Berger and Whistler provide a ground-breaking account of Schelling's first controversy with his critic A.C.A. Eschenmayer in 1801, which focused on the philosophy of nature. They argue that key Schellingian concepts, such as identity, potency and abstraction, were first forged in his early debate with Eschenmayer.

This thesis is a study of the relationship between 'nature' and 'spirit' in the philosophies of F.W.J. Schelling and G.W.F. Hegel. I aim to show that Schelling and Hegel are involved in a shared task of conceiving spiritual freedom as a necessary outcome of nature's inner, rational development. I argue that by interpreting spirit as 'emergent' from nature, the absolute idealists develop a 'third way' beyond Cartesian dualism and monist naturalism. For on the idealist account, nature and spirit are neither (...) ontologically discontinuous, as if separated by an insurmountable 'gap', nor are they identical, as if spirit were simply a 'second nature'. Rather, according to both Schelling and Hegel, spirit emerges from nature as its ontologically distinct and non-natural telos. What makes Schelling's and Hegel's philosophies of nature so unique, however, is not simply that they present spiritual freedom as dependent upon nature, but that the ontological specificity of spirit is shown to be rationally necessary. In fact, neither the early Schelling nor Hegel is concerned with the historical emergence of spirit. Rather, both philosophers see the 'emergence' of spirit as an atemporal feature of being that must be derived through sheer reason—be it Schelling’s method of 'depotentiation' or Hegel's dialectical logic. I therefore argue that by bracketing the question of historical emergence, Schelling and Hegel each develop a distinctive logic of emergence whereby spiritual freedom is shown to be necessary thanks to the ontological structure of the impersonal, natural world. In my concluding chapter, I consider Schelling's argument in his Berlin lectures of the 1840s that the idealist logic of emergence must be supplemented with a speculative consideration of historical emergence if philosophy is to be a complete science of reality. From this perspective, it looks as though both Hegel's and the early Schelling's 'logics of emergence', despite all their promise, presuppose the idea that nature's necessary stages need not express themselves in temporal succession in order for them to be fully realised. I conclude the thesis by suggesting that Schelling's Ages of the World was meant to overcome this apparent limit of the 'logic of emergence' without abandoning its fundamental aims. For in the Ages, nature's rationally necessary development is presented as unfolding in time, and time is understood as nothing other than the actual development of nature into spirit. (shrink)

It argues that the difference between these philosophers must be understood in light of their shared commitment to the philosophy of nature and the idea that spirit, or humanity, emerges from the natural world. This article presents the argument that our understanding of the nature of the relationship between modern constitutionalism and religious difference has suffered with the success of the story of legal tolerance and multiculturalism. Taking up the Canadian case, in which the conventional narrative of legal multiculturalism has such purchase, this piece asks how the interaction of law and religion – and, in particular, the practices of legal tolerance – would look if we sought in earnest to understand law as a (...) component, rather than a curator, of cultural diversity in modern liberal societies. Understanding the law as itself a cultural form forces us to think about the interaction of law and religion as an instance of cross-cultural encounter. Drawing from theoretical accounts of cross-cultural encounter and philosophical literature about the nature of toleration, and paying close attention to the shape of Canadian constitutional doctrine on religious freedom , this paper suggests that legal toleration is far less accommodative and far more assimilative than the conventional narrative lets on. Influential alternative theoretical accounts ultimately reproduce this dynamic because they similarly obscure the role of culture on both sides of the encounter of law and religion. Indeed, owing to the particular features of the culture of law’s rule, even the more thickly cultural “solutions” proposed in dialogic theory ultimately fail. In the end, this article exposes the very real cultural limits of legal tolerance. (shrink)

ld English manors have their ghosts. And though I would not want to call analytic philosophy a ‘manor’, nor exactly ‘old’, it certainly is of some decent English origin, and it left adolescence a while ago. No wonder then, that it is not exempt from haunting terrors. One particular spectre has been haunting it for decades; it already gave some analytic pioneers the creeps, and we still now and then find people terrified by it: the ghost of old Bradley has (...) not yet found its rest and keeps on threatening people with his notorious regress. The present essay is a lecture in exorcism; much of the fear old Bradley spread, so I will argue, peters out once we dare to look it in the eye. However, this essay is not primarily exegetical, and especially not an attempt in interpreting Bradley. I find Bradley’s writings, to say the least, not particularly accessible. Discussions of isolated passages from his longer treatises will probably be less fruitful than a careful study of the positions within the whole argumentative structure, supplied by the examination of Bradley’s intellectual upcoming. His treatments on relations and properties, in which he develops the famous regress argument, are motivated by a radical goal: a vindication of some form of monism. Using a new dataset of environmental, social, and corporate governance company ratings for the European market, this article examines whether socially responsible stock selection adds or destroys value in terms of portfolio performance. From 2004 to 2012, we find the following: Negative screens excluding unrated stocks from a representative European stock universe allow investors to significantly outperform a passive investment in a diversified European stock benchmark portfolio. Additional negative screens based on environmental and social scores neither add nor destroy portfolio (...) value, when cut-off rates are not too high. In contrast, governance screens can significantly increase portfolio performance under similar conditions. Thus, investors in the European stock market can do well while doing good. Because of a loss of diversification, positive screens can cause portfolios to underperform the benchmark. This implies that investors should concentrate on eliminating the worst firms. Our results are robust along several dimensions, namely, choice of performance measure, time, test parametrisation, portfolio weighting scheme, approximation of the risk-free rate, and consideration of transaction costs. Walter Benjamin's writings on the Paris shopping arcades and nineteenth- century urban industrial culture are frequently referenced in contemporary examinations of ‘modernity'. In current cultural studies Benjamin's investigation of the aesthetics of merchandise and his insights into the social fact of mass consumerism are repeatedly invoked. Indeed these investigations may be alluded to even more frequently than reference is made to Benjamin's once much reproduced essay ‘The Work of Art in the Age of Mechanical Reproduction'. A decade (...) and a half ago Benjamin's ‘Artwork’ essay was one of the most frequently cited essays in new art history and cultural studies academic textbooks. To put it crudely, a turnaround has occurred. In the 1970s academic attention spotlit Benjamin's materialist history of artistic production, distribution and reception as presented in the ‘Artwork’ essay and in ‘The Author as Producer’. The political events of 1968 had made Benjamin extremely readable. His thoughts discharged after some years delay. Most alluring to the German 68ers were the statements on political art and Benjamin's dissections of fascism. Also entrancing were Benjamin's analyses of experience. Benjamin wrote extensively, and from early on, about ways of expanding the conceptualisation of experience: sometimes philosophically - by means of Kant-critique, sometimes aesthetically — by a probing of surrealism and psychoanalysis, and sometimes practically – through experiments with hashish, which were later written up as protocols. John Berger's Ways of Seeing represented an original attempt to introduce Benjamin to an English audience, via the appropriately mass mediation of television. Benjamin was adopted as a leftist mascot, and a materialist who could recommend directions for art interpretation and more importantly, cultural practice. The approaches of the 1980s and 1990s, inflected by the priorities of feminist and postmodernist scholarship as they have loomed in cultural studies, art history and sociology, increasingly turned to those aspects of Benjamin's work that appear to illuminate a burgeoning interest in urbanism and consumerism. Interest has shifted away from cultural production and critique towards consumption and characterization. These days, Benjamin is regularly served up as one of the theorists who can vindicate a feel-good consumerism, lending a glamourizing and theoretical loftiness to the activity of shopping. Indeed, far from blasting the chimeras of commodity fetishism, Benjamin becomes the commodity's high-priest. (shrink)

This paper has two aims. The first is to present and defend a new argument for rights contributionism – the view that the notion of a moral claim-right is a contributory (or pro tanto) rather than overall normative notion. The argument is an inference to the best explanation: it is argued that (i) there are contributory moral factors that contrast with standard moral reasons by way of having a number of formal properties that are characteristic of rights, even though they (...) can be overridden, and (ii) that this is best explained by a view that takes these factors to correlate with rights. The second aim is to show that the truth of rights contributionism matters for normative ethics. More specifically, it is argued that rights contributionism clears the way for deontologists to justify the pre-theoretically plausible verdict that we have a duty to save the greater number in so-called Taurek scenarios – scenarios in which we have to choose between saving either a greater or a smaller number of different people. The chapter offers a novel and distinctively deontological explanation of this verdict that is based on the assumption that everyone has a pro tanto right to be saved in a Taurek scenario. (shrink)

BACKGROUND: Little is known about how hospitalized patients share decisions with physicians. METHODS: We conducted an observational study of patient-doctor communication on an inpatient medicine service among 18 hospitalized patients and 9 physicians. A research assistant (RA) approached newly hospitalized patients and their physicians before morning rounds and obtained consent. The RA audio recorded morning rounds, and then separately interviewed both patient and physician. Coding was done using integrated analysis. RESULTS: Most patients were white (61%) and half were female. Most (...) physicians were male (66%) and of Southeast Asian descent (66%). All physicians explained the plan of care to the patients; most believed that their patient understood. However, many patients did not. Physicians rarely asked the patient for their opinion. In all those cases, the decision had been made previously by the doctors. No decisions were made with the patient. Patients sometimes disagreed. CONCLUSIONS: Shared decision-making may not be the norm in hospital care. Although physicians do explain treatment plans, many hospitalized patients do not understand enough to share in decisions. When patients do assert their opinion, it can result in conflict. PRACTICE IMPLICATIONS: Some hospitalized patients are interested in discussing treatment. Improving hospital communication can foster patient autonomy. (shrink)

The existence and uniqueness of a maximum point for a continuous real—valued function on a metric space are investigated constructively. In particular, it is shown, in the spirit of reverse mathematics, that a natural unique existence theorem is equivalent to the fan theorem.

In a recent article in this journal, D. Wade Hands reviewed Charles Taylor's two-volume work, Philosophical Papers. Hands predicts that Taylor's work will have no impact on the philosophy of economics. This may indeed turn out to be the case; but if so, it will only be because the profession is not listening. Of course, it is typical of the profession to be more interested in exporting its product than in learning from other disciplines. This is exemplified in Hands's use (...) of the term “philosophy of economics” – philosophy is the handmaiden of the highly successful enterprise of economics. But this journal is called Economics and Philosophy, which means that a conversation requiring an openness and attentiveness is called for between economics and philosophy. (shrink)

Dini's theorem says that compactness of the domain, a metric space, ensures the uniform convergence of every simply convergent monotone sequence of real-valued continuous functions whose limit is continuous. By showing that Dini's theorem is equivalent to Brouwer's fan theorem for detachable bars, we provide Dini's theorem with a classification in the recently established constructive reverse mathematics propagated by Ishihara. As a complement, Dini's theorem is proved to be equivalent to the analogue of the fan theorem, weak König's lemma, in (...) the original classical setting of reverse mathematics started by Friedman and Simpson. Paperback $40.28, isbn 978-1-350-29704-3.The editors Steven Burik, Robert Smid and Ralph Weber, who have all made important revisions (...) to the theory of comparative philosophical method, have pulled together the contributions of ten other influential scholars in the field and their own work into this much-needed collection of essays. There has been much written about the methodology of comparative philosophy in the last hundred years. More recent reflections in this field have been strongly fueled by post-colonial evaluations as well as a proliferation of methodological approaches. Nonetheless, some consensus on what methods the field should adopt and to what ends still needs overt discussion. The editors argue in an Introduction and Epilogue to the volume that, now faced with the "obstacles" of often conflicting principles and aims of different methodological approaches which leads to their frequent mutual rejection, there is need for a wide acceptance of pluralism in the methodology of comparative philosophy (pp. 4–5). This methodological pluralism, for the editors, should be understood in two senses. Firstly, there should be a broad-based "methodological commitment to pluralism," which amounts to an acceptance that there is an existing plurality of philosophical traditions in the world which have very different foundational insights and worldviews (p. 254). Secondly, the fact that the plurality of philosophical traditions actually exhibits quite different approaches ought, despite any individual comparativist's preferred method, compel us to accept that this diversity is best dealt with by a plurality of research approaches (pp. 254–55). That is to say that, while the editors both acknowledge and endorse the particular specializations of any and all scholars engaged in intercultural philosophy, they urge each scholar to accept that both a descriptive and prescriptive pluralism of philosophical methodologies are necessary for the continued flourishing of the field. In order to demonstrate this descriptive and prescriptive pluralism, the editors organize the volume into what they call five "constellations" of discussion (p. 8).In the first "constellation" labeled "Necessary Conditions," Robert Neville, Jaap [End Page 1] van Brakel and Lin Ma offer general and detailed frameworks for what sorts of assumptions are needed for any comparative philosophical research to proceed fruitfully. Neville, while happily admitting that we need to be vigilant about biases and other limitations when crossing into other traditions, insists that philosophers need to at once be searching for the truth in any given comparison of ideas, while simultaneously always reflectively constructing the right categories on the basis of which the comparison may be justified and sound (pp. 22–27). Van Brakel and Ma present in their co-authored essay an elaborate blueprint for comparative research. This blueprint, while also conceding that there can never be "any one right interpretation" of any individual text, much less whole traditions, posit a basic "family resemblance principle" which highlights "mutually recognizable human practices" as the basic condition enabling comparative reflection in the first place (pp. 34–39).In the second "constellation," entitled "Generalization and Essentialization," Roger Ames and François Jullien insist in various ways that, while the essentialism that bedeviled previous eras of philosophy in general and comparative philosophy in particular should be rejected, generalizations are still fundamentally necessary to crystalize the most important ways in which traditions are distinct from one another. Ames, defending himself against recent allegations of essentialism in his approach, insists that the field needs to be supported by both a "self-reflective hermeneutical sensitivity" which acknowledges the positionality of the inquirer as well as a commitment to "search within the soil" of, in his case, the Chinese philosophical tradition for its own models of meaning (p. 58). To the latter end, Ames defends accurate generalizations which can help us understand "the language, the customs and the life-forms of a living tradition" since these, contrary to suspicions, aid us in preventing essentialization in comparative work (p. 63).
