A argumentação desenvolvida no presente artigo se propõe a defender a interpretação austera do construtivismo em Kant das objeções a ela levantadas por Jeremy Schwartz (2017) em seu artigo _Was Kant a ‘Kantian Constructivist’?_. Tendo isso em vista, primeiramente, procede-se à reconstrução da interpretação de Schwartz para a distinção analítico-sintética na esfera prática a partir da caracterização por contradição e à indicação de objeções para sua aceitação. Na sequência, apresenta-se a caracterização de analiticidade por continência e como esta pode ser (...) transposta para o caso dos imperativos sem resultar em conflitos com a interpretação austera do construtivismo. Por fim, delineiam-se considerações quanto à formalidade dos princípios constitutivos da razão prática e seu escopo, chegando à conclusão de que não se pode estabelecer uma identidade entre construtivismo austero e logicismo prático. This book investigates several dimensions of the concept of cosmopolitanism since Kant. The first of these dimensions is a world vision that considers the construction of a 'cosmopolitan self' as a question of justice. The second is the idea that a local political-legal order is fully democratic only if it respects the environment and the human rights of all people of the world, regardless of their citizenship. The third dimension concerns the practice of crossborder associations between individuals, institutionalized or not (...) (cosmopolitics, as Balibar called it). The fourth considers individuals as subjects of international law, as in the case of individual petitions concerning human rights through the European Court of Human Rights and individual responsibility in international criminal law. Finally, the fifth dimension is a form of ecological consciousness based on the relationship between the self and the cosmos, which would imply a profound revision of modern anthropocentric concepts."--Publisher. In this paper I argue that Kant’s political and juridical philosophy justifies a type of normative legal positivism that implies specific notions of law and legal freedom which determine and restrict the sphere of action of judges and jurists. Finally, I defend that, according to Kant’s practical philosophy, the normative connection between justice and law is not supposed to be carried out at the juridical level, as a meta-juridical theory, but at the political one, making it a meta-political theory.

In this article I argue that the current readings of permissive law fall into hermeneutical difficulties and do not completely explain Kant’s complex use of the concept. I argue that the shortcomings of these interpretations can only be overcome by relating permissive law to practical teleology. That teleological thinking has a role in Kant’s moral thought by way of history is not new. Here, however, I argue that the system of rights itself is in some manner teleologically situated. These four volumes address the question of the kinds of conduct may the state make criminal without infringing on the moral autonomy of individual citizens.

I defend a model of the musically extended mind. I consider how acts of “musicking” grant access to novel emotional experiences otherwise inaccessible. First, I discuss the idea of “musical affordances” and specify both what musical affordances are and how they invite different forms of entrainment. Next, I argue that musical affordances – via soliciting different forms of entrainment – enhance the functionality of various endogenous, emotiongranting regulative processes, drawing novel experiences out of us with an expanded complexity and phenomenal (...) character. I argue that music therefore ought to be thought of as part of the vehicle needed to realize these emotional experiences. I appeal to different sources of empirical work to develop this idea. In the contemporary debate on free will, most philosophers assume that the defense of libertarianism implies the defense of the notion of alternative possibilities. This article discusses this presupposition by showing that it is possible to build a libertarianism without alternative possibilities, apparently more robust than libertarianism with alternative possibilities. Inspired by Bergson, this nonclassical libertarianism challenges the idea that all causation implies the actualization of a predetermined possibility (an idea shared by determinism and classical libertarianism). Moreover, it challenges the (...) idea that free will is a mere choice between prefixed possibilities: for this libertarianism, free will is the result of a creative process of the mind—an entirely causal process whose outcome is not, however, predetermined. This nonclassical libertarianism describes the process of forming a will in a more realistic way than classical libertarianism does. Furthermore, it is not threatened by the problem of chance. While there is a steadily growing literature on epistemic injustice in healthcare, there are few discussions of the role that biomedical technologies play in harming patients in their capacity as knowers. Through an analysis of newborn and pediatric genetic and genomic sequencing technologies (GSTs), I argue that biomedical technologies can lead to epistemic injustice through two primary pathways: epistemic capture and value partitioning. I close by discussing the larger ethical and political context of critical analyses of GSTs and their broader (...) implications for just and equitable healthcare delivery. (shrink)

Em trabalhos anteriores, analisamos as formas pelas quais a sociologia vem sendo cobrada nos vestibulares de algumas universidades em diferentes regiões brasileiras e no ENEM. Além do entendimento de que formas são essas, uma das conclusões a que chegamos foi a de que, no ENEM, dificilmente há o acionamento de conhecimento sociológico prévio para a resolução da prova. Entendemos que, por mais que a cobrança na redação e de modo interdisciplinar traga algum reconhecimento ao saber sociológico, a construção de questões (...) que possam ir além da interpretação de texto é fundamental para a consolidação da sociologia no exame. Sendo assim, como continuidade de nossa reflexão, objetivamos, no presente trabalho, discutir, afinal, o que é esse conhecimento prévio, que pode ser entendido como conceitos, temas e teorias sociológicos. Mas quais são eles e como são cobrados na prática? Como sabemos, não há uma definição nacional dos conteúdos da sociologia, mas algumas propostas estaduais. Analisaremos quais são, segundo os editais das universidades, as matérias de sociologia presentes em alguns vestibulares, se é possível chegar a um mapa comum e se esse mapa é compatível ou não com os currículos mínimos estaduais. Para isso, analisaremos editais dos vestibulares em que a sociologia está presente e do ENEM. (shrink)

This paper deals with the transnationalism of racial anthropological frameworks and its role in the understanding of human difference during India’s decolonization and nation-building. With attention to the circulation of scientific objects, I focus on the practices and articulations of Irawati Karve, an Indian anthropologist with a transnational scientific trajectory and nationalistic political engagements. I argue that Karve’s adaptation of an internationally validated German racial approach to study caste, ethnic and religious groups contributed to the further racialization of these categories (...) as well as to the racialization of nationalistic projects in Maharashtra and India. I conclude with a reflection on the transnationalization of the coloniality of racialization. (shrink)

One of liberalism’s core commitments is to safeguarding individuals’ autonomy. And a central aspect of liberal social justice is the commitment to protecting the vulnerable. Taken together, and combined with an understanding of autonomy as an acquired set of capacities to lead one’s own life, these commitments suggest that liberal societies should be especially concerned to address vulnerabilities of individuals regarding the development and maintenance of their autonomy. In this chapter, we develop an account of what it would mean for (...) a society to take seriously the obligation to reduce individuals’ autonomy-related vulnerabilities to an acceptable minimum. In particular, we argue that standard liberal accounts underestimate the scope of this obligation because they fail to appreciate various threats to autonomy. (shrink)

In ”Skepticism,” Peter Klein distinguishes between the “Academic Skeptic” who proposes that we cannot have knowledge of a certain set of propositions and the “Pyrrhonian Skeptic” who refrains from opining about whether we can have knowledge. Klein argues that Academic Skepticism is plausibly supported by a “Closure Principle‐style” argument based on the claim that if x entails y and S has justification for x, then S has justification for y. He turns to contextualism to see if it can contribute to (...) the discussion between one who claims that we can have knowledge about some epistemically interesting class of propositions and the Academic Skeptic. He outlines the background of Pyrrhonian Skepticism, pointing out that the Pyrrhonist withholds assent concerning our knowledge‐bearing status because reason cannot provide an adequate basis for assent. He assesses three possible patterns of reasoning, and concludes that the Pyrrhonist view, that reason cannot resolve matters concerning the nonevident, is vindicated. (shrink)

Willard V. Quine’s 1951 article, “Two Dogmas of Empiricism” (Two Dogmas) was taken to be revolutionary because it rejects the analytic-synthetic distinction and the thesis that empirical statements are confirmed individually rather than holistically. The present chapter, however, argues that the overcoming of modern philosophy already included the overcoming of these theses by Hegelians, pragmatists and two critics of Hegelianism and pragmatism, Grace and Theodore de Laguna. From this perspective, Two Dogmas offers a Hegelian epistemology that was already superseded in (...) 1910. The perspective is largely based on the de Lagunas’ 1910 book Dogmatism and Evolution: Studies in Modern Philosophy. The de Lagunas’ book also helps to make clear that the real revolution Two Dogmas participated in was the marginalisation of their work and that of other speculative philosophers. Grace de Laguna surely recognised much of this when she stood opposite Quine as he first presented Two Dogmas. (shrink)

This chapter provides the background to the American women philosophers’ works that are introduced and collected in Knowledge, Mind and Reality: An Introduction by Early Twentieth-Century American Women Philosophers. We describe the institutional context which made these works possible and their methodological and theoretical background. We also provide biographies for their authors.

In this paper, I first consider a famous objection that the standard interpretation of the Lockean account of diachronicity (i.e., one’s sense of personal identity over time) via psychological connectedness falls prey to breaks in one’s personal narrative. I argue that recent case studies show that while this critique may hold with regard to some long-term autobiographical self-knowledge (e.g., episodic memory), it carries less warrant with respect to accounts based on trait-relevant, semantic self-knowledge. The second issue I address concerns the (...) question of diachronicity from the vantage point that there are (at least) two aspects of self—the self of psychophysical instantiation (what I term the epistemological self) and the self of first person subjectivity (what I term the ontological self; for discussion, see Klein SB, The self and its brain, Social Cognition, 30, 474–518, 2012). Each is held to be a necessary component of selfhood, and, in interaction, they are appear jointly sufficient for a synchronic sense of self (Klein SB, The self and its brain, Social Cognition, 30, 474–518, 2012). As pertains to diachronicity, by contrast, I contend that while the epistemological self, by itself, is precariously situated to do the work required by a coherent theory of personal identity across time, the ontological self may be better positioned to take up the challenge. In this paper I examine the concept of cross-temporal personal identity (diachronicity). This particular form of identity has vexed theorists for centuries -- e.g.,how can a person maintain a belief in the sameness of self over time in the face of continual psychological and physical change? I first discuss various forms of the sameness relation and the criteria that justify their application. I then examine philosophical and psychological treatments of personal diachronicity(for example,Locke's psychological connectedness theory; the role of episodic memory) (...) and find each lacking on logical grounds, empirical grounds, or both. I conclude that to achieve a successful resolution of the issue of the self as a temporal continuant we need to draw a sharp distinction between the feeling of the sameness of one's self and the evidence marshaled in support of that feeling. Politicians, preachers, and ordinary people speak often of character; psychologists study `personality', used as a term of art with meanings close to `character'. Most ethical philosophers in the last two hundred years, on the other hand, have not had much to say about character. This book attempts to understand character and to refocus ethical philosophy so that character is central.

The article is a summary of the paper presented at the VI Congress of Theology in St. Paul with the theme "Times urban: the challenges of ministry in the big city." The text deals with the relationship between modernity and postmodernity, revealing the challenges which are imposed on faith and reason in contemporary urban space. The ideological challenges based on the fundamental characteristics of this moment in history touching human relationships and pastoral practice because they relate primarily to the truth, (...) values, ethics and life. This complexity also reverberates in the recent speeches of the Magisterial of the Church showing the concern and attention to the whole man who is facing these provocations. (shrink)

Resenha do Livro "O ofício do filósofo estóico", de Rachel Gazolla.

Este artigo apresenta duas teses sobre as vantagens do uso de obras de arte para o ensino de Filosofia no Ensino Médio: a primeira é a de que obras de arte podem servir de introdução ao filosofar na escola - indo além das questões estéticas e chegando a interrogações da filosofia política, metafísica, moral e epistemológica. Num primeiro momento, apresenta-se exemplos de obras e casos ricos para esse intuito. Num segundo momento, parte desses particulares para uma compreensão mais ampla, explicando, (...) a partir das teses de Arthur Danto, Ronald Moore e Ronai Rocha, o valor didático e filosófico daquelas no Ensino Médio. Ainda quanto à primeira tese, sustenta-se que a arte também serve ao exercício de uma das principais competências filosóficas: a argumentação. A segunda tese é a de que as artes podem servir de ponto de partida para uma proposta curricular interdisciplinar: no presente caso, entre a Filosofia e as demais disciplinas escolares. Apresenta-se possíveis cruzamentos conceituais e temáticos entre as disciplinas em questão, fornecidos por obras de arte e outros fenômenos estéticos. Nossa conclusão é a de que abordar a arte no Ensino Médio, sob o ponto de vista filosófico, é uma oportunidade didática e cognitiva que não deve ser menosprezada. (shrink)

In this paper I argue that much of the confusion and mystery surrounding the concept of "self" can be traced to a failure to appreciate the distinction between the self as a collection of diverse neural components that provide us with our beliefs, memories, desires, personality, emotions, etc (the epistemological self) and the self that is best conceived as subjective, unified awareness, a point of view in the first person (ontological self). While the former can, and indeed has, been extensively (...) studied by researchers of various disciplines in the human sciences, the latter most often has been ignored -- treated more as a place holder attached to a particular predicate of interest (e.g., concept, reference, deception, esteem, image, regulation, etc). These two aspects of the self, I contend, are not reducible -- one being an object (the epistemological self) and the other a subject (the ontological self). Until we appreciate the difficulties of applying scientific methods and analysis to what cannot be reduced to an object of inquiry without stripping it of its essential aspect (its status as subject), progress on the "self", taken as a pluralistic construct, will continue to address only one part of the problems we face in understanding this most fundamental aspect of human experience. Dutch Book Arguments (DBAs) have been invoked to support various requirements of rationality. Some are plausible: probabilism and conditionalization. Others are less so: credal transparency and reflection. Anna Mahtani has argued for a new understanding of DBAs which, she claims, allow us to keep the DBAs for probabilism (and perhaps conditionalization) and reject the DBAs for credal transparency and reflection. I argue that Mahtani’s new account fails as (a) it does not support highly plausible requirements of rational coherence and (b) (...) it does not, even setting aside the first objection, succeed in undermining the DBAs for credal transparency or reflection. In an attempt to bridge the vast divide between classical Asian thought and contemporary Western philosophy, Joel J. Kupperman finds that the two traditions do not, by and large, supply different answers to the same questions. Rather, each tradition is searching for answers to their own set of questions--mapping out distinct philosophical investigations. Starting from the hunting treatise Cynegeticus, assigned to Xenophon, this article seeks to reflect on the way in which the construction of the ideal hunter of the polis described by the Attic author. This aim will aboard both practical terms - equipment, prey, methods of hunting conducting etc - and moral terms, taking in account the numerous attacks made against the sophists throughout the booklet. To accomplish this aim, the present text includes a brief recapitulation of Xenophon's life, the most (...) important historiographical interpretations on the Cynegeticus and its dating, and, finally, the way in which the Attic author describes his ideal Greek hunter. Note: Paper to appear in special issue of the journal Psychology of Consciousness: Theory, Research, and Practice, on the evolution of consciousness //// The explanatory challenge of sentience is known as the “hard problem of consciousness”: How does subjective experience arise from physical objects and their relations? Despite some optimistic claims, the perennial struggle with this question shows little evidence of imminent resolution. In this article I focus on the “why” rather than on the “how” of sentience. Specifically, why did (...) sentience evolve in organic lifeforms? From an evolutionary perspective this question can be framed: “What adaptive problem(s) did organisms face in their evolutionary past and how were those challenges met? I argue that sentience was a critical component of the adaptive solution (i.e., adopting an agentic stance) to increasingly complex and unpredictable demands placed on vertebrates approximately 500 million years ago (the so-called Cambrian explosion). One consequence of taking an agentic stance is that it freed the organism from its neural moorings, positioning it within phenomenal space outside its brain. (shrink)

In this paper I argue for the importance of treating mental experience on its own terms. In defense of “experiential realism” I offer a critique of modern psychology’s all-too-frequent attempts to effect an objectification and quantification of personal subjectivity. The question is “What can we learn about experiential reality from indices that, in the service of scientific objectification, transform the qualitative properties of experience into quantitative indices?” I conclude that such treatment is neither necessary for realizing, nor sufficient for capturing, (...) subjectively given states (such as perception, pain, imagery, fear, thought, memory) – that is, for understanding many of the principle objects of psychological inquiry. A “science of mind” that approaches its subject matter from a third-person perspective should, I contend, be treated with a healthy amount of informed skepticism. (shrink)

The epistemic position of an agent often depends on their position in a larger network of other agents who provide them with information. In general, agents are better off if they have diverse and independent sources. Sullivan et al. [19] developed a method for quantitatively characterizing the epistemic position of individuals in a network that takes into account both diversity and independence; and presented a proof-of-concept, closed-source implementation on a small graph derived from Twitter data [19]. This paper reports on (...) an open-source reimplementation of their algorithm in Python, optimized to be usable on much larger networks. In addition to the algorithm and package, we also show the ability to scale up our package to large synthetic social network graph profiling, and finally demonstrate its utility in analyzing real-world empirical evidence of ‘echo chambers’ on online social media, as well as evidence of interdisciplinary diversity in an academic communications network. Besides the better-known Nelson logic and paraconsistent Nelson logic, in 1959 David Nelson introduced, with motivations of realizability and constructibility, a logic called $\mathcal{S}$. The logic $\mathcal{S}$ was originally presented by means of a calculus with infinitely many rule schemata and no semantics. We look here at the propositional fragment of $\mathcal{S}$, showing that it is algebraizable, in the sense of Blok and Pigozzi, with respect to a variety of three-potent involutive residuated lattices. We thus introduce the first known algebraic (...) semantics for $\mathcal{S}$ as well as a finite Hilbert-style calculus equivalent to Nelson’s presentation; this also allows us to clarify the relation between $\mathcal{S}$ and the other two Nelson logics $\mathcal{N}3$ and $\mathcal{N}4$. O presente artigo tem por finalidade demonstrar que, apesar de não estar expresso no rol das cláusulas pétreas, o macroprincípio da fraternidade jurídica não é passível de ser suprimido do texto constitucional. Ainda que não esteja presente expressamente na parte dogmática da Constituição Federal de 1988, a fraternidade se apresenta de forma implícita em diversos dispositivos normativos fundamentais e expressamente no preâmbulo, trecho inaugural da Lei Fundamental. Desse modo, a pesquisa que ora se apresenta parte do seguinte questionamento: O princípio (...) jurídico da fraternidade pode ser considerado uma cláusula pétrea constitucional? Decisões judiciais recentes e estudos doutrinários contemporâneos no campo das ciências jurídicas evidenciam que, além de estar presente na parte introdutória da Constituição brasileira, também se encontra consubstanciada em diversos dispositivos fundamentais do corpo normativo constitucional. Pretende-se aqui identificar como o princípio da fraternidade jurídica se entrelaça com outros princípios fundamentais presentes no texto dogmático da Constituição da República. A metodologia aplicada a esta pesquisa é qualitativa e bibliográfica ao buscar fontes na doutrina jurídica relacionadas com a fraternidade e os direitos humanos fundamentais. (shrink)

We introduce the subject of modal model theory, where one studies a mathematical structure within a class of similar structures under an extension concept that gives rise to mathematically natural notions of possibility and necessity. A statement φ is possible in a structure (written φ) if φ is true in some extension of that structure, and φ is necessary (written φ) if it is true in all extensions of the structure. A principal case for us will be the class Mod(T) (...) of all models of a given theory T—all graphs, all groups, all fields, or what have you—considered under the substructure relation. In this article, we aim to develop the resulting modal model theory. The class of all graphs is a particularly insightful case illustrating the remarkable power of the modal vocabulary, for the modal language of graph theory can express connectedness, k-colorability, finiteness, countability, size continuum, size ℵ1, ℵ2, ℵω, ℶω, first ℶ-fixed point, first ℶ-hyper-fixed point, and much more. A graph obeys the maximality principle φ(a)→φ(a) with parameters if and only if it satisfies the theory of the countable random graph, and it satisfies the maximality principle for sentences if and only if it is universal for finite graphs. O objetivo da pesquisa é demonstrar a importância da fraternidade na democracia brasileira, caracterizada como representativa, ao menos em tese, visto que a vontade do povo não tem sido considera nas decisões que promovem mudanças legislativas substanciais. Diante disto surge a indagação central do presente estudo: Qual a contribuição da categoria da fraternidade em uma democracia? A metodologia aplicada a pesquisa é qualitativa e bibliográfica ao buscar fontes na doutrina jurídica relacionada com o tema e também quantitativa ao trazer dados (...) como forma de argumentação. Justifica-se o estudo pela relevância da fraternidade na construção da democracia no Brasil. (shrink)

Neste artigo pretendemos discutir a noção de construção da mente consciente a partir da perspectiva de Antonio Damásio. Para isso, centraremos nossa análise em Self comes to Mind. Em um primeiro momento é necessário delimitarmos o conceito de consciência na visão de Damásio, visando, com isso, a evitarmos equivocidades, na medida em que há várias definições de consciência. Acreditamos que, para uma melhor compreensão acerca do surgimento da mente consciente, é necessário levarmos em consideração os processos evolutivos aos quais o (...) homem está sujeito. A consciência é, pois, fruto de um desenvolvimento evolutivo já bem estabelecido pela ciência. Compreender o desenvolvimento evolutivo do self se torna tarefa de suma importância, na medida em que Damásio estrutura sua compreensão de mente consciente a partir do papel desempenhado pelo self na tarefa de agregar conteúdos mentais. Para Damásio, a origem da mente está associada ao momento em que um processo do self é adicionado a um processo mental básico. Quando não ocorre um self na mente, esta mente não é propriamente consciente, o que significa dizer que é o self que garante consciência a uma mente. Isso quer dizer que precisaremos discutir de forma clara e distinta o conceito de self e seus estágios, para que finalmente possamos entender os passos delimitados por Damásio para discutir a construção da mente consciente.
