Issues concerning patients' rights are at the center of bioethics, but the political basis for these rights has rarely been examined. In Bioethics in a Liberal Society: The Political Framework of Bioethics Decision Making , Thomas May offers a compelling analysis of how the political context of liberal constitutional democracy shapes the rights and obligations of both patients and health care professionals. May focuses on how a key feature of liberal society -- namely, an individual's right to make independent decisions (...) -- has an impact on the most important relational facets of health care, such as patients' autonomy and professionals' rights of conscience. Although a liberal political framework protects individual judgments, May asserts that this right is based on the assumption of an individual's competency to make sound decisions. May uses case studies to examine society's approach to medical decision making when, for reasons ranging from age to severe mental disorder, a person lacks sufficient competency to make independent and fully informed choices. To protect the autonomy of these vulnerable patients, May emphasizes the need for health care ethics committees and ethics consultants to help guide the decision-making process in clinical settings. What the Church teaches and why on issues of euthanasia, invitro fertilization, genetic counseling, assisted suicide, living wills, persistent vegetative state, organ transplants, and more.

I draw on neurobiological evidence to defend the rationalist thesis that moral judgments are essentially dependent on reasoning, not emotions (conceived as distinct from inference). The neuroscience reveals that moral cognition arises from domain-general capacities in the brain for inferring, in particular, the consequences of an agent’s action, the agent’s intent, and the rules or norms relevant to the context. Although these capacities entangle inference and affect, blurring the reason/emotion dichotomy doesn’t preferentially support sentimentalism. The argument requires careful consideration of (...) the empirical evidence (from neuroimaging to psychopathology) and philosophical analysis of the commitments of rationalism versus sentimentalism in ethics. The phenomenon of misplaced gratitude becomes visible from this perspective, where one catches sight of what oppression does to people. Only then can one see that if, for example, a woman is grateful for not being battered by her husband, her gratitude is misplaced because it is based on socially normative beliefs and practices that in themselves undermine the possibility of justice and moral integrity. One finds the problem of misplaced gratitude on the edges of Claudia Card's scathing and brilliant (...) critique of feminist care ethics as a form of slave morality. One of Card's achievements was to sustain a passionate engagement with issues of oppression coupled with close philosophical scrutiny. Care ethics risks including too much—as in the risk of caring for abusers. Misplaced gratitude is also dangerous because of its tendency to bind one to the abuser, and thereby to make one become complicit in one's own abuse. (shrink)

The elections of 1994 are described as a "political earthquake," a "triumph of conservatism" that reflects the continuing "drift to the right" on the part of the American population. The victorious Gingrich army of welltrained, well-funded "conservatives" call for a Contract with America that will finally "get government off our backs" so that we can return to the happy days when the free market reigned. They will restore "family values," ridding us of "the excesses of the welfare state" and the (...) other residues of the failed "big government" policies of New Deal liberalism and Johnson's "Great Society." By dismantling the "nanny state" they will succeed, where the Democrats have failed, to achieve the shared goal of all elite and leadership elements: to "create jobs for Americans" and win security and freedom for the "middle class." And they will take over and successfully lead the crusade to establish the American Dream of free market democracy, worldwide. (shrink)

Andean philosophy of nature or pachasophy results from topography and mode of production that, merged together, have produced an integrated and interacting worldview that blurs the line between culture and nature. Respecting Pacha, or the interconnectedness of life and geography, maintaining complementarity and equilibrium through symbolic interactions, and caring for Pachamama, the feminine presence of Pacha manifested mainly as cultivable soil are the basis of Andean environmental and social ethics. Reciprocity or ayni is the glue that holds everything together. This (...) weaving of traditional beliefs, customs, and ecologi­cal knowledge is rooted in the landscape and has sustained Quechua and Aymara societies during many millennia of knowing, using, and transforming the varied environments of the central Andes of South America. Any environmental ethics that influences people’s lives and promotes respectful and sustainable relationships with nature will be framed by already held worldviews. In Bolivia indigenous intellectuals are drawing on the ancient tradition of Pacha to trace an environmental ethics of pacha qamaña or the harmonious and integral well-being of life, the Earth, and the cosmos, and the ethics of suma qamaña as an all em­bracing ethical framework for the “good life” or “living well.” Although pacha qamaña and suma qamaña are rooted in the Andean mythological worldview, they will interest Western philosophers because the values they promote can be correctives for Western cultural traits that see little more than instrumental value in nature. In this sense, pacha qamaña and suma qamaña contribute to the broader discussion of environmental ethics. (shrink)

While the enormous influence of Martin Heidegger's thought in Japan and China is well documented, the influence on him from East-Asian sources is much lesser known. Descartes's greatest glory was to be the first to articulate, and systematically to defend, the new scientific ideal of explanation in terms of lawfulness. For the realm of matter, lawful connections replaced anthropomorphic volitions as the model of rational explanation. Descartes's use of explanation in terms of lawfulness, inspired by Galileo's beginnings in this enterprise, was vindicated by Newton's subsequent achievement. The burgeoning science of ethics has produced a trend toward pessimism. Ordinary moral thought and action, we’re told, are profoundly influenced by arbitrary factors and ultimately driven by unreasoned feelings. This book counters the current orthodoxy on its own terms by carefully engaging with the empirical literature. The resulting view, optimistic rationalism, shows the pervasive role played by reason, and ultimately defuses sweeping debunking arguments in ethics. The science does suggest that moral knowledge and virtue don’t come easily. However, despite (...) the heavy influence of automatic and unconscious processes that have been shaped by evolutionary pressures, we needn’t reject ordinary moral psychology as fundamentally flawed or in need of serious repair. Reason can be corrupted in ethics just as in other domains, but a special pessimism about morality in particular is unwarranted. Moral judgment and motivation are fundamentally rational enterprises not beholden to the passions. (shrink)

Thus philosophers have made remarkable contributions to our understanding of mechanics, the relativity theory, the quantum theory, probability, and geometry, as well as to the foundations of mathematics. More general discussions about theory construction, explanation, and concept formation always are illustrated and illuminated by reference to specific theories within science. In our generation, (...) most philosophers of science have taken for granted that physical science is descriptive, empirical, functional, and—leaving aside controversial interpretations of quanta—deterministic. In defending his interest-relative account of knowledge in Knowledge and Practical Interests (2005), Jason Stanley relies heavily on intuitions about several bank cases. We experimentally test the empirical claims that Stanley seems to make concerning our common-sense intuitions about these bank cases. Additionally, we test the empirical claims that Jonathan Schaffer seems to make in his critique of Stanley. We argue that our data impugn what both Stanley and Schaffer claim our intuitions about such cases are. To account for these (...) results, one must develop a better conception of the connection between a subject's interests and her body of knowledge than those offered by Stanley and Schaffer. This collection of essays brings together some of the leading legal, political and moral theorists to discuss the normative issues that arise when war concludes and when a society strives to regain peace. In the transition from war, mass atrocity or a repressive regime, how should we regard the idea of democracy and human rights? Should regimes be toppled unless they are democratic or is it sufficient that these regimes are less repressive than before? Are there moral reasons for thinking (...) that soldiers should be relieved of responsibility so as to advance the goal of peace building? And how should we regard the often conflicting goals of telling the truth about what occurred in the past and allowing individuals to have their day in court? In den letzten Jahren hat sich eine Vielfalt unterschiedlicher Gremien zur Ethikberatung entwickelt: vom Konsil mit einem einzelnen Berater bis zum Ethikkomitee. In dem Band werden die Ethikberatung, ihre Entwicklung und Anwendung, sowie die Gründung von Gremien in Krankenhäusern, Pflegeeinrichtungen, Hospizen und von niedergelassenen Ärzten anhand von Fallbeispielen erläutert. Dabei schlagen die Autoren eine Brücke zwischen traditioneller philosophischer Ethik und anwendungsbezogener klinischer Ethik. Auch rechtliche Fragen werden erörtert.

When tennis fan Jane Bronstein attended the 1995 U.S. Open she probably knew there was a remote chance her image would end up on television screens around the world. But she surely did not know she was at risk of becoming the object of worldwide attention on the David Letterman Show. As it happened, Letterman spotted an unflattering clip from the U.S. Open showing a heavyset Bronstein with peach juice dripping down her chin. Not only did he show the footage (...) six times that fall, but he ridiculed her on his “Top 10 List,” calling her a “seductive temptress,” even paying to put the clip on the Sony Jumbotron electronic billboard at Time Square.
