical alternative. -/- To understand our commitment to basic equality, Humanity without Dignity argues that we must begin with a consideration not of equality but of inequality. Rather than search for a chimerical value-bestowing capacity possessed to an equal extent by each one of us, we ought to ask: Why and when is it wrong to treat others as inferior? Sangiovanni comes to the conclusion that our commitment to moral equality is best explained by a rejection of cruelty rather than a celebration of rational capacity. Does the recent publication of Heidegger’s Black Notebooks require a re-evaluation of his thought? In the present text we will deal with this question and reach the conclusion that a change of theoretical perspective on Heidegger’s work is indeed justified. The franker and less cautious style of the Black Notebooks puts in the foreground stances that were already known, but were previously relegated to the background: it becomes possible thereby to establish that Heidegger’s philosophical views host a significant lot of (...) unwarranted prejudices, which are incorporated in his picture of the ‘history of being’. We argue that in his process of radical questioning Heidegger progressively drops all available rational methods and epistemic criteria, and that this paves the way to the unwitting reception of personal prejudices in his theoretical frame: Heidegger knowingly abandons all the theoretical instruments that could enable him to discriminate between deeply felt prejudices and proper philosophical intuitions. We conclude our analysis by proposing some criticisms that should be acceptable also to scholars sympathetic with Heidegger’s thought. Heidegger’s vindication of an ‘erratic’ way of thinking, where the journey is more qualifying than the result, turns out to be incompatible with the assertiveness of the many unjustified claims disseminated across the Black Notebooks. Moreover, Heidegger wants to show the narrowness of an overwhelmingly dialectical and argumentative attitude, while his late style of thinking unwittingly discredits an alternative philosophical style, that widely appeals to a ‘principle of charity’ in the collaboration between author and reader. Several attempts have been made previously to provide a biological grounding for cognitive architectures by relating their components to the computations of specific brain circuits. Often, the architecture's action selection system is identified with the basal ganglia. However, this identification overlooks one of the most important features of the basal ganglia—the existence of a direct and an indirect pathway that compete against each other. This characteristic has important consequences in decision-making tasks, which are brought to light by Parkinson's disease as (...) well as genetic differences in dopamine receptors. This paper shows that a standard model of action selection in a cognitive architecture cannot replicate any of these findings, details an alternative solution that reconciles action selection in the architecture with the physiology of the basal ganglia, and extends the domain of application of cognitive architectures. This paper reports on the findings of a qualitative study to understand how active adherence to the Christian faith influences the way SME owner-managers conceptualise their business practices. The study was based on in-depth interviews with 21 Christian SME owner-managers in Germany and the UK. Using a socio-psychological approach, the data analysis yielded a range of linguistic and conceptual resources that are peculiar to Christian discourse and that have the potential to influence business activity in rather distinctive ways. This paper (...) particularly focuses on those Christian concepts that could be regarded as distinct 'frames' for action. It outlines what effect these concepts had on the respondents and how they were related to business practices. The paper also discusses how this study could inform further research into the influence of other socio-cultural forms of identity on economic actors' conceptualisations of their own practice. Modeling law search and retrieval as prediction problems has recently emerged as a predominant approach in law intelligence. Focusing on the law article retrieval task, we present a deep learning framework named LamBERTa, which is designed for civil-law codes, and specifically trained on the Italian civil code. To our knowledge, this is the first study proposing an advanced approach to law article prediction for the Italian legal system based on a BERT (Bidirectional Encoder Representations from Transformers) learning framework, which has (...) recently attracted increased attention among deep learning approaches, showing outstanding effectiveness in several natural language processing and learning tasks. We define LamBERTa models by fine-tuning an Italian pre-trained BERT on the Italian civil code or its portions, for law article retrieval as a classification task. One key aspect of our LamBERTa framework is that we conceived it to address an extreme classification scenario, which is characterized by a high number of classes, the few-shot learning problem, and the lack of test query benchmarks for Italian legal prediction tasks. To solve such issues, we define different methods for the unsupervised labeling of the law articles, which can in principle be applied to any law article code system. We provide insights into the explainability and interpretability of our LamBERTa models, and we present an extensive experimental analysis over query sets of different type, for single-label as well as multi-label evaluation tasks. Empirical evidence has shown the effectiveness of LamBERTa, and also its superiority against widely used deep-learning text classifiers and a few-shot learner conceived for an attribute-aware prediction task. Anecdotal evidence has long lamented the status of social studies in elementary classrooms as observed by preservice teachers. As standardized testing has risen for mathematics and language arts, social studies has been pushed aside. In the aftermath of accountability legislation such as No Child Left Behind, research indicates that social studies is less visible in elementary classrooms due to an instructional focus on tested content areas (e.g. math, language arts, reading). In this study, approximately 90 elementary preservice teachers enrolled in (...) a social studies methods course responded to a survey and indicated the frequency and quality of lessons they observed over the course of a single semester. Findings report that preservice elementary teachers witnessed few, if any, lessons in social studies in the elementary classroom. Implications for teacher education are discussed. (shrink)

In this paper I explore the issue of how our personal life is given to us in experience as a whole to be actively shaped and determined. I examine in detail Husserl’s analysis of the kind of experience responsible for this achievement, which he terms Überschau and which thus far has never been addressed by scholars of phenomenology. First, I locate Überschau in the context of self-determination and highlight the difference between the unthematic pre-givenness of life in the phenomenon of (...) self-awareness and the actual, i.e. thematic givenness of life in acts of Überschau. Second, I contextualize Husserl’s discovery of Überschau in his analyses of ethical life and the possibility of a universal epoché. I argue that for Husserl the very possibility of ethical life and of phenomenology itself rest on the totalizing apprehension of one’s life rendered possible by Überschau. In the third section I spell out the essential characteristics of Überschau by contrasting this peculiar kind of consciousness with reproductive forms of consciousness such as recollection and expectation, which otherwise might be easily conflated with Überschau. In section four I reply to a possible objection to the very possibility of Überschau based on the consideration of the infinitely open stream of time-consciousness. I argue that the possibility of Überschau is tightly connected with the egological nature of consciousness as understood by Husserl. The ego does not coincide with its own conscious acts and thus enjoys a special vantage point on the totality of its own life. To conclude, I advance a speculative suggestion about the phenomenological origin of Überschau in the structure of self-awareness. This opens up a variety of possible lines of research that would connect Husserl with philosophers such as Augustine or Heidegger who are more immediately associated with the issue of personal life and its unity or lack thereof. This essay addresses issues concerningexplanation by exploring how explanatorystructures function within contemporarychemistry. Three examples are discussed:explanations of the behavior of gases using theideal gas law, explanations of trends inchemical properties using the periodic table,and explanations of molecular geometry usingdiagrammatic orbital schemes. In each case,the general explanatory structure, rather thanparticular explanations, occupies center stagein the analysis. It is argued that thisquasi-empirical investigation may be morefruitful than previous analyses that attempt toisolate the essential features of individualexplanations. There are two reasons for thisconclusion, (...) each discussed in some detail. First, the traditional analyses rely on highlyprecarious reasoning. Second, empiricallygrounded investigations provide a more naturalconnection to the core aim of analyses ofexplanation, namely to provide a rationale forthe widely expressed preference for explanatorytheories in science. We present a theory VF of partial truth over Peano arithmetic and we prove that VF and ID 1 have the same arithmetical content. The semantics of VF is inspired by van Fraassen's notion of supervaluation.

The sense of agency is the experience of being the origin of a sensory consequence. This study investigates whether contextual beliefs modulate low-level sensorimotor processes which contribute to the emergence of the sense of agency. We looked at the influence of causal beliefs on ‘intentional binding’, a phenomenon which accompanies self-agency. Participants judged the onset-time of either an action or a sound which followed the action. They were induced to believe that the tone was either triggered by themselves or by (...) somebody else, although, in reality, the sound was always triggered by the participants. We found that intentional binding was stronger when participants believed that they triggered the tone, compared to when they believed that another person triggered the tone. These results suggest that high-level contextual information influences sensorimotor processes responsible for generating intentional binding. (shrink)

Current debates on collective intentionality focus on the cognitive capacities, attitudes, and mental states that enable individuals to take part in joint actions. It is typically assumed that collective intentionality is a capacity which is added to other, pre-existing, capacities of an individual and is exercised in cooperative activities like carrying a table or painting a house together. We call this the additive account because it portrays collective intentionality as a capacity that an individual possesses in addition to her capacity (...) for individual intentionality. We offer an alternative view according to which the primary entity to which collective intentionality has to be ascribed is not the human individual, but a “form of life.” As a feature of a form of life, collective intentionality is something more than the specific capacity exercised by an individual when she cooperates with others. Collective intentionality transforms all the capacities of the bearers of this specific form of life. We thus call our proposal the transformative account of collective intentionality. (shrink)

ObjectiveThe purpose of this study was to assess if a relationship existed between audiologists’ perceptions of moral distress, occupational wellbeing, and patient-practitioner orientation.DesignThe Moral Distress Thermometer, Health and Safety Executive Management Standards Indicator Tool and Patient-Practitioner Orientation Scale was sent out to all audiologists registered with the professional body Audiology Australia.Study sample: A total of 43 audiologists completed the questionnaires.ResultsUsing a multiple linear regression model there was no evidence of a relationship between patient-practitioner orientation and (...) either moral distress or occupational wellbeing. However, an association between higher moral distress and lower occupational wellbeing was demonstrated. The occupational wellbeing subscales of ‘managerial support’, ‘peer support’, ‘relationships’, ‘role’, and ‘change’ were strongly associated with poorer scores on moral distress.ConclusionFor our sample of audiologists, ethical conflict appeared to be linked to reduced job satisfaction. There is a need to consider ways of providing supportive organisational structures in which ethical conflicts can be openly discussed and negotiated in order to improve occupational wellbeing in the profession. Belief, according to many philosophers, aims at truth. In this paper I discuss in what measure a pluralist conception of truth is compatible with this claim. In particular, I argue that if the idea is understood according to a teleological account, alethic pluralism can be adopted also in a strong form. I contend that while the teleological account of belief requires a generic concept of truth, it poses a few constraints on the property of truth. By contrast, at least a (...) moderate version of alethic pluralism is commanded by a normativist interpretation of the aim. (shrink)

Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

We study a class of formulas generalizing the weak law of the excluded middle and provide a characterization of these formulas in terms of Kripke frames and Brouwer algebras. We use these formulas to separate logics corresponding to factors of the Medvedev lattice.

To date, business ethicists, corporate social responsibility scholars as well as management theorists have been slow to provide a comprehensive and critical scrutiny of the Living Wage concept. The aim of this article, therefore, is to conceptualize the living wage in its philosophical as well as practical dimensions in order to open up the ethical implications of its introduction and implementation by companies. We set out the legal, socio-institutional and economic contexts for the debates around the LW and review arguments (...) for, and against, it. Key philosophical arguments from the perspectives of sustainability, capability and externality are invoked and discussed in order to demonstrate the issues and challenges involved for companies, state and civil society actors. Relevant examples from the private sector are examined to demonstrate some of the practical issues involved when the LW is introduced by employers. The article also recommends avenues for a research agenda into the LW for business ethicists, CSR and management researchers in contexts such as the UK, where a voluntary, rather than mandatory, approach to the implementation of the LW is adopted. According to a traditional view, logical validity consists in necessary truth preservation. Such an account has been argued to carry an apparent commitment to a unique property of truth to be preserved from premises to conclusion. Recent discussions, however, have concluded that if the metaphor of truth preservation is carefully unpacked, no need for a unique property is there. All is needed is that certain structural relations among instantiations of truth properties hold. Against this view, we argue that a unique (...) general truth property is indeed required by logical validity. We first show that the unpacking should be correctly understood since it imposes constraints on the concept and the properties of truth. We then demonstrate that, under such constraints, a general property is not imposed by truth preservation but by another feature of validity: its uniformity. Finally, some options that could be attempted to resist this result are discussed, showing that (strong) truth pluralism and deflationism are affected in different ways. (shrink)

In this article Mare liberum is placed within the context of seventeenth-century European politics. It focuses on the development of conventional relations between European States regarding their interests outside of Europe and their importance concerning the status of Asian and African 'actors'. It turns out that in spite of Mare liberum's high-sounding proclamation of equality of non-European sovereigns with European States, Grotius's position as well as Dutch policy was inspired by self-interest and was essentially opportunistic. The Dutch Republic – as (...) well as other European States – used the 'liberal' principles of Freedom of trade and the Universality of the Law of Nations to attack the Portuguese/Spanish claims of monopoly. However, as the Dutch Republic, Great Britain and France developed their own 'Spheres of Interest' in Asia, Africa and the Americas, they effectively excluded would-be competitors. Indeed, in the eighteenth century the 'pacte colonial' constituted a distinctive characteristic of the conventional and customary 'European Law of Nations'. As non-European political actors in the eighteenth century relatively lost military and political power, the European States finally relegated them to an inferior position, beyond the charmed circle of full 'subjects of Public International Law'. The article also is a contribution to the ongoing discussion about the relation between European imperialism and the development of the doctrine of European International Law. (shrink)

Non‐invasive brain stimulation is used to modulate brain excitation and inhibition and to improve cognitive functioning. The effectiveness of the enhancement due to transcranial direct current stimulation (tDCS) is still controversial, but the technique seems to have large potential for improvement and more specific applications. In particular, it has recently been used by athletes, both beginners and professionals. This paper analyses the ethical issues related to tDCS enhancement, which depend on its specific features: ease of use, immediate effect, non‐detectability and (...) great variability of effects. If tDCS were to become widespread, there could be some potential side effects, especially the rise of inequality in many selective competitive contexts. I discuss two possible scenarios to counter this effect: that of prohibition and that of compensation, each supported by reasons and arguments that seem plausible and worthy of consideration. In conclusion, I show why I think the scenario of compensation is the preferable one. (shrink)

A study of a group of elementary school students learning to control a computer‐implemented Newtonian object reveals a surprisingly uniform and detailed collection of strategies, at the core of which is a robust “Aristotelian” expectation that things should move in the direction they are last pushed. A protocol of an undergraduate dealing with the same situation shows a large overlap with the set of strategies used by the elementary school children and thus a marked lack of influence of classroom physics (...) training on this student's naive physics. The data from these two studies are pooled and elaborated into a “genetic task analysis” of how one might come to understand Newtonian dynamics as a more or less natural evolution from the naive state. In contemporary philosophy, it is tempting to apply the metaphysics of properties to the specific case of truth, in the hope of making progress on the investigation of the latter. In this paper, I argue that a different approach, mostly independent from the metaphysics of properties and based on the naturalness, in Lewis’ sense, of semantic nations, is often a better alternative, both in general and in some specific cases. In particular, adopting the new perspective, I present a new problem (...) of combining logical validity and strong truth pluralism, and offer a way to sharply distinguish deflationism and primitivism about truth. The main original upshot of the paper is offering a perspective on philosophy of truth that sheds new light on the general problem of truth and on some particular issues. (shrink)

Specific studies of the “situated ethics” of international surrogacy that address the structural conditions and local moral economies that sustain the trade are needed. In this essay, I describe the intimate industry of surrogacy in Thailand, exploring the local moral economy in which surrogacy is described as a form of Buddhist merit making and an opportunity to provide for one’s own children. This offers a further example of how other ethical values beyond the strictly economic are negotiated in commercial surrogacy (...) relationships. Situated ethics allow us to locate and understand the tensions, competing logics, and contradictions within ethical practices. (shrink)

It is often contended that certain enhancement technologies are acceptable, because they simply update traditional ways of pursuing the improvement of human capacities. This is not true with reference to moral bioenhancement, because of the radical difference between traditional and biotechnological ways of producing moral progress. These latter risk having serious negative effects on our moral agency, by causing a substantial loss of freedom and capacity of authentic moral behaviour, by affecting our moral identity and by imposing a standard conception (...) of moral personality. In this paper I explore the prospects of a Neo-Aristotelian position—according to which the difference between the human species and non-human animals is a difference in ‘form’—in the context of the question of how the human form of life is related to the idea of education. Two interpretations of this idea have been suggested by contemporary Neo-Aristotelian philosophy that offer contrasting accounts of the role played by education. According to the first, the idea of a formal difference goes with a (...) notion of potentiality, according to which the distinctiveness of the human is mainly a product of education, and hence a matter of second nature. According to the second, the idea of the human is the idea of a formally distinctive kind of first nature that explains the very possibility of education. I maintain that both interpretations do justice to an important aspect of human life yet fail fully to grasp the significance of the notion of ‘form’ that they employ. I argue that to embrace the insight that the difference of the human is a difference in ‘form’, we must think of the human as a form of life whose very concept contains the concept of education. The concept of education, I argue, is a logical concept, contained in the concept of life that it describes. (shrink)

En 1934, su creador, el filósofo y sociólogo Florian Znaniecki, afirmó que este era el método que debía ser adoptado en toda investigación sociológica. Su relevancia radica en que se propone encontrar explicaciones globales de los fenómenos sociales a partir de la utilización de técnicas cualitativas de investigación. Aquí adopto una perspectiva histórica que permite inscribir su (...) emergencia y evolución en un contexto mayor del desarrollo de metodologías cualitativas en sociología, para luego reflexionar sobre sus presupuestos epistemológicos y las críticas de las que fue objeto. Por último, realizo un balance de los aportes de esta metodología a la disciplina.: The aim of this article is to study analytic induction as a scientific research method, that is, as a valid way of making science. In 1934, the philosopher and sociologist Florian Znaniecki, its creator, referred to this methodology as the method that should be adopted by any sociological research. Its relevance lies on the fact that its goal is to find global explanations to social phenomena by using qualitative research techniques. I adopt a historical perspective to inscribe this method’s emergency and evolution in a larger context of the development of qualitative methods in sociology, and then reflect upon its epistemological basis and the criticisms made in relation to it. Cet article présente la philosophie des sciences de Max Frischeisen-Köhler, conçue comme une réponse critique aux néo-kantiens. Frischeisen-Köhler tire son enseignement à la fois de son professeur Wilhelm Dilthey et d’Edmund Husserl. Dans les quatre premières parties j’examine la critique que Frischeisen-Köhler adresse au néo-kantisme de l’École de Marbourg et à celui de l’École de Baden. Cette critique défend l’idée que la réalité joue un rôle dans la cognition en tant qu’élément totalement indépendant que la cognition doit reconnaître et qui (...) ne peut jamais se développer en dehors de sa propre légalité. Dans la cinquième section, je m’attache à la phénoménologie de Frischeisen-Köhler. Sa thèse principale est que la réalité est expérimentée comme telle dans l’action, de sorte que notre conscience de la réalité ne provient pas de considérations théoriques sur les causes hypothétiques de nos sensations, mais de nos activités dans le monde en tant qu’agents. La science part de cette expérience pré-scientifique de la réalité. Je conclus par une critique de la distinction que Frischeisen-Köhler établit entre conscience en général et subjectivité individuelle d’un point de vue phénoménologique. (shrink)
