“At-own-risk discharges” or “self-discharges” evidences an irretrievable breakdown in the patient–clinician relationship when patients leave care facilities before completion of medical treatment and against medical advice. Dissolution of the therapeutic relationship terminates the physician’s duty of care and professional liability with respect to care of the patient. Acquiescence of an at-own-risk discharge by the clinician is seen as respecting patient autonomy. The validity of such requests pivot on the assumptions that the patient is fully informed and competent to invoke an (...) at-own-risk discharge and that care up to the point of the at-own-risk discharge meets prevailing clinical standards. Palliative care’s use of a multidisciplinary team approach challenges both these assumptions. First by establishing multiple independent therapeutic relations between professionals in the multidisciplinary team and the patient who persists despite an at-own-risk discharge. These enduring therapeutic relationships negate the suggestion that no duty of care is owed the patient. Second, the continued employ of collusion, familial determinations, and the circumnavigation of direct patient involvement in family-centric societies compromises the patient’s decision-making capacity and raises questions as to the patient’s decision-making capacity and their ability to assume responsibility for the repercussions of invoking an at-own-risk discharge. With the validity of at-own-risk discharge request in question and the welfare and patient interest at stake, an alternative approach to assessing at-own-risk discharge requests are called for. The welfare model circumnavigates these concerns and preserves the patient’s welfare through the employ of a multidisciplinary team guided holistic appraisal of the patient’s specific situation that is informed by clinical and institutional standards and evidenced-based practice. The welfare model provides a robust decision-making framework for assessing the validity of at-own-risk discharge requests on a case-by-case basis. (shrink)

For decades, health information has been collected and shared for health care delivery and public health purposes. While the “primary use” of patient data for providing direct health care services is the cornerstone of health care practice, health departments rely on data sharing for research and analysis to support disease prevention and health promotion in the population. As the U.S. health system undergoes a digital revolution, health information that was previously captured in paper form now can be captured electronically. Electronic (...) health information has transformed the efficiency, capacity, and functions of the U.S. health system. For this reason, there is increased attention to the “secondary use” of electronic patient data for public health uses, including disease reporting and investigation, syndromic surveillance, and patient-specific or population-level communications about health conditions and their associated risk factors. White matter tracts are known to be susceptible to injury following concussion. The objective of this study was to determine whether contact play in sport could alter white matter metabolite levels in female varsity athletes independent of changes induced by long-term exercise. Metabolite levels were measured by single voxel proton magnetic resonance spectroscopy in the prefrontal white matter at the beginning and end of season in contact and non-contact varsity athletes. Sedentary women were scanned once, at a time equivalent to (...) the Off-Season time point. Metabolite levels in non-contact athletes did not change over a season of play, or differ from age matched sedentary women except that non-contact athletes had a slightly lower myo-inositol level. The contact athletes had lower levels of myo-inositol and glutamate, and higher levels of glutamine compared to both sedentary women and non-contact athletes. Lower levels of myo-inositol in non-contact athletes compared to sedentary women indicates long-term exercise may alter glial cell profiles in these athletes. The metabolite differences observed between contact and non-contact athletes suggest that non-contact athletes should not be used as controls in studies of concussion in high-impact sports because repetitive impacts from physical contact can alter white matter metabolite level profiles. It is imperative to use athletes engaged in the same contact sport as controls to ensure a matched metabolite profile at baseline. (shrink)

Brown and Pooley’s ‘dynamical approach’ to physical theories asserts, in opposition to the orthodox position on physical geometry, that facts about physical geometry are grounded in, or explained by, facts about dynamical fields, not the other way round. John Norton has claimed that the proponent of the dynamical approach is illicitly committed to spatiotemporal presumptions in ‘constructing’ space-time from facts about dynamical symmetries. If we cannot directly empirically test the claims of particular scientific theory, then it would be nice to have some other criteria with which to assess its viability. In his 2013 book, String Theory and the Scientific Method, Richard Dawid aims to develop such criteria, with an eye to vindicating research programs in disciplines where direct empirical data is scant or non-existent. In an accompanying paper, Dawid, Hartmann and Sprenger formalise Dawid’s so-called ‘No Alternatives Argument’ using a generalised Bayesian framework, (...) as a first step towards formalising Dawid’s entire re- search programme. In this paper, I argue that the formalisation of the NAA cannot play the central role in Dawid’s programme as intended. This is based on the observation that not all confirmation is non-negligible confirmation. For Dawid’s programme to be useful, it must demonstrate the viability not just of non-empirical theory confirmation, but of non-negligible non-empirical theory confirmation. I argue that Dawid et al.’s appeal to Bayesian confirmation theory to formalise his NAA cannot guarantee non-negligible confirmation. As a result, I conclude that if Dawid’s overall project is to succeed, it must do so without the NAA formalised in this way. (shrink)

In a recent article, Halvorson and Manchak (Br J Philos Sci, Forthcoming) claim that there is no basis for the Hole Argument, because (in a certain sense) hole isometries are unique. This raises two important questions: (a) does their argument succeed?; (b) how does this formalist response to the Hole Argument relate to other recent responses to the Hole Argument in the same tradition—in particular, that of Weatherall (Br J Philos Sci 69(2):329–350, 2018)? In this article, _ad_ (a), we argue (...) that Halvorson and Manchak’s claim does not go through; _ad_ (b), we argue that although one _prima facie_ plausible reading would see Halvorson and Manchak as filling an important hole (no pun intended) in Weatherall’s argument, in fact this reading is implausible; there is no need to supplement Weatherall’s work with Halvorson and Manchak’s results. The study aims to address the existing research gap through a thematic comparison between the aesthetics of Kant and Abhinavagupta. This paper explores Kant’s notion of aesthetic judgment based on disinterestedness with Abhinavagupta’s analysis of sādhāraṇīkaraṇa. We argue that the notions of “disinterested judgment” in Kant and sādhāraṇīkaraṇa in Abhinavagupta points towards the impersonal nature of aesthetic delight which makes the universality of aesthetic experience possible. Hence, aesthetics in both Kant and Abhinavgupta are not the personal and subjective experience but (...) a kind of universality based on the ability to experience the impersonal joy. However, the notion of aesthetic delight in Kant is confined to the agreeable mental states only while in Abhinavgupta the notion of rasa includes both positive as well as the negative mental states like fear, disgust, etc. In this regard, the paper will also analyze the affinity between notion of sensus communius in Kant and sahṛdaya in Abhinavagupta which highlights the importance of aesthetic community and the impersonal nature of aesthetic delight. No Singapore court decision has determined whether the doctor owes a duty to the parents of the doctor’s 16-year-old patient, to warn them that their child is engaging in sexual activities, and who subsequently has had an abortion. Similarly, the issue of (...) whether the doctor has a duty to protect the minor in such circumstances has also not been tested in the Singapore courts. Nonetheless, it is very unlikely that either duty will be found in this case.The general rule is that doctors owe a duty of confidentiality to their patients. This duty extends to children, and although no Singapore court has ruled on the matter, the law in England is clear.1 It is enshrined in section 4.2.3.1 of the Ethical Code & Ethical Guidelines of the Singapore Medical Council. It is not absolute and a number of exceptions have been carved out. The confidentiality duty can be overridden by legislation, court order, the public interest, or other justifiable circumstances that the doctor believes warrants disclosure.The age of consent for non-commercial consensual sexual activities in Singapore is 16.2 Therefore, there is no statutory responsibility on Dr. C under the criminal law to report the patients’ sexual activities to the authorities or anyone else. There is no other legislation or court order that compels disclosure. It is highly unlikely that the public interest would be served by disclosure. The consequences of such disclosure to the public interest were aptly put in a recent English case, when J. The doctor-patient relationship is between Dr. C and Miss M, and her parents have never been involved in the consultations or treatment decision-making process. They have not insisted on attending the consultations with their daughter, nor did they appear to object to Miss M consenting to treatment. Prior to their complaint, they had not sought any update or information about their daughter’s condition from Dr. C. Miss M specifically asked Dr. C not to reveal the contents of their conversations to her parents at the first consultation and the doctor agreed after attempting to convince her that it would be preferable to include her parents in the consultations. Miss M was obviously concerned about confidentiality and sought clarification from Dr. C. It appears as though Dr. C determined that Miss M had the capacity to exclude her parents from the consultations, and later to make her own treatment decisions, as a mature minor, and their doctor-patient relationship proceeded on that basis.It may be in the public interest for Dr. C to disclose confidential information about Miss M, even if she refuses to consent to it, if the doctor believes it is necessary to protect her from serious harm. The question is how to strike that balance and what tips it over to either side. In this case, the right for Mdm. W to make her own decision whether to undergo electroconvulsive therapy (ECT) must be balanced against the concern of the doctors and her (...) relatives regarding the possible consequences of not receiving the treatment. However, this question does not even arise if Mdm. W has capacity to make that decision. Mdm. W is the decision-maker for ECT treatment if she has capacity to make that decision.1The statutory regime that underpins decision-making for persons who may lack capacity is the Singapore Mental Capacity Act (SMCA).2 It is grounded in five Statutory Principles.3 The first three are the presumption the person has capacity, has the right to make an unwise decision, and the requirement that all practicable steps be taken to help the person make a decision. The fourth principle requires decisions made on behalf of the person lacking capacity to be taken in his or her best interests, and the final one states that the less restrictive option must be selected when making decisions for persons lacking capacity.The best practice is for the doctor to conduct a formal mental capacity assessment to determine whether Mdm. W can refuse consent for ECT. A formal assessment is appropriate in these circumstances because the decision is an important one concerning serious medical treatment.4 A trained specialist should conduct this assessment. The two-stage test for mental capacity is laid out in the SMCA.5 The first stage appears to be met because it requires the person to be suffering from an impairment or disturbance that affects the function of [End Page 227] the mind or brain, and Mdm. The SMCA states that a person is unable to make a decision if he or she cannot understand the information, weigh up the information, remember the information or communicate the decision.6If the formal assessment concludes that Mdm. W lacks capacity to refuse ECT treatment, then the decision should be taken in her best interests.7 Mdm. W ’s relatives have no legal right to make decisions on her behalf unless she has appointed one or more of her relatives to be her healthcare proxy under a valid Lasting Power of Attorney (LPA).8 If she made such an LPA, then the appointed proxy is the final decision-maker unless the treatment is life-sustaining or the doctor reasonably believes the treatment is necessary to prevent a serious deterioration in Mdm. W’s health.9 It is arguable that a clear and present danger of suicide may be reasonably classified by the doctor as a serious deterioration in Mdm. W’s health, although this issue has not been tested in the Singapore courts, which would mean that the appointed proxy would have to yield to the doctor as the final decision-maker. If Mdm. W did not make such an LPA, then the decision must be taken in her best interests, and is likely to be taken jointly between the healthcare team and the relatives.The best interests test involves a holistic appraisal of factors,10 balancing the benefits and burdens of the proposed ECT. The relevant factors that should be considered here include whether, when or if Mdm. W is likely to regain capacity, her beliefs and values, her past and present wishes, and the views of her relatives.11 We do not have any information about the first two factors but we do know Mdm. The article attempts to trace the evolution of the concept of civil society. Drawing from the work of political philosophers from the classical period, the period of renaissance, scientific revolution, the period of Enlightenment in the 18th century, and ideologies from the Marxist and Gramscian discourses, the article demonstrates the shifts in the meaning and implications of the concept, its relations to public spaces, accountability, governance, normative ideals of state and the relationship between the state and its citizens. The article (...) concludes its historical progression with the New Social Movements, wherein the civil society became synonymous with strategic action to construct 'an alternative social and world order’, a site for problem solving. Other contenders who put forth a renewed interest in the resurgence of civil society were the New Left, who assigned civil society a role to defend people’s democratic will in the face of state power, and the neoliberals who considered civil society as a site for subversion from authoritarian regimes. The article finally concludes with a call for urgent attention towards reclaiming the authority of the civil society in education scenario. (shrink)

This article argues that the specifically sexual nature of the political violence of the 1947 Partition of British India installs women's bodies as unambiguously sexed and ethnic. Through an analysis of Kirti Jain's 2001 theatre production of Aur Kitne Tukde (How Many Fragments?), I consider how Hindus, Muslims and Sikhs appropriate colonialist and nationalist ideologies surrounding the notion of ‘woman’ as repository of cultural value. The women in Jain's play are not a priori subjects who experience violence but rather the (...) experience of violence makes (and unmakes) them as gendered, ethnic and national subjects. I argue that they come into subjecthood after a violent objectification and are re-constituted by their experience of national and sexual violence. The performance of nationalism – through embodied acts of sexual violence, conversion, martyrdom and state violence – is enacted upon female bodies that are transformed into political artefacts. I ask how bodies are staged and commodified by acts of political violence and argue that marking female bodies through acts of political violence constitutes a mode of transcription to communicate with other men that will encounter this body. Cet article cherche à préciser les modes d' appropriation médiévale du paradoxe du Ménon selon lequel il est impossible de rien apprendre, c'est-à-dire de connaître quelque chose de nouveau. This article undertakes to define the modes of medieval appropriation of the Menons paradox according to which it is impossible to learn anything, that is to say, to know something new. First, we outline the vectors of textual transmission. The dialogue itself was not well known during the Middle Ages, so that the paradox and its possible solutions were apprehended mainly through the summary provided by Aristotle. For the 13 century commentators of the Posterior Analytics, this paradox favors an innatist conception of science. This conception is opposed by Aristotelian empiricism. The 14th century nominalists made this opposition still more radical. The refutation of Meno's argument provides an opportunity to develop a strictly naturalistic conception of the acquisition of knowledge. (shrink)

Pero subrayo con énfasis particular la diferencia de criterios, de un diálogo a otro. Mientras que en el primero predomina el criterio lógico de la estabilidad de epistêmê y la inestabilidad dóxa, debida respectivamente a la concatenación (desmós) y la falta de concatenación de sus elementos, el segundo enfatiza el criterio ontológico de los objetos:la misma cosa no puede ser aprehendida (...) por la ciencia y la opinión, pues la primera concierne al ser absoluto, identificado con las Formas platónicas, y la segunda a algo que es intermedio entre el ser absoluto y el no-ser absoluto. Después de objetar que Platón no logra demostrar su división tripartita de la realidad, sostengo que la diferencia de criterios aquí analizada se debe a la ausencia de la Teoría Platónica de las Formas en el Menón. While in the first prevails the logical criterion of stability of epistêmê and unstableness of dóxa, owing respectively to the concatenation (desmós) and the lack of concatenation of their elements, the second emphasizes the ontological criterion of objects: the same thing cannot be apprehended by science and opinion, for the former concerns to absolute being, identified with Platonic Ideas, while the latter to something which is halfway between absolute being and absolute not-being. After objecting that Plato fails to demonstrate his tripartite division of reality, I claim that the difference of criteria hereby analyzed is due to the absence of Plato’s Theory of Ideas in Meno. Štúdia sa zameriava na psychologické a didaktické metódy použité v Platónovom dialógu Menón. S využitím metódy dramatického čítania dialógu autor analyzuje dve kľúčové časti sokratovskej pedagogiky: negatívnu (aporetickú) charakterizovanú elenchom s cieľom nájsť a eliminovať chybné predpoklady, a pozitívnu (euporetickú), ktorej cieľom je pomôcť študentovi nájsť nové riešenia a prostredníctvom argumentácie ho priviesť k lepšiemu porozumeniu problému. V závere autor uvádza, že hlavným cieľom dialógu Menón je ukázať rozdiel medzi „sofistickým“ a „sókratovským“ spôsobom učenia. Zatiaľ čo prvý spočíva v memorovaní (...) autoritatívnych názorov a poznatkov učiteľa, sókratovský je založený na spoločnom hľadaní lepších argumentov. Plato’s Meno offers important elements of his educational theory. This article begins with a brief introduction to this work, and then presents an analysis of several ideas that appear throughout it, with a special emphasis on those dealing directly or indirectly with the central theme of education and human communication. The article concludes with a summary of the work’s main arguments.

Štúdia sa zameriava na psychologické a didaktické metódy použité v Platónovom dialógu Menón. S využitím metódy dramatického čítania dialógu autor analyzuje dve kľúčové časti sokratovskej pedagogiky: negatívnu (aporetickú) charakterizovanú elenchom s cieľom nájsť a eliminovať chybné predpoklady, a pozitívnu (euporetickú), ktorej cieľom je pomôcť študentovi nájsť nové riešenia a prostredníctvom argumentácie ho priviesť k lepšiemu porozumeniu problému. V závere autor uvádza, že hlavným cieľom dialógu Menón je ukázať rozdiel medzi „sofistickým“ a „sókratovským“ spôsobom učenia. Zatiaľ čo prvý spočíva v memorovaní (...) autoritatívnych názorov a poznatkov učiteľa, sókratovský je založený na spoločnom hľadaní lepších argumentov. This work articulates two thesis: one Socratic and one Platonic; and displays how the first one is heir of the second. The Socratic one is called the principle of priority of definition; the Platonic one is the Recollection theory. The articulation between both theses is possible due to the Meno’s paradox, which makes a criticism on the first thesis, but it is solved with the second one. The consequence of this articulation is a new interpretation of the Recollection theory, as (...) a theory of knowledge acquisition that depends, mainly, on a distinction between knowledge and true opinion. To conclude, a new interpretation of the knowledge/true opinion distinction is displayed –not in the traditional fashion, evaluating the propositions one by one, and in an atomic way–, but as big blocks or chains of propositions shaping knowledge through explanatory reasoning (aitías logismós). Robustness arguments hold that hypotheses are more likely to be true when they are confirmed by diverse kinds of evidence. Robustness arguments require the confirming evidence to be independent. We identify two kinds of independence appealed to in robustness arguments: ontic independence —when the multiple lines of evidence depend on different materials, assumptions, or theories—and probabilistic independence. Many assume that OI is sufficient for a robustness argument to be warranted. However, we argue that, as typically construed, OI is not a (...) sufficient independence condition for warranting robustness arguments. We show that OI evidence can collectively confirm a hypothesis to a lower degree than individual lines of evidence, contrary to the standard assumption undergirding usual robustness arguments. We employ Bayesian networks to represent the ideal empirical scenario for a robustness argument and a variety of ways in which empirical scenarios can fall short of this ideal. (shrink)

The value-free ideal for science holds that values should not influence the core features of scientific reasoning. We defend the difference-to-inference model of value-permeation, which holds that value-permeation in science is problematic when values make a difference to the inferences made about a hypothesis. This view of value-permeation is superior to existing views, and it suggests a corresponding maxim—namely, that scientists should strive to eliminate differences to inference. I discuss the "theory of recollection" in Plato's Meno (81a–86c). Socrates' comments on the "geometry lesson" (85b8–86c3) are used to support the claim that, in a Socratic dialogue, we ought to differentiate between between non-committal and committal questions (= those implying a commitment of the questioner). It is then argued that the "theory of recollection" is no Platonic doctrine: Socrates uses Pythagorean material against Meno who is acquainted with the Pythagorean tradition and whose eristical argument against the possibility of learning (...) is meant to be refuted by the paradoxical consequences about the slave-boy's learning Meno is made to admit. Noncommutative geometries generalize standard smooth geometries, parametrizing the noncommutativity of dimensions with a fundamental quantity with the dimensions of area. The question arises then of whether the concept of a region smaller than the scale—and ultimately the concept of a point—makes sense in such a theory. We argue that it does not, in two interrelated ways. In the context of Connes’ spectral triple approach, we show that arbitrarily small regions are not definable in the formal sense. While in the scalar (...) field Moyal–Weyl approach, we show that they cannot be given an operational definition. We conclude that points do not exist in such geometries. We therefore investigate (a) the metaphysics of such a geometry, and (b) how the appearance of smooth manifold might be recovered as an approximation to a fundamental noncommutative geometry. Most of the large-scale violence in the world will continue to occur within societies rather than between or among states. Yet the international community still has not developed the ethical-legal consensus or the institutions required to manage this terrible problem.

The value-free ideal in science has been criticised as both unattainable and undesirable. We argue that it can be defended as a practical principle guiding scientific research even if the unattainability and undesirability of a value-free end-state are granted. If a goal is unattainable, then one can separate the desirability of accomplishing the goal from the desirability of pursuing it. We articulate a novel value-free ideal, which holds that scientists should act as if science should be value-free, and we argue (...) that even if a purely value-free science is undesirable, this value-free ideal is desirable to pursue.
