Environmental regulation in middle-income and developing countries is often viewed with high degrees of pessimism. Although many countries have adopted protective laws, violations are widespread and institutions are weak. This paper analyzes the puzzle of shifting patterns of environmental regulation in Argentina, a country with widespread institutional weakness. Most regulators in Argentina take a firefighting approach, acting only when skirmishes emerge between communities and firms. Amidst regulatory chaos, improvements in the environmental performance of firms are few, and noncompliance remains the (...) norm. However, in the province of Tucumán, the pattern of regulation shifted, and officials began to systematically enforce regulations. This paper traces shifts in patterns of enforcement back to broad pressures that provoked industry and environmentalists to support increases in the internal and external components of state regulatory capacity. The analysis uncovers political dynamics that can contribute to strengthening the institutions necessary for sustainable development. (shrink)

This book offers an original and detailed reading of Plato's _Republic_, one of the most influential philosophical works in the emergence of Western philosophy. The author discusses the _Republic_ in terms of discursive events and political acts. Plato's act is placed in the context of a politico-discursive crisis in Athens at the end of the fifth and the beginning of the fourth century B.C that gave rise to the dialogue's primary question, that of justice. The originality of Dr. Ophir (...) lies in the way he reconstructs the _Republic's_ different spatial settings - utopian, mythical, dramatic and discursive - using them as the main thread of his interpretation. Against the background of Plato's critique of the organisation of civic-space in the Greek _polis_, the author relates the spatial settings in the Plato text to each other. This provides a basis for a re-examination of the relationship between philosophy and politics, which Plato's work advocates, and which it actually enacted. (shrink)

Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be 'believed' by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the 'religious' affinities of the constitutional preambles. They were (...) held as 'creeds' of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents' big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the 'renaissance' of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law. The contemporary state is not only the main force behind environmental change, but the reactions to environmental problems have played a crucial role in the modernisation of the state apparatus, especially because of its mediatory role. The Political Ecology of the State is the first book to critically assess the philosophical basis of environmental statehood and regulation, addressing the emergence and evolution of environmental regulation from the early 20th Century to the more recent phase of ecological modernisation and the (...) neoliberalisation of nature. The state is understood as the result of permanent socionatural interactions and multiple forms of contestation, from a critical politico-ecological approach. This book examines the tension between pro- and anti-commons tendencies that have permeated the organisation and failures of the environmental responses put forward by the state. It provides a reinterpretation of the achievements and failures of mainstream environmental policies and regulation and offers a review of the mains philosophical influences behind different periods of environmental statehood and regulation. Besides “personalism“, and “solidarity“, the “principle of subsidiarity” is the third layer of Christian Social Philosophy. It requires that in a good society political competences should be allocated at the lowest possible level if possible. What the single citizens can achieve should not be taken away from them by higher ranking political authorities. The same rule has to be applied inside a political community among the various levels of the government. In other words, the principle favors Federalism (...) as the organizing structure of the social order.The most important political document in which the principle of subsidiarity plays an important role is the EU-Treaty of Maastricht. Here, however, the principle is misunderstood as a pure procedural process to settle conflicts between the European Commission and the Member States in areas of shared competences. Instead it should be a means to revise the whole existing legal structure of the European Union.Subsidiarity is a constitutional norm. Here, every person in a free society must be respected by the political authorities. This implies that in a civil society political power must be limited, decentralised, and controlled by the citizens.À côté du “personalisme” et de la “solidarité”, le “principe de subsidiarité” est le troisième volet de la philosophie sociale chrétienne. This article discusses views of leadership in the light of the financial crisis. Giving attention to views such as Plato and modern technocratic views, the paper is structured around a discussion of a specific organisation; Manchester: Knowledge Capital (M:KC), an organisation that seems to me to exemplify in practice the ideas about leadership that I am proposing as being a valuable way forward.

The paper aims at revealing the key legal and political factors that determined the organization and holding of the referendum on unconditional and urgent withdrawal of the former USSR army from the territory of the Republic of Lithuania and restitution of damage to Lithuania. It is established that the main factor was that the Supreme Council-Reconstituent Seimas of the Lithuanian Republic adopted provisions on the status of the occupation army and was constant in seeking to ensure (...) the sovereignty of the state of Lithuania throughout its territory. The position of the nations, parliaments and governments of the Republics of Estonia and Latvia was yet another circumstance that the organizers of the referendum relied upon. Their position was aimed at ensuring that as a result of negotiations, the foreign military forces return to dislocation places in its own territory. Retrospective view on the phenomena and facts of the state’s internal and foreign politics in 1991-1992 makes it impossible not to notice that negotiations with the USSR and later, with the Russian Federation, took place in a complicated political arena. While Lithuania was seeking dynamism in negotiations, the other party was finding various excuses to impede dynamic actions and thus to delay positive agreements. Taking due regard to the situation, it was believed that a decision adopted by the Nation would speed up the negotiations on foreign state’s armed forces. (shrink)

We set out by tracking the political vicissitudes of the administration of justice and their connections with a range of phenomena: the neglect by politicians; a series of events and scandals and the very curious reactions of the judicial apparatus; several parliamentary investigation commissions without much effect. Then we take a critical look at partisan politicisation of the magistrature: negative evalution of their output thrives to it; but there are also partisan appointments and promotions, even absence and refusal of (...) training. Many contextual factors hinder a normal, acceptable process of politicisation: over- and underregulation, bad legislation, misconception on contra! over the administration of justice and over judges, non-democratic decisionmaking within the organisation of the magistrature, the development of wrong relationship inside the trias politica; but also other more external conditions were not met neither. We wind up with an examination of the assesment of recent governmental proposals: an improvement of criminal and judicial inquiries; foundation of a national advisory body for the magistrature; simplification of the legislation; modernisation of the courts activities; a more objective recruitment and selection system; more easy access to justice etc. The question raises as to wether it suffices to tinker with the sy stem of the administration of justice alone... Between the Belgian and the Italian situations are similarities and relevant differences. (shrink)

In this article, I address the ways in which debates in liberal, Marxist and postmodernist social theory have remoulded readings of emancipation – and how these reformulations have affected the organisation of emancipatory struggles by and in political parties and social movements. I focus on three conceptual ambiguities that have spurred theoretical disputes and restructured organisational imaginations of emancipation: who might struggle for liberation, to what end and in which ways. In all three respects, understandings of emancipation have become (...) increasingly individualised, contingent and process-oriented – both in theory and in its political-organisational correspondents. As a consequence, effective collective struggles for autonomy may become ever more difficult to organise. While occurring in the name of further liberation, the ongoing reinterpretation of emancipation and its impact on the political organisation of emancipatory struggles might in the end hamper or even undermine the very liberation and autonomy they had aimed to promote. This article offers a new interpretation of the second ‘theological’ pattern in Plato’s Republic. Situating Plato within his religious context, it argues that this pattern calls into question the traditional ancient model of divine epiphany. Divine epiphany was a central element in Greek religion. Yet, in the absence of a centralized religious organization, this model threatened the philosophers’ authoritative position. Plato’s second pattern seeks not only to undermine this potential threat but also to pave the way towards a (...) new, philosophicalmodel of divine epiphany, thus further establishing the philosophers’ authority and legitimacy within and outside his ideal city. Introduction. The author analyzes the features of the ideological confrontation and conflict between Iranian emigrant communities and the political elites of the Islamic Republic of Iran. The position of Iranian emigration is analyzed in the context of the activity of the Pahlavi dynasty representatives. The purpose of the article is to analyze the ideo- logical confrontation between the two projects of Iranian political identities in contexts of criticism of the clerical regime of Iran by representatives of the (...) Iranian political emigration of Pahlavi dynasty. Methods. Methodologically, the article is based on the principles of analyzing intellectual communities with the elements of the universal method of his- toricism and a comparative approach, which make it possible to identify and systematize the main features of the process of ideological confrontation between the Iranian elites and their critics from the Iranian political monarchist emigration. Scientific novelty of the study. On the one hand, the article analyzes the ideological confrontation between the clerical political regime of Iran and its critics from the communities of monarchical emi- gration as a state of remote or delayed conflict. On the other hand, the author analyzes this ideological controversy as a conflict not between society and power, but between two versions of political power: if the Iranian regime controls the political discourse in the country in fact, then its monarchist oppo- nents in exile attribute to it symbolic legitimacy and continuity with the tradition of Iranian statehood. Results. The main directions and features of criticism of the regime of the Islamic Republic of Iran by Iranian political emigrants of a monarchist orientation are analyzed; features of political ideol- ogy are shown; the forecast of the development of the political activity of the Iranian emigration is presented. Conclusions. The author believes that 1) the mo- narchical Iranian emigration is one of the centers of attraction for emigrants from Iran in Western Europe and North America; 2) the ideologists and theorists of the monarchical emigration are consist- ent critics of the political regime established in Iran in 1979; 3) criticism of the clerical, anti-secular and undemocratic regime of Tehran, its accusations of violating human rights and freedoms in in the cen- tre of the political doctrine of the Iranian emigra- tion; 4) the political ideal of emigration is a secular and democratic Iran, where rights and freedoms are respected, and religious minorities have equal rights with the Shiite Iranian majority. “Imagine A rather short-sighted person told to read an inscription in small letters from some way off….' So begins the quest for “the real nature of justice and injustice” undertaken in response to the challenge of Glaucon and Adeimantus to show that “justice pays”. It is often alleged that the search leads through analogy to a monster “organic” state that lives by devouring individual rights. I believe that these charges are mistaken. Plato's political theory does not derive from an (...) analogy which makes the state a monster individual with interests superior to and independent of those of ordinary citizens; it derives rather from a doctrine of objective interests discernible by those with special training and ability, interests which later thinkers have taken to be the object of a “real will”, unerring even where a person's mere empirical desires are shortsightedly misdirected. Plato identifies the interests of his ideal state with the objective interests of its citizens , and in his harmonious world, metaphysics, moral psychology, and political organization combine to ensure that those interests need never override individual mundane interests for they never conflict: they coincide. That the whole theory is dubious should not prevent us from seeing that just what the theory is may be clarified by examining the arguments which putatively lead to it, and that those arguments provide grounds for not confounding Plato's theory with others which may reach similar conclusions about political organization and obligation. How can the world be improved if the people inhabiting it do not believe they can transform it? A belief in such political fatalism is an important obstacle to social transformation, yet underexplored in the contemporary political theory literature. Political fatalism can be understood as a commitment to the belief that human agency cannot effectuate social transformation. In this article, I provide a typology of such political fatalism, considering its two main forms: fatalism of inevitability as (...) the positive version that humans do not have the power to affect positive social change, and fatalism of impossibility as the negative version that human agency does not play a role in avoiding negative social change such as climate catastrophe. Focussing particularly on the more pressing contemporary problem of the fatalism of impossibility, I develop three distinct dimensions along which fatalism has an impact: the cognitive, the affective, and the practical. Finally, I offer solutions, focussing on how to combine interventions on the cognitive, affective, and practical levels: historically sensitive critique, imagination, and a combination of bounded spontaneism and long-term political organisation. In the article, international contacts of Soviet students and teachers of secondary schools at the regional level in the 1950-1970s are considered on the basis of the published literature and new archival sources. In the context of the formation of the socialist community, relations between the USSR and East Germany were regarded as exemplary. Their high importance was determined by the role of the German question in world politics. Socio-economic and cultural rapprochement between the USSR and the GDR over a (...) large period of time formed international cooperation at the local level. Particular attention in the article is paid to advantageous practices of creating special schools, and international friendship clubs in the southern Urals. It is proved that the development of educational relations was conditioned by focusing extracurricular activities of the Soviet school on international education, the availability of highly qualified, enthusiastic organizers of higher education and creative teachers of the German language, with regional connections of the Russian-German friendship. The author noted that the close friendship linking the international students of the Southern Urals and the GDR was considered in the USSR as a part of traditional ideological and moral education. Foreign correspondence and practical cooperation, such as the organization of short-term assignments and trainings for teachers, guided tours for students, joint vacations in summer camps, spiritually enriched students and motivated them to improve their own language skills. Arguing from a basis in liberal-republican principles, this expanded conception of the economic structure of society contextualizes the market to make its transactions fair. The author shows that a property-owning democracy structures economic incentives such that the domination of one agent by another in the market is (...) structurally impossible. The result is a renovated form of capitalism in which the free market is no longer a threat to social democratic values, but is potentially convergent with them. It is argued that a property-owning democracy has advantages that give it priority over rival forms of social organization such as welfare state capitalism and market socialist institutions. The book also addresses the currently high levels of inequality in the societies of the developed West to suggest a range of policies that target the "New Inequality" of our times. For this reason, the work engages not only with political philosophers such as John Rawls, Philip Pettit and John Tomasi, but also with the work of economists and historians such as Anthony B. The aim of this study is to investigate the necessity of revising the Ethics Code of the Psychology and Counseling Organization of the Islamic Republic of Iran with respect to people’s rights and dignity and to avoid unfair discriminations toward sexual orientation and gender identity. It is said that confused diagnoses; wrong decision making; unethical practice; and the subsequent harm caused to lesbian, gay, bisexual, and transgender clients result from the lack of a clear code and relevant guidelines. In addition, certain conditions in Iran lead professional psychologists and researchers to avoid researching sexual minorities and gender identity, which negatively impacts the Ethics Code of the PCOIRI. Iranian and Western researchers have identified four primary sources to which psychologists and counselors can refer when faced with ethical dilemmas: developmental psychology, professional ethics codes, philosophy of psychology literature, and available researches and compilations on professional ethics. Finally it is suggested that, when dealing with homosexual clients and the related ethical dilemmas, Iranian psychologists and counselors need clear and specific guidelines and a professional ethics code developed from more appropriate reference points than legal and religious sources. A new reading of Plato’s political thought Plato famously defends the rule of knowledge. Knowledge, for him, is of the good. But what is rule? In this study, Melissa Lane reveals how political office and rule were woven together in Greek vocabulary and practices that both connected and distinguished between rule in general and office as a constitutionally limited kind of rule in particular. In doing so, Lane shows Plato to have been deeply concerned with the roles and (...) relationships between rulers and ruled. Adopting a longstanding Greek expectation that a ruler should serve the good of the ruled, Plato’s major political dialogues—the Republic, the Statesman, and Laws—explore how different kinds of rule might best serve that good. With this book, Lane offers the first account of the clearly marked vocabulary of offices at the heart of all three of these dialogues, explaining how such offices fit within the broader organization and theorizing of rule. Lane argues that taking Plato’s interest in rule and office seriously reveals tyranny as ultimately a kind of anarchy, lacking the order as well as the purpose of rule. When we think of tyranny in this way, we see how Plato invokes rule and office as underpinning freedom and friendship as political values, and how Greek slavery shaped Plato’s account of freedom. Reading Plato both in the Greek context and in dialogue with contemporary thinkers, Lane argues that rule and office belong at the center of Platonic, Greek, and contemporary political thought. Leviathan-Toth, Ernesto Neto’s anti/counter-installation which could be seen hanging from the vaults of the Panthéon in autumn 2006 does not seek to exploit this national memorial as a space in which to stand as an exhibition. It responds to all of its surrounding factors – physical, aesthetic, political, and metaphysical, to attack the representative art whose constitutive-constitutional role in the republic, according to Hobbes, can be seen in Leviathan’s frontispiece. Setting up a sort of Critique et Clinique of (...) Representation in all senses of the term beginning with the short-circuit between politics and aesthetics, Neto’s operation sets its sights on the expansive dis-organisation of the multitude living under the « democratic » regime of contractual representation of which the Panthéon is the temple. It provides a body for the rhizomatic-bioenergetic perversion of the Image of the State-Machine, of the Form-State, by projecting a new infra and supra-organic type of reality which draws its « energy » from the forces of the multitudo dissoluta whose radical and vital recomposition it advocates. This work or non-work, derived from a Brazilian political-aesthetic constructivism which is undergoing redefinition, can now only take place in the context of a practice of displacement which incorporates and is constituted of the spectator-participant. The originality of Foucault’s work lies in part in how he reverses the question of power, asking not how power is held and imposed, but how it is produced. In both his discussion of sovereignty and governmentality, though, Foucault skips over the res publica; a form of political organization that fits neither Foucault’s characterization of sovereignty nor the care of the self. I extend Foucault’s discussion to identify a ratio of government around the discipline of ownership by which (...) the res publica was made intelligible, its relations understood, and its logic organized. I end by suggesting some implications for neo-Roman interpretations of liberty as non-domination. (shrink)

One of the possible interpretations for the esteem Arendt had for the res publica makes us think of a form of government which is potentially capable of stimulate citizens to the exercise of public liberty. This form of government, based on a system of councils, constitutes, according to Arendt, the “real” republic which, although born from inside one of the branches of the revolutionary tradition, was destroyed by the State bureaucracy as well as by party apparatuses. In this paper, I argue that in the Republic Plato justifies the political authority of the guardians in light of the principle of partnership — a principle which fits coherently with other Platonic principles which undergird his political theory, including optimum functionality, social justice and power. Therefore, I argue that, by their respective professions, there is a cooperative interaction between the guardians and the producers as partners within the political structure of the ideal polis towards attaining (...) the eudaemonistic goals of both the individual and the polis. I contrast this with the orthodox interpretation that Plato justifies political authority using the idea of the Good — an interpretation which holds that since the citizens cannot grasp the Good, they assume an insignificant political position, including the allegations that they are cogs, slaves, morally obtuse, and politically inept. In this paper I work through an Antipodean phenomenon; the prevalence of copying or mimesis in processes of organising. Rejecting claims for a more authentically Antipodean way of organising, I argue that we need to properly understand the weight of the copy through philosophical inquiry into mimesis. I begin this inquiry with neo-institutional theoretical insights into mimesis. I then sketch out a short history of the emergence of the original and the copy. This Platonic distinction is then elaborated upon to (...) open up the copy with reference to Nietzsche’s concept of the eternal return, Benjamin’s analysis of the work of art in the age of mechanical reproduction, and Taussig’s analysis of mimesis. Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, (...) such discontinuities fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. Jurisprudence is the prudence of jus, law's consciousness and conscience. Throughout history, when thinkers wanted to contemplate the organisation of society or the relationship between authority and the subject, they turned to law. All great philosophers, from Plato to Hobbes, Kant, Hegel, Marx and Weber had either studied the law or had a deep understanding of legal operations. But jurisprudence is also the conscience of law, the exploration of law's justice and of an ideal law or equity at the bar (...) of which state law is always judged. Jurisprudence brings together 'is' and 'ought', the positive and the normative, law and justice. But after a long process of decay, legal theory is today characterised by cognitive and moral poverty. Jurisprudence has become restricted and academically peripheral, a guidebook to technocratic legalism and a legitimation of the existent. Critical jurisprudence returns to the classical tradition of a general philosophy of law and adopts a much wider concept of legality. It is concerned both with posited law and with the law of the law. All legal aspects of the economic, political, emotional and physical modes of production and reproduction of society are part of critical jurisprudence. This widening of scope allows a radical rethinking of the nature of rights, justice, sovereignty and judgement. A political philosophy of justice today must examine the political economy of law; transitions from Empire to nation; ideological and imaginary constructions through which we understand ourselves and relate to others; ways in which gender, race or sexuality create forms of identity that both discipline bodies and offer sites of resistance. Law's complicity with political oppression, violence and racism has to be faced before it is possible to speak of a new beginning for legal thought, which in turn is the necessary precondition for a theory of justice. Critical Jurisprudence offers an ethics of law against the nihilism of power and an aesthetics of existence for the melancholic lawyer. (shrink)

The organisational activity of Gottfried Wilhelm Leibniz fits squarely with the transformations in science and research that took place in the seventeenth-century Europe with the inspiration of the model presented by Francis Bacon in New Atlantis (Bacon 1626). This paper is an attempt to assess Leibniz’s efforts aimed at building a new enlightened society within the structures of the Holy Roman Empire of the German Nation. The philosopher’s reformatory projects also had an internationalist dimension for Leibniz saw science as an (...) area free of any political or societal boundaries. Leibniz’s activity in this field should be analysed not only in the context of social and civilisational changes taking place in Europe in the late seventeenth and the early eighteenth century but also take into account a wide spectrum of the philosopher’s research activities and his numerous contributions to diverse fields of knowledge, the value and significance of which could only be appreciated by later generations. While political blackness seems to be making quite a comeback, this resurgence has also met with frustration and ambivalence. This paper aims to make sense of why this mobilising concept is accepted in some contemporary black feminist circles and outright rejected in others. It unpicks the diasporic dimensions of political blackness, reflecting on the issues that converged to foreground ‘black’ as the basis for mobilising women of African and Asian decent to engage in collective activism. Attention is given (...) to the Organisation of Women of Asian and African Descent, a national network that linked black women's organisations and expressed and projected what the author defines as gendered political blackness. Interrogating its implications and the tendency towards ideological policing, the author argues that political blackness must be viewed as a politics of solidarity. If it is to maintain its viability, political blackness needs reframing, contextualising and further analysis. A retelling of its ideological underpinnings, and crucially the tensions and contradictions inherent in political blackness, offers a critical lens through which to rethink how we use it as a mobilising tactic in the present. Michael Wendeler’s disputation on the Turkish republic is a discussion of Ottoman history, political philosophy, and the concept of monarchy and tyranny. Half of his disputation concerns the identification of the Turks with the little horn which arises on the head of the fourth beast in the prophet’s vision described in the Book of Daniel 7:1–28. Giving copious historical references, Wendeler explains that this little horn cannot be referring to Christ as the Jews believe, nor to the Seleucid (...) monarch Antiochos Epiphanes as the Calvinists believe. Nor can it be identifed with the Antichrist as the Catholics believe. Wendeler puts forth a detailed argument that the little horn on the fourth beast in the prophecy of Daniel can only be identified with the Turkish monarch (Ottoman Sultan). In conclusion, Wendeler draws a parallel between the monstrous ‘little horn’—the tyrannical Turkish monarchy—and the tyranny of the Catholic Church, exemplified by the untrustworthy Pope and the satanic writings of the Catholic Machiavelli. The movement for ‘military preparedness’ in America and Britain gained tremendous momentum at the turn of the century. It assimilated the cult of manliness — the key public virtue, which allowed a person to claim possession of himself and a nation to reclaim possession of itself. An army was the means of marshalling a mass of people for regeneration. The symbol of a nation's preparedness to take control of its own soul was the readiness to bear arms. Although this movement (...) originated in the middle-class, Protestant cultures of the USA and England, its core ideas were adopted by many political movements. Affected by these ideas, as well as the formation of the Protestant Ulster Volunteers in 1913, a movement to reclaim Irish independence through the mass bearing of arms began in South and West Ireland in autumn 1914. Women were excluded from these Volunteer companies, but set up their own organization, Cumann na mBan, as an auxiliary to the men's. The Easter Rising in 1916 owed as much to older ideas of the coup d'état as new ideas of mass mobilization, but subsequent history recreated that Rising as the ‘founding’ moment of the Irish republic. It was not until mass conscription was threatened two years later that the mass of people were absorbed into the idea of an armed campaign against British rule. From 1919 to 1923, the reality of guerrilla-style war pressed people into a frame demanding discipline, secrecy, loyalty and a readiness to act as the prime nationalist virtues. The ideal form of relationship in war is the brotherhood, both as actuality and potent myth. The mythology of brotherhood creates its own myths of women (as not being there, and men not needing them) as well as creating the fear and the myth that rape is the inevitable expression of brotherhoods in action. Despite explicit anxiety at the time about the rape of Irish women by British soldiers, no evidence was found of mass rape, and that fear has disappeared into oblivion, throwing up important questions as to when rape is a weapon of war. The decade of war worsened the relationship of women to the political realm. Despite active involvement as ‘auxiliaries’ women's political status was permanently damaged by their exclusion as warriors and brothers, so much so that they disappear into the status of wives and mothers in the 1937 Irish Constitution. The article defines the nature of the Russian war against Ukraine in the context of social and state transformations of the 20th — 21st centuries. It is emphasized that this is a war of different worlds, mentalities, worldviews, ways of life, values, etc., which has been going on for many centuries in various forms (direct and mediated, open and veiled, hot and cold). The role of the religious-legal factor in the Russian war against Ukraine at various stages of Ukrainian state (...) formation (periods of the Ukrainian People’s Republic, Soviet, modern) is revealed. It is emphasized that it was during the time of the Ukrainian People’s Republic that the legal basis for the organization of the Ukrainian Local Orthodox Church, confessional differentiation and the establishment of freedom of conscience and interconfessional tolerance in Ukrainian society was created. Emphasized attention is paid to the fact that in the Soviet period, the Russian war against Ukraine continued in a new, veiled, hidden, invisible (at first glance) form with the active use of the religious factor. The results of this period have been determined, namely: rampant militant/ scientific atheism, radical extermination, Russification of Ukrainian Orthodoxy, liquidation of the Ukrainian Autocephalous Orthodox Church and the Ukrainian Greek Catholic Church, etc. Special attention is paid to the Soviet secular/political religion (Marxism-Leninism) as a key basis for the implementation of an aggressive policy regarding the historical memory and cultural identity of the Ukrainian people and a manipulative tool for the destruction of Ukrainian history, culture, worldview, nation, state and law in the information, hybrid, total, full-scale and other Russia’s wars against Ukraine. The article substantiates that improved legislation with an effective legal mechanism for its implementation, a strong civil society with developed institutions, including the institution of religion (church), adequate guarantees of religious rights and freedoms are important factors in ensuring state, national, religious security and victory of Ukraine (at the current stage) in the war waged against it by the Russian Federation. In his philosophical works Cicero addresses a number of questions concerning the role of old men in politics, most obviously in his dialogue De senectute of 44 BCE. How best should the old participate in politics and the wider community—what, if anything, do the old have to offer that is special or unique? How should the generations fit together in the body politic, and should age be a factor in the structural organisation of states? Should the old rule? This chapter (...) makes the following argument: (1) in De senectute Cicero develops a coherent line on the special political role of old men within the constitutional framework set out in his earlier De re publica, which can be seen as a call to arms in the contemporary Roman political context; and (2) this line is not just a restatement of traditional republican ideals: in a similar vein to what we see in De re publica, Cicero draws on and adapts some of the most important arguments from Plato’s Republic when addressing these questions regarding the role of old men in politics. Early in Plato’s Republic, two cities are depicted, one healthy and one with “a fever”—the so- called luxurious city. The operative difference between these two cities is that the citizens of the latter “have surrendered themselves to the endless acquisition of money and have overstepped the limit of their necessities” (373d).i The luxury of this latter city requires the seizure of neighboring lands and consequently a standing army to defend those lands and the city’s wealth. According to the main (...) character, Socrates, war thus finds its origin in communities living beyond the natural limits of necessity. In short, the healthy or true city is sustainable, limiting its consumption to actual needs, while the luxurious city seems not to be sustainable, living beyond its needs in a perpetual quest for more. Plato spends the rest of the Republic in the attempt to reveal the political organization and virtues—in particular, the virtue of moderation—necessary for the luxurious city to be just, healthy and thereby sustainable. The contrasting images of the two cities and Plato’s subsequent discussion raise important questions about the interrelations between justice, consumption and sustainability. In this paper we appropriate Plato’s images of these metaphorical cities to discuss over-consumption and unsustainable practices by the nations of the contemporary “first world”, which in turn perpetuate poverty and environmental degradation in the nations of the “two-thirds world”. Matters of equity and justice are preeminent in our discussion. (shrink)

This article examines the treatment of Armenians by the late Ottoman and Turkish republican state with a special focus on the social and political roles of the Armenian clergy, especially the patriarch. After giving a brief account of the historical evolution of the millet system – the principles and practices applied by the Ottoman state in its treatments of non-Muslims – the article tries to understand whether the new regime kept it or adopted a modern approach during the transition (...) from empire to nation-state. It concludes that the republican state has created a deliberate inconsistency in its treatment of the Armenian community and patriarch. Although it has avoided recognizing them as a group and their group’s rights it continuously discriminated against them because of their group identity. The republican state has tried to downgrade the patriarch to a mere religious figure without any social or political role which is defined de jure. However, it has continued to accept him as de facto leader of the Armenian community on some occasions. (shrink)

This fresh examination of the works of Montesquieu seeks to understand the shortcomings of the modern democratic state in light of this great political thinker’s insightful critique of commercial republicanism. The western democracies’ muted response to victory in the Cold War signaled the presence of a pervasive discontent, a sense that despite this victory liberal democracy itself was deeply flawed. Paul A. Rahe argues that to understand this phenomenon we must re-examine—starting with Montesquieu—the nature of liberal democracy, its character, (...) and its propensities. In a brilliant exposition of the works of Montesquieu Rahe identifies the profound sense of uneasiness fostered by the modern republic as a source of weakness and as the principal cause of the present discontents. This article turns to the issue of political representation that I argue is central to all forms of political thought and practice of the modern period. Taking political representation as its object, I argue that its crisis—that comes to a head in the travails of the Weimar Republic—provided the opportunity for forms of neoliberal representation to displace political representation with purportedly “neutral”, non-partisan and thus “fair” representational tools. In contrast, I seek to develop the idea (...) of “self-representation” with a discussion of paths not chosen at Weimar and via Italianoperaismo’s reflections on “class composition”, which combines collective self-representation with political organization. Representing each member of a collective to another as it develops epistemic and cartographic tools, it constructs group solidarity, organization and the capacity to act as it reclaims the collectivity alienated in modern political forms of representation and excluded from neoliberal ones. Julia Ward Howe, author of the lyrics to “The Battle Hymn of the Republic,” remains known as a poet, abolitionist, and founding member of the antiracist organization American Woman Suffrage Association, but her work on political philosophy and her foundational sense of the necessity for justice and suffrage for all without exception are still unexplored. Howe's speech, “The Position of Women in Plato's Republic” provides a window into the philosophy that shaped the second half of her (...) life and her political organizing. Howe explores problems feminist scholars have often had with Socrates's plans to educate and enfranchise women of the ruling class, analyzes the rhetoric behind Socrates's successful persuasion of reluctant interlocutors, and transforms Plato's arguments into overwhelming rhetorical support for universal suffrage. Howe's intellectual conversion to the cause of suffrage, which occurred later in life and after her support for the 15th Amendment, comes into focus as she wrestles with the questions fundamental to her change of heart: women's moral relationship to human excellence, whether suffrage would destabilize family life, the relationship of gender to divine genderless unity, and the relationship of the Platonic principle of the Good to practical political policy. The promotion of conservation agriculture for smallholders in sub-Saharan Africa is subject to ongoing scholarly and public debate regarding the evidence-base and the agenda-setting power of involved stakeholders. We undertake a political analysis of CA in Zambia that combines a qualitative case study of a flagship CA initiative with a quantitative analysis of a nationally representative dataset on agricultural practices. This analysis moves from an investigation of the knowledge politics to a study of how the political agendas of (...) the actors involved are shaping agrarian practices. From its initial focus on CA as soil conservation and sustainable agriculture, the framing of the initiative has evolved to accommodate shifting trends in the policy arena. In tandem with the increased focus on climate adaptation, we see an increased emphasis on private sector-led modernisation. The initiative has shifted its target group from the poorest smallholders to prospective commercial farmers, and has forged connections between its farmer-to-farmer extension network and private input suppliers and service providers. The link between CA and input intensification is reflected in national statistics as a significantly higher usage of herbicides, pesticides and mineral fertilizer on fields under CA tillage compared to other fields. We argue that the environmental and participation agendas are used to buttress CA as an environmentally and socially sustainable agricultural development strategy, while the prevailing practice is the result of a common vision for a private sector-led agricultural development shared between the implementing organisation, the donor and international organisations promoting a new green revolution in Africa.
