Some disagreements seem to be persistent: they are, pretty much, immune to persuasive argumentation. If that is the case, how can they be overcome? Can argumentation help us? I propose that to overcome persistent disagreements through argumentation, we need a dynamic and pluralistic version of argumentation. Therefore, I propose that argumentation, more than a tool that uses persuasion to change the mind of the counterpart, is a toolbox that contains persuasion, deliberation, negotiation, and other dialogical strategies that can be used (...) to reach an agreement. When parties attempt to persuade their opponents of the tenability of a certain standpoint using reasons, they will often find that the circumstances of the dialogue hinder their chances of resolution. Power imbalances, cognitive biases, lack of time or hidden interests are some of the circumstances they need to face. I will label these circumstances as _suboptimal settings for argumentation_. According to the pragma-dialectical tradition, higher-order conditions for critical discussion are unfulfilled in these cases (van Eemeren, Grootendorst, Jacobs, & Jackson, (...) 1993). The main question of this paper is the following: what is the normative standard that parties in a discussion need to follow to arrive at a resolution within such circumstances? I will defend a middle-ground solution between two extreme ones. The first extreme position, the _anything-goes policy_, claims that, given that the conditions for a reasonable exchange of reasons are not satisfied, the dialogue stands outside the domain of reason, so anything goes for the parties. The second extreme position, the _business as usual policy_, claims that, since critical discussion is a normative model, the same rules should apply in suboptimal settings. Finally, the _supernormal policy_ that I defend claims that we need a more general and comprehensive norm that I refer to as a _supernorm_ to evaluate these cases. The supernormal policy divides argumentation into two stages: preparation and resolution. In the preparation stage, the parties attempt to restore or compensate for the suboptimality of the setting, while in the resolution stage, they attempt to resolve their disagreement. I contend that the moves of the preparation stage should be evaluated by using the supernorm instead of by the rules for critical discussion (van Eemeren and Grootendorst 2004 ). At this point, the paper considers theoretical insights from Gilbert ( 1995, 1997, 2002 ) and Jacobs ( 2000, 2006 ) to understand what this entails. (shrink)

Gregory Bateson is well known for defining information by stating “In fact what we mean by information – the elementary unit of information – is a difference which makes a difference…” This conceptual perspective has the merit of simplicity and generality. Simplicity, in addressing the complexity of information. Generality, in seeking applicability to any and every field of human experience. The purpose of this paper is to focus the applicability of this conceptual approach by Bateson and use it to perform (...) a calculation of taking the difference between two grey-level digital images that are shifted one relative to the other. The digital images take the place of the field of view that a human being would have access through her sense of vision at two different spatial/temporal instances. The results show that it is possible to highlight the edges of the objects under scrutiny, as well as to highlight other differences within the object. Bateson’s “difference that makes a difference” would seem to provide a first step in the elusive meaning making process of humans. (shrink)

This paper defends negotiation as a way of rationally overcoming disagreements. Negotiation is a type of dialogue where the parties begin with a conflict and a need for cooperation, and their main goal is to make a deal as reported (Walton and Krabbe 1995, p 72). It has been discussed whether differences of opinion can be shifted from persuasion to negotiation dialogue. If two parties disagree, is it reasonable to overcome their disagreement by employing negotiation? Van Laar and Krabbe (2018a) (...) argue that negotiation is the correct way to settle disagreements when the parties arrive at a stalemate. Godden and Casey (2020) deny this. They argue that the goal of persuasion dialogue (to resolve a conflict by verbal means) can never be replaced by a bargaining procedure. This paper claims that shifts to negotiation are reasonable, but only if the shift meets two conditions. The practical condition requires the disagreement to be practical rather than theoretical, and the sacrifice condition requires that the parties freely agree to shift the dialogue to negotiation. When the parties do not meet these conditions, they commit fallacies such as ad consequentiam, ad baculum or the fallacy of middle ground. Finally, I argue that negotiation arises in practical argumentation when the parties assign different relative values to their goals. When this process occurs, we see negotiation as a small step within the practical argumentation process. Persuasion, deliberation and negotiation dialogue are, then, deeply intertwined and are sometimes indistinguishable. (shrink)

The following paper aims to develop the theoretical and practical consequences, philosophical presuppositions, and intellectual aporias to which the reader of Rosi Braidotti is confronted in her approach of an ethics of becoming and the ethical relationships of a transposed or posthuman subject. We take for this purpose two almost marginal examples of her book Transpositions, namely, the human relationships developed with Tamagotchis and other technologies and the so-called “ethics of the penultimate cigarette” which is framed in the “transposition of (...) death.” Braidotti’s posture will be examined and criticized on the light of authors who have reflected, also almost marginally, on the same problems and their contextualization in contemporary and modern philosophy. We intend to show that the author’s claims presume to be schizophrenic and, indeed, she maintains an unfortunate schizophrenic proposal. (shrink)

In this article I present an answer to the problem of deep disagreements posed by Robert Fogelin (1985). According to this author, there are disagreements that cannot be resolved rationally because they refer to “framework propositions”. I argue that, making certain distinctions, Fogelin’s conclusion is less serious than initially thought. The first distinction is between resolving and overcoming di-sagreements. From the fact that disagreements cannot be resolved, it does not follow that they cannot be overcome in other ways. Thus, together (...) with resolu-tion, the parties can overcome disagreements through means such as negotia-tion, mediation, arbitration or suspension of judgment. The second distinction is between theoretical and practical disagreements. As I argue, while for theo-retical disagreements the fact that they cannot be resolved implies that the only way to overcome them is by suspending judgment, for practical disagreements it is not possible to suspend judgment, but there are other ways to “manage di-sagreements”. Having made these distinctions, I conclude by pointing out that the fact that certain disagreements are deep does not prevent them from being overcome, which reflects a pluralistic view of the argumentation that should be further explored. For the epic journey of autumn migration, long-distance migratory birds use innate and learned information and follow strict schedules imposed by genetic and epigenetic mechanisms, the details of which remain largely unknown. In addition, bird migration requires integrated action of different multisensory systems for learning and memory, and the hippocampus appears to be the integration center for this task. In previous studies we found that contrasting long-distance migratory flights differentially affected the morphological complexity of two types of hippocampus astrocytes. Recently, (...) a significant association was found between the latitude of the reproductive site and the size of the ADCYAP1 allele in long distance migratory birds. We tested for correlations between astrocyte morphological complexity, migratory distances, and size of the ADCYAP1 allele in three long-distance migrant species of shorebird and one non-migrant. Significant differences among species were found in the number and morphological complexity of the astrocytes, as well as in the size of the microsatellites of the ADCYAP1 gene. We found significant associations between the size of the ADCYAP1 microsatellites, the migratory distances, and the degree of morphological complexity of the astrocytes. We suggest that associations between astrocyte number and morphological complexity, ADCYAP1 microsatellite size, and migratory behavior may be part of the adaptive response to the migratory process of shorebirds. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. En el artículo se presenta una descripción de la crítica a la modernidad demostrada por el filósofo argentino Enrique Dussel señalando el proceso mediante el cual se fue configurando como un proyecto europeo. En efecto, el artículo plantea que dicho proyecto se postula en el marco de una centralidad que iría a justificar las prácticas coloniales implementadas. Para lograr mantenerse dentro de la dinámica histórica, estos hábitos empezaron a circunscribirse en discursos míticos so pretexto de justificar la violencia efectuada en (...) las prácticas. Dussel, por su parte, propone la categoría de Transmodernidad como proyecto alternativo emergente a la modernidad europea. No obstante, esta propuesta es objeto de críticas como las del filósofo colombiano Santiago Castro-Gómez. (shrink)

En este artículo nos disponemos desarrollar la tesis según la cual la crítica elaborada por Santiago Castro-Gómez a Enrique Dussel se trató de una desnaturalización del análisis del filósofo argentino sobre el proyecto moderno, en la cual Castro-Gómez puso de relieve las prácticas de las herencias coloniales como condición de posibilidad para la emergencia de la modernidad, sin necesidad de recurrir a la figura fundante del sujeto, aspecto que sí se encuentra presente en la propuesta del mendocino. Esta (...) tesis se demostrará mediante un diálogo crítico entre estos dos autores en torno al problema de la modernidad y la colonialidad a partir de tres claves analíticas, la posmodernidad, la modernidad y la descolonización, con el fin de pensar el modo en que las prácticas coloniales operaron en el proyecto moderno a través del uso de los valores presentes en la misma modernidad, sin que ello implique caer en una supuesta desmodernización. Introducción: Los cambios biológicos, sicológicos, económicos y sociales que se observan durante el envejecimiento conllevan a pensar que en los ancianos existe una serie de factores que favorecen la aparición de una depresión. Objetivo: evaluar la efectividad de una intervención sicológica para disminuir la depresión en adultos mayores de la Casa de abuelos "Dr. Diego Tamayo Figueredo", de Puerto Padre, en el período de noviembre de 2013 - mayo de 2014. Material y métodos: se realizó un estudio de intervención (...) sicológica en una muestra de 12 adultos mayores de la casa de abuelos. Se aplicó un programa de intervención sicológica, así como la Escala de Depresión Geriátrica para realizar la valoración antes y después de la intervención. Se empleó el modelo Cognitivo- Conductual de Beck. Los datos fueron tratados según la estadística descriptiva. Resultados: el porciento más elevado de pacientes correspondió al grupo de ancianos con edades entre los 60 y 90 años de edad. Respecto al sexo, el más frecuente es el masculino. El asma bronquial, la hipertensión arterial y la diabetes Mellitus representaron el mayor porciento de antecedentes patológicos personales. Conclusión: la intervención sicológica resultó efectiva pues se logró disminuir a leve los niveles iniciales de depresión establecida y los considerados con leve a no depresión, por lo tanto se afirma que con su aplicación fue modificado el estado emocional de los adultos mayores que se implicaron en la muestra. Introduction: Biological, psychological, financial and social changes observed during aging lead to think that there is a series of factors that favor the appearance of depression in senior citizens. Objective: Assessing the effectiveness of a psychological intervention in order to reduce depression in senior citizens from "Dr. Diego Tamayo Figueredo" Senior Citizens' House, Puerto Padre, from November 2013 to May 2014. Material and methods: A psychological intervention study was conducted on a sample of 12 senior citizens from the house. A psychological intervention program as well as the Geriatrics Depression Scale were applied before and after the intervention in order to make the assessment. The Beck's cognitive-behavior model was used. Data was processed according to descriptive statistics. Results: The highest percentage of patients corresponded to a group of seniors between 60 and 90 years of age. Regarding sex, males are more common. Bronchial asthma, arterial hypertension and diabetes mellitus represented the highest percentage of personal pathological history. Conclusion: The psychological intervention proved to be effective since initial established depression levels were reduced to minor and those considered as minor were reduced to no depression ; therefore, it is stated that its application modified the state of mind of the senior citizens involved in the sample. Scholarship on ancient Pyrrhonism has made tremendous advances over the past three decades, thanks especially to the careful reexamination of Sextus Empiricus’ extant corpus. Building on this momentum, the authors of the eight essays collected here examine some of the most vexed and intriguing exegetical and philosophical questions posed by Sextus’ presentation of this form of skepticism. The essays explore in a new light the skeptical interpretation of Plato, the differences between Pyrrhonism and Cyrenaicism, the Pyrrhonist’s stance on ordinary life, (...) religion, language, and ethics, Sextus’ discussion of our access to our own mental states, and the relationship between Pyrrhonism and epistemic internalism and externalism. Through the explorations of excellent scholars, this book provides a new understanding of Plato's _Theaetetus_, an absolute masterpiece which contains fundamental insights – about the nature of human cognition, perception, rationality – which are still at the centre of the contemporary debate.

Algorithmic systems and predictive analytics play an increasingly important role in various aspects of modern life. Scholarship on the moral ramifications of such systems is in its early stages, and much of it focuses on bias and harm. This paper argues that in understanding the moral salience of algorithmic systems it is essential to understand the relation between algorithms, autonomy, and agency. We draw on several recent cases in criminal sentencing and K–12 teacher evaluation to outline four key ways in (...) which issues of agency, autonomy, and respect for persons can conflict with algorithmic decision-making. Three of these involve failures to treat individual agents with the respect they deserve. The fourth involves distancing oneself from a morally suspect action by attributing one’s decision to take that action to an algorithm, thereby laundering one’s agency. (shrink)

ABSTRACT: So far in this book, we have examined algorithmic decision systems from three autonomy-based perspectives: in terms of what we owe autonomous agents (chapters 3 and 4), in terms of the conditions required for people to act autonomously (chapters 5 and 6), and in terms of the responsibilities of agents (chapter 7). -/- In this chapter we turn to the ways in which autonomy underwrites democratic governance. Political authority, which is to say the ability of a government to exercise (...) power, may be justifiable or not. Whether it is justified and how it can come to be justified is a question of political legitimacy. Political legitimacy is another way in which autonomy and responsibility are linked. This relationship is the basis of the current chapter, and it is important in understanding the moral salience of algorithmic systems. We will draw the connection as follows. We begin, in section 8.1, by describing two uses of technology: crime predicting technology used to drive policing practices and social media technology used to influence elections (including by Cambridge Analytica and by the Internet Research Agency). In section 8.2 we consider several views of legitimacy and argue for a hybrid version of normative legitimacy based on one recently offered by Fabienne Peter. In section 8.3 we will explain that the connection between political legitimacy and autonomy is that legitimacy is grounded in legitimating processes, which are in turn based on autonomy. Algorithmic systems—among them PredPol and the Cambridge Analytica-Facebook-Internet Research Agency amalgam—can hinder that legitimation process and conflict with democratic legitimacy, as we argue in section 8.4. In this essay, I consider an evolutionary debunking argument (EDA) that purports to undermine the epistemic justification of the belief in the reliability of our belief-forming processes, and an evolutionary vindicating argument (EVA) that seeks to establish that such a belief is epistemically justified. Whereas the EDA in question seems to fall prey to crippling self-defeat, the EVA under consideration seems to fall prey to vicious circularity. My interest in those arguments and the problems they face lies in what they (...) might tell us about the possibly aporetic nature of reason. For, if we take the EDA and the EVA in question to consist of true or plausible premises and valid inferences at which we arrive through a meticulous use of reason, then their falling victim to either crippling self-defeat or vicious circularity might be regarded as a sign that, when we push rational reflection on the reliability, or lack thereof, of our belief-forming capacities to the limit, we end up in a situation of aporia from which there seems to be no escape. In _Sociocybernetics and Political Theory in a Complex World_, Roberto Mancilla offers new takes on known ideas of political and constitutional theory; the advent of information technology and globalization puts them in crisis, as many stem from centuries past.

The empirical relationship between a firm’s social performance and its financial performance is still not well established in the literature. Despite more than 30 years of research and more than 100 empirical studies on the issue, the results are still mixed. We argue that the heterogeneous results found in previous studies are not due exclusively to problems related with the measurement instruments or the samples used. Instead, we posit that a more fundamental problem related with the endogeneity of social strategic (...) decisions could be driving most of the empirical findings. We show that, using a panel data of 658 firms from 1991 to 2005, how some of the results found in previous research change, and some are even reversed when endogeneity is properly taken into account. This paper takes the view that compensated donation and altruism are not incompatible. In particular, it holds that the arguments against giving compensation stand on weak rational grounds: the charge that compensation fosters “commodification” has neither been specific enough to account for different types of monetary transactions nor sufficiently grounded in reality to be rationally convincing; although altruism is commendable, organ donors should not be compelled to act purely on the basis of altruistic motivations, especially if there are good reasons (...) to believe that significantly more lives can be saved and enhanced if incentives are put in place, and offering compensation for organs does not necessarily lead to exploitation—on the contrary, it may be regarded as a necessity in efforts to minimise the level of exploitation that already exists in current organ procurement systems. I criticize the widely accepted “practical” interpretation of the universality test contained in Kant’s first formula of the categorical imperative in the Groundwork of the Metaphysics of Morals – the formula of the universal law of nature. I argue that this interpretation does not work for contradictions in conception because it wrongly takes contradictions in the will as the model for them and, as a consequence, cannot establish a clear distinction between the two kinds of contradiction. This interpretation also assumes (...) an understanding of universality that departs from Kant’s own and, cannot, for this reason, capture the kind of contradiction that he explicitly claims to establish. I provide an alternative interpretation, which I call revised logical interpretation, that allows us to account for contradictions in conception, including those examples that the practical interpretation cannot handle, as well as to establish a clear distinction between the two kinds of contradiction. We offer an ethical assessment of the market for data used to generate what are sometimes called “consumer scores” (i.e., numerical expressions that are used to describe or predict people’s dispositions and behavior), and we argue that the assessment has ethical implications on how the market for consumer scoring data should be regulated. To conduct the assessment, we employ two heuristics for evaluating markets. One is the “harm” criterion, which relates to whether the market produces serious harms, either for participants (...) in the market, for third parties, or for society as a whole. The other is the “agency” criterion, which relates to whether participants understand the nature and significance of the exchanges they are making, if they can be guaranteed fair representation, or if there is differential need for the market’s good. We argue that consumer scoring data should be subject to the same sort of regulation as the older FICO credit scores. Although the movement in the 1990s that was aimed at regulating the FICO scores was not aimed at restraining a market per se, we argue that the reforms were underwritten by concerns about the same sorts of problems as those outlined by our heuristics. Therefore, consumer data should be subject to the same sort of regulation. (shrink)

A proposal to allow prisoners to save their lives or to be eligible for commutation of sentence by donating kidneys for transplantation has been a subject of controversy in the Philippines. Notwithstanding the vulnerabilities associated with imprisonment, there are good reasons for allowing organ donations by prisoners. Under certain conditions, such donations can be very beneficial not only to the recipients but to the prisoners themselves. While protection needs to be given to avoid coercion and exploitation, overprotection has to be (...) avoided. The prohibition on the involvement of prisoners in organ transplantation constitutes unjustified overprotection. Under certain conditions, prisoners can make genuinely independent decisions. When it can be reasonably ascertained that they are able to decide freely, society should recognise an obligation to help them implement their decisions, such as when they intend to donate an organ as a way of asserting their religious faith and performing a sacrifice in atonement for their sins.
