Em Aristóteles, o prazer pode fazer o homem cometer atos vis, enquanto a dor pode impedi-lo de realizar atos nobres. Por isso, para o autor, é preciso ponderar prazer e dor pelo hábito, de tal modo a tornar-se um homem virtuoso, que sente prazer ao realizar ações nobres. Diferentemente, para Kant, uma ação perde seu valor moral caso seja realizada por causa de alguma inclinação, ou seja, se uma ação foi realizada com prazer, ainda que ela seja correta, ela perde (...) o valor moral. De um lado oposto, temos Mill, que considera moral o que traz felicidade, e a felicidade é gerada pela maximização do prazer e minimização da dor. Ainda que com tratamento diferenciado, estas três correntes relacionam o estudo da moral aos sentimentos, o que consideramos um erro. Defendemos que o certo e o errado devem ser analisados de forma lógica e racional para o atingimento de determinada finalidade, de tal modo que o sentimento gerado pela ação não pode ser capaz de dignificar juízos morais e nem de ser fundamento para a constituição dos mesmos. In this study we examined whether parents’ perceptions of students’ anxiety as well as perceived support from both teachers and classmates were predictive of changes in students’ academic motivation during the first wave of COVID-19. To this end, we used a retrospective pretest-posttest design together with a latent change score model to analyze our data. From April to May of 2020, 394 Portuguese parents of students in grades 1–9 participated in this study. Our results showed that students’ anxiety and teachers’ (...) social support, as perceived by parents, were highly significant predictors of academic motivation changes. Specifically, we found a negative effect of anxiety and a positive effect of teachers’ social support on students’ academic motivation. Our results did not show, however, a significant predictive role of classmates’ social support. This study provides an important contribution to further understand the intrapersonal and interpersonal factors that are associated with the decline of students’ academic motivation during the COVID-19 pandemic. The pivotal role of teachers in sustaining students’ academic motivation and other relevant educational implications for the ongoing pandemic are discussed. (shrink)

La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Business Ethics: A European Review, EarlyView.

The contemporary confluence of globalization and ethical pluralism is at the origin of many ethical challenges that confront business nowadays, both in practice and in theory. One of the challenges arising from the development of globalization has to do with respect for cultural diversity. It is often said that the success of economic globalization tends towards social and cultural homogeneity. To the extent that cultural diversity is usually seen as a valuable reality, that global trend seems to contradict our efforts (...) to respect ethical pluralism, both personal and cultural, within society. In this paper I argue that (a) ethical minimalism, despite its emphasis on tolerance and justice, does not take pluralism seriously into account in present-day society, and (b) ethical minimalism is not suited to balancing the homogenizing trend of globalization. Certainly ethical norms are necessary, but by no means are they sufficient in themselves to encourage either justice or tolerance; nor are they sufficient to inspire and encourage good practices and sound regulations. Instead, virtue-based ethics has the capacity of inspiring and encouraging good practices. Particularly, virtue-based ethics is able to inspire a serious dialogue about ethical and legal issues both in the public arena and within organizations. (shrink)

The purpose of this paper is to view Kant's approach to education in the broader context of Kant's philosophy of culture and history as a process whose direction should be reflectively assumed by human freedom, in the light of man's moral vocation. In this context, some characteristic tensions of his enlightened approach to education appear. Thus, while Kant takes the educational process to be a radically moral enterprise all the way through—and hence, placed in a relational context—he also aspires to (...) constitute education as a science, to be improved through experiments, thereby paving the way for a systemic approach to education; in spite of its moral inspiration, his systemic approach not only could enter into conflict with the moral demand of taking each individual subject as an end, but is also marked by an intrinsic paradox, already involved in the ambiguity of the term ‘humanity’, which might mean a) humanity as a moral disposition present in each individual human being or b) humanity as a whole, as the ‘human species’. U ovom članku raspravljamo o hipotezi proširenog jastva Andyja Clarka i Davida Chalmersa, a osobito o prigovoru prema kojemu proširenom jastvu nedostaje stabilnost i kontinuitet koji su potrebni da bismo ga smatrali identičnim kroz vrijeme. Pokušavamo pokazati da je taj prigovor neodrživ. Raspravljamo i o gledištu prema kojemu se drugi tip jastva, to jest narativno jastvo, također može shvatiti kao prošireno, i tvrdimo da stabilnost i kontinuitet toga tipa jastva također nisu ugroženi ako ga proširimo izvan granica čovjekova tijela. Stoga, (...) barem što se tiče tih tipova jastva, kada razmišljamo o problemima osobnog identiteta, nije potrebno ograničiti se na internalizirano jastvo. (shrink)

In this study, we aim to disentangle pantomime from early signs in a newly-born sign language: Sao Tome and Principe Sign Language. Our results show that within 2 years of their first contact with one another, a community of 100 participants interacting everyday was able to build a shared language. The growth of linguistic systematicity, which included a decrease in use of pantomime, reduction of the amplitude of signs and an increase in articulation economy, showcases a learning, and social interaction (...) process that constitutes a continuum and not a cut-off system. The human cognitive system is endowed with mechanisms for symbolization that allow the process of arbitrariness to unfold and the expansion of linguistic complexity. Our study helps to clarify the role of pantomime in a new sign language and how this role might be linked with language itself, showing implications for language evolution research. (shrink)

The Fourth Industrial Revolution based on digitalization, the development of AI, robotics, big data, and increasing automation is dredging up older debates on the end of human work. This article contributes to this debate arguing that these changing circumstances represent an opportunity to advance a renewed consideration of human work. By emphasizing its most distinctively human dimensions, including gratuitousness, relationality, and meaningfulness, we propose the articulation of a social model that recognizes relational goods as a specific contribution of human work (...) in an attempt to overcome the state and the market's monopoly of public life built around the dichotomy between the private and the public. Such a social model is based on the concept of circular subsidiarity, which represents a departure from traditional notions of subsidiarity by promoting a dynamic and reciprocal interplay between three essential societal spheres: the state, the market, and organized civil society, all of which have their role to fulfill by providing security, efficiency, and relational goods. Ultimately, this article suggests that circular subsidiarity can lead to a more inclusive and equitable social model by acknowledging how relational goods not only humanize civil society but also sustain the functioning of both the market and the state. This article deals with the relationship between argumentation and persuasion. It defends the idea that these two concepts are not as opposed as all too often said. If it is important to recognize their differences (there are argumentative discourses without persuasion and persuasive discourses without argumentation), there is nevertheless an overlap, in which characteristics are taken from both. We propose to call this overlap “persuasive argumentation”. In order to bridge argumentation and persuasion, we will first distinguish the latter from manipulation. (...) Rigorous attention has been paid to moral distress among healthcare professionals, largely in high-income settings. More obscure is the presence and impact of moral distress in contexts of chronic poverty and structural violence. Intercultural ethics research and dialogue can help reveal how the long-term presence of morally distressing conditions might influence the moral experience and agency of healthcare providers. This article discusses mixed-methods research at one nongovernmental social support agency and clinic in Rio de Janeiro, Brazil. Chronic levels of moral (...) distress and perceptions of moral harm among clinicians in this setting were both violent, following Nancy Scheper-Hughes’ use of that term, and a source of exceptional and innovative care. Rather than glossing over the moral variables of work in such desperate extremes, ethnography in these settings reveals novel skills and strategies for managing moral distress. (shrink)

In this article, I explore the way in which Korsgaard’s approach to obligation as springing from the reflective rejection of that which threatens one’s own identity can account for obligations towards others, without making the latter relative to obligations to oneself. To this end, I begin by stressing the role of reflexivity in ethical relationships, and show how this reflexivity is mediated by reference to law, which applies both to the self and to the other. On this basis, I then (...) argue that Korsgaard’s account of the interplay between practical and moral identity reflects the very structure of practical reason, which requires both a particular and a universal premise in order to issue practical reasons for action– and the corresponding obligations. Within this framework, I argue that Korsgaard’s solution to the problem outlined above lies in having stressed the shareable character of reasons such that it is neither your reason nor my reason that obligates me, but rather reason as such. This solution, however, requires a further argument aimed at clarifying what makes your reasons different from my own. (shrink)

The expression “a culture of freedom” is unmistakably modern. Yet its meaning is not immediately clear. My purpose in this paper is to clarify the possible meaning of this expression by taking Kant’s practical philosophy as a point of reference. In order to do so, I will depart from Kant’s explicit conception of culture, and try to relate it to his own distinction between external and internal freedom, especially as it appears in the Metaphysics of Morals.

Although Kant is not usually counted among the forerunners of social sciences, any look at the work of the most prominent social theorists of the past century shows the pervasive influence of Kant's philosophy. This influence is obvious and crucial at the epistemological level, if only because Kant himself set the frame for subsequent discussion of the difference between human and natural sciences. Yet, Kant's work is also rich in substantive contributions to social theory, which may be articulated around his (...) conception of culture and cultural progress. (shrink)

In Understanding Moral Obligation (2012), Robert Stern sets out to provide a fresh interpretation of the role of autonomy in Kant’s moral philosophy and attempts to rectify J. B. Schneewind’s standard account in The Invention of Autonomy (1998). While Stern agrees that Kant’s resort to autonomy is at the basis of a constructivist account of moral obligation, he claims that autonomy plays no role in Kant’s theory of value, such that, in this respect, Kant remains a realist. Accordingly, Stern characterizes (...) Kant’s moral philosophy as a “hybrid” view because he sees it as involving a compromise between realism with regard to value and constructivism with regard to obligation. Stern’s interpretation relies on a sharp distinction between value and obligation. The purpose of the present article is to question his reliance on that rigid distinction, which involves intermixing theoretical and practical reason and assumes a distorted view of human agency. This article explores one aspect of Kant's crucial contribution to the philosophy of culture. It does so by analysing two different approaches to the notion of culture, which are explicit in his work. The first, which may be called "genetical", presents culture almost as a result of a natural dialectic. The second, which I call "practical", regards culture as a task for the human being.

El objetivo de este artículo es evaluar dos fundamentos morales que permiten enmarcar la discusión acerca de la justicia social y el desarrollo humano. Por un lado, Amartya Sen parte de presupuestos éticos como la libertad para brindar un marco evaluativo que analice la pobreza y la calidad de vida. Por el otro, Martha Nussbaum, desde presupuestos filosóficos como la dignidad, establece una guía práctica para el correcto funcionamiento y desarrollo de la vida humana. Ambos autores convergen en la idea (...) según la cual la pobreza es una condición de vulnerabilidad ante la vida y que, además, sus consecuencias transgreden las distintas dimensiones políticas, económicas y sociales de la vida humana. De ahí que se pueda decir que la pobreza transgrede y obstruye el pleno goce de los derechos políticos, económicos, sociales y culturales de los ciudadanos. A pesar de sus diferencias conceptuales, ambas posturas brindan nuevas herramientas interpretativas a la hora de tematizar el desarrollo humano y analizar la pobreza. Estas amplían y enriquecen el concepto de justicia social. Esta ampliación da un nuevo sentido a lo concebido como desarrollo humano, toda vez que este puede ser considerado como un derecho. Ahondar sobre el carácter vinculante de considerar el desarrollo humano como un derecho, se convierte en una herramienta conceptual eficaz en la lucha contra la pobreza. (shrink)

Within the field of didactics of second language teaching, it is believed that phonic errors cannot be completely corrected due to the significant influence of L1. However, improving the processes of acquisition of an L2 implies learning pronunciation properly. Given the importance of pronunciation for communication, it is necessary to deeply know the nature of phonic errors, which requires a specific classification aimed to describe, classify and categorize them. This article is intended to test the validity and efficiency of the (...) taxonomy developed in the project AACFELE. To accomplish our objective we: a) collected the most significant phonic errors made by learners of Spanish from nine different nationalities and b) categorized those errors. As a result, we found that the classification entails plenty of trouble caused by the impossibility of marking the boundaries of the numerous phenomena involved in the pronunciation of a sound; that is why we considered the need of redefining some of the suggested categories and assessed the adequacy of maintaining other ones less useful. Despite these circumstances, the most significant outcome was the reliable proof that the taxonomy AACFELE allowed us to label and describe diverse phonic errors using common criteria, which represents the first step to accurately study phonic acquisition of a foreign language. The execution of critical thinking depends on a set of skills and dispositions. It is unanimously accepted that skills represent the cognitive component, but consensus varies with regard to dispositions. Although most theoreticians admit that this is a complex construct integrated by motivations and mental habits, they don’t explain further. We have performed a study attempting to explore the internal structure of dispositions. We suggest a possible hypothesis of “Motivational Genesis of Dispositions,” according to which disposition would be formed by (...) motivation and by mental habits, although the contribution of each of these factors would change depending on the practice gained in critical thinking. Thus, when a person is not practised in critical thinking, motivation makes a greatercontribution than mental habits. Nevertheless, with practice and motivated exercise of the skills of critical thinking, the influence of these mental habits increases. The regression analyses carried out support such a hypothesis. Este trabalho tem como objetivo apresentar a experiência de construção de um curso de formação de professores de ciências e de matemática com caráter interdisciplinar. O trabalho foi desenvolvido a partir da interpretação de alguns aspectos da história da educação em ciências e matemática no Brasil que ainda se manifestam nas práticas pedagógicas e dos contextos político e social nos quais se desenvolveu a experiência de construção do Curso de Ciências – licenciatura da Universidade Federal de São Paulo. A tradição (...) de disciplinas escolares independentes e a própria formação disciplinar dos docentes do curso constituíram grandes desafios para a implantação de um curso interdisciplinar, com foco na promoção do diálogo das ciências naturais e da matemática com os desafios sociais e educacionais da atualidade brasileira. A análise aponta que nesse percurso foram enfrentados muitos desafios de ordem conceitual, estrutural e institucional, mas que o resultado (ainda em movimento) foi a organização de um curso com bases teóricas híbridas que desenvolve grande variedade de experiências de integração dos campos da ciência e da matemática e promove uma formação interdisciplinar e contextualizada. RESUMEN:En este trabajo se analiza el modo en que Kant distingue entre sentimiento y emoción, por un lado, y emoción y pasión, por otro, para mostrar: 1) que bajo el término “emoción” Kant entiende principalmente la afección orgánica privada de contenido cognitivo, aunque precedida y seguida de representaciones; 2) que la emoción constituye un elemento integral de lo que Kant denomina “sentimiento”, término del que se sirve para designar la dimensión subjetiva de la experiencia en sentido amplio, no limitado a (...) la afección empírica; 3) que su concepción negativa de la pasión justifica la posterior distinción entre emoción y pasión introducida en los estudios científicos. ABSTRACT:In this article I analyze Kant’s distinction between feeling and emotion, on the one hand, and emotion and passion, on the other. The objective is to show: 1) that by the term “emotion” he understands organic affection, deprived of cognitive content, although preceded and followed by representations; 2) that emotion so understood constitutes for Kant an integral part of “feeling”, by which Kant designates the subjective dimension of experience, in a broad sense, which is not limited to empirical affection; 3) that his negative approach to passion justifies the sharp distinction between emotion and passion introduced in scientific studies of emotion. In this article I argue the relevance of natural law for framing and addressing ethical issues raised by the practice of business in a global context. There are historical, as well as systematic reasons for this. On the historical side, it can be argued that the origin of modern economics is linked to a cultural context, still influenced by modern natural law theories. Thus, even if Hume’s moral theory is everything but a natural law theory, either in the traditional or (...) the modern sense, his “laws of nature” (fixation of property, rules for its transference, and promises) represent a systematization of the rules of justice necessary to preserve the space of economic freedom required for development of a commercial society. This systematization is in line with the classical approach to natural law, which nevertheless presents further advantages for developing an ethical approach to economic activity, since it brings with itself a conception of economic agency richer than that of Hume: a conception that is not necessarily linked to pursuit self-interest, but rather is inspired by ethical motives right from the start. Indeed, on the systematic side, the classical natural law is seen as the law of practical reason: a set of principles in charge of inspiring both virtuous action and legal practice, so that we can realize the human good. Assuming the embodied and social nature of human beings, as well as the various cultural realizations of humanity, a natural law approach to ethics is in a position to stimulate a dynamic and bottomup articulation of the personal and common good, concern for progress and sustainable development, universal principles and cultural variations. This article analyzes the evolution of aesthetic role of the nature in the Middle Ages from the point of view of the philosophical systems influence on the interpretation of the corporal as a legitim way to the knowledge of the truth. it studies the intimate approach of neo-platonism, the shaping of its premises in the rejection of physical beauty and the change that occured after the assimilation of Aristotelianism toward a naturalistic outsourcing of the intellectual and artistic interests.

This article analyzes the treatment of natural philosophy in the work of Thomas Aquinas from the point of view of assimilation of the Aristotelian physical corpus. It focuses primarily on the Aquinas’s defense of the conception of the fallibility of the natural reason, the provisional and revisable character of all physical theories, the necessity of intercultural dialogue to discover the truths about nature, and Aquinas’s role in the development of the skeptical attitude in scientific research of the mobile’s world.

Populism’s Challenges to Political Reason can be seen as a consequence of social and cultural trends, the so called ‘emotional culture’, that have been accentuated in recent decades. By considering those trends, this article aims at shedding light on some distinctive marks of contemporary populism in order to argue for a reconfiguration of the public sphere that, without ignoring emotion, recovers argumentation and persuasion based on facts and reason.

Como se aprende? O que é uma imagem sem imagens? Estas questões são o ponto de partida para o estudo das relações das imagens com a aprendizagem. Propomo-nos pensar que a aprendizagem não se pode fazer sem uma unidade de conexão, um processo criador virtual-actual. Aprender é uma “tarefa infinita” e transformadora dos movimentos do corpo, do pensamento e do espaço-tempo conjugados, que exige um encontro concreto feito de uma “familiaridade prática” experimental. Fundado em 14 de janeiro de 1933 como remanescente das associações culturais criadas pelo movimento anarquista e anarco-sindicalista nas primeiras décadas do século XX, o Centro de Cultura Social de São Paulo tem por objetivo o aprimoramento intelectual, a prática pedagógica e os debates públicos. Nesse intuito, organiza palestras, cursos, seminários, filmes, peças teatrais, entre outros, além de manter um acervo de arquivo e biblioteca voltada principalmente para os estudos. Desenvolve formas de ação e formação de militantes e de livres (...) pensadores, tendo sido comum a formação de diversos centros de cultura ou congêneres em meados do século XX. A obra Pedagogia, sujeitos e resistências é resultado de um seminário promovido pelo Centro de Cultura Social de São Paulo em Junho de 2009 com o propósito de discutir o funcionamento das verdades do poder e dos poderes da verdade que circundam as várias práticas políticas e pedagógicas na contemporaneidade. Nesse sentido, a obra em questão, como bem apresenta Silvio Gallo, é resultado do esforço intelectual de jovens pesquisadores que transformaram um encontro de estudos em matéria concreta e viva de resistência ao instituído em prol da liberdade de expressão e de criação de novos modos de vida. Esta coletânea de textos apresenta-se extremamente inovadora no que concerne a educação e a pedagogia porque apresenta o funcionamento de micropolíticas cotidianas capazes de mobilização-transformação do mesmo e da mesmidade político,pedagógica e educacional tão correntes nos dias de hoje. RESUMO Um retorno ao ser aparece na contemporaneidade como uma via teórica importante para se pensar as possibilidades de uma política e de uma ética livres das conformações legadas pela história do Ocidente. É nesse sentido que Giorgio Agamben desenvolve em "O uso dos corpos" o que chamará de uma arqueologia da ontologia, buscando verificar se o acesso a uma ontologia ainda é possível nos dias de hoje. Partindo de Aristóteles, passando pela escolástica, até chegar a Heidegger, Agamben evidencia como (...) a divisão binária do ser - em duas experiências contrapostas e ao mesmo tempo dependentes - mantém-se como uma aporia no pensamento e na práxis ocidental. A ontologia, como lugar originário da articulação histórica entre linguagem e mundo, é então percorrida por suas fraturas, levando o filósofo a propor uma nova leitura do ser a partir do que entende como ontologia modal. A partir dessas ideias, busca-se investigar como essa articulação medial entre essência e existência, ser e ente, comum e singular - constituída sempre em devir - propiciaria uma nova perspectiva do ser, na qual ontologia e ética se confundem. ABSTRACT A return to the being emerges in the contemporaneity as an important theoretical way to think about the possibilities of a politics and an ethics free from the legacy bequeathed by the Western history. In this sense, Giorgio Agamben develops, in the book "The use of the bodies", what he calls an archaeology of ontology, seeking to verify if the access to an ontology is still possible nowadays. Starting from Aristotle, passing by the Scholastics, until arriving at Heidegger, Agamben highlights how the binary division of being - in two opposed and, at same time, dependent experiences - remains an aporia in Western thought and praxis. The ontology, as the origin of the historical articulation between language and world, is then traversed by its fractures, leading the philosopher to propose a new reading of the being from what he understands as modal ontology. From these ideas, we intend to investigate how this medial articulation between essence and existence, being and entity, common and singular -always founded in a becoming - would provide a new perspective of the being in which ontology and ethics end up mixed. Analisando a comunicação memética a partir dos pontos de vista da semiologia saussuriana e do dispositivo biopolítico tal como pensado por Foucault e Agamben, bem como estabelecendo conexões entre essas teorias e o uso desse tipo de comunicação na política brasileira contemporânea, foi possível perceber neste artigo que os memes, em especial os memes políticos, em vez de operarem por meio da subjetivação, operam como dispositivos dessubjetivantes.
