Movements like the Arab Spring, Occupy Wall Street, and the Tea Party embody some of our deepest intuitions about popular politics and 'the power of the people'. They also expose tensions and shortcomings in our understanding of these ideals. We typically see 'the people' as having a special, sovereign power. Despite the centrality of this idea in our thinking, we have little understanding of why it has such importance. Imagined Sovereignties probes the considerable force that 'the people' exercises on our (...) thought and practice. Like the imagined communities described by Benedict Anderson, popular politics is formed around shared, imaginary constructs rooted in our collective imagination. This book investigates these 'imagined sovereignties' in a genealogy traversing the French Enlightenment, the Haitian Revolution, and nineteenth-century Haitian constitutionalism. It problematizes taken-for-granted ideas about popular politics and provokes new ways of imagining the power of the people. (shrink)

We tend to imagine revolution as a vivid tableau of uprisings and armed conflicts. Much less notice is taken of the complex layers of meaning that shape our understanding of these events: why some are seen as just expressions of a popular will, while others are condemned as wild disruptions of political order. A critical understanding of politics must grapple with these subtle, often unnoticed normative issues. This essay tries to understand some of the processes that create political normativity, investigating (...) the way revolutionary movements use time to endow themselves with normative value. I sketch a genealogy of revolution across three centuries, noting changes in its meaning, observing the rise of discourse as an important mode of revolutionary activity, and tracing a shifting mosaic of temporalities that are politicized in important ways. Time is instrumentalized to justify political insurgency in this history. Time, in short, becomes a tool of revolution. (shrink)

This essay follows Michel Foucault’s inspiration to develop an archaeology of subaltern politics. In the archives left from the Haitian Revolution, we find occasional references to slaves wearing the tricolor cockade, the famous symbol of French republicanism. The archives are silent on what wearing the cockade “meant,” however, or why whites found it so threatening. Rich layers of meaning are packed into these silences. They reveal a great deal about the performative character of the public sphere and the epistemological complexity (...) of mixing race with revolutionary politics. Wearing the cockade was a screen of projection for all kinds of ideas, including the paranoid fears and guilty conscience of white slaveholders. It probed tensions implicit within Enlightenment colonialism, making those tensions explicit to white elites. By eliciting this self-critical response, the cockade served as a disruptive enigma well suited to the critical and political needs of people not allowed to speak. (shrink)

My discussion of Massimiliano Tomba's Insurgent Universality focuses on intertwined themes of historicism, normativity, and revolution that I find particularly generative. By drawing them together I hope to trace out important parts of the book's conceptual infrastructure, especially the way it uses insurgent moments of the past to conceptualize alternative modernities. My particular focus is the sense in which Tomba hopes to “reactivate” important aspects of past insurgent moments. In the end, I argue that his arguments actually go much farther (...) to displace universalism than he credits them. Agreeing with the spirit of Tomba's work rather than its letter, I believe that he provides us with good grounds to focus on insurgent multiplicities rather than insurgent “universality.”. (shrink)

[Reflexive citizenship and the paradoxes of participation; ].

Kevin Olson's “When is the Time of Revolution” constructs a critical genealogy of revolutionary temporality and how it creates political normativity. This comment evaluates Olson's discussion of revolutionary temporality against the empirical historical archive of modern revolutions in order to argue that we should also be sensitive to the multiple, overlapping, and competing temporalities that not only normativize revolution, but are in fact the terrain of revolutionary struggle.

From the time of Locke, discussions of personal identity have often ignored the question of our basic metaphysical nature: whether we human people are biological organisms, spatial or temporal parts of organisms, bundles of perceptions, or what have you. The result of this neglect has been centuries of wild proposals and clashing intuitions. What Are We? is the first general study of this important question. It beings by explaining what the question means and how it differs from others, such as (...) questions of personal identity and the mind-body problem. It then examines in some depth the main possible accounts of our metaphysical nature, detailing both their theoretical virtues and the often grave difficulties they face. The book does not endorse any particular account of what we are, but argues that the matter turns on more general issues in the ontology of material things. If composition is universal--if any material things whatever make up something bigger--then we are temporal parts of organisms. If things never compose anything bigger, so that there are only mereological simples, then we too are simples--perhaps the immaterial substances of Descartes--or else we do not exist at all (a view Olson takes very seriously). The intermediate view that some things compose bigger things and others do not leads almost inevitably to the conclusion that we are organisms. So we can discover what we are by working out when composition occurs. (shrink)

There is much to admire in this book. It is written in a pleasingly straightforward style, and offers insight on a wide range of important issues.

Work on a computer program called SMILE + IBP (SMart Index Learner Plus Issue-Based Prediction) bridges case-based reasoning and extracting information from texts. The program addresses a technologically challenging task that is also very relevant from a legal viewpoint: to extract information from textual descriptions of the facts of decided cases and apply that information to predict the outcomes of new cases. The program attempts to automatically classify textual descriptions of the facts of legal problems in terms of Factors, a (...) set of classification concepts that capture stereotypical fact patterns that effect the strength of a legal claim, here trade secret misappropriation. Using these classifications, the program can evaluate and explain predictions about a problem’s outcome given a database of previously classified cases. This paper provides an extended example illustrating both functions, prediction by IBP and text classification by SMILE, and reports empirical evaluations of each. While IBP’s results are quite strong, and SMILE’s much weaker, SMILE + IBP still has some success predicting and explaining the outcomes of case scenarios input as texts. It marks the first time to our knowledge that a program can reason automatically about legal case texts. (shrink)

Abstract:Qi has been both understood separately as substance and as field. This essay argues that qi in the Zhuangzi is both substance and field together. This qi field-substance is bidimensional where its vertical axis is that of substance and its horizontal axis that of field. This essay argues that the vertical dimension does not imply a substance dualism but a holism where qi differs in degrees of refinement; it argues that the horizontal dimension is composed of interrelated yinyang forces that (...) constitute an "empty" field. It also argues that at the center of this qi field-substance is the heart-mind and the body and, by drawing on rich resonances between the Zhuangzi and phenomenology, that human beings bring the fields of qi that they are situated in into certain coherences. The goal of this article is to motivate the idea of a social reason and demonstrate its usefulness in social theorizing. For example, in a society that values getting married young, the fact that one is young is a reason to get married. In racist and sexist societies, we have social reasons to be racist and sexist. Social reasons give rise to social requirements and obligations, where these requirements often conflict with prudential and moral requirements. My application of reasons to (...) social philosophy parallels Charles Mills' and Carole Pateman's applications of social contract theory to political philosophy. While they use social contract theory to make sense of patriarchy and white supremacy, I use the theory of normative reasons to make sense of social injustice. Reasoners compare problems to prior cases to draw conclusions about a problem and guide decision making. All Case-Based Reasoning (CBR) employs some methods for generalizing from cases to support indexing and relevance assessment and evidences two basic inference methods: constraining search by tracing a solution from a past case or evaluating a case by comparing it to past cases. Across domains and tasks, however, humans reason with cases in subtly different ways evidencing different mixes of and mechanisms for these components.In (...) recent CBR research in Artificial Intelligence (AI), five paradigmatic approaches have emerged: statistically-oriented, model-based, planning/design-oriented, exemplar-based, and adversarial or precedent-based. The paradigms differ in the assumptions they make about domain models, the extent to which they support symbolic case comparison, and the kinds of inferences for which they employ cases. (shrink)

An important and engaging book on a key argument in contemporary debates about free will and moral responsibility.

This paper advances the conception of social entrepreneurs as caring entrepreneurs. We argue that the care ethics of social entrepreneurs, implying the pursuit of caring goals through caring processes, can be challenged when they engage in the process of scaling up their ventures. We propose that social entrepreneurs can sustain their care ethics as the essential dimension of their venture only if they are able to build a caring enterprise. Organizational care designates the set of organizing principles that facilitate the (...) embedding of care ethics at an organizational level, beyond the imprinting induced by social entrepreneurs’ personal ethics. This article provides an overview of, and thematic justification for, the special issue of the journal of Artificial Intelligence and Law entitled “E-Discovery”. In attempting to define a characteristic “AI & Law” approach to e-discovery, and since a central theme of AI & Law involves computationally modeling legal knowledge, reasoning and decision making, we focus on the theme of representing and reasoning with litigators’ theories or hypotheses about document relevance through a variety of techniques including machine learning. We also identify (...) two emerging techniques for enabling users’ document queries to better express the theories of relevance and connect them to documents: social network analysis and a hypothesis ontology. This paper offers a phenomenological analysis of Heidegger’s account of “the uncanny” as it relates to the coronavirus pandemic. It explores how the pandemic has disrupted Dasein’s sense of “homelike” familiarity and how this disruption has undermined our ability to be, that is, to understand or make sense of things. By examining our experience of temporality, lived-space, and intersubjectivity, the paper illuminates different ways in which the pandemic has left us confused and anxious about our self-interpretations and future projects. The (...) paper concludes by showing how the uncanny is not simply something we feel in times of crisis; it is, for Heidegger, who we are. This means the secure feeling of familiarity that we embodied prior to the pandemic was an illusion all along, that we are not and never have been at-home in the world. (shrink)

There is growing interest in understanding and eliciting division of labor within groups of scientists. This paper illustrates the need for this division of labor through a historical example, and a formal model is presented to better analyze situations of this type. Analysis of this model reveals that a division of labor can be maintained in two different ways: by limiting information or by endowing the scientists with extreme beliefs. If both features are present however, cognitive diversity is maintained indefinitely, (...) and as a result agents fail to converge to the truth. Beyond the mechanisms for creating diversity suggested here, this shows that the real epistemic goal is not diversity but transient diversity. (shrink)

We argue that explainable artificial intelligence (XAI), specifically reason-giving XAI, often constitutes the most suitable way of ensuring that someone can properly be held responsible for decisions that are based on the outputs of artificial intelligent (AI) systems. We first show that, to close moral responsibility gaps (Matthias 2004), often a human in the loop is needed who is directly responsible for particular AI-supported decisions. Second, we appeal to the epistemic condition on moral responsibility to argue that, in order to (...) be responsible for her decision, the human in the loop has to have an explanation available of the system’s recommendation. Reason explanations are especially well-suited to this end and we examine whether – and how – it might be possible to make such explanations fit with AI systems. We support our claims by focusing on a case of disagreement between human in the loop and AI system. (shrink)

In Being and Time, Martin Heidegger introduces a unique interpretation of death as a kind of world-collapse or breakdown of meaning that strips away our ability to understand and make sense of who we are. This is an ‘ontological death’ in the sense that we cannot be anything because the intelligible world that we draw on to fashion our identities and sustain our sense of self has lost all significance. On this account, death is not only an event that we (...) can physiologically live through; it can happen numerous times throughout the finite span of our lives. This paper draws on Arthur Frank’s (At the will of the body: reflections on illness. Houghton, Boston, 1991) narrative of critical illness to concretize the experience of ‘ontological death’ and illuminate the unique challenges it poses for health care professionals. I turn to Heidegger’s conception of ‘resoluteness’ (Entschlossenheit) to address these challenges, arguing for the need of health care professionals to help establish a discursive context whereby the critically ill can begin to meaningfully express and interpret their experience of self-loss in a way that acknowledges the structural vulnerability of their own identities and is flexible enough to let go of those that have lost their significance or viability. The Psychological Ethics and National Security (PENS) task force was assembled by the American Psychological Association (APA) to guide policy on the role of psychologists in interrogations at foreign detention centers for the purpose of U.S. national security. The task force met briefly in 2005, and its report was quickly accepted by the APA Board of Directors and deemed consistent with the APA Ethics Code by the APA Ethics Committee. This rapid acceptance was unusual for a number of reasons but (...) primarily because of the APA's long-standing tradition of taking great care in developing ethical policies that protected anyone who might be impacted by the work of psychologists. Many psychological and non-governmental organizations (NGOs), as well as reputable journalists, believed the risk of harm associated with psychologist participation in interrogations at these detention centers was not adequately addressed by the report. The present critique analyzes the assumptions of the PENS report and its interpretations of the APA Ethics Code. We demonstrate that it presents only one (and not particularly representative) side of a complex set of ethical issues. We conclude with a discussion of more appropriate psychological contributions to national security and world peace that better respect and preserve human rights. (shrink)

In this paper, I draw on Heidegger’s phenomenology of “moods” (_Stimmungen_) to interpret loneliness as a diffused and atmospheric feeling-state that often undergirds the lives of older adults, shaping the ways in which they are attuned to and make sense of the world. I focus specifically on residents in long-term care facilities to show how the social isolation and lockdown measures of the COVID-19 pandemic dramatically intensified the mood. The aim is to shed light on how profound and totalizing the (...) experience has been for residents. Making use of Heidegger’s account of the affective “collapse” or “breakdown” (_Zusammenbruch_) of meaning, I argue that when older adults are functionally locked in their rooms for months at a time and cut off from the orienting routines and rhythms of the relational world, the result is a crumbling of the fundamental meaning-structures that constitute subjectivity. The global sense of abandonment and disconnection strips away the possibility for self-understanding, and residents are often left confused and abandoned to an existence that has been drained of meaning and significance. In _Marx at the Margins_, Kevin Anderson uncovers a variety of extensive but neglected texts by the well-known political economist which cast what we thought we knew about his work in a startlingly different light. Analyzing a variety of Marx’s writings, including journalistic work written for the _New York Tribune_, Anderson presents us with a Marx quite at odds with our conventional interpretations. Rather than providing us with an account of Marx as an exclusively class-based thinker, Anderson here offers (...) a portrait of Marx for the twenty-first century: a global theorist whose social critique was sensitive to the varieties of human social and historical development, including not just class, but nationalism, race, and ethnicity, as well. _Marx at the Margins _ultimately argues that alongside his overarching critique of capital, Marx created a theory of history that was multi-layered and not easily reduced to a single model of development or revolution.
