We put forward a synopsis of the development and institutional (...)

Is Etiquette Relevant to Medical Ethics? Ethics and Aesthetics in the Works of John Gregory (1724–1773).Giovanni Maio - 1999 - Medicine, Health Care and Philosophy 2 (2):181-187.
The writings of the Scottish physician and philosopher John Gregory play an important role in the modern codification of medical ethics. It is therefore appropriate to use his work as a historical example in approaching the question how elements of aesthetics were incorporated in 18th century medical ethics. The concept of a Gentleman is pivotal to the entire medical ethics of John Gregory as it provides him with the ethical source of the duty to patients. Gregory makes the trustworthiness of (...)

The cultural specifity of research ethics--or why ethical debate in France is different.G. Maio - 2002 - Journal of Medical Ethics 28 (3):147-150.
In the search for a globally binding ethical minimal consensus in dealing with research on human beings the awareness of the cultural specificity of such questions will be of central importance. France provides a good example of such cultural specificities. Three basic structures of French discussion on research ethics can be enumerated: first the particular weight placed on therapeutic benefit, second a particular accentuation on freedom and voluntarism, and third its lesser attention to the aspect of ability to give consent. (...)

The Republican Schoolmaster and the Problem of Religion in America.Gerald De Maio - 2018 - Journal of Interdisciplinary Studies 30 (1-2):169-194.
There is a view that the U.S. Supreme Court has acted as a “republican schoolmaster,” defining and educating the public on the permissible interaction between government and religion. The Court gave government, especially state governments, considerable latitude until incorporation of the religion clauses in the 1940s. In Everson v. Board of Education (1947), the Court articulated a rigid conception of church and state which set precedents for decades. Those precedents restricted accommodation to religion by government, based on an incomplete reading (...)

Individuals who deviate from social norms by committing crimes may have reduced facial emotion recognition abilities. Nevertheless, a specific category of offenders – i.e. organised crime (OC) members – is characterised by hierarchically organised social networks and a tendency to manipulate others to reach their illicit goals. Since recognising emotions is crucial to building social networks, OC members may be more skilled in recognising the facial emotion expressions of others to use this information for their criminal purposes. Evidence of a (...)

Predictive Probability and Analogy by Similarity in Inductive Logic.Maria Concetta Di Maio - 1995 - Erkenntnis 43 (3):369 - 394.
The λ-continuum of inductive methods was derived from an assumption, called λ-condition, which says that the probability of finding an individual having property $x_{j}$ depends only on the number of observed individuals having property $x_{j}$ and on the total number of observed individuals. So, according to that assumption, all individuals with properties which are different from $x_{j}$ have equal weight with respect to that probability and, in particular, it does not matter whether any individual was observed having some property similar (...)

The embryo in relationships: A French debate on stem cell research.Giovanni Maio - 2004 - Journal of Medicine and Philosophy 29 (5):583 – 602.
While many European countries are entering unknown legal terrain where the embryo in vitro is concerned, France can already look back on a long tradition of public discussion and legal codification of ways of dealing with in vitro embryos. In its comprehensive law of 1994, France had still rejected embryo research; however, due to the promising perspectives of stem cell research, the new law now pending implies a clear liberalization of the 1994 provisions. Both the French lawmakers and the National (...)

In this thesis I defend and pursue that line about the foundations of probability theory which has come to be known as "the logicist view about probability", and, in particular, the shape which it took in Carnap's Inductive Logic. ;Most philosophers who now deal with probability theory claim that Carnap's program of Inductive Logic has failed. The main aim of my thesis is to show that this judgment is based on a fundamental misunderstanding about the nature and the aim of (...)

In the context of a wider investigation into Christianity as dialogue with non-Christians, and following up on a study of the approach of Thomas Aquinas through «demonstrative or probable reasons», the present study examines the approach of Francis of Assisi, who went off to preach to the Sultan and ordered his friars to give witness to the Gospel without resorting to discussions or conflicts, and that of Bonaventure, who, like Paul in the First Letter to the Corinthians, insisted on the (...)

The modern concept of 'dialogue' among persons and groups of different religions or 'world-views' is the fruit of interaction between Christian tradition and the technique of dialogue in Greek philosophy. Dialogue in general requires a classification of those in dialogue , a prototype and an archetype of mediation , a teleotype or final objective , a procedural type , and a representation of spacial logic . This article examines especially the Thomistic approach, through demonstrative and probable reasons.

On the historiographic plane, the confrontation between the texts of Bonaventure and of Thomas Aquinas regarding the structure of human knowledge, reveals common features and divergent ones. Both are, moreover, «scholastics» in the elaboration of the sources, in so far as they do not select only some data of tradition , but seek through various paths to assume and to synthetise coherently the whole tradition known to them. Bonaventure has followed the path of extrapollation of the single data from their (...)

Segundo S. Boaventura, (...)

Research ethics and the principle of justice as fairness – a restatement.Giovanni Maio - 2003 - Theoretical Medicine and Bioethics 24 (5):395-406.
In my recent article, I addressed the question of whether a potential categorical exclusion of decisionally impaired patients from non-therapeutic medical research would be inaccordance with the Principle of Justice as Fairness. I came to the conclusion that a categorical exclusion of decisionally impaired persons from relevant research projects may collide with Rawls’s understanding of Justice as Fairness. Derek Bell has criticized my paper by denying that it is legitimate to apply Rawls to this bioethical problem. In my restatement I (...)

A narrative analysis of a sequence from a documentary on the withholding of treatment in persistent vegetative state allows the discernment of several characteristics of the approach of the media to medical ethical problems: (1) The arrangement of the story units in the film sequence corresponds to established patterns of movie dramaturgy. (2) The documentary ”hollywoodizes” morality; it interprets the arena of the problem in the realm of the movie theatre and not in the realm of ethical discourse. (3) The (...)

The relevance of Rawls' principle of justice for research on cognitively impaired patients.P. D. Dr Giovanni Maio - 2002 - Theoretical Medicine and Bioethics 23 (1):45-53.
An ethical conflict arises when we must perform research in the interest of future patients, but that this may occasionally injure the interests of today''s patients. In the case of cognitively impaired persons, the question arises whether it is compatible with humane healthcare not only to treat, but also to use these patients for research purposes. Some bioethicists and theologians have formulated a general duty of solidarity, also pertaining to cognitively impaired persons, as a justification for research on these persons. (...)

The justification of non-therapeutic research on incapacitated persons isastill unsolved problem, because in this situation, both legitimising factors of research - informed consent and therapeutic benefit - are absent and the question arises as to whether such research is morally justifiable at all. The paperwill ask if there could be arguments for such research. One argument could be that under certain circumstances, an institutionally decreed global renunciation of any type of research on this group of persons could also be illegitimate. (...)

When making consumption choices, people often fail to meet their own standards of both ethics and frugality. People also generally tend to demand more of others than they do of themselves. But little is known about how these different types of hypocrisy interact, particularly in relation to attitudes toward ethical consumption. In three experiments, we integrate research methods using anchoring and hypocrisy within the context of ethical consumption. Across three experiments, we find a default expectation that people should spend less (...)

The term “moral heuristic” as used by Sunstein seeks to bring together various traditions. However, there are significant differences between uses of the term “heuristic” in the cognitive and the social psychological research, and these differences are accompanied by very distinct evidential criteria. We suggest the term “moral heuristic” should refer to processes, which means that further evidence is required.

Using self-affirmation to increase intellectual humility in debate.Paul H. P. Hanel, Deborah Roy, Sam Taylor, Michael Franjieh, Christopher Heffer, Alessandra Tanesini & Gregory R. Maio - manuscript
Intellectual humility, which entails openness to other views and a willingness to listen and engage with them, is crucial for facilitating civil dialogue and progress in debate between opposing sides. In the present research, we tested whether intellectual humility can be reliably detected in discourse and experimentally increased by a prior self-affirmation task. Three-hundred and three participants took part in 116 audio and video-recorded group discussions. Blind to condition, linguists coded participants’ discourse to create an intellectual humility score. As expected, (...)

In his paper, “The Relevance of Rawls’ Principle of Justice for Research on Cognitively Impaired Patients” (Theoretical Medicine and Bioethics 23 (2002):45–53), Giovanni Maio has developed a thought-provoking argument for the permissibility of non-therapeutic research on cognitively impaired patients. Maio argues that his conclusion follows from the acceptance of John Rawls’s principles of justice, specifically, Rawls’s “liberty principle” Maio has misinterpreted Rawls’s “libertyprinciple” – correctly interpreted it does notsupport non-therapeutic research on cognitivelyimpaired patients.
