En efecto, sin soslayar la interpretación ya clásica de aquél se indaga sobre la posibilidad de pensarlo como tributario de una heteronomía que señala de alguna manera a la autonomía una dignidad sobre la cual ésta no puede tener prácticamente ninguna injerencia. Resumen El artículo expone la noción de temporalidad discontinua implícita formalmente en la fenomenología de la conciencia interna del tiempo de Husserl y las correspondencias equivalentes que se encuentran en una lectura atenta de la obra de Marcel Proust. Para eso se reconstruye la peculiar noción de tiempo implícita en la obra de ambos autores mostrando el sentido diferencial y discontinuo que la misma reviste. A partir de dicha reconstrucción se desarrollan las implicaciones críticas que la misma acarrea respecto de (...) las concepciones tradicionales de memoria, subjetividad y corporalidad. Finalmente se hacen algunas consideraciones respecto de las influencias recíprocas entre filosofía y arte.The article exposes the notion of a discontinuous temporality formally implied in Husserl's phenomenology of internal time consciousness and its corresponding equivalencies found in an attentive reading of the work of Marcel Proust. To this end, the peculiar notion of time implicit in the work of both authors is reconstructed showing the differential and discontinuous sense that this notion has. It is developed the critical implications that this reconstruction carries with it regarding the traditional conceptions of memory, subjectivity and corporeality. Esta investigación ofrece un esbozo de una forma alternativa de concebir la categoría clásica de la subjetividad que subyace al concepto de objeción de conciencia y de desobediencia civil. La mayoría de los puntos de vista habituales sobre este tema se centran en el individuo y sus derechos. Demostrando que este enfoque es insuficiente y, por lo tanto, insatisfactorio, esta investigación destaca la importancia de conceptualizar de nuevo la categoría de subjetividad, lo que a su vez hará posible una nueva (...) forma de conceptualizar la noción de objeción de conciencia, es decir, pensar en ella no más como un derecho individual, sino como un deber de responsabilidad social. Para la explicitación de este enfoque alternativo, esta investigación se basa principalmente en la obra de Emmanuel Levinas, quien centra todas sus reflexiones filosóficas en la perspectiva del otro. In the present paper it is shown, following Levinas, that Ethics, understood as an intersubjective relation among completely separate subjects, sets itself up starting from concrete events that determine man's historical existence, but these are invested with the peculiarity of being events which escape the ontological order. Rather, they send to somewhere beyond, outside ontology, signifying above all in an ethical fashion, i.e., in a way other than being.

This paper addresses the problem of articulating ethics with justice, as it would seem impossible to think the practical application of one without denying the other at the same time. Indeed, as Levinas puts it, justice is violence within ethics when trying to compare the incomparable. On the contrary, ethics is an asymmetrical and irreversible relationship between two, where justice seems to have no room at all. This work seek to provide an articulation between both immeasurable dimensions by a renewed (...) attention to the issue of temporality of ethics and by including the concept of impure, taken from the work of Jean Guitton, from which it is understood that both dimensions are co-implicated from the very difference that constitute them. In this article I try to prove that the crisis of the West is necessarily linked to the crisis of a monotheism, which has lost its primordial sense. Indeed, because God was conceived of in Western civilization on the basis of the Plotinian unus—that is, on the basis of identity—and every other relationship to alterity was conceived of following this very same criterion, sociality was defined as plurality of the individual, as a mere numerical multiplicity. Against this conception I sketch (...) a new schema for thinking of God and thinking of the relation to otherness based on a differentiality irreducible to any identity. I depict this differentiality as based on the Husserlian conception of time consciousness, defining it not only as a mere lack of identity but as a non-indifference for the other. Hence, I conclude that it is possible to think of a true monotheism that fosters a multiplicity of religions that are not indifferent but responsible to each other. (shrink)

En el presente artículo se intenta poner de relieve cómo la comp- rensión levinasiana del tiempo contribuye a la recuperación del valor y del sentido del instante presente, el cual ha sido menospreciado hasta nuestros días en gran parte de la tradición filosófica en tanto concebido a partir del tiempo, pensado este último como duración. Se trata así pues de pensar el sentido propio del instante en sí mismo, en cuanto momento presente, independientemente del sentido fun- cional que se le (...) asigna como parte de un conjunto –la duración– que lo abarca y en el que se absorbe. Se tratará por lo tanto de imaginar otras metáforas para explicar el acaecer temporal, distintas de la del punto, de la línea o de la del flujo del devenir; metáforas a partir de las cuales el tiempo ha sido siempre comprendido como un continuo homogéneo. Estas representaciones abstractas del tiempo presentan un orden que reúne los instantes, pero carecen de la noción de un instante central: ese instante por excelencia que es el presente. (shrink)

Die levinassche Erschließung von Gerechtigkeit als dem Äußersten zu Denkenden fordert eine Reflexion darüber heraus, wie Gerechtigkeit jeweils wieder in der konkreten Begegnung mit den Anderen verwirklicht wird. Wie ist die erhoffte Gerechtigkeit des Einen mit dem konkret werdenden Ethischen durch die Handlung des Anderen zum Zeitpunkt des Geschehens verstrickt? Diese »Verstrickung« wird als eine Komplikation verstanden, welche die beruhigte Einsamkeit des modernen Subjekts stört. Dieses störende Ereignis der Verantwortung lässt sich nicht als Ergebnis eines Kalküls zwischen Verbotenem und Erlaubtem (...) begreifen. Denn die wirkliche Gerechtigkeit geschieht nur in der konkreten geschichtlichen Handlung, die die theoretischen Widersprüche, die sich in einem zeitlos-idealistischen Denken zu geben scheinen, übersteigt. The aim of this study consists of postulating an ethical approach to Human Rights conceiving them as rights of the other, claiming that this approach represent a starting point for the development of a legal pluralism that contributes to the achievement of an effective and authentic peace. For this study is based on the premise that the law must be able to deal with the serious and still pending social and environmental problems that underlie the violations of human rights, especially (...) those of ecological nature. By way of conclusion, the need for a radical change of the paradigm is evidenced, for which a perspective of ethics as a linguistic praxis is proposed, since such praxis has the potential to inspire the reformulation of human rights, for the purpose of reversing the dynamics of violence imposed by the logic of identity underlying the current legal system. IntroductionLifestyle modifications are part of comprehensive treatment plans to help manage the symptoms of pre-existing chronic conditions. However, behavior change is notoriously difficult as patients often lack the necessary support. The present manuscript outlines the development of a Green Health Prescription pathway that was designed to link patients with appropriate lifestyle interventions and to support attendance. Strengths, Weaknesses, Opportunities, and Threats analysis was undertaken in three focus groups to highlight areas of strength and weakness within the proposed pathway prior to (...) delivery. The SWOT analyses revealed that the pathway was supported by all three focus groups. Weaknesses and threats were identified including sustainability of nature-based interventions in terms of funding, the need to connect patients with appropriate interventions based on their physical and mental health needs, and the requirement to have a “one-stop shop” for information to ensure that the pathway was accessible for all service-users and healthcare professionals. Results were addressed and considered throughout the development of the pathway.DiscussionThe Green Health Prescription pathway was launched in 2019 and gave patients the ability to receive a prescription from a healthcare professional, community service, or to self-refer. The pathway allows patients to contact a consultant, via a telephone service, who is trained to match them with a programme that the patient believes will be enjoyable and that fits their treatment needs. Data collection to assess the efficacy of the pathway is ongoing. (shrink)

In this paper, we present a non-trivial and expressively complete paraconsistent naïve theory of truth, as a step in the route towards semantic closure. We achieve this goal by expressing self-reference with a weak procedure, that uses equivalences between expressions of the language, as opposed to a strong procedure, that uses identities. Finally, we make some remarks regarding the sense in which the theory of truth discussed has a property closely related to functional completeness, and we present a sound and (...) complete three-sided sequent calculus for this expressively rich theory. The urban environment is increasingly engaging with artificial intelligence, a focus on the automation of urban processes, whether it be singular artefacts or city-wide systems. The impact of such technological innovation on the social dynamics of the urban environment is an ever changing and multi-faceted field of research. In this paper, the space and time defined by the autonomous vehicle is used as a window to view the way in which a shift in urban transport dynamics can impact the temporal (...) experience of an individual. Using the finite window of time created by an autonomous vehicle, a theoretical framework is put forward that seeks to show how contrasting narratives exist regarding the experience of the window of time within the autonomous vehicle. By taking a theoretical approach informed by social theory, the dissolution of barriers between separate spheres of life is explored to highlight the increased commodification of time. In focusing on both the space and time created by the autonomous vehicle this approach seeks to highlight how artificial intelligence can provide a contemporary space in the urban environment while also opening a new window of time. The cognitive dissonance observed when comparing the narratives of autonomous vehicle stakeholders and the historical shift in time use leads to a belief that technology makes the user more free in terms of time. With this paper the autonomous vehicle is shown to be an ideal space and time to view the way in which the use of such technology does not increase free-time, but further dissolves the boundaries between what is and what is not work-time. The illicit diffusion of intimate photographs or videos intended for private use is a troubling phenomenon known as the diffusion of Non-Consensual Intimate Images (NCII). Recently, it has been feared that the spread of deepfake technology, which allows users to fabricate fake intimate images or videos that are indistinguishable from genuine ones, may dramatically extend the scope of NCII. In the present essay, we counter this pessimistic view, arguing for qualified optimism instead. We hypothesize that the growing diffusion of deepfakes (...) will end up disrupting the status that makes our visual experience of photographic images and videos epistemically and affectively special; and that once divested of this status, NCII will lose much of their allure in the eye of the perpetrators, probably resulting in diminished diffusion. We conclude by offering some caveats and drawing some implications to better understand, and ultimately better counter, this phenomenon. (shrink)

This study investigates how e-business capabilities and digital marketing strategies jointly influence business performance in the e-commerce industry, which has experienced unprecedented growth driven by technological advancements and changing consumer behavior. E-business capabilities encompass the use of technology and digital infrastructure, while digital marketing strategies are employed to attract and retain online customers. The study examines the effect of e-business capabilities through digital marketing strategies on the customer satisfaction and loyalty of UAE e-commerce industry. The research is descriptive and explanatory, (...) and uses a structured 5-scale Likert questionnaire to collect data from the HR managers of 135 e-commerce companies based in UAE. The statistical analysis is performed using structural equation modeling. The findings highlight the significant relationship of the study variables. Consequently, the results of this study provide valuable insights for e-commerce businesses, elucidating the need to invest in robust e-business capabilities to support effective digital marketing efforts. Additionally, the research underscores the significance of tailoring digital marketing strategies to align with specific business objectives and customer segments. The study also contributes to the literature on digital transformation, by demonstrating how e-business capabilities and digital marketing strategies can enable e-commerce firms to adapt and thrive in the dynamic and competitive digital environment. La naturaleza de lo humano se pone en cuestión, sobre todo, cuando la alteramos en su propia esencia, no solo en su entorno, y, además, desde su propio inicio. Se trata, (...) pues, de una disrupción y alteración sustancial ad intra del ser humano, no ad extra, como ocurre con la tecnología, aún cuando esta también tiene, obviamente, muchos efectos en el interior de aquél. Los cambios que se derivan de la Biotecnología y, concretamente, de la edición genómica, por un lado, ofrecen un enorme potencial para desarrollar nuevos conceptos, métodos y novedosas aplicaciones para los urgentes retos y necesidades de la sociedad. Por el otro lado, tales biotecnologías son percibidas como si tuvieran el potencial de desafiar y, a veces, desdibujar las actitudes, valores y modelos culturales de la propia sociedad. A tal reto no puede estar, obviamente, ajeno el Derecho en atención a los valores, intereses y derechos en conflicto. Si la pregunta que debemos nuevamente formularnos es qué es el hombre o qué es la naturaleza humana, el Derecho debe también ofrecer respuestas que permitan dar un sentido jurídico contemporáneo a tal esencia, preguntas que conectan directamente con el propio concepto jurídico de dignidad, no solo en cuanto valor ontológico del ser humano, sino también, recogiendo los términos explícitos del artículo 10.1 de nuestra Constitución, en cuanto fundamento del orden político y de la paz social. The objective of this article is to analyze the relationships between theories of strategic design and participatory design, in multiple commercial alliances between local entrepreneurs from different sectors and their integrated application in the urban context. Various authors have dealt with these strategic issues in isolation and less frequently have addressed them from the entrepreneurial experience. A review of the specific literature allows us to account for the main concepts involved in this approach. The case being analyzed refers to a (...) fitness-related venture in the city of La Plata, which articulated, together with other local actors, a collaborative strategy that led to the application of a superior business model for its sector. In addition, he capitalized on his role as an influencer on the social network Instagram, as a way to enhance the project’s comprehensiveness. The topics that are addressed synthesize the key concepts that allow us to interpret the praxis relieved. And from them, create a model that can be applied in other markets and territories to promote young local development. And in this way, different actors, complementary products and services serve to jointly promote a co-productive and self-managed culture. (shrink)

The reasonable person standard is used in adjudicating claims of self-defence. In US law, an individual may use defensive force if her beliefs that a threat is imminent and that force is required are beliefs that a reasonable person would have. In English law, it is sufficient that beliefs in imminence and necessity are genuinely held; but the reasonableness of so believing is given an evidential role in establishing the genuineness of the beliefs. There is, of course, much contention over (...) how to spell out when, and in virtue of what, such beliefs are reasonable. In this chapter, we identify some distinctive issues that arise when we consider that implicit racial bias might be implicated in the beliefs in imminence and necessity. Considering two prominent interpretations of the reasonable person standard, we argue that neither is acceptable. On one interpretation, we risk unfairness to the defendant-who may non-culpably harbour bias. On another, the standard embeds racist stereotypes. Whilst there are formulations of the defence that may serve to mitigate these problems, we argue that they cannot be avoided in the presence of racist social structures. (shrink)

In recent years, the concept of “integrity” has been frequently discussed by scholars, and deployed by courts, in the domain of criminal procedure. In this paper, we are particularly concerned with how the concept has been employed in relation to the problem of the admissibility of evidence obtained improperly. In conceptualising and addressing this problem, the advocates of integrity rely on it as a standard of conduct for the criminal justice authorities and as a necessary condition for the state authority (...) to condemn and punish. We raise a series of challenges that need answering before integrity can perform these roles. Our aim is not to show that integrity is useless in normative theorising about the admissibility of evidence, and about the criminal process in general. Rather, it is to give guidance for the elaboration of a theory of integrity that is cogent, coherent, and has useful implications for the process of proof. (shrink)

This paper aims to show that the Middle Platonists’ appeal to the Timaeus was grounded in a complex and effective philosophical reasoning: the Middle Platonists conceived of Plato’s text as a web of passages which Plato himself had carefully established. Only a few of them were granted a qualified priority, namely, those offering a complete and comprehensive philosophical account of the key elements which the Platonists regarded as fundamental. This will allow us to show that the Middle Platonists’ preference for (...) the Timaeus does not depend on the fact that it is systematic. Rather it is systematic insofar as it proves capable of giving context to passages from other dialogues and provides them with an account that is philosophically sound. (shrink)

“[I]t is the belief men betray, and not that which they parade which has to be studied.” This short Peircean sentence has been the subject of important yet underrated attention in the reception of Peirce’s philosophy, passing through the art historians Edgar Wind and Erwin Panofsky and arriving finally at Bourdieu. This paper explores the affinities between Peirce’s and Panofksy’s thinking, as well as their historical connections and their common sources, taking its cue from an analysis of the similar arguments (...) the two authors offer to justify the analogy between Gothic architecture and Scholasticism. The fulcrum for the comparison between Peirce and Panofsky is located in the writings of Edgar Wind: a leading figure, this article proposes, in the history of European pragmatism. (shrink)

The focus of this paper is the prima facie plausible view, expressed by the principle of Counter-Closure, that knowledge-yielding competent deductive inference must issue from known premises. I construct a case that arguably falsifies this principle and consider five available lines of response that might help retain Counter-Closure. I argue that three are problematic. Of the two remaining lines of response, the first relies on non-universal intuitions and forces one to view the case I construct as exhibiting a justified, true (...) belief to which none of the usual diagnoses of knowledge failure in Gettier cases apply. The second line involves claiming that Fake Barns and its ilk are misdiagnosed by epistemological orthodoxy as Gettier cases. We are thus confronted by a trilemma: either the case I discuss undermines the first-blush plausible principle of Counter-Closure; or the case I discuss instantiates a novel kind of Gettier case; or a popular conception of a key range of alleged Gettier cases must be rejected. No matter which horn we choose, the case points to a philosophically curious conclusion. (shrink)

Experimentation represents today a ‘hot’ topic in computing. If experiments made with the support of computers, such as computer simulations, have received increasing attention from philosophers of science and technology, questions such as “what does it mean to do experiments in computer science and engineering and what are their benefits?” emerged only recently as central in the debate over the disciplinary status of the discipline. In this work we aim at showing, also by means of paradigmatic examples, how the traditional (...) notion of controlled experiment should be revised to take into account a part of the experimental practice in computing along the lines of experimentation as exploration. Taking inspiration from the discussion on exploratory experimentation in the philosophy of science—experimentation that is not theory-driven—we advance the idea of explorative experiments that, although not new, can contribute to enlarge the debate about the nature and role of experimental methods in computing. In order to further refine this concept we recast explorative experiments as socio-technical experiments, that test new technologies in their socio-technical contexts. We suggest that, when experiments are explorative, control should be intended in a posteriori form, in opposition to the a priori form that usually takes place in traditional experimental contexts. The question about the scientific nature of computing has been widely debated with no universal consensus reached about its disciplinary status. Positions vary from acknowledging computing as the science of computers to defining it as a synthetic engineering discipline. In this paper, we aim at discussing the nature of computing from a methodological perspective. We consider, in particular, the nature and role of experiments in this field, whether they can be considered close to the traditional experimental scientific method or, instead, (...) they possess peculiar and unique features. We argue that this experimental perspective should be taken into account when discussing the status of computing. We critically survey how the experimental method has been conceived and applied in computing, and some open issues that could be tackled with the aid of the history of science, the philosophy of science, and the philosophy of technology. Relational quantum mechanics is an interpretation of quantum theory which discards the notions of absolute state of a system, absolute value of its physical quantities, or absolute event. The theory describes only the way systems affect each other in the course of physical interactions. State and physical quantities refer always to the interaction, or the relation, between two systems. Nevertheless, the theory is assumed to be complete. In previous works, an ontology of properties for quantum mechanics has been proposed, according to which quantum systems are bundles of properties with no principle of individuality. The aim of the present article is to show that, since quasi-set theory is particularly suited for dealing with aggregates of items that do not belong to the traditional category of individual, it supplies an adequate meta-language to speak of the proposed ontology of properties and its structure.
