  4. What Do Law Professors Believe about Law and the Legal Academy?Eric Martínez & Kevin Tobia - 2023 - Georgetown Law Journal 112:111-189.
Legal theorists seek to persuade other jurists of certain theories: Textualism or purposivism; formalism or realism; natural law theory or positivism; prison reform or abolition; universal or particular human rights? Despite voluminous literature about these debates, tremendous uncertainty remains about which views experts endorse. This Article presents the first-ever empirical study of American law professors about legal theory questions. A novel dataset of over six hundred law professors reveals expert consensus and dissensus about dozens of longstanding legal theory debates. -/- (...)

    Re-evaluating GPT-4’s bar exam performance.Eric Martínez - forthcoming - Artificial Intelligence and Law:1-24.
Perhaps the most widely touted of GPT-4’s at-launch, zero-shot capabilities has been its reported 90th-percentile performance on the Uniform Bar Exam. This paper begins by investigating the methodological challenges in documenting and verifying the 90th-percentile claim, presenting four sets of findings that indicate that OpenAI’s estimates of GPT-4’s UBE percentile are overinflated. First, although GPT-4’s UBE score nears the 90th percentile when examining approximate conversions from February administrations of the Illinois Bar Exam, these estimates are heavily skewed towards repeat test-takers (...)

The planetary boundaries concept has profoundly changed the vocabulary and representation of global environmental issues. The article starts by highlighting the strengths and weaknesses of planetary boundaries from a social science perspective. It is argued that the growth imperative of capitalist economies, as well as other particular characteristics detailed below, are the main drivers of the ecological crisis and exacerbated trends already underway. Further, the planetary boundaries framework can support interpretations that do not solely emphasize technocratic operational approaches and costs, (...)

The notion of societal boundaries aims to enhance the debate on planetary boundaries. The focus is on capitalist societies as a heuristic for discussing the expansionary dynamics, power relations, and lock-ins of modern societies that impel highly unsustainable societal relations with nature. While formulating societal boundaries implies a controversial process – based on normative judgments, ethical concerns, and socio-political struggles – it has the potential to offer guidelines for a just, social-ecological transformation.

The Material Intricacies of Coulomb’s 1785 Electric Torsion Balance Experiment.Elay Shech & Eric Hatleback - unknown
Contemporary scholars are engaged in a debate over whether Charles Augustin Coulomb’s results that he presented in his 1785 and 1787 memoirs to the Paris Academy of Sciences were attained experimentally or theoretically. In this paper, we study Coulomb’s famous 1785 electric torsion balance experiment through analysis of relevant texts and, more importantly, through a replication that is more faithful to Coulomb’s original design than previous attempts. We show that, despite recent claims, it has so far proved impossible to obtain (...)

No Exit: Death Drive, Dystopia, and the Long Winter of the American Dream in Harold Ramis’s The Ice Harvest.Eric D. Smith - 2024 - Utopian Studies 34 (3):380-398.
Abstractabstract:This article examines Harold Ramis’s 2005 noir comedy The Ice Harvest as the critically dystopian counter-panel to his beloved 1993 film Groundhog Day, a film frequently discussed within the paradigm of utopia. While starkly different in genre, tone, and reception, the two films comprise a dialectical dyad that registers the historical transition from the utopian cultural effervescence of the early 1990s to the tragic foreclosure of imaginative horizons and the dystopian transformation of economic, political, and social landscapes in the new (...)

International Law for a Time of Monsters: ‘White Genocide’, The Limits of Liberal Legalism, and the Reclamation of Utopia.Eric Loefflad - 2022 - Law and Critique 35 (1):191-212.
For critical legal scholars, the ongoing far-right assault upon the liberal status quo poses a distinct dilemma. On the one hand, the desire to condemn the far-right is overwhelming. On the other hand, such condemnations are susceptible to being appropriated as a validation of the very liberalism that critical theorists have long questioned. In seeking to transcend this dilemma, my focus is on the discourse of ‘white genocide’ — a commonplace belief amongst the far-right/white nationalists that ‘whites’, as a discrete (...)

Contrary to Vaesen's argument that humans are unique with respect to nine cognitive capacities essential for tool use, we suggest that although such cognitive processes contribute to variation in tool use, it does not follow that these capacities arenecessaryfor tool use, nor that tool use shaped cognition per se, given the available data in cognitive neuroscience and behavioral biology.

Five Interconnections of Race and Class.Michael Billeaux-Martinez & Calnitsky David - forthcoming - Historical Materialism:1-42.
This paper proposes a five-part empirical typology of interconnections of race and class. We describe the mechanisms whereby (1) race is a form of class relation; (2) race relations and class relations reciprocally affect each other; (3) race acts as a sorting mechanism into class locations; (4) race acts as a mediating linkage to class locations; and (5) race interacts with class in determining other outcomes. Rather than insisting on one or another mechanism as the overarching framework for conceptualising the (...)

Revisiting Masculine and Feminine Grammatical Gender in Spanish: Linguistic, Psycholinguistic, and Neurolinguistic Evidence.Anne L. Beatty-Martínez & Paola E. Dussias - 2019 - Frontiers in Psychology 10.
Research on grammatical gender processing has generally assumed that grammatical gender can be treated as a uniform construct, resulting in a body of literature in which different gender classes are collapsed into single analyses. The present work reviews linguistic, psycholinguistic, and neurolinguistic research on grammatical gender from different methodologies and across different profiles of Spanish speakers. Specifically, we examine distributional asymmetries between masculine and feminine grammatical gender, the resulting biases in gender assignment, and the consequences of these assignment strategies on (...)

In this article I examine several related views expressed by Robin Hendry concerning molecular structure, emergence and chemical bonding. There is a long-standing problem in the philosophy of chemistry arising from the fact that molecular structure cannot be strictly derived from quantum mechanics. Two or more compounds which share a molecular formula, but which differ with respect to their structures, have identical Hamiltonian operators within the quantum mechanical formalism. As a consequence, the properties of all such isomers yield precisely the (...)

This paper explains Sophie de Grouchy’s philosophical debts to Adam Smith. I have three main reasons for this: first, it should explain why eighteenth-century philosophical feminists found Smith, who has—to put it mildly—not been a focus of much recent feminist admiration, a congenial starting point for their own thinking; second, it illuminates De Grouchy’s considerable philosophical originality, especially her important, overlooked contributions to political theory; third, it is designed to remove some unfortunate misconceptions that have found their way into Karin (...)

It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. Linguistics of Saying is to be analyzed in the speech act conceived as an act of knowing. The speaking, saying and knowing subject, based on contexts and the principles of congruency and trust in the speech of other speakers, will create meanings and interpret the sense of utterances supplying the deficiencies of language by means of the intellective operations mentally executed in the act of speech. In the intellective operations you can see three steps or processes: first the starting point, (...)

Linguistics of saying studies language in its birth. Language is the mental activity executed by speaking subjects. Linguistics of saying consists in analyzing speech acts as the result of an act of knowing. Speaking subjects speak because they have something to say. Tthey say because they define themselves before the circumstance they are in. And this is possible because they are able to know. Speaking, then, is speaking, saying and knowing. In this sense there is a progressive determination. Knowing makes (...)

    Decolonization of AI: a Crucial Blind Spot.Carlos Largacha-Martínez & John W. Murphy - 2022 - Philosophy and Technology 35 (4):1-13.
Critics are calling for the decolonization of AI (artificial intelligence). The problem is that this technology is marginalizing other modes of knowledge with dehumanizing applications. What is needed to remedy this situation is the development of human-centric AI. However, there is a serious blind spot in this strategy that is addressed in this paper. The corrective that is usually proposed—participatory design—lacks the philosophical rigor to undercut the autonomy of AI, and thus the colonization spawned by this technology. A more radical (...)

    Complexes, rule-following, and language games: Wittgenstein’s philosophical method and its relevance to semiotics.Sergio Torres-Martínez - 2021 - Semiotica 2021 (242):63-100.
This paper forges links between early analytic philosophy and the posits of semiotics. I show that there are some striking and potentially quite important, but perhaps unrecognized, connections between three key concepts in Wittgenstein’s middle and later philosophy, namely, complex, rule-following, and language games. This reveals the existence of a conceptual continuity between Wittgenstein’s “early” and “later” philosophy that can be applied to the analysis of the iterability of representation in computer-generated images. Methodologically, this paper clarifies to at least some (...)

This article introduces Agentive Cognitive Construction Grammar, an emerging field that seeks to connect the linguistic system with speaker-meaning. The stated purpose is thus to tackle a pervasive disconnect in both cognitive linguistics and construction grammar, whereby the linguistic system and speaker selections are separated in the belief that language is essentially a mental process associated with the brain, and hence, separated from bodily experience. I contend this view by introducing a triadic model of construction in which form and function (...)

Philip Kitcher has proposed a theory of explanation based on the notion of unification. Despite the genuine interest and power of the theory, I argue here that the theory suffers from a fatal deficiency: It is intrinsically unable to account for the asymmetric structure of explanation, and thus ultimately falls prey to a problem similar to the one which beset Hempel's D-N model. I conclude that Kitcher is wrong to claim that one can settle the issue of an argument's explanatory (...)

In contrast, we argue for an account of self-deception that involves more robustly deceptive unconscious processes. These processes are strategic, flexible, and demand some retention of the truth. We offer substantial empirical support for unconscious deceptive processes that run counter to certain philosophical and psychological claims that the unconscious is rigid, ballistic, and of (...)

The argument is that higher-level organisms use complex predictive reasoning to deal with uncertainty, while non-cognizant species, such as SARS-CoV-2, rely on an economy-driven heuristic to enter host cells. From this viewpoint, the current pandemic is characterized as a clash of representations resulting from the anthropocentric construction of the self, which neglects (...)
