The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. En el siguiente ensayo intento una consideración amplia del problema de la institución fuerte a partir de la cuestión del doblez metafórico del lenguaje y su articulación metafísico-principial. Se trata de una cuestión problemática que cabría situar como un prolegómeno posible de acceso al pensamiento Jacques Lezra en torno a una cosmología heteróclita y una república material o salvaje –pensamiento según el cual el “republicanismo salvaje” dependería de producir e instituir conceptos defectivos de asociación política que den lugar a “instituciones (...) defectivas”. Para ello apunto al trabajo de Lezra sobre la trama de relaciones entre lenguaje, institución y deconstrucción en Paul de Man; a la paradigmática reductio ad unum en la institución del lenguaje y su maximización como unidad ideal del sentido y estructura lógica del mundo en la fenomenología de Edmund Husserl; a la necrofilología de Lezra como teoría materialista de los conceptos y de la inestabilidad ontológica del mundo; y, por último, a la cuestión del principio de equivalencia y traductibilidad general en la época del capitalismo global. A partir de una reflexión más amplia sobre el _vínculo entre poder e imagen_, y de la imagen como dispositivo y potencia, enfocamos aquí la figura de José “mulato” Gil de Castro –pintor peruano inmigrante en Chile y retratista de las elites eclesiásticas, políticas y militares sudamericanas–, abordando su producción de imágenes inscritas en la _funcionalidad glorificante_ _y generadora de signos del poder soberano_ –incluso allí donde retrata al “pueblo”– en un contexto histórico en que los imaginarios soberanistas colonial y (...) estatal-nacional se organizan al hilo del discurso “humanista” de corte eurocéntrico y del racismo como reverso inmunitario de su norma antropológica. La operación artística de Gil de Castro y su contexto nos ofrecen un interesante escenario microhistórico para comprender el fenómeno de la “secularización” moderna –o “transición”–, en la medida en que la matriz en el campo religioso de su operatoria pictórica se desplaza a un campo político y militar en donde el ejercicio del poder soberano se comprende y se practica como un intento de dar forma a lo social de acuerdo a un _paradigma_ _angelológico_ con raíces en una _metafísica política_ _teo-onto-antropológica_. Notwithstanding the potential danger to security and privacy, sharing and publishing data has become usual in Data Science. To preserve privacy, de-identification methodologies guided by risk estimation have been designed. Two issues associated with classical risk metrics are, on the one hand, the adequacy of the metric and, on the other hand, its static nature. In this paper, we present metrics for estimating risk based on the emerging semantics provided by Formal Concept Analysis. The metrics are designed to estimate the (...) a priori risk of compromised data deletion. Furthermore, by applying specialized variable forgetting methods for association rules, it is shown how to reflect the effect of deleting attributes belonging to potentially dangerous quasi-identifier sets. Additionally, a study of the role of the risk metric in confidence-based reasoning for re-identification is presented. (shrink)

The COVID-19 (SARS-CoV-2) pandemic dealt a severe blow to society as a whole and required countries to confront a situation that exceeded the limits of their borders. In this paper, we analyze how these countries as well as supranational organizations responded to this unprepared global emergency. We also explore what alternative models have been proposed in the wake of this crisis and propose some changes—other ways of acting—so that in future pandemics or global emergencies, we can deal with the situation (...) more effectively. Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Altruism and solidarity are concepts that are closely related to organ donation for transplantation. On the one hand, they are typically used for encouraging people to donate. On the other hand, they also underpin the regulations in force in each country to different extents. They are often used indistinctly and equivocally, despite the different ethical implications of each concept. This paper aims to clarify to what extent we can speak of altruism and solidarity in the predominant models of organ donation. (...) It also raises the ethical question of whether these categories are adequate as a basis for such models, bearing in mind that organs are a scarce resource and that a shortage of them may mean that fewer lives are saved or improved. The technical possibilities of biomedicine open up the opportunity to intervene in ageing itself with the aim of mitigating, reducing or eliminating it. However, before undertaking these changes or rejecting them outright, it is necessary to ask ourselves if what would be lost by doing so really has much value. This article will analyse the desirability of ageing from an individual point of view, without circumscribing this question to the desirability or undesirability of death. First, we will present the three (...) most widely used arguments to reject biomedical interventions against ageing. We will argue that only the last of these arguments provides a consistent answer to the question of the desirability of ageing. Second, we will show that the third argument falls prey to a conceptual confusion that we will call the paradox of ageing: although ageing entails negative health effects, it leads to a life stage with valuable goods. Both valuations, one positive and the other negative, refer to two different dimensions of ageing: the chronological and the biological. We will defend that, by not adequately distinguishing these two types of ageing, it does not become apparent that all the valuable goods exclusive to ageing derive only from its chronological dimension. Third, we will argue that, if we just conceive ageing biologically, it is undesirable. We will elaborate on the two kinds of undesirable effects biological ageing has: direct and indirect. Finally, we will respond to potential objections by adducing that these are insufficient to weaken our argument. (shrink)

Räsänen has responded to our article by arguing that this process has certain desirable aspects and, therefore, our position is inconsistent. Räsänen develops two arguments to defend his position. We will call the first the argument from the totality of the ageing process and the second the argument from the reduced goods of the ageing process. In this reply, we will give reasons to show that both (...) arguments fail. The first, on the one hand, starts from a dubious conception of ageing and, on the other hand, even accepting this conception, its reformulation is morally empty. En busca de un acceso al fenómeno del amor, se propone interrogarlo conforme al tipo de atención que promueve, asumiendo y discutiendo los recursos aportados por la fenomenología husserliana, así como por las fenomenologías contraintencionales, en particular la de Waldenfels. De este modo, si para describir este fenómeno es preciso dar cuenta del fundamento afectivo de la atención, también hay que reconocer que el (...) amor es vivido como un hecho original o un acontecimiento que implica para el amante una reorientación existencial y atencional. ABSTRACT The article inquires into the attentionality inherent to love as a privileged and primordial experience of care. Seeking access to the phenomenon of love, we suggest inquiring into it according to the type of attention it promotes, drawing on and discussing the resources provided by Husserlian phenomenology, as well as by counter-intentional phenomenologies, particularly Waldenfels'. Thus, while it is necessary to account for the affective grounds of attention in order to describe this phenomenon, it is also essential to recognize that love is experienced as an original fact or as an event that entails an existential and attentional reorientation of the lover. This chapter analyses the prospects of using neuroimaging methods, in particular functional magnetic resonance imaging (fMRI), for philosophical purposes. To do so, it will use two case studies from the field of emotion research: Greene et al. (2001) used fMRI to uncover the mental processes underlying moral intuitions, while Lindquist et al. (2012) used fMRI to inform the debate around the nature of a specific mental process, namely, emotion. These studies illustrate two main approaches in cognitive neuroscience: Reverse inference and (...) ontology testing, respectively. With regards to Greene et al.’s study, the use of Neurosynth (Yarkoni 2011) will show that the available formulations of reverse inference, although viable a priori, seem to be of limited use in practice. On the other hand, the discussion of Lindquist et al.’s study will present the so far neglected potential of ontology-testing approaches to inform philosophical questions. (shrink)

En la primera parte se muestran las diferentes aristas de la cuestión de la religión, poniendo énfasis en los aspectos filosófico-políticos, sobre todo el que concierne a la “traducción” del lenguaje religioso al secular como un “requisito” de acceso a la esfera pública. En la segunda parte, se reconstruye, señalando sus límites o dificultades, el concepto de “traducción” en Habermas. Para ello, (...) se apela, además, a algunas categorías conceptuales propuestas por Jean-Marc Ferry. La traducción en este marco puede ser entendida en dos sentidos: como una reformulación semántica que apunta a ampliar el universo discursivo de origen (traducción como desencapsulamiento) y como una transformación de los géneros pre o para-argumentativos en argumentativos (traducción como cambio de género discursivo). An important question in the debate regarding the nature of politically significant human kinds, such as gender, race, and sexual orientations, is concerned with the question of whether these human kinds are socially constructed (Stein 1999; Root 2000; Haslanger 2012; and Ásta 2013). In order to settle this debate, a more fundamental question needs to be answered: what does it mean to say that a category is socially constructed? -/- Recently, many philosophers have become interested in this issue (Hacking 1999; (...) Stein 1999; Haslanger 2003; Mallon 2007; Diaz-Leon 2015; Ásta 2015). They all seem to agree that there is not a single notion of social construction, but rather, there are different notions of social construction for different purposes. The important question in order to formulate a useful notion of social construction, then, is which project is at issue, and which notion of social construction is more useful for the purposes of that project. In this chapter I will focus on two projects that social constructivists are often interested in, namely, (i) the project of arguing against the inevitability of a trait, that is, to show that those features are not determined by human nature; and (ii) the project of arguing against the universality of a trait, that is, to show that a certain human category or kind is not a universal, transcultural, culture-independent property and that it cannot be applied to other cultures, places, and times; and I will discuss which notion of social construction is more useful with respect to each project. -/- My main questions, then, will be the following: (a) Is there any notion of social construction that entails that if X is socially constructed, then X is not inevitable, that is, X is not determined by human nature? (b) Is there any notion of social construction that entails that if X is socially constructed, then X is not transcultural or universal? (shrink)

Are feelings an essential part or aspect of emotion? Cases of unconscious emotion suggest that this is not the case. However, it has been claimed that unconscious emotions are better understood as either (a) emotions that are phenomenally conscious but not reflectively conscious, or (b) dispositions to have emotions rather than emotions proper. Here, I argue that these ways of accounting for unconscious emotions are inadequate, and propose a view of emotions as non-phenomenal attitudes that regard their contents as relevant (...) to one's motivations. El presente trabajo se propone señalar algunas tareas posibles para la ética del discurso de Karl-Otto Apel en la actualidad. Tales tareas pueden concentrarse en la necesidad de una teoría de la institucionalización del discurso práctico, como forma de racionalidad práctica realizada socialmente. La pregunta que se ha de responder es qué condiciones marco debe cumplir el discurso para que pueda ser puesto en práctica y qué efectos político-institucionales puede producir en el contexto de instituciones realmente existentes. A partir de (...) Gehlen y de Luhmann -aunque en menor medida-, Apel interpreta a las instituciones como sistemas de autoafirmación que, por un lado, liberan a los sujetos de la carga de la acción, pero, por otro lado, limitan o condicionan la racionalidad práctica consensual-argumentativa propia del discurso. Las coerciones (Sachzwänge) funcionales de las instituciones configuran un campo de acción y un tipo de racionalidad que, de acuerdo con Apel, deberían estar bajo el control del discurso institucionalizado como esfera pública racional (Öffentlichkeit). La relación entre los criterios normativos ideales del discurso práctico institucionalizado y las instituciones realmente existentes debe interpretarse como una tensión o entrelazamiento dialéctico no superable. Si esta interpretación es correcta, la ética del discurso, en tanto teoría crítica de la sociedad, no puede ser entendida como una aplicación sin más de criterios normativos ideales a la realidad histórica o de adecuación de esa realidad a los criterios ideales en su sentido vertical, sino como de mutua correlación horizontal. In this paper, I focus on an influential account of phenomenal concepts, the recognitional account, and defend it from some recent challenges. According to this account, phenomenal concepts are recognitional concepts that we use when we recognize experiences as “another one of those.” Michael Tye has argued that this account is viciously circular because the relevant recognitional abilities involve descriptions of the form “another experience of the same type,” which is also a phenomenal concept. Tye argues that we avoid the (...) circularity worry if we explain the reference-fixing of phenomenal concepts in terms of dispositions to re-identify tokens of the same type without appealing to any further phenomenal concepts. However, he argues, this account is incompatible with the intuitive claim that phenomenal concepts seem to involve rich modes of presentation of their referents. Philip Goff and others have similarly argued that a recognitional account of phenomenal concepts would make phenomenal concepts opaque, that is, unable to reveal anything about their referents, which seems problematic. In this paper, I present a new version of the recognitional account that avoids the circularity worry without entailing that phenomenal concepts are opaque. (shrink)

En este artículo exploramos los elementos y temas rurales y campesinos en la poética y el pensamiento de Antonio Machado. Su «palabra esencial en el tiempo» tendría un carácter eminentemente rural fruto de su aguda conciencia de la modernización capitalista como una fuerza abstracta que socava las formas de producción y socialización campesina y que impone una lógica productiva que imposibilita una relación de no explotación con la naturaleza y la conformación de una sociedad emancipada. Relacionamos esta consideración de la (...) temporalidad capitalista con la que contemporáneamente establecieron Walter Benjamin y Ernst Bloch. En la exploración del pasado y de formas de experimentar el tiempo premodernas estos pensadores descubrirían un potencial emancipatorio que debiera ser explotado por cualquier proyecto revolucionario. Este trabajo realiza un estudio metafísico sobre la noción de contacto en términos de límites a partir de una ontología de objetos materiales. Dos cosas están en contacto cuando sus límites (o partes de ellos) se topan espacialmente. Las tesis relacionista y la substantivista sobre la naturaleza del espacio son evaluadas en sus compromisos respecto a la idea de contacto. Sin embargo, puesto que considerando algunos descubrimientos de la física cuántica es posible descartar la idea de contacto físico, la discusión (...) requiere ser trasladada a un espacio topológicamente continuo. Aquí la idea de contacto requiere solucionar la compatibilidad entre la existencia de un espacio continuo y la existencia de límites como un tipo de discontinuidad. Cuatro tesis son evaluadas: clásica, superposición, brecha, y coincidencia. Esta última es defendida puesto que, a diferencia de las otras, no renuncia a características ontológicas fundamentales de un límite y es la menos arbitraria sobre su pertenencia. (shrink)

Gonzalo Rodriguez-Pereyra presents an original study of the place and role of the Identity of Indiscernibles in Leibniz's philosophy. The Principle of the Identity of Indiscernibles rules out numerically distinct but perfectly similar things; Leibniz derived it from more basic principles and used it to establish important philosophical theses. Rodriguez-Pereyra aims to establish what Leibniz meant by the Principle of Identity of Indiscernibles, what his arguments for and from it were, and to assess those arguments and Leibniz's claims about the (...) Principle of Identity of Indiscernibles. He argues that Leibniz had a very strong version of the principle, according to which no possibilia are intrinsically perfectly similar, where this excludes things that differ in magnitude alone. The book discusses Leibniz's arguments for the Identity of Indiscernibles in the Meditation on the Principle of the Individual, the Discourse on Metaphysics, Notationes Generales, Primary Truths, the letter to Casati of 1689, the correspondence with Clarke, as well as the use of the Identity of Indiscernibles in Leibniz's arguments against the Cartesian conception of the material world, atoms, absolute space and time, the Lockean conception of the mind as a tabula rasa, and freedom of indifference. Rodriguez-Pereyra argues that the Identity of Indiscernibles was a central but inessential principle of Leibniz's philosophy. (shrink)

A widespread need to explain the behavior and outcomes of AI-based systems has emerged, due to their ubiquitous presence. Thus, providing renewed momentum to the relatively new research area of eXplainable AI (XAI). Nowadays, the importance of XAI lies in the fact that the increasing control transference to this kind of system for decision making -or, at least, its use for assisting executive stakeholders- already affects many sensitive realms (as in Politics, Social Sciences, or Law). The decision-making power handover to (...) opaque AI systems makes mandatory explaining those, primarily in application scenarios where the stakeholders are unaware of both the high technology applied and the basic principles governing the technological solutions. The issue should not be reduced to a merely technical problem; the explainer would be compelled to transmit richer knowledge about the system (including its role within the informational ecosystem where he/she works). To achieve such an aim, the explainer could exploit, if necessary, practices from other scientific and humanistic areas. The first aim of the paper is to emphasize and justify the need for a multidisciplinary approach that is beneficiated from part of the scientific and philosophical corpus on Explaining, underscoring the particular nuances of the issue within the field of Data Science. The second objective is to develop some arguments justifying the authors’ bet by a more relevant role of ideas inspired by, on the one hand, formal techniques from Knowledge Representation and Reasoning, and on the other hand, the modeling of human reasoning when facing the explanation. This way, explaining modeling practices would seek a sound balance between the pure technical justification and the explainer-explainee agreement. (shrink)

In this study, we propose considering membership in the Ethics Officer Association (EOA) as a proxy for the firm's commitment to ethical decision making, and we analyze the influence of firm- and CEO-specific characteristics on this commitment. While we observe a positive relationship between membership and firm size, we also document a negative relationship between EOA membership and the executive's time in position and, to a more modest extent, accounting returns. Pursuing this further, we present evidence that firms with past (...) legal issues may seek EOA membership as a signal of their intention to be compliant in the future. (shrink)
