The paper sets out from Göodel's question about primitive concepts, in connection with Gödel's proposal of the employment of phenomenological method. The author assumes that the answer that can be found in Kant is relevant as a starting point. In a modification of the approach by K. Reich, a reconstruction of Kant's "deduction'' of logical forms of judgment is presented, which serve Kant as the basis for his "metaphysical deduction of categories'' including substantiality and causality. It is proposed that different (...) aspects of Kant's "original unity of self-consciousness'' as applied and attached to concrete representations step by step yield different forms of concepts, judgments, and inferences. Categorical, hypothetical and disjunctive judgments are shown to be gradually strengthening the conditions of bringing our representations under the "objective unity of consciousness", and in this way gradually implementing logical laws. The corresponding concepts of substantiality, causality, and mutual influence appear to be grounded in the primitive forms of our thinking. (shrink)

Kant's use of the leading thread of his table of logical forms of judgment to analyze judgments of taste yields more results than Allison's account allows. It reveals in judgments of taste the combination of two judgments: a descriptive judgment about the object, and a normative judgment about the judging subjects. This paper argues that the cognitive status and cognitive value of thoughts should be clarified through a description of the mechanics of the theoretical power of judgment. Three pairs of concepts essentially constitute its tools: 1. determinative and reflective judgments; 2. constitutive and regulative principles; and 3. transcendental and empirical applications. Against the general approach to dealing with these concepts, i.e., against the tendency to consider them as synonymous or as forming a parallel structure, this article sharpens the distinctions between (...) these three pairs of concepts. For that reason the methodological hypothesis according to which there is no inner relation between these respective pairs of concepts will be put to the test. The hypothesis says that these concepts should be prima facie combinable: e. g., one should be able to say what a judgment that is simultaneously transcendental, regulative and determining would be like, or why such a combination is impossible. Combining the three concept-pairs creates eight possibilities that are presented systematically in the table at the end of the article. In the section of the Critique of Pure Reason entitled "Clue to the Discovery of All Pure Concepts of the Understanding," Kant criticizes Aristotle for having "thrown together" his list of categories. On the basis of what Kant says in that same section, however, it has seemed to many readers that Kant's presentation of the categories on the basis of the table of the logical forms of judgment is no less "rhapsodic." In this and other related respects the so-called (...) metaphysical deduction of the categories has long been a major stumbling block for students of Kant's theoretical philosophy. What precisely is the "principle" on the basis of which, according to Kant, the basic concepts of transcendental philosophy are to be sought? Why and how are the categories derived from forms of judgment? A primary goal of clinical practice is to respect patient autonomy. To promote this goal for patients who have lost the ability to make their own decisions, commentators recommend that surrogates make their treatment decisions based on the substituted judgment standard. This standard is commonly interpreted as directing surrogates to make the decision the patient would have made in the circumstances, if the patient were competent. However, recent commentators have argued that this approach—attempting to make the decision the patient would (...) have made if competent—is theoretically problematic, practically infeasible, and ignores the interests of the patient9s family and loved ones. These commentators conclude that the substituted judgment standard should be revised significantly, or abandoned altogether. While this response would avoid the cited problems, it also would require substantial changes to clinical practice and would raise significant problems of its own. The present paper thus considers the possibility that the criticisms do not point to problems with the substituted judgment standard itself; instead, they point to problems with the way it is most commonly interpreted. This analysis suggests that the substituted judgment standard need not be dramatically revised or abandoned. Instead, it should be interpreted in a way that effectively promotes respect for the autonomy of incompetent patients. The ‘endorsed life’ interpretation described here helps clinicians and surrogates to achieve this important goal. To clarify this approach, we explain how it differs from three other recently proposed alternatives to the standard interpretation of the substituted judgment standard. (shrink)

A psychiatric advance directive (PAD) is a communication tool that promotes patients’ autonomy and gives capacitated adults who live with serious mental illnesses the ability to record their preferences for care and designate a proxy decision maker before a healthcare crisis. Despite a high degree of interest by patients and previous studies that recommend that clinicians facilitate the completion of PADs, the rate of implementation of PADs remains low. Research indicates that many clinicians lack the necessary experience to facilitate the (...) completion of PADs and to use them, and, as a consequence, do not effectively engage patients about PADs. This study developed practical recommendations for clinicians to improve their ability to communicate and facilitate PADs. We (1) thematically analyze definitions of PADs published in 118 articles across disciplines, and (2) present our recommendations for enhanced communication in clinical practice that emphasize patient-centeredness, usefulness, and clarity, aligned with evidence-based practices that put patients’ autonomy and understanding first. While there is no one-sizefits- all script to engage patients in complex conversations, our recommended strategies include an emphasis on patients’ autonomy, the adaptation of word choices, the use of metaphor not simile, and checking for patients’ understanding as effective methods of clinical communication. In this paper I offer a reading of the 1790 Introduction to the Critique of Judgement intended to show that the Critique of Judgement itself attempts to make good a serious deficit in the argumentation of the Critique of Pure Reason. In effect, the conditions outlined in the Critique of Pure Reason could be fulfilled without experience being constituted. There must therefore be additional conditions for the possibility of experience. And an account of these is to be found in the (...) Critique of Judgement, despite the repeated insistence in the text itself that its strictures operate on the level of a merely 'reflective' judgement, quite distinct from the 'determinant' judgements underwriting the time-determination of logical operations in the first Critique. The new transcendental elements for the condition of possibility of experience turn out, through an analysis of the concept of affinity, to table a novel, transcendental, conception of matter irreducible to the experiential understanding of matter and conditioning its possibility. In conclusion, I suggest that the structure of reflective judgement can itself be understood as a description of the operation of this transcendental matter in the special case of the transcendental spontaneity required by the Kantian subject to constitutive experience. In his table of judgements, Kant added infinity as a third quality. An infinite judgement ‘All S are non-P’ is said to differ from the affirmative ‘All S are P’ because it ascribes a negative predicate; and it differs from the negative ‘No S is P’ because it has a richer content. The present paper puts three interpretations of this surplus content to six tests. Among other things, it is examined whether these interpretations marry up with Kant’s solution (...) to the first antinomy, his conception of analyticity and the principle of complete determination. The unpleasant conclusion is that none of the interpretations can make its mark as the most adequate one. It thus remains unclear what Kant had in mind when positioning infinite judgements besides affirmative and negative ones. (shrink)

Christians all over the world celebrate the Eucharist as an important aspect of their faith. Arising from Paul's warning in 1 Corinthians 11:27-30 that persons who eat the Lord's Supper unworthily bring judgment upon themselves, some churches in Nigeria restrict the Communion to supposedly holy members. This article examined the text with a view to appraising this attitude towards the Communion. It applied the historical exegesis and the analytical approach. The article found that the restriction of the Eucharist to selected (...) members of the congregation is counter-productive and self-defeating in that many Christians are denied the opportunity to partake of it. Paul's view of judgment upon participants derived from his Jewish perception in which affliction was always seen as divine punishment. Furthermore, at its inception the celebration of the Communion does not reflect the idea that it was meant for only holy people. In view of this, and the fact that the Jewish perception need not apply in the modern and scientific world, the work concluded that the mainline churches in Nigeria have to review their attitude towards the Communion such that all Christians are encouraged to participate in it. While laying emphasis on reverent and loving behaviour at the Lord's Table, the idea of the Communion causing illness and death should be completely jettisoned. CONTRIBUTION: This article is a contribution to New Testament Theology and Christian ethics. The proposal to make the Eucharist more accommodating is significant for congregational harmony in the church in Nigeria. (shrink)

There is a large tradition of work in moral psychology that explores the capacity for moral judgment by focusing on the basic capacity to distinguish moral violations (e.g. hitting another person) from conventional violations (e.g. playing with your food). However, only recently have there been attempts to characterize the cognitive mechanisms underlying moral judgment (e.g. Cognition 57 (1995) 1; Ethics 103 (1993) 337). Recent evidence indicates that affect plays a crucial role in mediating the capacity to draw the moral/conventional distinction. (...) However, the prevailing account of the role of affect in moral judgment is problematic. This paper argues that the capacity to draw the moral/conventional distinction depends on both a body of information about which actions are prohibited (a Normative Theory) and an affective mechanism. This account leads to the prediction that other normative prohibitions that are connected to an affective mechanism might be treated as non-conventional. An experiment is presented that indicates that “disgust” violations (e.g. spitting at the table), are distinguished from conventional violations along the same dimensions as moral violations. There is ample evidence that in classical truth table task experiments false antecedents are judged as ?irrelevant?. Instead of interpreting this in support of a suppositional representation of conditionals, Schroyens (2010a, 2010b) attributes it to the induction problem: the impossibility of establishing the truth of a universal claim on the basis of a single case. In the first experiment a truth table task with four options is administered and the correlation with intelligence is inspected. It is observed that (...) ?undetermined? is chosen in one third of the judgements and ?irrelevant? in another third. A positive correlation is revealed between intelligence and the number of ?irrelevant? and ?undetermined? judgements. The data do not exclude that a part of the ?irrelevant? judgements in classical truth table task experiments might be caused by the induction problem. In the second experiment participants are presented with a simplified four-option truth table task and asked for a justification of their judgements. These justifications show the induction problem is not the reason for choosing the ?irrelevant? or ?undetermined? option, which is supportive for a suppositional representation of conditionals. This paper provides an account of Kant's categories of freedom, explaining how they fit together and what role they are supposed to play. My interpretation places particular emphasis on the structural features that the table of the categories of freedom shares with the table of judgements and the table of categories laid out by Kant in the Critique of Pure Reason. In this way we can identify two interpretative constraints, namely (i) that the categories falling under (...) each heading must form a synthetic unity whereby the third one derives from the combination of the other two. and (ii) that the first two categories falling under each heading must be morally undetermined and sensibly conditioned, while the third category is sensibly unconditioned and determined only by the moral law. As Kant shows in A 71–76 of the First Critique, his table of the twelve “logical functions of understanding” (in A 70) is an indispensable extension of a table of four well-known logical functions that we find in a section of the Logic that was “already finished” in Aristotle’s times: The Square of Oppositions. The undisputed completeness of this special table thus warrants the completeness of Kant’s general table as well. Any further philosophical proof of completeness (...) for Kant’s table of judgements as a whole is therefore not necessary at all. And due to the contingency of “kind and number” of human forms of intuition and functions of judgment, such a ‘proof’ would not even be possible according to Kant – and thus it is not a subject (or even a part) of his Transcendental Deduction of the Categories. A concluding evaluation of Kant’s own statements about the proof-structure of the B-Deduction as a whole supports this claim. (shrink)

John MacFarlane argues against objectivism about “tasty”/”not tasty” in the following way. If objectivism were true then, given that speakers use “tasty”/”not tasty” in accordance with a rule, TP, speakers would be using an evidently unreliable method to form judgements and make claims about what is tasty. Since this is implausible, objectivism must be false. In this paper, I describe a context in which speakers deviate from TP. I argue that MacFarlane's argument against objectivism fails when applied to uses (...) of “not tasty” within this context. Some of the key ethical considerations are avoiding conflicts of interest, maintaining independence of judgement, maintaining fairness, transparency, full disclosure, privacy and confidentiality, respect, responsibility, accountability, empowerment and sustainability. There are several ethical frameworks in public health, but none focusing on the monitoring and evaluation process. There is a need to institutionalise the (...) ethical review of M&E proposals. A theoretical framework for ethical considerations is proposed in this paper. This proposed theoretical framework can act as the blueprint for building the capacity of ethics committees to review M&E proposals. A case study is discussed in this context. Hegel called world history a court of judgement, a world court, and in his Lectures on the Philosophy of World History he took Africans before that court and found them to be barbaric, cannibalistic, preoccupied with fetishes, without history, and without any consciousness of freedom. -/- In this paper, after rehearsing some of the more familiar objections to Hegel's verdict against Africa, I turn the tables and put Hegel on trial. More specifically, given that much of Hegel's account is directed (...) against the Ashanti, I will use what is known about them and especially what Hegel either did know or should have known, to take him before the court of the Ashanti, where the use of evidence can be interrogated. The results of this examination render all the more pressing the need to give an account of how Hegel applied his system of justice to Africa, which I attempt to do in the second part of the paper. In the third part, I return to the interpretation of Hegel's statement about Africa as unhistorical and, having restored it to its context in Hegel's system, show its. (shrink)

The prevailing interpretation of Kant’s _First Critique _in Anglo-American philosophy views his theory of a priori knowledge as basically a theory about the possibility of empirical knowledge, or the a priori conditions for that possibility. Instead, Robert Greenberg argues that Kant is more fundamentally concerned with the possibility of a priori knowledge—the very possibility of the possibility of empirical knowledge in the first place. Greenberg advances four central theses: the _Critique_ is primarily concerned about the possibility, or relation to objects, (...) of a priori_,_ not empirical knowledge, and Kant’s theory of that possibility is defensible; Kant’s transcendental ontology must be distinct from the conditions of the possibility of a priori knowledge; the functions of judgment, in Kant’s discussion of the Table of Judgments, should be seen according to his transcendental logic as having content, not as being just logical forms of judgment making; Kant’s distinction between and connection of ordering relations and reference relations have to be kept in mind to avoid misunderstanding the _Critique_. At every step of the way Greenberg contrasts his view with the major interpretations of Kant by commentators like Henry Allison, Jonathan Bennett, Paul Guyer, and Peter Strawson. Not only does this new approach to Kant present a strong challenge to these dominant interpretations, but by being more true to Kant’s own intent it holds promise for making better sense out of what have been seen as the _First Critique_’s discordant themes. Two important characteristics of CIHR were crucial for the development of research on aging. The first was that CIHR, unlike MRC, was entrusted with the challenge of supporting the whole spectrum of health research, from the basic biomedical perspective to clinical research, research on health services and policies as well as social aspects of health research, not to mention research on ethics and other perspectives (including the science of research). The second characteristic of the nascent CIHR that impacted the community of research on aging was the decision that a small part of the overall CIHR budget would be used to address priority-driven questions or topics (strategic competitions), while the majority of the budget would be invested in grants and awards programs that would be investigator-initiated, as in the time of the MRC (open competition). Since its inception, CIHR has included 13 institutes that are central to the priority-driven actions. The CIHR Institute of Healthy Aging thus became the CIHR Institute of Aging in all versions of its documentation. But above and beyond this important name change, the real work of Dr. Hebert, accompanied by the first Institute Advisory Board1, chaired by Prof. Dorothy Pringle, was to identify the gaps, the needs and the opportunities. In the third Critique Kant details an aesthetic operation of judgment that is surprising considering how judgment functioned in the first Critique. In this book, I defend an understanding of Kant’s theory of Geschmacksurteil as detailing an operation of the faculties that does not violate the cognitive structure laid out in the first Critique. My orientation is primarily epistemological, elaborating the determinations that govern the activity of pure aesthetic judging that specify it as a "bestimmte" type of judgment without transforming (...) it into "ein bestimmendes Urteil". I focus on identifying how the logical functions from the table of judgments operate in the pure aesthetic judgment of taste to reveal "the moments to which this power of judgment attends in its reflection". In the course of doing so, a picture emerges of how the world is not just cognizable in a Kantian framework but also charged with human feeling, acquiring the inexhaustible, inchoate meaningfulness that incites "much thinking". The universal communicability of aesthetic pleasure serves as the foundation that grounds robust intersubjective relations, enabling genuine connection to others through a shared a priori feeling. Errol Lord explores the boundaries of epistemic normativity. He argues that we can understand these better by thinking about which mental states are competitors in rationality’s competition. He argues that belief, disbelief, and two kinds of suspension of judgment are competitors. Lord shows that there are non-evidential reasons for suspension of judgment. One upshot is an independent motivation for a certain sort of pragmatist view of epistemic rationality.

In this philosophically sophisticated and historically significant work, John H. Zammito reconstructs Kant's composition of The Critique of Judgment and reveals that it underwent three major transformations before publication. He shows that Kant not only made his "cognitive" turn, expanding the project from a "Critique of Taste" to a Critique of Judgment but he also made an "ethical" turn. This "ethical" turn was provoked by controversies in German philosophical and religious culture, in particular the writings of Johann Herder and the (...) Sturm und Drang movement in art and science, as well as the related pantheism controversy. Such topicality made the Third Critique pivotal in creating a "Kantian" movement in the 1790s, leading directly to German Idealism and Romanticism. The austerity and grandeur of Kant's philosophical writings sometimes make it hard to recognize them as the products of a historical individual situated in the particular constellation of his time and society. Here Kant emerges as a concrete historical figure struggling to preserve the achievements of cosmopolitan Aufkl-rung against challenges in natural science, religion, and politics in the late 1780s. al-Qurṭubī (d. 671/1273) was a scholar of tafsīr, ḥadīth and fiqh. He experienced both Western and Eastern civilizations in the geography of Andalusia and Egypt, respectively. In his famous Tafsīr called al-Jâmi li-Aḥkâm al-Qur’ān, al-Qurṭubī comparatively explained and interpreted all legal verses. Also, in addition to exploring the spesific legal rulings denoted in the Qur’ān and the Sunnah, al-Qurṭubī has largely interpreted the legal norms regarding the issues of jurisprudence. By doing this, al-Qurṭubī contributed to the formation and development of (...) a civil codification activity under a kazuistic format. The casuistic structure of the legal exegesis of the Qur’ān is anlaysed in terms of the form and content in the sample of al-Jâmi. Therefore, neither the similarity or similarity of the schools of the legal exegesis of Qur’ān and of the legal schools nor the disciplines of positive law, but their kazuistic structures, which systems they built and which interpretation methods and techniques they operated on this basis, were evaluated in terms of their original structure. In this direction, the article emphasizes that the casuistic structure of the legal exegesis of Qur’ān is established on and by the Prophet’s sayings and practices. Although, it has been observed that it is a unique tradition, both as form and content, and that the interpretation means are identified with its own unique structure, it has been concluded that the casuistic method is not one of the fundamental elements of both this tradition and Islamic legal thought. This means that the casuistic method is always a tool that can be changed and transformed according to the conditions of time and space.Summary: As it is stated in al-Isrāʾ 17/106: “And (it is) a Qur’ān which we have separated (by intervals) that you might recite it to the people over a prolonged period. And we have sent it down progressive.”, the Qur’ān is revelaed in about twenty-three years by taking into consideration the sociocultural positions of its interlocutors. The Prophet Muḥammad explained the Qur’ān by the virtue of the ayah: “(We sent them) with clear proofs and written ordinances. And We revealed to you the message (i.e. that you may make clear to the people what was sent down to them and that they might give thought.” (an-Naḥl 16/44). Of course, there is no subject integrity in this Qurānic chronology-which also reflects life. As a matter of fact, the issues related to individual and society have been independently analyzed by a casuistic/case-based method and ruled in accordance with the intention of Allāh. It can be seen that the ayahs “They ask you about wine and gambling. Say, ‘In them is great sin and (yet, some) benefit for people. But their sin is greater than their benefit.’ And they ask you what they should spend. Say, ‘The excess (beyond needs).’ Thus Allāh makes clear to you the verses (of revelation) that you might give thought.” (al-Baqara 2/219) and other ayahs such as (al-Baqara 2/186; al-Nisāʾ 4/176; al-Anfāl 8/1) reflect the casuistic method in terms of form and content. This can also be exemplified by the Sunna. For example, when the question “Is it permissible to perform ablutions with sea water?” was posed to Messenger of Allāh. He said that “It’s water is clean and his dead (fish) are lawful “(Abū Dāwūd, “Ṭaḥāra”, 41). By this answer, the Prophet Muḥammad indeed ruled and established a general rule.It can be said that this early example table formed the basis of the legal exegesis of the Qur’ān in terms of origin, source and application, and that its shape and content are often immanent in the examples it contains. In this article, based on the prophetic period, the legal exegesis of the Qur’ān and casuistic structure has been studied with an analytical and critical approach. Again, because the casuistic method is one of the universal concepts of east-west science and cultural life, an interdisciplinary approach was exhibited in this study. The roots of the casuistic method date back to 5000 BC and the legal systems of the society and states of antiquity are examined from this method. This method is chosen and used in the legal exegesis of the Qur’ān. However, this study does not analyse the sameness or the similarity of the legal exegesis of the Qur’ān and the legal schools nor the positive law disciplines, but the casuistic structures used by these, the systems they have built on this basis and the interpretation methods and techniques they have been used and analyzed in terms of their originality.In effect, the article embodies the Qur’ānic exegesis called al-Jâmi li-Aḥkâm al-Qur’ān by al-Qurṭubī (d. 671/1273), a scholar of tafsīr, ḥadīth and fiqh. In addition to the works of the aḥkām al-Qur’āns, which deal with the interpretation of the ayahs related to the subjects of ʿibādāt, muʿāmalāt ve ʿuḳūbāt, many other works have been used in parallel with the development of the legal exegesis of the Qur’ān. al-Qurṭubī, who comparingly explained the legal verses in his tafsīr, investigated the aspects of the Qur’ān and Sunna that indicate the aḥkām, generally interpreted the existing legal norms within the framework of evidence and introduced his own opinions and etasblished his ijtihād. Thus, he benefited from the tafsīr accumulation and contributed to the formation and development of a civil legalization activity with casuistic format. As a matter of fact, the casuistic/case-based method has been used as a codification/tadwīn technique by Western and Eastern legal disciplines and systems. The casuistic method covers both concrete event and abstract ruling methods. In the casuistic method, which is fact-based event, the laws are organized according to all possible events that can be experienced. On the other hand, the abstract method, which is defined as the abstract ruling method, aims to organize the laws in a general and abstract framework. In the article, it is stated that the legal exegesis of the Qur’ān contains both concrete and abstract dimensions in its own way. It has been emphasized that the legal exegesis of the Qur’ān is based on divine revelation (waḥy) and that it is separated from human law as its origin and source, and that this feature is its most faithful characteristic. On this basis, the legal exegesis of the Qur’ān is a separate scholarly tradition and has its own definition, subject and purpose. Its original structure and function have been noted. As a matter of fact, the subject and purpose of the legal exegesis of the Qur’ān always require the tafsīr and taʾwīl of the legal verses having regard to the Qur’ān and Sunna. It is also necessary for the purpose of investigating the ways in which nuṣūṣ (an explicit statement upon which a ruling is based) can refer to the provisions and to resolve the issues related to individuals and society. As a matter of fact, the legal verses function as a guide for humanity until the day of judgment as the inspiration for religious-legal matters; they contain the content and provisions that offer happiness in the two worlds. This paper defends three theses on the normativity of the suspension of judgment. First, even if beliefs have to fit the truth and disbelief the false, suspension can still have satisfiable fittingness conditions. Second, combining this view with specific theses on the link between fittingness and normative reasons in favour of attitudes commits one to the existence of reasons to suspend judgement, which are neither reasons to believe nor reasons to disbelieve. These independent reasons, in turn, generate a form of (...) epistemic permissivism. Finally, I argue that there are different routes to derive this commitment to independent reasons for suspending judgement. Not only fittingness-centred approaches to epistemic normativity but also many analyses in terms of reasons are committed to this form of epistemic permissivism. (shrink)
