The arts of rule cover the exercise of power by princes and popular sovereigns, but they range beyond the domain of government itself, extending to civil associations, political parties, and religious institutions. Making full use of political philosophy from a range of backgrounds, this festschrift for Harvey Mansfield recognizes that although the arts of rule are comprehensive, the best government is a limited one.
This is an excellent article, probably the best there is in defence of prohibiting the sale of organs, and it deserves a much fuller discussion of detail than there is space for here.1 My concerns, however, are with generalities rather than detail. Although some such argument might justify prohibition of organ selling in particular places and at particular times, it is difficult to see how it could support the kind of general, universal policy currently accepted by most advocates of prohibition.Whenever (...) the subject of organ selling is discussed, it is useful to keep in mind the natural history of the debate. Prohibition was instituted by most governments and professional bodies just about as quickly as possible after it was discovered that payment for kidneys was going on, and was a direct response to feelings of moral outrage. It all happened without time for debate. It was only later, as challenges appeared, that justifications began to be produced; and when they did they followed a pattern long familiar to philosophers, and more recently recognised by moral psychologists, of determined efforts to find a justification for the initial intuition that organ selling must be wrong. New arguments kept appearing in the cause as earlier attempts were shown to fail, and many were so weak that they could not have seemed plausible unless their advocates had already been committed to their conclusion. If knowing requires believing on the basis of evidence that entails what’s believed, we have hardly any knowledge at all. Hence the near-universal acceptance of fallibilism in epistemology: if it's true that "we are all fallibilists now" (Siegel 1997: 164), that's because denying that one can know on the basis of non-entailing evidence1is, it seems, not an option if we're to preserve the very strong appearance that we do know many things (Cohen 1988: 91). Hence the significance of concessive knowledge (...) attributions (CKAs) (Rysiew 2001)—i.e., sentences of the form 'S knows that p, but it's possible that q' (where q entails not-p). To many, utterances of such sentences sound very odd indeed. According to David Lewis (1996: 550), however, such sentences are merely "overt, explicit" statements of fallibilism; if so, their seeming incoherence suggests that, contrary to our everyday epistemic pretensions, "knowledge must be by definition infallible" after all (ibid.: 549). -/- Recently Jason Stanley (2005) has defended fallibilism against the Lewisian worry that overtly fallibilistic speech is incoherent. According yo Stanley, CKAs are not just odd-sounding: in most cases, they are simply false. But this doesn't impugn fallibilism. Insofar as the odd-sounding utterances Lewis cites state the fallibilist idea, the latter portion thereof ('S cannot eliminate a certain possibility in which not-p', e.g.) expresses the idea that the subject's evidence doesn't entail what's (allegedly) known (hence, the negation of any contrary propositions). According to Stanley, however, this is not the best reading of the possibility clauses CKAs contain. On the correct account of the latter, while the sentences Lewis cites are almost always self-contradictory, they don't capture the fallibilist idea after all. Here, we argue that the sentences in question do express precisely the fallibilist idea, but argue that Lewis has nonetheless failed to raise a problem for the latter. In addition, we respond to worries that the resulting view of the semantics of epistemic possibility statements has certain unacceptable consequences. (shrink)
Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the (...) realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew. (shrink)

Politics, Philosophy & Economics, Ahead of Print. Sometimes, people consent to sex because they face social constraints. For example, someone may agree to sex because they believe that it would be rude to refuse. I defend a consent-centric analysis of these encounters. This analysis connects constraints from social contexts with constraints imposed by persons e.g. coercion. It results in my endorsing what I call the “Constraint Principle.” According to this principle, someone's consent to a sexual encounter lacks justificatory force if (...) they are consenting because withholding consent has an adverse feature, they are entitled to withhold consent without it being the case that withholding consent has this adverse feature; and it is not the case that the consent-giver has sincerely expressed that, out of the options that are available to their sexual partner, they most prefer to go through with the sexual encounter in the circumstances. ABSTRACT Previous research has consistently highlighted the importance of stakeholder engagement in identifying and developing solutions to ethical challenges in genomic research, especially in Africa where such research is relatively new. In this paper, we examine what constitutes good ethical practice in research, from the perspectives of genomic research participants in Uganda. Our study was part of a multi-site qualitative study exploring these issues in Uganda, Ghana and Zambia. We purposively sampled various stakeholders including genomic research participants, researchers, research ethics (...) committee members, policy makers and community members. This paper presents the findings from in-depth interviews with 27 people with diabetes who had participated in a diabetes genomic study. Data were collected using semi-structured interviews. Manual thematic content analysis was conducted using a framework approach. Findings indicate three key requirements that research participants see as vital for genomic research to be more responsive to research participants’ needs and contextual realities: de-emphasising the role of experts and institutions in the consenting process, clarity about the timing and nature of feedback both of findings relevant to the health of individuals and about the broad progress of the study, and more effective support for research participants during and after the study. This study investigated effects of codes of ethics on perceptions of ethical behavior. Respondents from companies with codes of ethics (n = 465) rated role set members (top management, supervisors, peers, subordinates, self) as more ethical and felt more encouraged and supported for ethical behavior than respondents from companies without codes (n = 301). Key aspects of the organizational climate, such as supportiveness for ethical behavior, freedom to act ethically, and satisfaction with the outcome of ethical problems were impacted by (...) the presence of an ethics code. The mere presence of a code of ethics appears to have a positive impact on perceptions of ethical behavior in organizations, even when respondents cannot recall specific content of the code. (shrink)

Research on whistle-blowing has been hampered by a lack of a sound theoretical base. In this paper, we draw upon existing theories of motivation and power relationships to propose a model of the whistle-blowing process. This model focuses on decisions made by organization members who believe they have evidence of organizational wrongdoing, and the reactions of organization authorities. Based on a review of the sparse empirical literature, we suggest variables that may affect both the members' decisions and the organization's responses.
In 1978, as the protests against the Shah of Iran reached their zenith, philosopher Michel Foucault was working as a special correspondent for _Corriere della Sera_ and _le Nouvel Observateur_. During his little-known stint as a journalist, Foucault traveled to Iran, met with leaders like Ayatollah Khomeini, and wrote a series of articles on the revolution. _Foucault and the Iranian Revolution _is the first book-length analysis of these essays on Iran, the majority of which have never before appeared in English. Edward Pols long ago established himself as a philosopher of first rank. His carefully wrought studies have succeeded each other with regularity, The Recognition of Reason, Whitehead’s Metaphysics, Meditation on a Prisoner: Towards Understanding Action and Mind, and The Acts of Our Being: A Reflection on Agency and Responsibility. While clearly within a tradition that can be traced through modernity to the middle ages and to classical philosophy, Pols is no slave to the past. He recognizes the perennial character of (...) fundamental philosophical problems, their complexity, and the challenge they offer to the contemporary investigator. This perspicacity does not lead him to deny the worth of past efforts, but positions him to frame old problems in a new way. Janet is known almost exclusively for his left-step periodic table (LSPT). A study of his writings shows him to have been a highly creative thinker and a brilliant draftsman. His approach was primarily arithmetic-geometric, but it led him to anticipate the discovery of deuterium, helium-3, transuranian elements, antimatter and energy from nuclear fusion. He recognized the (n + ℓ) rule well before Madelung and correctly placed the actinides. Ethical reasoning is an integral part of the work of a clinical ethics consultant. Ethical reasoning has a close relationship with an individual’s beliefs and values, which, for religious adherents, are likely to be tightly connected with their spiritual perspectives. As a result, for individuals who identify with a religious tradition, the process of thinking through ethical questions is likely to be influenced by their religious worldview. The connection between ethical reasoning and one’s spiritual perspective raises questions about the role (...) that CECs’ personal religious worldviews should play in their professional lives and their consultative work. This paper offers numerous arguments critiquing the inclusion of a consultant’s own spiritual perspective in her work and has identified only limited circumstances under which such inclusion might be permissible. In particular, these arguments lead to the conclusion that a CEC’s personal beliefs should never influence her ethical analysis or development of a recommendation. Further, religious appeals should not be used in communication during decision-making conversations other than to describe the patient or surrogate’s stated perspective. There may be limited cases in which a CEC may share her spiritual worldview with a patient with the intent of building a collaborative relationship, but such situations should be approached with extreme caution. In this paper we argue that attention to the intricacies relating to belief illustrate crucial difficulties with Schellenberg's hiddenness argument. This issue has been only tangentially discussed in the literature to date. Yet we judge this aspect of Schellenberg's argument deeply significant. We claim that focus on the nature of belief manifests a central flaw in the hiddenness argument. Additionally, attention to doxastic subtleties provides important lessons about the nature of faith.
The "mainstream" as the term is employed here finds it headwaters in antiquity, if not in the pre-Socratics, certainly in Plato and Aristotle. Through the centuries, that philosophy has been utilized and developed by the Stoics, the Neo-Platonists, the Scholastics, the Arabs, and by the Early Moderns. Dougherty approaches his topics from the perspective of the mainstream, specifically from the vantage point represented in contemporary discourse by the realism of Plato, Aristotle, and Aquinas. In commenting on contemporary social and (...) political issues, Dougherty provides a critique of the humbug that often passes as philosophy. Much of what is published as philosophy, he claims, has little to do with the pursuit of wisdom, and much is written without any knowledge of the history of philosophy - for example, a professor of moral philosophy, by his own admission, lecturing without any knowledge of the Stoics, and another professor at a prominent university, in a nationally televised series of lectures devoted to the history of philosophy, jumping from Plato to Descartes with nothing in between. Dougherty argues that the ancients, no less intelligent or observant than we, have much to say to us about nature, human nature, and the polity. It is from the vantage point of what he takes to be perennial philosophy that Dougherty discusses topics such as "The Acquisition and Use of Power," "Property as a Condition of Liberty," "Tolerance." "Responsibility," and "The Nature of Scientific Explanation." Briefly Considered is divided into three parts. Part One presents a series of essays on contemporary social and political issues. Part Two surveys some recent works in the history and philosophy of science, and Part Three provides an introduction to Islamic scholarship that will aid those seeking an understanding of the origins and history of that movement. In this most recent addition to the Palgrave Frontiers in Philosophy of Religion series, Trent Dougherty tackles the problem of animal pain. His book is an appropriate addition to the series as a 'report from the frontier' (3-4) of philosophy of religion for two reasons. First, Dougherty takes on a serious aspect of the problem of evil that has been historically neglected in most philosophical discussions of the problem (with the recent exceptions of Michael Murray's book, Nature Red (...) in Tooth and Claw (2008) and Nicola Hoggard Creegan's treatment of the subject in Animal Suffering and the Problem of Evil (2013) ). Second, Dougherty's attempt to reconcile the 'great profusion and intensity of animal suffering' (31) with the existence of a maximally great Being is inventive and original: Dougherty argues that the only possible way that animal suffering could be justified is if animals are resurrected and deified in much the same way that humans will be at the eschaton (3). While Dougherty admits that his project might 'strike the average reader as a bit far-fetched' (2), he does an admirable and convincing job of defending his theodicy's natural fit with Christian theism. In recent decades, left political projects in the United States have taken a strong legalistic turn. From affirmative action to protection against sexual harassment, from indigenous peoples’ rights to gay marriage, the struggle to eliminate subordination or exclusion and to achieve substantive equality has been waged through courts and legislation. At the same time, critiques of legalism have generally come to be regarded by liberal and left reformers as politically irrelevant at best, politically disunifying and disorienting at worst. This conjunction (...) of a turn toward left legalism with a turn away from critique has hardened an intellectually defensive, brittle, and unreflective left sensibility at a moment when precisely the opposite is needed. Certainly, the left can engage strategically with the law, but if it does not also track the effects of this engagement—effects that often exceed or even redound against its explicit aims—it will unwittingly foster political institutions and doctrines strikingly at odds with its own values. Brown and Halley have assembled essays from diverse contributors—law professors, philosophers, political theorists, and literary critics—united chiefly by their willingness to think critically from the left about left legal projects. The essays themselves vary by topic, by theoretical approach, and by conclusion. While some contributors attempt to rework particular left legal projects, others insist upon abandoning or replacing those projects. Still others leave open the question of what is to be done as they devote their critical attention to understanding what we are doing. Above all, Left Legalism/Left Critique is a rare contemporary argument and model for the intellectually exhilarating and politically enriching dimensions of left critique—dimensions that persist even, and perhaps especially, when critique is unsure of the intellectual and political possibilities it may produce. For centuries scientists have claimed that women are intellectually inferior to men and blacks are inferior to whites. Although these claims have been contested and corrected for centuries, they still continue to be made. Meanwhile, scientists have documented the harm done to women and blacks by the publication of such claims. Can anything be done to improve this situation? Freedom of research is universally recognized to be of first-rate importance. Yet, constraints on that freedom are also universally recognized. I consider (...) three of these constraints and argue for tighter restrictions on race- and gender-related cognitive differences research on their basis. (shrink)
Two major reasons feminists are concerned with science relate to science's social effects: that science can be a powerful ally in the struggle for equality for women; and that all too frequently science has been a generator and perpetuator of inequality. This concern with the social effects of science leads feminists to a different mode of appraising science from the purely epistemic one prized by most contemporary philosophers of science. The upshot, I suggest, is a new program for philosophy of (...) science, a program for a socially responsible philosophy of science. (shrink)
Efforts to professionalize the field of bioethics have led to the development of the Healthcare Ethics Consultant-Certified Program intended to credential practicing healthcare ethics consultants. Our team of professional ethicists participated in the inaugural process to support the professionalization efforts and inform our views on the value of this credential from the perspective of ethics consultants. In this paper, we explore the history that has led to this certification process, and evaluate the ability of the HEC-C Program to meet the (...) goals it has set forth for HCECs. We describe the benefits and weaknesses of the program and offer constructive feedback on how the process might be strengthened, as well as share our team’s experience in preparing for the exam. Functionalism in the philosophy of mind is the doctrine that what makes something a mental state of a particular type does not depend on its internal constitution, but rather on the way it functions, or the role it plays, in the system of which it is a part. This doctrine is rooted in Aristotle's conception of the soul, and has antecedents in Hobbes's conception of the mind as a “calculating machine”, but it has become fully articulated (and popularly endorsed) only (...) in the last third of the 20th century. Though the term ‘functionalism’ is used to designate a variety of positions in a variety of other disciplines, including psychology, sociology, economics, and architecture, this entry focuses exclusively on functionalism as a philosophical thesis about the nature of mental states. If business requires ethical solutions that are viable in the liminal landscape between concepts and corporate office, then business ethics and corporate social responsibility should offer tools that can survive the trek, that flourish in this well-traveled, but often unarticulated, environment. Indeed, feminist ethics produces, accesses, and engages such tools. However, work in BE and CSR consistently conflates feminist ethics and feminine ethics and care ethics. I offer clarification and invoke the analytic power of three feminist ethicists 'in action' whose (...) investigations into the "grey zones" of harms; identity and representational conventions; and "asymmetrical reciprocity" harmonize with business ethics' requirements. Tom Dougherty argues that culpably deceiving another person into sex is seriously wrong no matter what the content about which she is deceived. We argue that his explanation of why deception invalidates consent has extremely implausible implications. Though we reject Dougherty’s explanation, we defend his verdict about deception and consent to sex. We argue that he goes awry by conflating the disclosure requirement for consent and the understanding requirement. When these are distinguished, we can identify how deceptive disclosure (...) invalidates consent. This alternative explanation also allows for a response to Neil Manson’s recent criticisms of Dougherty’s argument. (shrink)
The goal of this paper is to propose a relational turn in healthcare professionalism, to improve the responsiveness of both healthcare professionals and organizations towards care of patients, but also professionals. To this end, it is important to stress the way in which difficult situations and vulnerability faced by professionals can have an impact on their performance of work. This article pursue two objectives. First, I focus on understanding and making visible shared vulnerability that arises in clinical settings from a (...) triple perspective: patient and family, health professionals, and institutions. Second, to address this challenge for professionalism, in this paper I articulate the term "relational centered-patient professionalism", which has two main axes. The relational approach means taking into account how the relationships among professionals, patients and institutions determine the constitution and evolution of those professional values. The focus on patient centered care is indispensable, because it is the ultimate goal pursued by the development of these professional values, and must always be at the center. (shrink)
