In the Netherlands fertility doctors increasingly formulate protocols, which oblige patients to quit their unhealthy lifestyle before they are admitted to IVF procedures. We argue that moral arguments could justify parenting protocols that concern all future parents. In the first part we argue that want‐to‐be parents have moral responsibilities towards their future children to prevent them from harm by diminishing or eliminating risk factors before as well as during the pregnancy. This is because of the future children's potential to become (...) of a certain type, more specifically: a person that will be the want‐to‐be parents' child. Want‐to‐be parents intend to become pregnant and therefore have an additional moral reason to diminish the risks. Also, people who become pregnant unintentionally have the responsibility to prevent their children from harm, unless they become pregnant due to contraception failure. All people not wanting to become pregnant should use contraception methods carefully.In the second part of this paper we translate the want‐to‐be parents' responsibilities into practice. We distinguish four determinants of risk factors: modifiability, chance, severity and effort. We examine some evidence‐based risk factors based on these variables and deduce levels of responsibility.In conclusion, formulating informal requirements for want‐to‐be parents is morally required and therefore also for want‐to‐be parents in need of medical assistance. The protocols developed by fertility doctors in the Netherlands could be seen as the precursor for a general, informal Parenting Protocol that could be developed on the basis of an extended and thoroughly debated risk‐responsibility analysis. Informed consent is a key condition for prenatal screening programmes to reach their aim of promoting reproductive autonomy. Reaching this aim is currently being challenged with the introduction of non‐invasive prenatal testing (NIPT) in first‐trimester prenatal screening programmes: amongst others its procedural ease—it only requires a blood draw and reaches high levels of reliability—might hinder women’s understanding that they should make a personal, informed decision about screening. We offer arguments for a renewed recognition and use of informed consent compared to (...) informed choice, and for a focus on value‐consistent choices and personalized informational preferences. We argue for a three‐step counselling model in which three decision moments are distinguished and differently addressed: (1) professionals explore women’s values concerning whether and why they wish to know whether their baby has a genetic disorder; (2) women receive layered medical‐technical information and are asked to make a decision about screening; (3) during post‐test counselling, women are supported in decision‐making about the continuation or termination of their pregnancy. This model might also be applicable in other fields of genetic (pre‐test) counselling, where techniques for expanding genome analysis and burdensome test‐outcomes challenge counselling of patients. The squabble continues.Sarah: ‘So what? Does old age exclude you from society? (...) Of course we have to treat him.’‘But the investment will only last for a few years, and think of the risks, he may die from the operation. He should go home and, well, live what there is to live.’She shakes her head, her hair giving her a red aura. ‘I think he ought to have the operation.’‘I think it would be best if he should accept that time is running out, that life is finite, the whole existential rigmarole, et cetera.’‘Quite presumptuous of you to think he has not accepted that. Why? Just because he is old and did not kill himself?’ Sarah is indignant. ‘If he had done just that, we would have lamented about how we do not take care of our elderly, that society doesn't care, and that certainly there is no right to die unless your situation is totally hopeless and you're in a lot of pain. Studie over de morele toelaatbaarheid van medische experimenten met mensen.

The central idea of this “article” is that certain developments such as extreme simplification, the politicisation of medical ethics, the “normative industry” and “empirethics”, may seriously threaten the (future) practice of medical ethics.

Objectives To evaluate whether the requirement of “minimal risk and burden” for paediatric research without direct benefit to the subjects compromises the ability to obtain data necessary for improving paediatric care. To provide evidence-based reflections on the EU recommendation that allows for a higher level of risk. Design and setting Systematic analysis of the approval/rejection decisions made by the Dutch Central Committee on Research involving Human Subjects (CCMO). Review methods The analysis included 165 proposals for paediatric research without direct benefit (...) that were reviewed by the CCMO between January, 2000, and July, 2007. A separate, in-depth analysis of all drug studies included 18 early phase drug studies and nine other drug studies without direct benefit. Results 11 out of 165 studies were definitively rejected because the CCMO did not regard the risk and/or burden to be minimal. In three of these 11 cases (including two early phase drug studies) the requirement of minimal risk and burden was cited as the only reason for rejection. Four other early phase drug studies also involved risks and/or burdens that were not regarded to be minimal but were nevertheless approved. Conclusions The requirement of minimal risk and burden, aiming to protect research subjects, occasionally leads to rejection of protocols. Early phase drug studies relatively often do not comply with the requirement. Committees may find ways to approve important studies that formally should be rejected, but that is not a desirable solution. The regulatory framework should be revised to make such occasional exceptions to the requirement legitimate and transparent. (shrink)

Dutch decline is usually studied as a topic in economic history: when did it really start, what shape did it take? In this article an attempt is made to show the actual awareness of the strengths and weaknesses of the Dutch economy, in the terms used by participants in three public debates. The classical Dutch discourse of decay and decline evolved in response to national and international political reality. The Bickerse Beroerten debate of 1650 shows the conflict between neo-Roman and (...) neo-Athenian tendencies. Subsequently, the explanation of Dutch decline (the effect of luxury) by the Anglo-Dutch pamphleteer Bernard Mandeville is shown to be markedly different from his advice to the English (to allow luxury). Finally, the 1630s Dutch debate between Lieven de Beaufort and his critics represents the maturing of the Dutch vocabulary of decline, including its failure to take into account the organisational preconditions of modern society. The witch-hunt of the Burgundian town of Arras in 1459-1460 was the first large- scale, state-sponsored witch-hunt of Western Europe. However, immediately following this witch-hunt we still find evidence of a reluctance to accept the realities of witchcraft among the populace, made plain in the official appeal record of the accused Seigneur Colard de Beaufort at the parlement de Paris. Scepticism of this kind stirred the Dominican cleric Johannes Tinctor out of retirement to write a vicious demonological treatise to convince (...) the courts of Burgundy and France of the existence and dangers of a sect called vaudois, a term that had come to refer to witches. This essay closely examines Tinctor's heavy use of crusading imagery in his Invectives contre la secte de vauderie to justify and rationalize his arguments for duke Philip the Good of Burgundy and his court, a court renowned for consistent but empty promises of crusade and an elaborate culture bloated with an idealized infatuation with chivalric virtue and romance. In the autumn of the middle ages, when the traditional eastern crusade against "Saracens" had become frustratingly difficult to organize, what could be more appealing to a court so starved for crusade than a cry for war against an even greater enemy hiding amongst the populace, threatening Christendom from within? Philosophers of science have come to accept that contextual values can play unavoidable and desirable roles in science. This has raised concerns about the need to distinguish legitimate and illegitimate value influences in scientific inquiry. I discuss here four such concerns: epistemic distortion, value imposition, undermining of public trust in science, and the use of objectionable values. I contend that preserving epistemic integrity and avoiding value imposition provide good reasons to attempt to distinguish between legitimate and illegitimate influences of values (...) in science. However, the trust and the objectionable values concerns constitute no good reason for demarcation criteria. (shrink)

This article reflects on childhood times based on the words chrónos, kairós and aión, which the Greeks use to conceptualize time, in dialogue with different authors, such as Kohan, Pohlmann, Skliar, Kohan and Fernandes. In the pedagogical field, we explore how Pedagogy of Childhood has focused on the importance of childhood temporality and children’s agency, with contributions from Hoyuelos, Parrini, Aguilera et al., Barbosa, Oliveira-Formosinho e Araújo, Oliveira-Formosinho, Pinazza and Gobbi. We reflect on what forms of organizing time are possible (...) when we think about children and their childhoods. Would it be a continuous and chronological time, a time of opportunity for the instant or the timeless intensity of the aiónic? Would it be possible to open spaces in school for other temporalities, given its immersion in chronological time, and its extreme emphasis on routine? We seek a relationship between forms of temporality, philosophy, and early education in order to explore alternative possibilities in the relationship between child and the school context, and conclude that, since the child’s is the aiónic time of intense experience, it is in the heightened dynamic immediacy and the multiple symbolic languages of play that it may be possible to create pedagogical structures that provide a dwelling for childhood temporality. In this chapter, we focus on animism and how it is studied in the cognitive science of religion and cultural anthropology. We argue that philosophers of religion still use (outdated) normative notions from early scientific studies of religion that go back at least a century and that have since been abandoned in other disciplines. Our argument is programmatic: we call for an expansion of philosophy of religion in order to include traditions that are currently underrepresented. The failure of philosophy of (...) religion to discuss and accommodate different perspectives means a large part of human religious beliefs, practices, and experiences remains outside its purview. As a point of focus, we examine animism in two cultures as a way to think about what sorts of questions and ideas an expansion of philosophy of religion into lesser-explored traditions could offer. O silêncio e a invisibilidade são as palavras que melhor representam a história da mulher no decorrer de muitos séculos. Desde a antiguidade, as mulheres foram impedidas de falar, e até nos dias atuais, infelizmente, pouco se valoriza o discurso feminino. Em diversas sociedades, o direito a expressar-se é severamente combatido, punido com rigor. A essas mulheres, vilipendiadas em seus direitos, resta um único espaço: o da subalternidade. Nesse contexto de subalternidade, habitando o espaço prisional marginal, fazer uso da palavra (...) e apropriar-se do direito à fala é um ato de coragem e de rebeldia. O presente artigo analisa o testemunho de uma mulher em situação de prisão que, até chegar ali, teve quase todos os seus direitos humanos profanados. A narrativa destaca suas experiências e traz à luz suas memórias e a maneira como dialoga com o passado. A partir da cela da prisão, a mulher produz o seu discurso, elabora o seu balbucio, que embora abafado, ultrapassa as grades e os altos muros. É através do poder de sua voz que ela reivindica o direito à fala, o direito de recontar-se, de falar de si. Neste artigo, analisamos, sob a perspectiva dos Estudos Culturais, a história narrada por VB1, uma mulher negra que cumpre pena em regime fechado. A partir desta análise, propomos uma reflexão sobre o espaço prisional, o direito à fala e o papel da memória nesse processo. Teremos como referências teóricas as identidades culturais em tempos de pós-modernidade com Stuart Hall, as reflexões sobre memória individual e coletiva de Maurice Halbwachs, estudos acerca da subalternidade com Hugo Achugar e Gayatri Spivak, espaço fronteiriço e memórias subalternas com Edgar Nolasco, reflexões sobre o papel da mulher propostas por Michele Perrot, entre outros. This article raises the issue of the foundation of ethics in the situation of the pluralism of modern and contemporary society. Then , two types of answers to these problems are analyzed: comunitarism as the identitary ethics of an 'ourselves', and contractualism as the ethics of the partners' interests, which present themselves as rival theories in opposition to the universalism of kantian morality. It is however shown , how Kant himself had already worked at different levels of human integration with (...) both models: that of social contract and that of ethical community, and had articulated them in his system. The universal principle of morality , on the other hand, places itself at the meta-level of the profound grammar of the ethos of communities and contracts . Finally, it is observed that Kant´s fundamental ethical texts have not explicitly dealt with the hermeneutical problem of moral judgment in contexts of action. However, some passages of the Grundlegung are analyzed, as well as the Second Part of the Critique of Practical Reason, in which we find precise indications on this issue. It is maintained, that the observed lack of treatment may be bridged by means of widening the scope of the doctrine of reflexive judgment of aesthetic taste of the Third Critique's first part, which appears relevant, not for the foundation of the principle of morality, but for its application, i.e., for moral life.Este artículo plantea el problema de la fundamentación de la ética en la situación del pluralismo de la sociedad moderna y contemporánea. Se analizan luego dos tipos de respuesta a este problema: el comunitarismo como la ética identitaria de un nosotros, y el contractualismo como la ética de los intereses de los socios, los cuales se presentan como teorías rivales frente al universalismo de la moralidad kantiana. Se muestra sin embargo cómo el propio Kant había trabajado ya en distintos planos de la integración humana con los dos modelos del contrato social y de la comunidad ética, y los había articulado en su sistema. El principio universal de la moralidad se ubica en cambio en el meta-nivel de la gramática profunda del ethos de las comunidades y de los contratos . Se observa finalmente que los textos éticos fundamentales de Kant no han tratado de manera explícita el problema hermenéutico del juicio moral en los contextos de acción. Se analizan no obstante algunos pasajes de la Grundlegung y la Segunda Parte de la Crítica de la Razón Práctica, en los que hay indicaciones precisas sobre este problema. Se sostiene que la observada laguna se puede sortear mediante la ampliación de los alcances de la doctrina del juicio reflexivo del gusto estético de la primera parte de la Tercera Crítica, la cual parece relevante, no para la fundación del principio de la moralidad, pero sí para su aplicación, es decir: para la vida moral. Este texto tem dois objetivos principais: apresentar o conceito de “lei natural” e aquilo que seria a sua expressão como “lei escrita” e, depois, reinterpretar este conceito a partir de uma perspectiva nietzschiana. Para alcançar este duplo objetivo urge, pois, em primeiro lugar, traçar, nas suas grandes linhas, as vicissitudes que atravessou a teoria da “lei natural” ao longo da tradição #losó#ca até a sua culminância naquelas correntes do direito natural, típicas dos tempos modernos. Convém também assinalar que este conceito (...) encerra no seu bojo, como derivações, as noções de necessidade, de #nalidade e providência. Eis por que, para interpretá-lo e criticá-lo, são utilizadas algumas intui- ções e análises de Nietzsche que, ao longo de sua obra, não cessa de se referir, direta ou indiretamente, a estas questões e, também, àquela de acaso. Não se trata, portanto, de simplesmente apresentar uma crítica de Nietzsche aos conceitos de “lei natural” e “lei escrita”, mas, principalmente, de examiná-los à luz de seu pensamento. (shrink)

La producción cinematográfica constituye una fuente primaria en la construcción del conocimiento histórico, aunque la aprobación de sus aportaciones es muy reciente y coincide con la renovación de las técnicas de investigación en los análisis historiográficos que desbordan la primacía documental de los textos escritos. La relevancia potencial del cine en los estudios sociales está avalada por su condición primaria, la cual ejemplifica un “medio internacional de masas”. Partiendo de esta premisa, este trabajo intenta analizar y problematizar diferentes miradas que (...) rompen con la tradicional aproximación predominante al conflicto político norirlandés en el cine. Al respecto, Agenda Oculta, En el nombre del padre y En el nombre del hijo son tres producciones cinematográficas que ofrecen diferentes maneras de atender y entender categorías polisémicas que son problemáticas en la comprensión de la realidad política del Ulster, tal y como sucede con la democracia, la justica, la violencia, el terrorismo o los derechos humanos. Antipathy is an affective phenomenon which has not received much attention by philosophers and psychologists, unlike its antonym, sympathy. However, antipathy is a phenomenon that contributes to and fuels many of the challenges related to our social behaviours and interpersonal relationships. Antipathy’s exact nature needs to be identified, if only because of the importance it has, for example, in political opposition, in loss of civility, but also in situations that cause poor psychological well-being. It would be then essential to be (...) able to determine whether antipathy is a phenomenon that could be felt on a short term (an episode) or last in the long term (a disposition), since it would allow to study and measure more precisely the nature of the acts it gives rise to, the range of its intensity or/and its social consequences. Like sympathy, antipathy is most often understood as an affective phenomenon that lasts over time. Antipathy is often presented as an instinctive and irrational aversion to something or someone. Yet this common definition is too similar to the definition of other affective phenomena such as disgust or even fear. This article will therefore examine the nature of antipathy by differentiating it from other emotional phenomena that resemble it. But more importantly, the limited existing literature on antipathy mostly characterises it as an affective disposition. In this paper, I will rather argue that antipathy is a conscious emotion, i.e., an emotion that occurs consciously and has a phenomenology. (shrink)

O objetivo deste artigo é refletir acerca da valorização dos cabelos crespos em crianças enquanto resistência estético-política a partir das relações entre os conceitos de infância, afrofuturismo, cabelo crespo e sankofa. O artigo se fundamenta epistemologicamente em algumas perspectivas teóricas interdisciplinares e afrocentradas; e a metodologia se baseou na observação participante em marchas e encontros de valorização da estética negra entre 2014 e 2019 em nove capitais do Brasil. Com base neste arcabouço teórico-metodológico, a infância foi situada como ponto de (...) partida para se pensar as relações étnico-raciais em diáspora, a fim de vislumbrar novas produções epistemológicas, estéticas e políticas que se distanciem das elaborações subjetivas coloniais. Abrindo caminhos e possibilidades, reconectar-se com o passado sustentado por memórias, histórias e estéticas da cultura africana é também ter a condição de alterar o futuro. Sendo assim, este pensamento pode conduzir à construção de possíveis roteiros para reparação social e convergência de práticas alicerçadas por valores e sentidos estéticos africanos. (shrink)

Quelle est la tâche – plutôt que la contribution – de la philosophie à l’égard du langage? Dans cet article, il s’agit de revisiter la réponse de Paul Ricœur à cette question, à partir de son texte “Philosophie et langage.” Ricœur assigne à la philosophie la tâche de se réapproprier la triple médiation langagière: “chemin” du langage vers monde, “chemin” du langage vers le sujet et “chemin” du langage vers la communauté humaine. Partant de l’expérience concrète des sujets parlants, Ricœur (...) s’oppose à la clôture systémique présupposée par la conception structuraliste du langage, qui suspend la fonction de la référence dans la relation de signification. À partir d’une conception élargie de la référence – qui inclut la fonction poétique du langage –, le philosophe dégage de la notion de “monde du texte” la dimension ontologique constitutive du langage: dans sa fonction poétique, en effet, le langage révèle, selon lui, les possibilités multiples de notre mode d’existence. Nous montrons enfin que c’est à travers la notion d’attestation que Ricœur établit une connexion entre la réouverture de la triple médiation du langage et l’élaboration de cette nouvelle ontologie. Neste artigo pretendemos discutir a noção de construção da mente consciente a partir da perspectiva de Antonio Damásio. Para isso, centraremos nossa análise em Self comes to Mind. Em um primeiro momento é necessário delimitarmos o conceito de consciência na visão de Damásio, visando, com isso, a evitarmos equivocidades, na medida em que há várias definições de consciência. Acreditamos que, para uma melhor compreensão acerca do surgimento da mente consciente, é necessário levarmos em consideração os processos evolutivos aos quais o (...) homem está sujeito. A consciência é, pois, fruto de um desenvolvimento evolutivo já bem estabelecido pela ciência. Compreender o desenvolvimento evolutivo do self se torna tarefa de suma importância, na medida em que Damásio estrutura sua compreensão de mente consciente a partir do papel desempenhado pelo self na tarefa de agregar conteúdos mentais. Para Damásio, a origem da mente está associada ao momento em que um processo do self é adicionado a um processo mental básico. Quando não ocorre um self na mente, esta mente não é propriamente consciente, o que significa dizer que é o self que garante consciência a uma mente. Isso quer dizer que precisaremos discutir de forma clara e distinta o conceito de self e seus estágios, para que finalmente possamos entender os passos delimitados por Damásio para discutir a construção da mente consciente.
