In this article we explore the ethical issues raised by permitting patients to pay for participation in clinical trials, and discuss whether there are any categorical objections to this practice. We address key considerations concerning payment for participation in trials, including patient autonomy, risk/benefit and justice, taking account of two previous critiques of the ethics of P4. We conclude that such trials could be ethical under certain strict conditions, but only if other potential sources of funding have first been explored (...) or are unavailable. (shrink)

In this paper, we give an account of the most dominant styles of the past 30 years, particularly in Europe, seeking to show their specific merits and problems. We focus on three styles of governance: a technocratic style, an applied ethics style, and a public participation style. We discuss their merits and deficits, and use this analysis to (...) assess the potential of the recently established governance approach of ‘Responsible Research and Innovation’. Both the European Union and the Council of Europe have a bearing on privacy in genomic databases and biobanking. In terms of legislation, the processing of personal data as it relates to the right to privacy is currently largely regulated in Europe by Directive 95/46/EC, which requires that processing be “fair and lawful” and follow a set of principles, meaning that the data be processed only for stated purposes, be sufficient for the purposes of the processing, be kept only for (...) so long as is necessary to achieve those purposes, and be kept securely and only in an identifiable state for such time as is necessary for the processing. The European privacy regime does not require the de-identification of personal data used in genomic databases or biobanks, and alongside this practice informed consent as well as governance and oversight mechanisms provide for the protection of genomic data. South Africa’s groundbreaking constitution explicitly confers a right of access to sufficient water. But the country is officially ‘water-stressed’ and around 10 % of the population still has no access to on-site or off-site piped or tap water. It is evident that a disconnect exists between this right and the reality for many; however the reasons for the continuation of such discrepancies are not always clear. While barriers to sufficient water are myriad, one significant factor contributing to insufficient and unpredictable (...) access to water is the high percentage of broken water pumps. Previous studies have reported that between 20 and 50 % of all hand operated water pumps installed on the African continent are broken, or out of use. Monitoring and maintenance of pumps, which in South Africa is the responsibility of local municipalities is often ineffective, in part due to the distances between municipal centres and rural communities and the consequent costs of site visits, as well as breakdowns within the local bureaucratic system. The emergence of new telemetry tools that can remotely monitor water applications constitutes a novel and cost-efficient alternative to undertaking regular sites visits. Sustainable, appropriate, low-cost telemetry systems are emerging that could be used to monitor the operational performance of water pumps, or a wide range of other field parameters, and to communicate this information swiftly and cheaply to water service providers, using SMS messages. Data on the performance of water pumps could also be made available to the public online. This is an example of how ICT can be used for water resources management and environmental regulation, as well as in the governance of socio-economic rights: helping to optimize water allocation by improving communication and strengthening accountability. Ideally, guidelines reflect an accepted position with respect to matters of concern, ranging from clinical practices to researcher behaviour. Upon close reading, authorship guidelines reserve authorship attribution to individuals fully or almost fully embedded in particular studies, including design or execution as well as significant involvement in the writing process. These requirements prescribe an organisation of scientific work in which this embedding is specifically enabled. Drawing from interviews with nutrition scientists at universities and in the food industry, we demonstrate that (...) the organisation of research labour can deviate significantly from such prescriptions. The organisation of labour, regardless of its content, then, has consequences for who qualifies as an author. The fact that fewer food industry employees qualify is actively used by the food industry to manage the credibility and ownership of their knowledge claims as allonymous science: the attribution of science assisted by authorship guidelines blind to all but one organisational frame. Im Jahr 2011 hat die EU eine Richtlinie erlassen, um in diesem Kontext Rechtssicherheit herzustellen. Bisher gibt es keine umfassenden systematischen Studien über ethische Aspekte grenzübergreifender Gesundheitsversorgung. In dieser Arbeit werden die rechtlichen Entwicklungen der grenzübergreifenden Gesundheitsversorgung dargestellt und die in der Literatur vereinzelt erwähnten ethisch relevanten Aspekte heuristisch und auf Patiententypologien aufbauend systematisch inventarisiert und diskutiert. Es zeigt sich, dass die Möglichkeit der Patientenmobilität und die damit vor (...) allem verbundenen Finanzierungsregelungen die Autonomie einiger Patienten sicherlich verbessern kann. Allerdings können wohl nicht alle Patienten Versorgungsverbesserungen erwarten. Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. In this innovative study, Lea David critically investigates the relationship between human rights and memory, suggesting that, instead of understanding human rights in a normative fashion, human rights should be treated as an ideology. Conceptualizing human rights as an ideology gives us useful theoretical and methodological tools to recognize the real impact human rights has on the ground. David traces the rise of the global phenomenon that is the human rights memorialization agenda, termed 'Moral Remembrance', and explores what (...) happens once this agenda becomes implemented. Based on evidence from the Western Balkans and Israel/Palestine, she argues that the human rights memorialization agenda does not lead to a better appreciation of human rights but, contrary to what would be expected, it merely serves to strengthen national sentiments, divisions and animosities along ethnic lines, and leads to the new forms of societal inequalities that are closely connected to different forms of corruptions. Liberal thinkers of the eighteenth and nineteenth centuries were alert to the political costs and human cruelties involved in European colonialism, but they also thought that European expansion held out progressive possibilities. In Progress, Pluralism, and Politics David Williams examines the colonial and anti-colonial arguments of Adam Smith, Immanuel Kant, Jeremy Bentham, and L.T. Hobhouse. Williams locates their ambivalent attitude towards European conquest and colonial rule in a set of tensions between the impact of colonialism on European states, the (...) possibilities of progress in distant and diverse places, and the relationship between universalism and cultural pluralism. In so doing he reveals some of the central ambiguities that characterize the ways that liberal thought has dealt with the reality of an illiberal world. What is called ``orthodox'' quantum mechanics, as presented in standard foundational discussions, relies on two substantive assumptions --- the projection postulate and the eigenvalue-eigenvector link --- that do not in fact play any part in practical applications of quantum mechanics. I argue for this conclusion on a number of grounds, but primarily on the grounds that the projection postulate fails correctly to account for repeated, continuous and unsharp measurements and that the eigenvalue-eigenvector link implies that virtually all interesting properties are (...) maximally indefinite pretty much always. I present an alternative way of conceptualising quantum mechanics that does a better job of representing quantum mechanics as it is actually used, and in particular that eliminates use of either the projection postulate or the eigenvalue-eigenvector link, and I reformulate the measurement problem within this new presentation of orthodoxy. IN a discussion of the reading in Lucan i. 231, Richard Bentley dismissed Grotius's suggestion Ariminon: ignes on the correct grounds that, like Virgil, Lucan avoids starting a new sentence or clause at the beginning of the sixth foot of the hexameter, except with a pair of monosyllables or with a word emphasized either by repetition or by a strong contrast.

Among classical Latin poets, Juvenal is unusually richly provided with ancient scholia; at the same time, the scholia exhibit an unusual degree of ignorance and sheer stupidity. What is perhaps most surprising, however, is the extent to which these commentators appear to have been worse informed than we are today concerning the identity of individuals who appear in the satires.

In 1884 Ivo Bruns began his Lucrez-Studien, on the relationship between Lucretius' treatment of Epicureanism and the exposition by the philosopher himself in the extant Epistles, with the question for whom did Lucretius write? His answer was to show that the general public, who were the poet's real objective, were very different readers from the disciples whom Epicurus addressed in the Letter to Herodotus and similar works. This conclusion, and the subsequent investigation of the ways in which this difference affected (...) the treatment of doctrine in the two works, does not concern me. My interest is rather in the manner in which Bruns tackles the problem of the ostensible addressee, Memmius, and the extent to which this man remains in Lucretius' mind throughout the whole six books. Margaret Cavendish was a philosopher, poet, scientist, novelist, and playwright of the seventeenth century. Her work is important for a number of reasons. It presents an early and compelling version of the naturalism that is found in current-day philosophy; it offers important insights that bear on recent discussions of the nature and characteristics of intelligence and the question of whether or not the bodies that surround us are intelligent or have an intelligent cause; it anticipates some of the central views (...) and arguments that are more commonly associated with figures like Thomas Hobbes and David Hume. This is the first full account of Cavendish’s philosophy and covers the whole span of her work. David Cunning begins with an overview of Cavendish’s life and work before assessing her contribution to a wide range of philosophical subjects, including her arguments concerning materialism, experimentation, the existence of God, social and political philosophy and free will and compatibilism. Setting Cavendish in both historical and philosophical context, he argues that like Spinoza she builds on central tenets of Descartes’ philosophy and develops them in a direction that Descartes himself would avoid. She defends a plenum metaphysics according to which all individuals are causally interdependent, and according to which the physical universe is a larger individual that constitutes all of reality. Cavendish is essential reading for students of seventeenth-century philosophy, early modern philosophy and seventeenth-century literature. (shrink)

Humanists, for whom "man is the measure" of reality, exaggerate our capacity to live without the sense of an independent measure. Absolutists, who proclaim our capacity to know an independent reality, exaggerate our cognitive powers. This paper describes how to compare laws (often from a common root) between jurisdictions. It identifies differences between Civil and Common Law traditions, and the importance of Sovereignty in implementing international instruments. It then discusses both a neutral language approach and finally a functional approach to comparing different jurisdictions' instruments.

The only external evidence we have of the date of publication of Suetonius' Caesares is the statement of Iohannes Lydus that it contained a dedication to Septicius Clarus as praetorian prefect—a statement, incidentally, which is related to the correct nomenclature of the office, and not in any way to the persons concerned. This dedication, lost along with the opening chapters of Iulius, must accordingly have been made some time during the years 119–22, before Septicius and Suetonius were dismissed from their (...) respective posts, apparently for lack of respect to the empress. What is by no means certain is that the dedicatory epistle was attached originally to the whole series of Lives; nor that all the Lives were completed, far less published, while Suetonius was still employed as ab epistulis to Hadrian. This paper introduces questions about the nature of law. It briefly identifies why modern biotechnology poses interesting issues for regulation. Thereafter it considers two questions—the legitimacy of law, and the relationship between law and morality. It concludes by considering issues of participation and of appealing to the public interest.

In an earlier study I argued that the appearance of the name of Memmius in the first, second, and fifth books alone of Lucretius de Rerum Natura is only the most striking indication of a fundamental change in the poet's attitude towards his reader which is already well established quite a short way through book 5, and which makes it almost incontestable that Lucretius wrote books 3, 4, and 6 after he had lost all hope of converting Memmius to Epicureanism.

The critical concern of the present volume is contemporary naturalism, both in its scientific version and as represented by newly emerging hopes for another, philosophically more liberal, naturalism.1 The papers collected here are state-of-the-art discussions that question the appeal, rational motivations, and presuppositions of scientific naturalism across a broad range of philosophical topics. As an alternative to scientific naturalism, we offer the outlines of a new non- reductive form of naturalism and a more inclusive conception of nature than any provided (...) by the natural sciences. Our authors collectively believe that holding scientific naturalism up for philosophical scrutiny and challenging its misconceptions is of the first importance both for understanding ourselves and our place in the world; and, also, for the future direction of philosophy itself. We propose a formal framework for interpretable machine learning. Combining elements from statistical learning, causal interventionism, and decision theory, we design an idealised explanation game in which players collaborate to find the best explanation for a given algorithmic prediction. Through an iterative procedure of questions and answers, the players establish a three-dimensional Pareto frontier that describes the optimal trade-offs between explanatory accuracy, simplicity, and relevance. Multiple rounds are played at different levels of abstraction, allowing the players to explore overlapping causal (...) patterns of variable granularity and scope. We characterise the conditions under which such a game is almost surely guaranteed to converge on a optimal explanation surface in polynomial time, and highlight obstacles that will tend to prevent the players from advancing beyond certain explanatory thresholds. The game serves a descriptive and a normative function, establishing a conceptual space in which to analyse and compare existing proposals, as well as design new and improved solutions. (shrink)
