The just war tradition assumes that civil war is a possible site of justice. It has an uneasy relationship with liberalism, because the latter resists the idea that insurgency and counterinsurgency can be justified in moral terms. The paper suggests that, even if this is true, these two schools of thought are closer to each other than often appears to be the case. In particular, the paper argues that insurgency and counterinsurgency can be justified using the liberal assumptions that nonviolent (...) opposition is the proper non-institutional technique to fight oppressive regimes, and that law enforcement is the appropriate response to unjustified rebellions. Given these assumptions, insurgent warfare is limited to circumstances in which, firstly, nonviolent resistance is no longer a reasonable course of action; and secondly, insurgents have the intention to create the political conditions that are needed to make it a coherent option again.Counter insurgent warfare, in turn, is restrained to those situations in which, first, there is a rebellion or revolution even though the use of nonviolent strategies for conflict and change remains a reasonable choice; and second, police agencies lack the resources that arerequired for managing and suppressing rebel activities. Is it possible to interfere with individual decision-making while preserving freedom of choice? The purpose of this article is to assess whether ‘libertarian paternalism’, a set of political and ethical principles derived from the observations of behavioural sciences, can form the basis of a viable framework for the ethical analysis of public health interventions. First, the article situates libertarian libertarianism within the broader context of the law and economics movement. The main tenets of the approach are then presented and particular (...) attention is given to its operationalization through the notion of a ‘nudge’. Essentially, a ‘nudge’ consists in an intervention, which aims to suggest one choice over another by gently steering individual choices in welfare-enhancing directions yet without imposing any significant limit on available choices. Finally, the article concludes that, while it fails as an overreaching framework of ethical analysis, libertarian paternalism nonetheless constitutes a valuable addition to the conceptual toolbox of public health ethics. Za klasično in moderno politično filozofijo od Hobbesa prek Kanta in Hegla do Marxa postanemo državljani, ko svojo zakoreninjenost v družinske in družbene vezi spremenimo v pravni in/oziroma politični obstoj. Judith Butler in Marc Abélès, s tem da poudarjata prekarnost politike, postavljata pod vprašaj klasične distinkcije, kot je ločevanje med zasebnim in javnim, ko pokažeta, da sta imanentnost in kontingentnost konfliktov konstitutivna za vznik politike danes. Ker mislita politiko onstran države, tako Butler kot Abélès pojmujeta politični prostor kot križišče različnih (...) razsežnosti konkretnega prostora, kjer postane vidna prekarnost teles. Opirajoč se na ta dognanja, se avtorica distancira od ontologije prekarnosti, kolikor le-ta zamrači radikalno kontingentnost svobode, ki je vedno svoboda pod različnimi pogoji. Zato da bi lahko naredili vidno kontingentnost ustvarjanja političnega prostora, je zato nujno upoštevati konkretne družbene in zgodovinske pogoje takega ustvarjanja. Neontološko pojmovanje prekarnosti politike pa nasprotno omogoča pokazati nenavadno bližino metod, ki jih uporabljajo v psihoanalizi in politični antropologiji. Psihoanalizi in politiki je skupno to, da konstruirata prostor za tavanje. Toda če psihoanalize vseeno ni mogoče priličiti politiki, kolikor ima namreč opraviti s posameznimi singularnostmi in ne kolektivi, pa vseeno lahko ponudi orodja za analizo političnih situacij. Da bi se izognili lažni dilemi utopičnega idealizma in konzervativnega empiricizma, ko gre za transformacijo realnega, pričujoči članek obravnava disjunktivno sintezo dveh ločenih, a povezanih področij delovanja in mišljenja: področje spolnega nezavednega in področje političnih sprememb. Kritični pretres tradicionalne heglovske in/ali marksovske teze, da lahko spremenimo realno zgolj, če izhajamo iz resnične in koherentne teorije, je izhodišče za analizo treh primerov naddoločenosti, ki je značilna za sodobne emancipatorne boje: »politiko ulice«, »revolucijo« in »reorganizirajočo dinamiko spolnega nezavednega«. S poudarjanjem kontingentne artikulacije (...) emancipacije in »resnične želje« članek analizira realne, vendar nepredvidljive posledice, kot izhajajo iz kontigentnosti lastne situacijske naddoločenosti. Ker producirajo neutopični »onkraj«, so ti trije primeri naddoločenosti sodobnih bojev obravnavani kot lokalizirane antiutopije, ki predstavljajo neverjetno, a resnično »topio« za emancipacijo, namesto da bi postali normativni model. Un ouvrage récent de L. Villemin, Pouvoir d’ordre et pouvoir de juridiction , se penche sur l’histoire théologique de la distinction entre « pouvoir d’ordre » et « pouvoir de juridiction » pour en éprouver la validité théologique actuelle. Au fil des siècles, ce binôme a décrit des réalités très variables. En distinguant pouvoir sur le corps eucharistique et pouvoir sur le corps ecclésial, il a consacré un déplacement de la relation classique entre ecclesia et ministerium vers une relation entre (...) potestas et eucharistia. Cela n’est pas sans conséquences pour la vie ecclésiale, la théologie et le droit canonique. Or, Vatican II a choisi d’utiliser un concept unitaire du pouvoir dans l’Eglise, à savoir celui de potestas sacra. N’y a-t-il donc pas lieu d’abandonner la distinction entre ordo et iurisdictio ? Dans la foulée des conclusions de l’ouvrage, Alphonse Borras dégage des perspectives fécondes pour penser les ministères – leur attribution autant que leur exercice – et l’habilitation qu’ils impliquent à servir l’Eglise qui porte l’Evangile en ce lieu. This paper considers Freud's 1920 text, Beyond the Pleasure Principle, in light of Jacques Derrida's critical commentary on it in The Post Card. Against the deconstructive reading that highlights the performative aspects of Freud's speculative remarks, David-Ménard reads Freud's theory of the death drive as an epistemological and experimental hypothesis necessary for giving an account of the complexity and diversity of the clinical phenomenon of repetition in psychoanalysis. Though the death drive never appears locatable as such in the various examples (...) given by Freud, it is nonetheless accessible in the constellation of differences produced by traumatic dreams, children's games, etc. (shrink)

L’ouvrage de Mgr Rouet et de ses collaborateurs traite de l’expérience des « communautés locales » dans le diocèse de Poitiers, projet diocésain qui repose sur la vocation baptismale des chrétiens et leur capacité de porter la mission de l’Église, en dialogue avec la société. Cette expérience donne à penser en matière de théologie pratique par sa cohérence ecclésiologique et son articulation avec la réalité ambiante. Elle appelle cependant un approfondissement théologique de ses présupposés et quelques précisions canoniques.

Le récent motu proprio Omnium in mentem a modifié le canon 1008 du Code de droit canonique de 1983 et ajouté un troisième paragraphe au canon 1009. Ces changements concernent le sacrement de l’ordre. Ils sont examinés ici sous l’angle du ministère diaconal. Sur l’arrière-fond de la doctrine de Vatican II et de ses développements ultérieurs, l’auteur présente une exégèse des nouveaux canons dont il regrette la déficience de la conceptualité juridique sans pour autant majorer leur portée théologique. Il se (...) réjouit cependant que le service soit désormais le dénominateur commun du ministère ordonné. Les diacres sont habilités à servir le corps ecclésial du Christ pour qu’il réalise sa mission dans le monde.
