ABSTRACT Many philosophers who wish to defend abortion, but who have become frustrated by the resistance of the personhood question to yield to any nonarbitrary solution welcomed Judith Thomson's ‘A defense of abortion.’Thomson argues that abortion is sometimes justifiable even if the foetus is a person. In this paper I argue that Thomson's argument is a defense of abortion, rather than merely extraction without death, only because of the current state of medical technology. Once the technology is in place to (...) extract foetuses while preserving their lives and to allow them to develop to full term outside the uterus, Thomson cannot defend the killing of the foetus. If she is right, however, a woman will still have the right to have a foetus extracted from her body. Finally, it is pointed out that the source of the problem with Thomson's argument is the major premise in most arguments for the permissibility of abortion: a woman's right to control her own body. If the defence of abortion is to entail a defence of the termination of the foetus, then this premise, understood as the right to remove an unwanted entity from one's body or the right to alter one's body as one wishes, simply will not do the trick. DNA joining enzymes play an essential role in the maintenance of genomic integrity and stability. Three mammalian genes encoding DNA ligases, LIG1, LIG3 and LIG4, have been identified. Since DNA ligase II appears to be derived from DNA ligase III by a proteolytic mechanism, the three LIG genes can account for the four biochemically distinct DNA ligase activities, DNA ligases I, II, III and IV, that have been purified from mammalian cell extracts. It is probable that the specific cellular roles (...) of these enzymes are determined by the proteins with which they interact. The specific involvement of DNA ligase I in DNA replication is mediated by the non‐catalytic amino‐terminal domain of this enzyme. Furthermore, DNA ligase I participates in DNA base excision repair as a component of a multiprotein complex. Two forms of DNA ligase III are produced by an alternative splicing mechanism. The ubiqitously expressed DNA ligase III‐α forms a complex with the DNA single‐strand break repair protein XRCC1. In contrast, DNA ligase III‐β, which does not interact with XRCC1, is only expressed in male meiotic germ cells, suggesting a role for this isoform in meiotic recombination. The poor seem easy to identify: those who do not have enough money or enough of the things money can buy. This book explores a different approach to poverty, one suggested by the notion of capabilities emphasized by Amartya Sen and Martha Nussbaum. In the spirit of the capabilities approach, the book argues that poverty refers not to a lack of things but to the lack of the ability to live life in a particular way. The authors argue that the (...) poor are those who cannot live a life that is discovered and created rather than already known. Avoiding poverty, then, means having the capacity and opportunity for creative living. The authors argue that the capacity to do skilled work plays a particularly important role in creative living, and suggest that the development of the ability to do skilled work is a vital part of solving the problem of poverty. Heidegger’s key word Ereignis is frequently translated as “event,” “event of being,” or “event of appropriation.” No ordinary event in the realm of beings, it is an event in which the meaning of being is recognized in difference from beings. In the history of philosophy, this insight into being set in motion the inception of a philosophical discourse within which we are still thinking. Inspired and guided by his philosophy of history, Heidegger hoped our own reflections on being could likewise (...) appropriate and set in motion preparations for another inception, another experience and understanding of what it means for something to be. Whereas, for the early Greek philosophers, their insight was an experience of awe and wonder, and perhaps also dread, for us of today that insight can set in motion a more “inward” turn, a process that puts in question who we are as human beings and who we want to become, and stirs us to acknowledge our responsibility for being in response to a time when being is under assault. (Inquiry, Vol. 18 [1975], No. 3), Michael Moore attempts to clarify and refute what he takes to be the radical (existential) position concerning the nature and diagnosis of mental illness. Moore's dissatisfaction with certain formulations and conceptualizations of the radical position is endorsed; as also the need to introduce greater rigor and precision into the discussion of mental illness. But can the Good of the ethical life and the Justice of the political be reduced to measurement and calculation? If they are matters of measure, are they not also absolutely immeasurable? This book examines Husserl's concept of necessary, a priori, and absolutely certain indubitable evidence, which he terms apodictic, and his related concept of complete evidence, which he terms adequate. To do so it explicates some of the more general relevant features of phenomenology as a whole.

This essay argues that Merleau-Ponty’s phenomenological description of gestural motility in his Phenomenology of Perception contributes to, and in a material way carries forward, not only (1) the account of alienation that Marx proposes in his writings on the condition of manual labour, but also (2) the reflections, at once critical and utopian, that Marx set out in his 1844 Economic and Philosophical Manuscripts , evoking in terms of praxis the realization and fulfillment of our sensuous nature as embodied beings. It is also argued, here, that Merleau-Ponty’s critique of the philosophical accounts of gesture formulated by intellectualism and naturalism shows that, in spite of their differences, they are both ideologically constituted systems of thought that uncritically reflect, and consequently reproduce, the alienations and reifications to which Marx calls attention in his critique of capitalism. I examine Heidegger's reflections on the Anaximander fragment, concentrating on the question of justice. In his commentary, Heidegger draws on Nietzsche's thoughts about justice, the will to power, and nihilism to formulate an interpretation of the fragment that connects it to the epochal history and destiny of being. This "ontological" interpretation, constructed in a compelling reading of the history of philosophy, requires that Heidegger first address the historicism and "ontological forgetfulness" prevailing in historical consciousness and historiography, in order to begin (...) thinking towards the possibility of another epoch of being, releasing us from the injustice that is inherent in the ontology that rules in the present historical dispensation. Although Heidegger avoids moral prescription, he cannot avoid critical entanglement in the moral-juridical sense of justice, despite his claims and protestations, since, as his own account of the fragment implies, justice and ontology must be inseparable. Reading Heidegger's commentary in relation to Benjamin's philosophy of history, I argue that Heidegger's reflections on justice suggest a narrative of tragic hope that resembles Benjamin's configuration of justice in his reading of the Baroque mourning-play, where the hopelessly fragmented and imperiled image of justice is revealed as emerging from a Leidensgeschichte fatefully bound up in the continuum of a Schuldgeschichte. In a study that goes beyond the ego affirmed by Freudian psychology, David Levin offers an account of personal growth and self-fulfillment based on the development of our capacity for listening. The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.

In this study, I examine the significance of the trace and its legibility in the phenomenologies of Merleau-Ponty and Levinas, showing that this trope plays a more significant role in Merleau-Ponty's thinking than has been recognized heretofore and that it constitutes a crucial point of contact between Merleau-Ponty and Levinas. But this point of contact is also, in both their philosophies, a site where their thinking is compelled to confront its limits and the enigmas involved in the description of the (...) topography of a hermeneutical flesh. It is argued that the significance of the trace consists in its alterity, its registering and inscribing in the very matter of the flesh an imperative spiritual assignment: the morally binding hold of the other person on my capacity to be responsive to the other's needs and bear responsibility for the other's welfare. The retrieval or recuperation of the trace, which, I argue, is inscribed as a certain predisposition in what, borrowing from Merleau-Ponty, we might call the prepersonal topology of the flesh, would thus constitute a task of the utmost importance for the formation of the moral self. However, given the paradoxical temporality of the trace and the hermeneutical nature of its legibility, the retrieval of the trace is not actually possible. Nevertheless, the attempt to retrieve it - one's commitment to retrieving it - is an absolutely imperative existential task, determining the character of the moral self. In both Merleau-Ponty and Levinas, however, the problematic nature of this recuperative project is manifested in the ambiguous, equivocal modality of their rhetoric, supposedly engaged in the phenomenological description of the primordial 'inscription', but oscillating, in fact, undecidably between descriptive and prescriptive, constative and performative, literal and metaphorical modes of discourse. It is argued that this, far from being a fault, is necessitated by the hermeneutic nature of the trace, which requires that the description be invocative and evocative, provoking a deep transformation in experience that would make the description true. It accordingly becomes clear that and why the moral phenomenologies of Merleau-Ponty and Levinas, depending as they must on a metaphorical interaction between language and experience, cannot function within the framework of the traditional correspondence theory of truth. In lieu of an abstract, here is a brief excerpt of the content:David Michael Levin ROUSSEAU'S CURSE Pretext Rousseau is the author of a text he called his Confessions. ' But neither a text nor a confession can exist without a reader, or an other. Like it or not, we readers are participants in the rite of Rousseau's confessions. Do we have anything to confess? When the reading of a confession uncovers the spelling of a curse, so that the (...) self-accused author appears to accuse his readers, the discoverers of the curse can no longer pretend their neutrality and innocence. In fact, the detectives must assume the identity of the accused. In such a special case, then, the inevitable work of textual interpretation magically doubles as the story of a mysteriously elusive "crime" and its final, or anyway presumed detection. But, as in the very best of such stories, neither the skillfully executed crime nor its invisible author—if indeed these terms denote anything at all—need be what they seem. So perhaps the only thing we can say for sure here is that the spelling of the curse is the curse of spelling. And this puts us on the track of a mystery as ancient as the art of writing itself—a mystery whose story the scholars of hermeneutics have thus far preferred to ignore. The mystery I have in mind is the secret affinity between writing and death. A careful hermeneutic approach to Plato's critique of writing, however, may give us a crucial clue. For what binds written language to the power of death is its role in mourning, its incarnation in the form of shadows: black configurations of shadows placed for visibility against the white of the paper. In Plato's Myth of the Cave, the crime of writing is dimly adumbrated. Writing is idolatry, worship of false images, shadows. Rousseau's Confessions, written near the end of his life in the shadow of death, does not escape the shadows of doubt and suspicion which we, his readers, having discovered our own selves inscribed into the darkness of the text, cannot easily refrain from casting. But as soon as we recognize in the shapes of these shadows a suspicion for which 76 David Michael Levin77 we are responsible, we must confess our fatal complicity in the closing of the hermeneutical circle. Commentary on the Text If Rousseau's Confessions does not read like the typical memoir, neither does it read like the typical confession. A final twist awaits us. We read with a certain innocence, or faith, not prepared for the transitive conclusion: the text, as it happens, will bequeath a monstrous and impossible burden. What is the reader to do? How could it be that this man, who seemed to honor us, and won our trust with the candor of his revelations, should so boldly, by one cross conceit, vanish, only to leave us double-crossed and within a labyrinth which, as he would have us believe, we ourselves have wrought? What are we to make of his work? At first, the Confessions appears to be a work of light: with dazzling clarity of mind and courage no less prismatic, Rousseau proposes to take his readers into the gloomy chasms of his soul. "My purpose," he declares, "is to display to my kind a portrait in every way true to nature, and the man I shall portray is myself" (p. 17). That this, however, is not the whole of his intention, we learn through a neighboring sentence. For he says: "Let the last trumpet sound when it will, I shall come forward with this work in my hand, to present myself before my Sovereign Judge, and proclaim aloud: 'Here is what I have done'..." (p. 17). And yet, even this does not fully disclose his design, since he concedes, somewhat later, that "it is as if, feeling my life escaping from me, I were trying to recapture it at its beginnings" (p. 31). But in the end, as in the beginning, darkness and light are one. And indeed, deep into the Seventh Book, we see that the author's light does begin to dim, and that he no longer speaks with much assurance. Nor is... (shrink)

This paper has three aims: first, to redeem some of Freud's most fundamental insights, so courageous and revolutionary that they were not even entirely appealing and intelligible to Freud himself; not understanding their teacher, Freud's disciples systematically distorted or suppressed his boldest speculations. By concentrating on an early Buddhist text of great profundity it is hoped to push our understanding of Freud beyond Freud himself. The exotic nature of this text makes it an especially powerful instrument for cutting through the (...) conservatism and resistance of venerable Freudian doctrine; secondly, to make more accessible a text which will encourage Western thinkers to do some serious thinking in the Buddhist way; and thirdly to examine the relationship between id and ego; it is shown why and how the egological construction (ego/superego) blocks the spontaneity of libidinal fulfillment.
