In this paper, we determine whether illegal hunting should be construed as a crime of dissent. Using the Nordic countries as a case study where protest-driven, illegal hunting of protected wolves is on the rise, we reconsider the crime using principles of civil disobedience. We invoke the conditions of intentionality, nonevasion, dialogic effort, non-violence and appeal to parameters of reasonable disagreement about justice and situate the Nordic illegal hunting phenomenon at a nexus between conscientious objection, assisted disobedience and everyday resistance. (...) This examination leads us to contend that the crime has heretofore received an inadequate response limited to punishment and deterrence. This contention finds support in the worsening predicaments of illegal hunting following harsh sanctions and stigmatization. Although hunters publicize injustices through their crimes, we find that killing wolves as a means to deliberative ends disqualifies hunters’ dissent as legitimate disobedience, creating an obligation of deliberative uptake on the part of society. Nonetheless, in a critical contribution to the field of criminal justice, we argue that it is instead the conditions of deliberative suboptimality experienced by hunters that create this obligation of uptake. Hence, in order to fulfill this obligation, we contend that the burden falls on regulatory agencies to better articulate the justifications for the policies that coerce hunters. We also advocate creating novel institutions to provide hunters with effective opportunities for contesting wildlife conservation directives. (shrink)

Ian Tattersall is curator emeritus of the Spitzer Hall of Human Origins at the American Museum of Natural History, and an authoritative voice on the subject of human origins. The book offers anyone a chance to catch up on the current state of the art. One thing we learn is that the comparison with apes is misleading. None of our ancestors were much like an ape. Hominid forebears have been evolving rapidly and dramatically away from apes for more than two (...) million years. Hunting is another red herring. We did not evolve to be hunters, or under conditions where hunting success was crucial to survival. Technology also does not drive our evolution. New stone technologies never emerge with new species. In each case, old kinds of hominids begin to do new things with stone and other material. What most differentiates early hominids from chimpanzees, and disqualifies emphasis on hunting, is that coming down from the trees to walk on two legs made hominids opportunistic generalists. As Tattersall tells it, the acquisition of modern human qualities was not a gradual, progressive accumulation of adaptations, nor is the emergence of our species predictable from earlier trends, or a threshold effect of gradually rising brain size. It was an abrupt and recent event, primarily in response to deteriorating (increasingly dry and cold) climate. We did not adapt genetically to the changed conditions, but accommodated to them through culture, creating a lifestyle with a new level of freedom from the environment, which might change without making people unable to cope. Maybe that is why many today remain indifferent to the threat of climate change. We are accustomed not to worry about such things. We have always pulled through. Such optimism is bred in the bone. But it was only right in the past, and this comfortable habit may be our doom. (shrink)

Garland E. Allen’s 1978 biography of the Nobel Prize winning biologist Thomas Hunt Morgan provides an excellent study of the man and his science. Allen presents Morgan as an opportunistic scientist who follows where his observations take him, leading him to his foundational work in Drosophila genetics. The book was rightfully hailed as an important achievement and it introduced generations of readers to Morgan. Yet, in hindsight, Allen’s book largely misses an equally important part of Morgan’s (...) work – his study of development and regeneration. It is worth returning to this part of Morgan, exploring what Morgan contributed and also why he has been seen by contemporaries and historians such as Allen as having set aside some of the most important developmental problems. A closer look shows how Morgan’s view of cells and development that was different from that of his most noted contemporaries led to interpretation of his important contributions in favor of genetics. We argue that Hamiltonian mechanics is more fundamental than Lagrangian mechanics. Our argument provides a non-metaphysical strategy for privileging one formulation of a theory over another: ceteris paribus, a more general formulation is more fundamental. We illustrate this criterion through a novel interpretation of classical mechanics, based on three physical conditions. Two of these conditions suffice for recovering Hamiltonian mechanics. A third condition is necessary for Lagrangian mechanics. Hence, Lagrangian systems are a proper subset of Hamiltonian systems. Epistemic akrasia arises when one holds a belief even though one judges it to be irrational or unjustified. While there is some debate about whether epistemic akrasia is possible, this paper will assume for the sake of argument that it is in order to consider whether it can be rational. The paper will show that it can. More precisely, cases can arise in which both the belief one judges to be irrational and one’s judgment of it are epistemically rational in (...) the sense that both are supported by sufficient evidence. In _Ecce Homo_ Friedrich Nietzsche calls himself "the first immoralist" and adds "that makes me the annihilator _par excellence_". The thesis of this paper is that Platonic Forms are angels. I make this identification by claiming that Platonic Forms have the characteristics of angels, in particular, that Platonic Forms are alive. I offer four arguments for this claim. First, it seems that engaging in self-directed action is a sufficient condition for being alive. The Forms are, as teleological activities, self-directed actions. Second, bodies receive their being from their Forms, and some bodies are essentially alive. Third, in the Good, all (...) the types of goodness, including life, are identical. The Forms are appearances of the Good. Fourth, since the Good imparts as much goodness as it can, the Forms are alive unless there is some bar to their being alive. There are good reasons to think that there is no such bar. I then show that ethical vices do not give body to human form, but give body to other forms—those that are evil angels. Lastly, I provide a survey of the relationships that various religious traditions posit between ethical vice and the demonic. (shrink)

The use of deception and dishonesty is widely accepted as a fact of life in policing. This paper thus defends a counterintuitive claim: Good faith is a normative foundation for the police as a political institution. Good faith is a core value of contracts, and policing is contractual in nature both broadly (as a matter of social contract theory) and narrowly (in regard to concrete encounters between law enforcement officers and the public). Given the centrality of good faith to policing, (...) dishonesty and deception on par with fraud are justified only as a narrowly circumscribed investigative tool that is constrained by institutional commitments to the fair distribution of security and the rule of law. The practical upshot is the preclusion of most dishonest and deceptive police tactics on par with fraud, leading to an institution that is less proactive and more reactive. (shrink)

Science and mathematics continually change in their tools, methods, and concepts. Many of these changes are not just modifications but progress---steps to be admired. But what constitutes progress? This dissertation addresses one central source of intellectual advancement in both disciplines: reformulating a problem-solving plan into a new, logically compatible one. For short, I call these cases of compatible problem-solving plans "reformulations." Two aspects of reformulations are puzzling. First, reformulating is often unnecessary. Given that we could already solve a problem using (...) an older formulation, what do we gain by reformulating? Second, some reformulations are genuinely trivial or insignificant. Merely replacing one symbol with another does not lead to intellectual progress. What distinguishes significant reformulations from trivial ones? According to what I call "conceptualism" (or "conceptual empiricism"), reformulations are intellectually significant when they provide a different plan for solving problems. Significant reformulations provide inferentially different routes to the same solution. In contrast, trivial reformulations provide exactly the same problem-solving plans, and hence they do not change our understanding. This answers the second question about what distinguishes trivial from significant reformulations. However, the first question remains: what makes a new way of solving an old problem valuable? Here, a bevy of practical considerations come to mind: one formulation might be faster, less complicated, or use more familiar concepts. According to "instrumentalism," these practical benefits are all there is to reformulating. Some reformulations are simply more instrumentally valuable for meeting the aims of science than others. At another extreme, "fundamentalism" contends that a reformulation is valuable when it provides a more fundamental description of reality. According to this view, some reformulations directly contribute to the metaphysical aim of carving reality at its joints. Conceptualism develops a middle ground between instrumentalism and fundamentalism, preserving their benefits without their costs. I argue that the epistemic value of significant reformulations does not reduce to either practical or metaphysical value. Reformulations are valuable because they are a constitutive part of problem-solving. Both science and mathematics aim at solving all possible problems within their respective domains. Meeting this aim requires being able to plan for any possible problem-solving context, and this requires reformulating. By reformulating, we clarify what we need to know to solve problems. Still, one might wonder whether the value of reformulations requires underlying differences in explanatory power. According to "explanationism," a reformulation is valuable only when it provides a better explanation. Explanationism stands as a rival middle ground position to my own. However, it faces numerous counterexamples. In many cases, two reformulations provide the same explanation while nonetheless providing different ways of understanding a phenomenon. Hence, reformulating can be valuable even when neither formulation is more explanatory. Methodologically, I draw on a variety of case studies to support my account of reformulation. These range from classical mechanics to quantum chemistry, along with examples from mathematics. Symmetry arguments provide a paradigmatic example: the mathematics of symmetry groups radically recasts quantum mechanics and quantum chemistry. Nevertheless, elementary approaches exist that eschew this additional mathematical apparatus, solving problems in a more tedious but less mathematically-demanding manner. Further examples include reformulations of quantum field theory, Arabic vs. Roman numerals, and Fermat's little theorem in number theory. In Beyond Humanity a leading philosopher offers a powerful and controversial exploration of urgent ethical issues concerning human enhancement.

Recently, Australia became the second jurisdiction worldwide to legalize the use of mitochondrial donation technology. The Mitochondrial Donation Law Reform (Maeve’s Law) Bill 2021 allows individuals with a family history of mitochondrial disease to access assisted reproductive techniques that prevent the inheritance of mitochondrial disease. Using inductive content analysis, we assessed submissions sent to the Senate Committee as part of a programme of scientific inquiry and public consultation that informed drafting of the Bill. These submissions discussed a range of bioethical (...) and legal considerations of central importance to the political debate. Significantly, submissions from those with a first-hand experience of mitochondrial disease, including clinicians and those with a family history of mitochondrial disease, were in strong support of this legislation. Those in support of the Bill commended the two-staged approach and rigorous licencing requirements as part of the Bill’s implementation strategy. Submissions which outlined arguments against the legislation either opposed the use of these techniques in general or opposed aspects of the implementation strategy in Australia. These findings offer a window into the ethical arguments and perspectives that matter most to those Australians who took part in the Senate inquiry into mitochondrial donation. The insights garnered from these submissions may be used to help refine policy and guidelines as the field progresses. (shrink)
