The author argues that in Sein und Zeit Heidegger speaks about knowledge only in negative terms and thus he is missing the possibility of a synthesis between our being-in-the-world and our knowledge of objects. Consequently, the discussion of all instruments, ready-to-hand for knowing something, does not take place. All measuring instruments represent exactly the link between the pragmatic and the theoretical level of human existence. The essay comes to the conclusion, that the lack of any positive description concerning the ontological (...) possibility of the synthesis between existential and categorical analyssis is the reason for the gap between Heidegger’s philosophy and the world of quantifying sciences. Abstract:Robert Sugden has suggested a normative standard of freedom as ‘opportunity’ that is supposed to help realign normative economics – with its traditional rational choice orientation – with behavioural economics. While allowing preferences to be incoherent, he wants to maintain the anti-paternalist stance of orthodox welfare economics. His standard, though, presupposes that people respond to uncertainty about their own future preferences by dismissing any kind of self-constraint. We argue that the approach lacks psychological substance: Sugden's normative benchmark – the ‘responsible (...) person’ – can hardly serve as a convincing role model in a contractarian setting. An alternative concept is introduced, and some implications are briefly discussed. (shrink)

Mental-threshold egalitarianism, well-known examples of which include Jeff McMahan’s two-tiered account of the wrongness of killing and Tom Regan’s theory of animal rights, divides morally considerable beings into equals and unequals on the basis of their individual mental capacities. In this paper, I argue that the line that separates equals from unequals is unavoidably arbitrary and implausibly associates an insignificant difference in empirical reality with a momentous difference in moral status. In response to these objections, McMahan has proposed the introduction (...) of an intermediate moral status. I argue that this move ultimately fails to address the problem. I conclude that, if we are not prepared to give up moral equality, our full and equal moral status must be grounded in a binary property that is not a threshold property. I tentatively suggest that the capacity for phenomenal consciousness is such a property, and a plausible candidate. (shrink)

Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Interactive social cognition theory and approaches of developmental psychology widely agree that central aspects of emotional and social experience arise in the unfolding of processes of embodied social interaction. Bi-directional dynamical couplings of bodily displays such as facial expressions, gestures, and vocalizations have repeatedly been described in terms of coordination, synchrony, mimesis, or attunement. In this paper, I propose conceptualizing such dynamics rather as processes of affective resonance. Starting from the immediate phenomenal experience of being immersed in interaction, I develop (...) the philosophical notion of affective resonance to refer to a dynamic entanglement of moving and being-moved in relation. The concept of affective resonance makes visible that the interaction dynamic itself creates an affective experience rather than transmitting internal feeling states between pre-existent individuals. This leads to a philosophical framework in which relationality and ontogeny are primary over separate individuals, and in which the naturalistic distinction of a fundamental physical level versus an emerging level of social processes has to be given up. Data analytics and data-driven approaches in Machine Learning are now among the most hailed computing technologies in many industrial domains. One major application is predictive analytics, which is used to predict sensitive attributes, future behavior, or cost, risk and utility functions associated with target groups or individuals based on large sets of behavioral and usage data. This paper stresses the severe ethical and data protection implications of predictive analytics if it is used to predict sensitive information about single individuals or (...) treat individuals differently based on the data many unrelated individuals provided. To tackle these concerns in an applied ethics, first, the paper introduces the concept of “predictive privacy” to formulate an ethical principle protecting individuals and groups against differential treatment based on Machine Learning and Big Data analytics. Secondly, it analyses the typical data processing cycle of predictive systems to provide a step-by-step discussion of ethical implications, locating occurrences of predictive privacy violations. Thirdly, the paper sheds light on what is qualitatively new in the way predictive analytics challenges ethical principles such as human dignity and the (liberal) notion of individual privacy. These new challenges arise when predictive systems transform statistical inferences, which provide knowledge about the cohort of training data donors, into individual predictions, thereby crossing what I call the “prediction gap”. Finally, the paper summarizes that data protection in the age of predictive analytics is a collective matter as we face situations where an individual’s (or group’s) privacy is violated using dataotherindividuals provide about themselves, possibly even anonymously. The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an (...) expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration. In general, there are two main approaches to settling the alleged conflict between religion and science. On the first approach, one argues that there is not even the possibility of such a conflict, since the uses of religious utterances are sufficiently different from those of scientific ones to constitute them a distinct logical type. Thus, if religion appears to conflict with science, either this is merely an appearance, or else one of them, at least, is also performing the function of (...) the other, in which case their conflict is really either a scientific conflict or a religious conflict. In no case, however, can the truth of a scientific utterance be any reason for inferring the falsity of a religious one, and much less can it be any reason for entertaining doubts about the religious utterance's logical propriety. This paper sets out the notion of a current “biopolitical turn of digital capitalism” resulting from the increasing deployment of AI and data analytics technologies in the public sector. With applications of AI-based automated decisions currently shifting from the domain of business to customer (B2C) relations to government to citizen (G2C) relations, a new form of governance arises that operates through “algorithmic social selection”. Moreover, the paper describes how the ethics of AI is at an impasse concerning these larger societal (...) and socioeconomic trends and calls for an ethics of AI that includes, and acts in close alliance with, social and political philosophy. We introduce the syntactical notion of a decoration and the semantical notion of a critical sequence. We conjecture that any unsolvable term β-reduces to a term admitting a decoration. The main result of this paper concerns the interconnection between those two notions: given a graph model or stable model (...) D, we show that any unsolvable term admitting a decoration and having a non-empty interpretation in D generates a critical sequence in the model. In the last section, we examine three classical graph models, namely the model B(ω) of Plotkin and Scott, Engeler's model D A and Park's model D P . _Contexts of Justice,_ highly acclaimed when it was published in Germany, provides a significant new intervention into the important debate between communitarianism and liberalism. Rainer Forst argues for a theory of "contexts of justice" that leads beyond the narrow confines of this debate as it has been understood until now and posits the possibility of a new conception of social and political justice. This book brings refreshing clarity to a complex topic as it provides a synthesis of traditions and (...) theories that leads to a truly original approach. Forst makes a four-part distinction to decipher the debate between communitarianism and liberalism. These four parts concern the constitution of the self, the neutrality of law, the ethos of democracy, and the opposition between universalism and contextualism. Based on the belief that computational modeling (thinking in terms of representation and computations) can help to clarify controversial issues in emotion theory, this article examines emotional experience from the perspective of the Computational Belief–Desire Theory of Emotion (CBDTE), a computational explication of the belief–desire theory of emotion. It is argued that CBDTE provides plausible answers to central explanatory challenges posed by emotional experience, including: the phenomenal quality,intensity and object-directedness of emotional experience, the function of emotional experience and its relation (...) to cognition and motivation, and the relation between emotional experience and emotion. In addition, CBDTE avoids most objections that have been raised against cognitive theories of emotion. A remaining objection, that beliefs are not necessary for the emotions covered by CBDTE, is rejected as empirically unsupported. (shrink)

Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. The same as with many other concepts, once one considers the concept of power more closely, fundamental questions arise, such as whether a power relation is necessarily a relation of subordination and domination, a view that makes it difficult to identify legitimate forms of the exercise of power. To contribute to conceptual as well as normative clarification, I suggest a novel way to conceive of power. I argue that we only understand what power is and how it is exercised once (...) we understand its essentially noumenal nature. I claim that the real and general phenomenon of power is to be found in the noumenal realm, that is, in the space of reasons, understood as the realm of justifications. On that basis, I defend a normatively neutral notion of power that enables us to distinguish more particular forms of power, such as rule, coercion, or domination.
