A partir de la constatación de la baja representación femenina en órganos políticos como parlamentos y gobiernos en distintos países y de su escasa presencia en puestos de representación social, todo ello con especial referencia a España, el artículo discute los principales problemas ético-políticos que presenta la propuesta de las cuotas electorales en tres apartados. En el primero considera las principales objeciones en torno a los derechos asociados a la libertad electoral, defendiendo que la mayoría de las limitaciones que las (...) cuotas imponen a esos derechos pueden estimarse como un sacrificio justificado temporalmente para alcanzar el objetivo de una sociedad más igualitaria. El segundo apartado trata las objeciones que el sistema de cuotas se presentan en nombre del carácter individual y, a la vez, no vinculado de la representación, pretendiendo mostrar que las formas de representación por grupos y de intereses parciales no sólo son tradicionales y muy comunes en los sistemas democráticos realmente existentes, sino que pueden ser un precio necesario, de nuevo temporal, para ir acercándose al ideal de una representación de individuos diferentes pero iguales y al fin más desvinculada de intereses parciales. En el tercer apartado se analizan las objeciones contra las cuotas electorales en nombre de la idea de igualdad para poner de manifiesto que, en general, se trata de objeciones que proceden de un malentendido a propósito del significado ético y políticamente defendible de la idea de igualdad. Afrontadas las anteriores objeciones de alcance ético-político, el artículo concluye remitiendo la discusión al ámbito de la política práctica. (shrink)

Las relaciones que pueden establecerse entre azar, igualdad y biotecnología suscitan un debatebien prolijo en el campo de la filosofía moral, generando dudas y numerosas discusiones. La reflexión sobre el alcance moral de ciertas hipotéticas posibilidades que podría brindar la biotecnología, permite iluminar el debate sobre la suerte bruta en materia de justicia distributiva.

Background: Waiving parent permission can be an option in some epidemiological and social research with adolescents. However, exemptions have not been uniformly considered or applied. Our aim is to critically assess the different factors that could be taken into account when making decisions about waiving active parental permission in observational research with adolescents.DiscussionIn some cases alternatives to parental permission could be applied to protect the rights of both adolescents and parents and also to assure the benefits to adolescents as a (...) group that can come from appropriately conducted studies. However, the criteria of ensuring minimal risk can be difficult to define and apply and a distinction between harm and discomfort is reviewed. Waiving active parental permission could be acceptable when the risk of harm is minimal; when the research questions are related to an activity for which adolescents are not legally considered to be children; when the risk of harm or discomfort may increase if parental permission is required; and when risk of discomfort is low because the questionnaire is not potentially offensive for some adolescents and/or for some parents.SummaryStringent rules concerning parental permission in some studies could be detrimental to adolescents. In the international context of a progress toward more inclusive educational systems and practices, the role of Special Education teachers is being transformed. From an inclusive perspective, these professionals increasingly support students and their teachers in the mainstream classroom, avoiding segregation. However, Special Education teachers often struggle to reach and support all students with special needs and their teachers to provide quality inclusive education. For this reason, more research is still needed on in-service training strategies for the inclusion of students (...) with special needs that effectively translate into evidence-based school practices that improve the education of all students. This article analyses the impact of two evidence-based dialogic training programs of Special Education teachers working in mainstream schools carried out in Mexico during the 2018–2019 school year. Through in-depth interviews with participants, it was identified how, after the training, teachers increasingly grounded their actions on scientific evidence and promoted interactive learning environments that improved the educational inclusion of their students with special needs. This training also became the venue to make evidence-based educational actions available to other students without special needs, improving the quality of education provided to all students. Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...) the place of death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of death rather than the actual place of death. Causes of deaths and different patterns of deaths were discussed, indicating that many of these deaths are preventable. Lack of an internationally recognised standard definition of death in custody is a major concern. Key aspects such as place, time, and causes of death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary deaths in prison and to protect vulnerable prisoners. (shrink)

ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

Riassunto : Questo articolo propone un confronto tra la teoria mente-corpo di Henri Bergson e gli ultimi sviluppi della filosofia della mente e, più specificamente, con il cosiddetto “esternalismo”. Lo scopo è duplice. In primo luogo, si vuole sostenere che l’opera del filosofo francese ha anticipato i principali punti teorici dell’esternalismo: la teoria della percezione di Bergson, infatti, ha molti e rilevanti tratti in comune con la cosiddetta 4E Cognition, che finora non sono stati adeguatamente riconosciuti. In secondo luogo, l’articolo (...) intende anche mostrare come il quadro ontologico in cui Bergson colloca la propria interpretazione dell’esperienza cosciente, possa fungere da utile riferimento per il modello esternalista, al fine di sistematizzare i dati sperimentali entro un orizzonte teorico coerente. La teoria della "percezione pura" di Bergson, infatti, supera il modello correlazionista dell’esperienza, rilevando come quest’ultima, allo stato puro, si collochi nelle cose stesse, a un livello di realtà che precede la divaricazione dell’esperienza tra soggetto e oggetto, livello che deve essere pensato come l’origine impersonale della coscienza soggettiva. Towards an ontological model: In this article we contrast Henri Bergson’s mind-body theory with the latest developments in Philosophy of Mind, more specifically, in so-called “Externalism”. This paper has two specific aims. First, we argue that the work of this French philosopher anticipated the main theoretical concepts of Externalism. Indeed, Bergson’s theory of perception shares many important features, which have not been adequately recognized until now, with so-called 4E Cognition. Second, we show how Bergson’s basic ontology, which frames his interpretation of conscious experience, could offer a coherent theoretical framework to systematize experimental data in an externalist model. Bergson’s theory of “pure perception” goes beyond correlation, showing that our experience, in its purest state, takes place within things themselves, at a level of reality that precedes the bifurcation of experience into a subject and an object. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

What ethical framework should be used as a basis for teaching business ethics? Should business ethics be taught by ethicists in a separate course, by business faculty in business courses, or perhaps by both? These are some of the issues this paper will address. The paper begins with a review of the literature concerning approaches to teaching business ethics. Next, some ethical frameworks for teaching business ethics are considered. Finally, the paper proposes that students should apply their own personal values (...) to business ethical issues in the classroom, thus providing future business leaders with a process for resolving ethical dilemmas. In environmental ethics, the legal and political representation of non-humans is a widespread aspiration. Its supporters see representative institutions that give voice to non-humans' interests as a promising strategy for responding to the illegitimate worldwide exploitation of non-human beings. In this article I engage critically with those who support this form of representation, and address two issues central to any account concerned with the legal and political representation of non-human living beings: what should be represented? And what are the conditions (...) of such a representation? The answers I provide to these queries count as a first step towards a comprehensive account of the institutional representation of non-human nature. (shrink)

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

The ethic of care has often been opposed to the ethic of justice as offering a different and even a contradictory approach to moral problems. This article argues that, from the perspective of the discourse ethic, both approaches are complementary in a very fundamental sense, since each one applies to one of two stages of moral reasoning that are as different as they are interconnected. It argues, in particular, that while justice is concerned with the justification and elaboration of norms, (...) care is concerned with finding a solution for specific moral situations. The article then places considerations of care at the centre of ideal discourse and subordinates the importance of rational understanding and moral justification to intuitive communication. (shrink)

En Suárez no se encuentra un tratamiento sistemático del derecho en sentido subjetivo, pero el Dr. Eximio dispuso de una elaborada doctrina sobre esta cuestión. Suárez entiende el derecho en sentido subjetivo como una potestad o facultad moral del sujeto que se funda en su naturaleza racional. Su pensamiento sobre el particular, especialmente su doctrina sobre el derecho a la propiedad privada, parece haber ejercido una amplia influencia en la Inglaterra del siglo XVII.

En este artículo analizaré algunos puntos de convergencia entre la filosofía transhumanista y la crítica filosófica contemporánea al antropocentrismo. Para ello distinguiré entre un tipo de programa normativo fuerte y uno débil en el transhumanismo. El argumento central reside en que la normatividad fuerte en el discurso transhumanista, al suponer que es posible seleccionar exclusivamente las características “propiamente humanas” para ser conservadas en el estadio post-humano, se basa en una concepción pre-darwiniana de la especie humana, lo cual posee implicancias tanto (...) epistemológicas como éticas. El jesuita Francisco Suárez como eminente teólogo, filósofo y jurista de su época juega un papel relevante como precedente en la construcción de las categorías del pensamiento moderno. Una de estas categorías, no contemporánea del doctor eximio, es la de los derechos humanos. Son muchos los autores que anticipan alguno de sus elementos fundamentales ya en el pensamiento en torno al Derecho que desarrolla Francisco Suárez en sus principales tratados de filosofía jurídica y política como el De Legibus y la (...) Defensio fidei. En este trabajo trataremos de conectar la virtualidad del planteamiento suarista en el ámbito de los derechos humanos, explorando en su obra estos antecedentes y la dirección en la que los mismos se dirigen, así como las posibilidades de dialogo que abre en torno a la construcción de la concepción de los derechos humanos en el contexto actual. Using a comprehensive sample of U.S. non-profit hospitals from 2011 to 2015, we examine the effects of state community benefits regulation on the amount of charity care provided by and the operational efficiency of U.S. non-profit hospitals. First, we document that, under such regulations, non-profit hospitals provide more charity care and less compensated care as a proportion of net revenue. We infer from these findings that CBR has the potential to increase both non-profit hospitals’ amount of charity care and their (...) efficiency of operations. Second, by examining variation in CBR types, we find no differences between having provision or having reporting requirements on the amount of charity care offered. Moreover, when we consider CBR with both provision and reporting requirements, the combination of these two requirements does not incrementally enhance charity care offerings, suggesting that the requirements may serve as substitutes with comparable effect. Lastly, we show that several state-level characteristics influence the relationship between CBR and charity care: CBRs in states with a higher gross domestic product and percentage of revenue received in taxes have incrementally lower associations with charity care, while hospitals in states where populations have, on average, higher household incomes have greater associations between CBR and charity care. Our findings highlight the effects that state-enacted regulation can have on socially beneficial behavior by non-profits. (shrink)

According to the brain drain argument, there are good reasons for states to limit the exit of their skilled workers (more specifically, healthcare workers), because of the negative impacts this type of migration has for other members of the community from which they migrate. Some theorists criticise this argument as illiberal, while others support it and ground a duty to stay of the skilled workers on rather vague concepts like patriotic virtue, or the legitimate expectations of their state and co-citizens. (...) In this article, on the contrary, we suggest that the liberal conception of states’ legitimate political authority demands, and not just permits, that developing states from which migration of skilled workers occurs set up contractual mechanisms. These mechanisms will ensure that state-funded training in the health sector is provided against a commitment on the part of future professionals to reciprocate with their services for the benefits obtained. If one of the conditions for the state to maintain legitimate political authority is to provide basic services such as healthcare to its subjects (while respecting at the same time their autonomy and freedom), then this is what developing states affected by the brain drain ought to do. What we call the authority-based approach to the brain drain also helps to clarify the obligations that other states have not to interfere with these contractual mechanisms when they exist, and not to profit from their absence. Inspired by FIFA’s legal instruments of training compensation and solidarity mechanism for the transfer of players, we conclude by suggesting a plausible global policy to complement this authority-based approach. El artículo presenta los principales resultados de un estudio realizado entre 1998 y 2000 con hombres jóvenes de la Ciudad de Cali, Colombia, profundizando en sus prácticas de distinción en torno al cuerpo, la vestimenta, los espacios de sociabilidad, las mujeres como objetos de ostentación y sus dinámicas de prestigio. El estudio es desarrollado en base a observación participante y a la implementación de entrevistas con grupos de jóvenes entre 14 y 22 años, tanto de sectores medios bajos, como medios (...) altos, e indaga en sus opiniones sobre la moda, el prestigio, la distinción social y los comportamientos que otorgan o quitan el estatus.
