Continued scientific and medical progress in Central and Eastern Europe depends on the development of an atmosphere that is conducive to implementing the changes that are necessary to bring better health and longer lives for everyone. Privatization and commercialization are threatening the objectivity of clinical research and the availability of health care because uncontrolled market mechanisms focused on profit are nurturing conflict of interest that generate bias and unreliability into research and medicine. Changes are needed that address the following: – (...) The amount of public support for basic and clinical research and health care, – standards for the conduct of clinical trials and delivery of health care, – administrative procedures for responding to the conflict of interest problem. We report the identification of a recurrent, 520-kb 16p12.1 microdeletion associated with childhood developmental delay. The microdeletion was detected in 20 of 11,873 cases compared with 2 of 8,540 controls and replicated in a second series of 22 of 9,254 cases compared with 6 of 6,299 controls. Most deletions were inherited, with carrier parents likely to manifest neuropsychiatric phenotypes compared to non-carrier parents. Probands were more likely to carry an additional large copy-number variant when compared to matched controls. The clinical (...) features of individuals with two mutations were distinct from and/or more severe than those of individuals carrying only the co-occurring mutation. Our data support a two-hit model in which the 16p12.1 microdeletion both predisposes to neuropsychiatric phenotypes as a single event and exacerbates neurodevelopmental phenotypes in association with other large deletions or duplications. Analysis of other microdeletions with variable expressivity indicates that this two-hit model might be more generally applicable to neuropsychiatric disease. © 2010 Nature America, Inc. La segunda parte analiza la evoluciónde la democracia y de la justicia social durante el proceso de integración. The contemporary sociology of morality is a form of descriptive ethics that shrinks away from any sort of prescriptive ethics. Building on the moral philosophies of John Dewey, and also of Alasdair MacIntyre and Paul Ricoeur, and in dialogue with recent work by Stefan Bargheer, this article proposes a more ambitious program of critical social ethics that connects concerns with character and the common good but tempers them with attention to alienation and oppression.

END OF MODERNITY, TWILIGHT OF ART. GIANNI VATTIMO AND HIS PHILOSOPHICAL PATHS This essay is an introduction to Vattimo’s book “The end of modernity” — the collection of thesis about the relation between modernity and post-modernity discourses. Aim of that essay is to put that relation in a context of reflection over a crucial revision about the cultural values status in late modernity. Nowadays, as Vattimo claims, “Twilight of art” comes closer asymptotical to metaphysical discourse and communication process in technological-determined (...) world. Therefore, “the end” of modernity, or so-called “postmodernism” is a spatiotemporal, limitless, in a state of flux, boundless communication structure between peoples, values, tradition and progress, structure that makes a necessity from idea of consensus. ABSTRACT This text aims to reflect on why speech genres are relevant to variation studies, especially for third wave studies, whose central issue is the notion of style. Through bibliographic research, we examine part of the literature of the third wave of variation studies and part of the literature of the Bakhtinian approach, focusing on the notion of style, to (i) highlight some connections between these approaches and to (ii) articulate them, in some other points. The results of this reflection (...) indicate that speech genres are relevant to the interests of third wave studies because (i) linguistic style is a property of speech genres, upgradeable due to the aesthetic finalizations they receive; and (ii) an understanding of style requires an understanding of the (social and formal) constitution of the genres, in which categories of analysis that are of interest to the third wave of variation studies are indicated. BackgroundExpanded access is the use of investigational drugs (IDs) outside of clinical trials. Generally it is performed in patients with serious and life-threatening diseases who cannot be treated satisfactorily with authorized drugs. Legal regulations of expanded access to IDs have been introduced among others in the USA, the European Union (EU), Canada and Australia. In addition, in the USA an alternative to expanded access is treatment under the Right-to-Try law. However, the treatment use of IDs is inherently associated with a (...) number of ethically relevant problems.Main textThe objective of this article is to present a coherent framework made up of eight requirements which have to be met for any treatment use of an ID to be ethical. These include a justified need for the use of an ID, no threat to clinical development of the ID, adequate scientific evidence to support the treatment, patient’s benefit as the primary goal of the use of an ID, informed decision of a patient, fair access of patients to IDs, independent review, as well as the dissemination of treatment results.ConclusionsWhile this framework is essentially consistent with the legal regulations of expanded access of the USA, the EU, Canada and Australia, it is substantially wider in scope because it addresses some important issues that are not covered by the regulations. Overall, the framework that we developed minimizes the risks and threats, and maximizes potential benefits to each of the four key stakeholders involved in the treatment use of IDs including patients, doctors, drug manufacturers, and society at large. The technological advances of the 20th century resulted in the creation of the Internet and its introduction into everyday life on a global scale. The Internet provides access to information and the sale and purchase of goods. Medications are also subject to trade. Their sale is conducted by online pharmacies and their global turnover amounts to hundreds of billions of dollars. Medications ordered over the Internet are sent by mail all over the world. Considering the events of recent years, we (...) cannot exclude the risk of a terrorist attack through online pharmacies. Terrorists can establish such companies, legally or illegally, or acquire ones already existing. Parcels, which are highly trusted by the customers of online pharmacies, can, for example, be contaminated with dangerous materials. The sale of online medications in the international system is potentially dangerous and requires international regulation. (shrink)

En esta contribución se analizan dos grandes períodos de la obra intelectual de Pietro Barcellona. El primero se corresponde con sus originarias reflexiones sobre los distintos usos del derecho, en el sentido de la transformación-adecuación de las instituciones y del ordenamiento jurídico italiano de la postguerra con los principios de la Constitución de 1948. De este primer período hay que destacar sus investigaciones sobre el uso alternativo del derecho y de los lazos de funcionalidad existentes entre el Estado, la economía (...) y el derecho. En el segundo período, se analiza el tránsito del pensamiento barcelloniano hacia las cuestiones que deben enriquecer un concepto de democracia plena de sentido para un individuo cada vez más alienado, sometido a la lógica de lo económico y, por tanto, menos libre y autónomo. Barcellona afronta esta última cuestión analizando los fundamentos de la Modernidad, para comprender principalmente dos cosas: a) el destino del individuo en esta fase de la sociedad occidental, y b) saber cómo ha logrado la burguesía, a través de qué principios y formas, consolidar y reproducir su hegemonía social en la sociedad moderna. En esta etapa el siguiente trabajo se centra, en primer lugar, en su teoría del individualismo propietario y en la crítica al "derecho igual", para después, en un segundo momento, plantear sus propuestas acerca de la política y de la democracia como forma de vida. Todo el análisis de la obra de Barcellona, considerada por los autores del siguiente ensayo, como fundamental para entender diversos aspectos jurídico-políticos de las sociedades post-industriales, ha sido desarrollado respetando el orden cronológico de la producción intelectual de Barcellona a lo largo de los dos períodos tratados. Several logical puzzles, riddles and problems are defined based on the notion of games in informative contexts. Hintikka argues that epistemology or the theory of knowledge must be considered from the notion of information. So, knowledge cannot just be based on the notions of belief and justification. The present proposal will focus on the logical structure of information, and not only on the quantification of information as suggested by Claude A. Shannon. In many cases, the information bits, although seemingly or (...) factually contradictory, are quite relevant. The paraconsistent systems of logic offer a formalization of reasoning that can support certain contradictions. The well-known “Bar-Hillel–Carnap Paradox” causes embarrassment when it concludes that the informational content of a contradiction would be maximum, opposing the traditional notion that the semantic information must be true, and that contradictions are necessarily false. In the light of a vast political information ‘buffet’, so-called news-avoiders stay away from the news for indefinite periods of time. Recent research suggests that news avoidance can be intentional or unintentional. However, research has mostly focused on one form of news avoidance or has not differentiated at all. Based on survey data, this study (a) identifies and compares motivations for intentional and unintentional avoidance and (b) investigates drivers of different news avoidance motives. Findings suggest that, overall, avoidance is rooted (...) in the preference for other pastimes, with intentional avoiders also being tired of news and seeing it as too negative, biased, and unreliable. Further, different motives are driven by specific characteristics: Political knowledge and internal efficacy relate to ‘cognitive’ motives, empathy, and being negativity-prone to ‘emotional’ motives, while external efficacy relates to ‘political’ motives. La aprobación en junio de 2008 por el Parlamento Europeo de la Directiva de retorno —denominada también Directiva de la infamia o Directiva de expulsión— consolida el proceso de involución que sobre los derechos humanos se viene produciendo en la Unión Europea desde que el miedo a la inmigración irregular se incardinó en sus instituciones. Si bien las legislaciones de extranjería de los años ochenta contenían normas que regulaban el internamiento y la expulsión no es hasta la Directiva 2001/40/CE que (...) comienza a tomar forma una política comunitaria centrada en la inmigración irregular y las expulsiones de migrantes. Las medidas de retorno son, dice la Comisión europea, “una piedra angular de la política de migración de la UE”. Desde entonces, la barbarie de los centros de retención e internamiento, el socavamiento de los derechos y la exclusión y criminalización de los migrantes extranjeros se han convertido en el caballo de batalla de las asociaciones defensoras de los derechos humanos. La erosión que las legislaciones y medidas de expulsión están provocado en los derechos y libertades y en las instituciones del Estado de derecho es inmensa. El retroceso y la erosión en los derechos y libertades es tan grande que ya no es posible continuar hablando sin más de Estados de derecho en la UE, sino más bien de máquinas administrativas para el internamiento y la expulsión, de “Estados expulsores” (1), donde las personas extranjeras son tratadas como semipersonas (2) e incluso como “no-personas” (3). What is the relationship between natural science, social science, and religion? The dominant paradigm in contemporary social science is scientism, the attempt to apply the methods of natural science to the study of society. However, scientism is problematic: it rests on a conception of natural science that cannot be sustained. Natural scientific understanding emerges from an instrumental and objectifying relation to the world; it is oriented toward control and manipulation of the physical world. Social‐scientific understanding, by contrast, must begin with (...) a practical and meaningful relation to the world: it is oriented toward the mediation of values and objective possibilities in the social world. Social science is therefore a form of practical reason based on objective claims. But while social‐scientific understanding starts with interpretation, its possibilities by no means end there. In particular, by developing abstract and objectified models of society as a system, social science opens existing social organization to critical reflection. Religion, by contrast, is a form of speculative reason about ultimate values, based on subjective claims of religious experience. Social science nevertheless shares with religion an orientation toward values and concern with the “good life.”. (shrink)

Traffic research shares a fundamental dilemma with other areas of empirical research in which humans are potentially put at risk. Research is justified because it can improve safety in the long run. Nevertheless, people can be harmed in the research situation. Hence, we need to balance short-term risks against long-term safety improvements, much as in other areas of research with human subjects. In this paper we focus on ethical issues that arise when human beings are directly affected in the performance (...) of research by examining how the ethical requirements in biomedical research can inform traffic research. After introducing the basic ethical requirements on biomedical research, each of the major requirements is discussed in relation to traffic research. We identify the main areas where biomedical research and traffic research differ, and where the ethical requirements from the former cannot easily be transferred to the latter. Finally, we argue that there is a need for systematic studies of the ethics of traffic research and point to some of the issues that need to be addressed. (shrink)

Background: The development of the COVID-19 pandemic has prompted the implementation of many procedures to safeguard against further increases in illness. Unfortunately, this has drastically reduced residents’ contact with their families, which has increased feelings of loneliness and isolation. This is particularly difficult in long-term care facilities, where the risk of developing depression is higher than in the general population.Objectives: The aim of the study was to assess the risk of depression among the residents of long-term care institutions in Poland (...) during the COVID-19 pandemic and to determine the relationship between the risk of depression and the occurrence of cognitive impairment in the study group.Methods: The study included 273 residents from long-term care institutions in Poland. The risk of depression was determined based on an originally designed questionnaire. The cognitive state of the subjects was assessed using the screening test Mini-Mental State Examination. Both the depression risk assessment and the MMSE test were conducted twice: in March and December 2020.Results: In March, severe dementia was present in 28.2% of the residents and normal MMSE scores were observed in 16.1% of the subjects; in December, the prevalence of severe dementia increased to 31.1% and that of normal scores decreased to 10.3%. In March, no participant was found to be at high risk of depression and moderate risk was observed in 14.3% of the subjects; in December, 2.6% of the residents had a high risk score and 45.4% had a moderate risk score. Statistical analysis revealed that higher MMSE scores correspond with a higher risk of depression.Conclusion: A higher risk of depression was observed with the development of the pandemic. Residents with cognitive impairment were characterised by a lower risk of depression compared to individuals with normal MMSE scores. During the study, progression of cognitive impairment was observed in the residents. (shrink)

The essay attempts to outline the historical ideological ties between Spain and its former Latin American colonies, with the main accent on the period following Spain’s and most of Latin America’s conversion to democracy in the wake of the fall of the Franco regime and other Latin-American military dictatorships. The author offers a detailed analysis, focusing especially on the democratic, decidedly pro-European and left-liberal government in Spain and its impact on Latin America, most of which today shows clear leftist tendencies. José Ortega y Gasset not only expressed his views on subjects such as art or mass culture but he was also one of the promoters and founders of a United Europe which he considered a cultural unity. However, his view on the proper functioning of multicultural societies was as skeptical as his attitude towards the possibility of constructing an unified world that could be based on cultural coexistence of the Western World societies. This essay is an introduction and summary of (...) my detailed study under preparation on the idea of Europe in contemporary Spanish thought. An historical interpretation of Spanish civilization from its earliest beginnings to the present time is presented in the article. I undertake the problem of Spain’s European vocation, specific features of its Christian culture, especially Iberian links with the Islamic world and the question of changes in Spanish identity. The article presents reflections on Europe by the Generation of ‘98 Spanish writers and thinkers (chiefly Angel Ganivet, Miguel de Unamuno and Ramiro de Maeztu) who, in the face of defeat (1898) in the Spanish-American War, proclaimed a program of moral and cultural rebirth for Spain. Their ambivalent attitude towards Europe was rejected by José Ortega y Gasset and Salvador de Madariaga, both the most pro-European 20th century Spanish intellectuals. The problem of Spanish relation to Europe was also widely discussed after the Civil War under General Franco regime. The evolution from initial isolation to a fuller integration with Europe of the regime and its conservative Catholic culture are also shown in the article. Much attention is devoted to the present-day civil and European Spain led by democratic socialists. (shrink)

The paper discusses the place occupied by Latin America and Eastern Europe in the contemporary world-system in the era of increasing globalization. It discusses the dominant types of consciousness in both parts of the world, where a tendency to overcome dependence and peripheral position are noticeable as is a desire for democracy and foreign relations based on partnership. What is long raised and very characteristic for thinkers coming from those very different regions of the globe are attempts to create a (...) new universalistic philosophy, more or less utopian, for the whole of mankind. In the history of human thought, various writers have called their philosophies universal, universalistic or simply “universalism”. Almost every philosophical or scientific theory claims to be of universal importance, to be a generalization and universality, but relatively few have believed that the term “universalism” to be the only adequate, and therefore only viable, description of their own thought system or newly constructed theory. Efforts to construct, develop or reconstruct a theory, viewpoint, vision or universalistic attitude—or merely to reinforce universalistic postulates—have (...) long been undertaken in many different countries. Such attempts include those that implicitly assume or imply some sort of universalism. I would like to emphasize that I am principally interested in the visions, frequently appearing in Poland, whose authors, and not merely commentators, have defined their own philosophy, more or less refined, as universalism. John Paul’s universalism is a continuation of a tradition of universalist thinking lasting two thousands years. It makes it possible to look at the reality of the individual man and of the whole of humanity in their personalistic and communitarian dimensions at one time. Christian universalism has been closely tied to the concept ofuniversalism that was related to the Pope and imperial Rome, or even to Byzantium. (shrink)

Celem artykułu jest przedstawienie wybranych wątków związanych ze sprawowaniem przez Mikołaja Zebrzydowskiego urzędu starosty krakowskiego (1585–1620). Autor skoncentrował się na trzech kwestiach: objęciu starostwa, zaangażowaniu Zebrzydowskiego w sprawowanie wymiaru sprawiedliwości oraz wpływie rokoszu sandomierskiego (1606–1608) na działalność grodu krakowskiego. Główną podstawę źródłową tekstu stanowią krakowskie akta grodzkie, przechowywane w Archiwum Narodowym w Krakowie. Będąc studium przypadku, artykuł bada problem z perspektywy historycznoprawnej, krytycznie analizuje źródła oraz korzysta z metod statystycznych i porównawczych. Dzięki ich wykorzystaniu udało się odtworzyć przebieg czynności, które (...) doprowadziły do objęcia starostwa przez Zebrzydowskiego w 1585 r. Z zestawienia działalności Zebrzydowskiego z Janem Zamoyskim i Gabrielem Tarnowskim wynika, że jego zaangażowanie w sprawowanie wymiaru sprawiedliwości nie było duże, chociaż większe niż poprzednika i następcy. Limitując roki, Zebrzydowski chętnie powoływał się na sprawy prywatne, ale jego następca czynił to jeszcze częściej. Duży wpływ na funkcjonowanie starostwa miał rokosz sandomierski. Sąd nie działał przez ponad trzy i pół roku, urząd przez ponad 17 miesięcy, a kancelaria grodzka przez niecały rok. W sporze o położoną na Wawelu kamienicę starościńską, który stanowi symbol konfliktu Zebrzydowskiego z Zygmuntem III, rację należy przyznać królowi, pełnoprawnemu właścicielowi budynku, chociaż jego postępowanie w tej sprawie zaostrzało napięcie. This article discusses the character of hegemonic subjectification as it is seen by Ernesto Laclau. By explaining the concepts of the constitutive features and form of a hegemonically acquired political identity, such as antagonism, undecidability, overdetermination and decision, I define the social fields and dynamics of subjectification. At the same time, I adopt that such subjectification occurs within the boundaries of the particular –universal, i.e., the ideologically assigned view of identity as totality. Besides, in contrast to Laclau, I juxtapose the (...) dialectically conceived form of the particular–universal relation with its poststructuralist Laclau’s version, and I try to prove that—contrary to Laclau—the idea of hegemony enjoys its vitality thanks to Theodor W. Adorno’s concept of negative dialectics. To determine the points of similarity of the two methods of constructing and deconstructing identity and subjectivity, I reject Elmar Flatschart’s incomparability argument. Lastly, I point out the earlier mentioned points of convergence: on Adorno’s part—the concept of proper names and the concept of constellation; on Laclau’s part—the concept of undecidability and decision which keep discourse ontologically and epistemologically open. This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

Recent findings demonstrate sex-related differences in the neurobiological mechanisms by which emotional arousal influences memory, and raise questions about the extent to which memory for emotional events may differ between males and females. Here we examine whether sex-related differences exist in the recall of central information and peripheral detail from an emotional story. Healthy subjects viewed a brief, narrated slide-show containing emotional elements in its middle section. One week later, they received an incidental multiple-choice recognition test for the story. Following (...) the test, each subject completed the BEM Sex-Role Inventory, an assessment of sex-related masculine and feminine traits. The results reveal no differences in recall of either central or peripheral story information when considering the performance of actual men and women, but a significant difference when considering male and females as determined by their BEM test scores. “BEM” males showed significantly enhanced recall of central emotional information. “BEM” females did not. Both groups showed significantly enhanced recall of peripheral emotional information, although this effect appeared larger in BEM females than in BEM males. The influences of “BEM” sex and type of information significantly interacted to influence emotional memory performance. These findings confirm the existence of sex-related influences in the recall of emotional information, and suggest that sex-related traits, rather than actual sex per se, may be a more sensitive indicator of these influences. The essay begins from Alan Gewirth's influential account of human rights, and specifically with his argument that the human right to political participation can only be fulfilled by competitive, liberal democracy. I show that his argument rests on empirical, rather than conceptual grounds, which opens the possibility that in China, alternative forms of participation may be legitimate or even superior. An examination of the theory and contemporary practice of ‘democratic centralism’ shows that while it does not now adequately support the (...) right to political participation, a reformed version could. I focus in particular on the roles that could be played by consultative institutions, looking both to recent Chinese proposals and to analogues currently existing in Japan. I conclude that a reformed democratic centralism may well be the objective toward which Chinese people should strive. (shrink)

The use of role-playing (“active learning”) as a teaching tool has been reported in areas as diverse as social psychology, history and analytical chemistry. Its use as a tool in the teaching of engineering ethics and professionalism is also not new, but the approach develops new perspectives when used in a college class of exceptionally wide cultural diversity. York University is a large urban university (40,000 undergraduates) that draws its enrolment primarily from the Greater Toronto Area, arguably one of the (...) most culturally diverse cities in the world, embracing the largest percentage of Canada’s immigration. Among the area’s five million inhabitants, 50% identify themselves as a visible minority born outside Canada, while over 100 languages and dialects are spoken daily. Although students admitted from this international pool have usually been exposed to western attitudes during secondary education and are rapidly assimilated into Canadian culture, responses to specific ethical issues are strongly influenced by their prior culture. Two and three-part scripts for case studies based on NSF or original scenarios were written to illustrate issues such as gifts, attitudes towards women and ethnic minorities, conflict of interest, whistle-blowing, sexual harassment, individual rights, privacy, environment, intellectual property, and others. Following the presentation, the actors lead group discussion based on previously specified questions. Once the initial shyness and reluctance of some cultures has been overcome through the building of rapport, students have written original scripts based on hypothetical or prior personal situations. The method is now being adopted in a short course format to assist the professional integration of foreign trained engineers. (shrink)

The authors develop an analysis of education. They show how education carries an essentially arbitrary cultural scheme which is actually based on power. More widely, the reproduction of culture through education is shown to play a key part in the reproduction of the whole social system.

This book traces the growth of philosophical justifications of toleration. The contributors discuss the grounds on which we may be required to be tolerant and the proper limits of toleration. They consider the historical and conceptual relation between toleration and scepticism and ask whether toleration is justified by considerations of autonomy or of prudence. The papers cover a range of perspectives on the subject, including Marxist and Socialist as well as liberal views. The editor's introduction prepares the ground by discussing (...) the essential features of the subject and offers a lucid survey of the theories and arguments put forward in the book. The collection arises out of the Morrell Toleration Project at the University of York and all the papers were written as contributions to that project. A distinction is made between moral indoctrination and instruction in ethics. It is argued that the legitimate and important field of computer ethics should not be permitted to become mere moral indoctrination. Computer ethics is an academic field in its own right with unique ethical issues that would not have existed if computer technology had not been invented. Several example issues are presented to illustrate this point. The failure to find satisfactory non-computer analogies testifies to the uniqueness of computer ethics. (...) Lack of an effective analogy forces us to discover new moral values, formulate new moral principles, develop new policies, and find new ways to think about the issues presented to us. For all of these reasons, the kind of issues presented deserve to be addressed separately from others that might at first appear similar. At the very least, they have been so transformed by computing technology that their altered form demands special attention. (shrink)

Creative accounting, which generally involves the preparation of financial statements with the intention of misleading readers of those statements, is prima facie a form oflying, as defined by Bok.1 This paper starts by defining and illustrating creative accounting. It examines and rejects the arguments for considering creative accounting, in spite of its deceptive intent, as not being a form of lying. It then examines the ethical issues raised by creative accounting, in the light of the literature on the ethics of (...) lying. This literature includes the evaluation of various excuses and justifications for lying, and these are examined here in relation to creative accounting. It is concluded that even in circumstances in which creative accounting would arguably serve a worthy purpose, that purpose would be at least as well served by honest communication. (shrink)
