In this paper, I take up the conciliatory-steadfast debate occurring within social epistemology in regards to the phenomenon of peer disagreement. I will argue, because the conciliatory perspective al-lows us to understand argumentation pragmatically—as a method of problem-solving within a community rather than as a method for obtaining the truth—that in most cases, we should not simply agree to disagree.

This paper deals with an important strand of nihilistic arguments to be found in the works of two philosophers who have so far never been studied comparatively: the sophist Gorgias and the Buddhist monk Nāgārjuna. After having reconstructed Gorgias' moves in the first section of On What is Not (Sections 1-4), the paper shows how the nihilist arguments Gorgias uses mostly feature, under a new light, in the philosophy of emptiness developed by Nāgārjuna (Sections 5-8). The paper ends with a (...) hermeneutical suggestion: that is, to replace traditional ‘sceptical’ interpretations of Gorgias and Nāgārjuna with an alternative one, which takes them as possibly committed to nihilism. A "slippery slope argument" is a type of argument in which a first step is taken and a series of inextricable consequences follow, ultimately leading to a disastrous outcome. Many textbooks on informal logic and critical thinking treat the slippery slope argument as a fallacy. Walton argues that used correctly in some cases, they can be a reasonable type of argument to shift a burden of proof in a critical discussion, while in other cases they are (...) used incorrectly. Walton identifies and analyzes four types of slippery slope argument. Walton presents guidelines that show how each type of slippery slope argument can be used correctly or incorrectly, using over fifty case studies of argumentation on controversial issues. Are counterfactuals with true antecedents and consequents automatically true? That is, is Conjunction Conditionalization: if (X & Y), then (X > Y) valid? Stalnaker and Lewis think so, but many others disagree. We note here that the extant arguments for Conjunction Conditionalization are unpersuasive, before presenting a family of more compelling arguments. These arguments rely on some standard theorems of the logic of counterfactuals as well as a plausible and popular semantic claim about certain semifactuals. Denying Conjunction Conditionalization, then, requires (...) rejecting other aspects of the standard logic of counterfactuals, or else our intuitive picture of semifactuals. (shrink)

Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of exclusion (...) that has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

This paper applies recent work on scripts and stories developed as tools of evidential reasoning in artificial intelligence to model the use of argument from analogy as a rhetorical device of persuasion. The example studied is Gerry Spence’s closing argument in the case of Silkwood v. Kerr-McGee Corporation, said to be the most persuasive closing argument ever used in an American trial. It is shown using this example how argument from analogy is based on a similarity (...) premise where similarity between two cases is modeled using the device of a story scheme from the hybrid theory of legal evidential reasoning (Bex in Arguments, stories and criminal evidence: a formal hybrid theory. Springer, Dordrecht 2011). It is shown how the rhetorical strategy of Spence’s argumentation in the closing argument interweaves argument from analogy with explanation through three levels. (shrink)

This paper uses argumentation tools such as argument diagrams and argumentation schemes to analyze four examples of argument from analogy, and argues that to proceed from there to evaluating these arguments, features of the context of dialogue need to be taken into account. The evidence drawn from these examples is taken to support a pragmatic approach to studying argument from analogy, meaning that identifying the logical form of the argument by building an argument diagram of (...) the premises and conclusion is not by itself sufficient for argument evaluation. To get further, it is argued, the argument evaluator needs to take into account how this particular argument was used in context to support a conversational goal.Cet article utilise des outils d'argumentation tels que des diagrammes d'argument et des schèmes d'argumentation pour analyser trois exemples d'argument par analogie, et soutient que pour évaluer ces arguments de manière adéquate, il est nécessaire de tenir compte du contexte d'utilisation de l'argument. Ces exemples suggèrent que l’étude des arguments par analogie à partir de seulement l’identification de leur forme logique n'est pas adéquate. Pour aller plus loin, on avance que l'analyste d'argument doit prendre en compte comment un argument particulier a été utilisé dans un contexte pour soutenir un but conversationnel. (shrink)

Anonymous argumentation has recently been the focus of public controversy: flash points include the outing of pseudonymous bloggers by newspapers and the launch of an academic journal that expressly permits pseudonymous authorship. However, the controversy is not just a recent one—similar debates took place in the nineteenth century over the then common practice of anonymous journalism. Amongst the arguments advanced by advocates of anonymous argumentation in either era is the contention that it is essential if the widest range of voices (...) are to be heard; amongst the counterarguments of its critics, that it weakens the credibility of individual arguments and irresponsibly cheapens the standard of public discourse. In this paper, a case study is conducted to test the capability of the Carneades Argumentation System to model the argumentation in a case where forensic evidence was collected in an investigation triggered by a conflict among art experts on the attribution of a painting to Leonardo da Vinci. A claim that a portrait of a young woman in a Renaissance dress could be attributed to da Vinci was initially dismissed by art experts. Forensic investigations were carried out, and evidence (...) was collected by art history experts and scientific experts. The expert opinions were initially in conflict, but new evidence shifted the burden of proof onto the side of the skeptics. This paper presents an analysis of the structure of the interlocking argumentation in the case using argument mapping tools to track the accumulation of evidence pro and con. (shrink)
