Privacy by Design, a globally accepted framework for personal data management and privacy protection, advances the view that privacy cannot be assured solely by compliance with regulatory frameworks but must become an organisation’s default mode of operation. We are proposing a similar template for the research ethics review process. The Research Ethics by Design framework involves research ethics committees engaging researchers during the design phase of the proposal so that ethical considerations may be directly embedded in the science as opposed (...) to being viewed as addendums after the fact. This collaborative research design proposal results in the establishment of a culture of ethical research rather than research with ethical oversight. Both researchers and research ethics committees come to view the review process as one in which individual protection and collective benefit co-exist in a doubly-enabling positive-sum manner. Numbers 25 presents a human crisis requiring swift leadership interventions to curb the plague. Leadership failure plays out on a number of levels before decisive and resolute interventions are taken. This passage shows a human-created crisis that somewhat parallels the coronavirus disease 2019 outbreak and offers reflective pragmatic approaches taken to ensure immediate arresting of the pandemic and perhaps future curbing of a similar instigation.CONTRIBUTION: Africa has always been known to respond rather belatedly to crises that cost human lives and (...) also for waiting for solutions to come from elsewhere. How do we change that paradigm going forward and what does it mean for the analysis of biblical texts? The Cas9 endonuclease is the central component of the Type II CRISPR/Cas system, a prokaryotic adaptive restriction system against invading nucleic acids, such as those originating from bacteriophages and plasmids. Recently, this RNA‐directed DNA endonuclease has been harnessed to target DNA sequences of interest. Here, we review the development of Cas9 as an important tool to not only edit the genomes of a number of different prokaryotic and eukaryotic species, but also as an efficient system for site‐specific transcriptional repression or (...) activation. Additionally, a specific Cas9 protein has been observed to target an RNA substrate, suggesting that Cas9 may have the ability to be programmed to target RNA as well. Cas proteins from other CRISPR/Cas subtypes may also be exploited in this regard. Thus, CRISPR/Cas systems represent an effective and versatile biotechnological tool, which will have significant impact on future advancements in genome engineering. (shrink)

We often say that one reason is stronger, or weightier, than another. These are metaphors. What does normative strength or weight really consist in? Scanlon (2014) offers a novel answer to this question. His answer appeals to counterfactuals of various kinds. I argue that appealing to counterfactuals leads to deep problems for his view.

Moorean arguments are a popular and powerful way to engage highly revisionary philosophical views, such as nihilism about motion, time, truth, consciousness, causation, and various kinds of skepticism (e.g., external world, other minds, inductive, global). They take, as a premise, a highly plausible first-order claim (e.g., cars move, I ate breakfast before lunch, it’s true that some fish have gills) and conclude from it the falsity of the highly revisionary philosophical thesis. Moorean arguments can be used against nihilists in ethics (...) (error theorists), too. Recently, error theorists have recognized Moorean arguments as a powerful challenge and have tried to meet it. They’ve argued that moral Moorean premises seem highly credible to us, but aren’t, by offering various debunking explanations. These explanations all appeal to higher-order evidence—evidence of error in our reasoning. I argue that drawing attention to higher-order evidence is a welcome contribution from error theorists, but that the higher-order evidence actually counts further against error theoretic arguments—including their debunking explanations—and further in favor of Moorean arguments and the commonsense views they support. Along the way I answer a few prominent objections to Moorean arguments: that they are objectionably question-begging, rely on categorizing some facts as “Moorean Facts”, and that reports of one’s credence in a proposition bears no interesting relation to that proposition’s credibility. Arguments from disagreement against moral realism begin by calling attention to widespread, fundamental moral disagreement among a certain group of people. Then, some skeptical or anti-realist-friendly conclusion is drawn. Chapter 2 proposes that arguments from disagreement share a structure that makes them vulnerable to a single, powerful objection: they self-undermine. For each formulation of the argument from disagreement, at least one of its premises casts doubt either on itself or on one of the other premises. On reflection, this shouldn’t be (...) surprising. These arguments are intended to support very strong metaphysical or epistemological conclusions about morality. They must therefore employ very strong metaphysical or epistemological premises. But, given the pervasiveness of disagreement in philosophy, especially about metaphysics and epistemology, very strong premises are virtually certain to be the subject of widespread, intractable disagreement—precisely the sort of disagreement that proponents of these arguments think undermine moral claims. Thus, these arguments undermine their own premises. If Chapter 2’s argument is sound, it provides realists with a single, unified strategy for responding to any existing or forthcoming arguments from disagreement. (shrink)

Are we being played? Is our understanding of the traditionally fixed and static concepts of philosophy based on an oversimplification? This book explores some of the theories of the self since Descartes, together with the rationalism and the empiricism that sustain these ideas, and draws some startling conclusions using Gadamer's philosophical study of play as its starting point. Gadamer's ludic theory, Sampson argues, reveals a dynamic of play that exists at the deepest level of philosophy. It is this dynamic (...) that could provide a solution in relation to the Gadamer/Habermas hermeneutics debate and the Gadamer/Derrida relativism debate, together with a theory of totality. (shrink)

One of the deepest and longest-lasting debates in ethics concerns a version of the Euthyphro question: are choiceworthy things choiceworthy because agents have certain attitudes toward them or are they choiceworthy independent of any agents’ attitudes? Reasons internalists, such as Bernard Williams, Michael Smith, Mark Schroeder, Sharon Street, Kate Manne, Julia Markovits, and David Sobel answer in the first way. They think that all of an agent’s normative reasons for action are grounded in facts about that agent’s pro-attitudes (e.g., her (...) desires, valuing states, normative judgments). According to the most popular brand of internalism, idealizing internalism, an agent’s reasons are grounded, not in her actual pro-attitudes, but rather in what her pro-attitudes would be in suitably idealized conditions. Idealizing internalists presuppose that, for any agent with an irrational set of attitudes, there is one uniquely rational set that that agent would have if she were to undergo the relevant idealizing process. I argue that this assumption is false and that it raises two puzzles for idealizing internalism: one about the existence of practical reasons and another about their normative weight. I argue that idealizing internalists have an adequate solution to the first puzzle but not the second. Indeed, when they try to solve the second puzzle, they confront a dilemma. This second puzzle and the associated dilemma thus constitutes a powerful, but so far unnoticed, difficulty for idealizing internalism. (shrink)

Even though the concept of sustainability emerged from a reality-life emergency, its discourse seems diverse, built even on different onto-gnoseological and teleological assupmtions. This is mainly due to the different perceptions of life held by individuals, as well as to the hegemonic class interests. Then, derived from this different perceptions of life and interests, has been the behavior of human beings on the Earth; sometimes in accordance to it, but many others in outright aggression to it. And if life’s way (...) shows life itself, it can be changed, even collapsed by the anthropic hegemonic actions that take place in the planet. It is therefore important to reflect on the categorical and conceptual frameworks that underlie discourse, in order to build a way of thinking that includes all formas of life, that enhances the eco-existentiality of the individual and its community for the enrichment of all. In this thought-provoking work, Tony D. Sampson presents a contagion theory fit for the age of networks. Unlike memes and microbial contagions, _Virality_ does not restrict itself to biological analogies and medical metaphors. It instead points toward a theory of contagious assemblages, events, and affects. For Sampson, contagion is not necessarily a positive or negative force of encounter; it is how society comes together and relates. Sampson argues that a biological knowledge of contagion has been universally distributed (...) by way of the rhetoric of fear used in the antivirus industry and other popular discourses surrounding network culture. This awareness is also detectable in concerns over _too much connectivity_, such as problems of global financial crisis and terrorism. Sampson’s “virality” is as established as that of the biological meme and microbe but is not understood through representational thinking expressed in metaphors and analogies. Rather, Sampson interprets contagion theory through the social relationalities first established in Gabriel Tarde’s microsociology and subsequently recognized in Gilles Deleuze’s ontological worldview. According to Sampson, the reliance on representational thinking to explain the social behavior of networking—including that engaged in by nonhumans such as computers—allows language to overcategorize and limit analysis by imposing identities, oppositions, and resemblances on contagious phenomena. It is the power of these categories that impinges on social and cultural domains. Assemblage theory, on the other hand, is all about relationality and encounter, helping us to understand the viral as a positively sociological event, building from the molecular outward, long before it becomes biological. In his recent article entitled ‘Can We Believe the Error Theory?’ Bart Streumer argues that it is impossible (for anyone, anywhere) to believe the error theory. This might sound like a problem for the error theory, but Streumer argues that it is not. He argues that the un-believability of the error theory offers a way for error theorists to respond to several objections commonly made against the view. In this paper, we respond to Streumer’s arguments. In particular, in sections 2-4, (...) we offer several objections to Streumer’s argument for the claim that we cannot believe the error theory. In section 5, we argue that even if Streumer establishes that we cannot believe the error theory, this conclusion is not as helpful for error theorists as he takes it to be. (shrink)

This article asserts the significance of the portrayal of the political art of statesmanship as weaving, and aims to show how this image emphasizes two main aspects of the political art of statesmanship. Firstly, the image implies a three-dimensionality, both through the process of weaving and through the thickness of the protective fabric this produces, that in turn indicates the vital aspect of corporeality in politics. Secondly, weaving as a paradigmatic example of the art of statesmanship presents a way of (...) incorporating different entities and joining diverse threads into a cohesive unity, without reducing them to a form of sameness as mere mathematical counting would. These two aspects are in turn connected to an emphasis on the importance in good statesmanship of recognizing the specificity of the occasion and the variety and difference of the innumerable qualities to be interlaced in weaving the fabric of a good society. A 16-year-old adolescent who identifies as transgender wishes to consider fertility preservation prior to the use of gender-affirming hormones. The adolescent’s parents are divorced, and one parent supports fertility preservation while the other does not. This case explores the minor’s future reproductive autonomy and parental decision making in a field where there is limited evidence of known harms and benefits to the use of fertility preservation in the transgender population and about future potential regret from lack of consideration of fertility (...) preservation during the prime window of opportunity. People sometimes knowingly undermine the achievement of their own goals by, e.g., playing the lottery or borrowing from loan sharks. Are these agents acting irrationally? The standard answer is “yes.” But, in a recent award-winning paper, Jennifer Morton argues “no.” On her view, the norms of practical reasoning an agent ought to follow depend on that agent’s resource context (roughly, how rich or poor they are). If Morton is correct, the orthodox view that the same norms of practical rationality apply (...) to all agents needs revision. I argue that Morton’s arguments fail on empirical and philosophical grounds. What’s at stake? If Morton is correct, poverty relief agencies ought to re-design their incentives so resource-scarce agents can rationally respond to them. If I’m correct, resource-scarce agents do act irrationally in the cases under discussion, and we shouldn’t be shy about saying so. Instead of declaring them rational, we should try to understand the causes of their irrational behavior and help them better succeed by their own lights. (shrink)

The predominant contemporary concept of time is arguably measurable time, promoted as being in accordance with science. This is commonly understood as the time of physics, as, for instance, E. A. Milne claims in an article from 1950 on the modern conception of time, contrasting this with Plato's description of time as the “moving image of eternity”. The prevalence of an emphasis on measurability within such a conception of time is hard to avoid, although this can be nuanced somewhat. In (...) this article I turn to the ancient Greek notion of kairos in order to find another approach to the question of conceptions of temporality. A main objective is to indicate what this concept signifies in terms of adjusting to circumstances, catching the right moment and paying attention to due measure. I also briefly consider Baltasar Gracián's notions of festina lente and détencion in an attempt to show how this suggests a way in which we may be able to develop the ability to do the right thing at the right moment. Chomsky has constructed an empirical theory about syntactic universals of natural language by defining a class of 'possible languages' which includes all natural languages (inter alia) as members, and claiming that all natural languages fall .within a specified proper subset of that class. I extend Chomsky's work to produce an empirical theory about natural4anguage semantic universals by showing that the semantic description of a language will incorporate a logical calculus, by defining a relatively wide class of 'possible calculi', and by (...) specifying a proper subset of that class which, I hypothesize, includes the calculi needed for the semantic description of any natural language. I argue that the special status, with respect to natural languages, of this particular type of logical calculus is an empirical finding which does not follow from any independently-known principles, and I conclude that the question why the laws of human thought have the structure they do is a biological rather than a logical question. The central purpose of this article is to argue for the extreme pertinence of psychoanalysis for all contemporary thought on the state, violence, and war. I restrict myself exclusively to a close reading of Freud's writings , finding them a formidable instrument of political analysis rivaled only by the radical political thought of Michel Foucault and Giorgio Agamben, to whose work they bear a surprising affinity. Jacques Derrida has also highlighted the crucial importance of Freud's correspondence with Einstein for contemporary (...) reflections on war, violence, cruelty, and sovereignty. I attempt to show that Freud is thus a remarkably contemporary political thinker and a highly radical one as well. (shrink)

As “real socialism,” it continues to oppress the peoples of the East. Years ago, we could console ourselves by “explaining” Stalinism as a “deviation” or “degeneration” from a once purer socialism. Yet this historical accident seems to possess an extraordinary viability. Stalinism has confronted threats to its (...) hegemony by sending in tanks in Budapest, Prague and Kabul. It has withstood the revelations of the Gulag, the debacle in Kampuchea, the military coup in Poland, and twenty-six years of Fidel. (shrink)

This article focuses on Grotius’s treatment of obligations arising from wrongdoing in his Inleidinge. The work has clear parallels with the natural law formulation of the same topic in De Jure Belli ac Pacis, and this article explores the extent of the similarities. It focuses on points of divergence, suggesting that the theoretical coherence of the natural law approach to obligations arising from wrongdoing was challenged primarily by extant legislative enactments. These provided either for region-specific doctrines, or rules that proved (...) difficult to reconcile with the underlying principles of natural law, especially the primacy of fault. While much of the Inleidinge’s treatment of liability arising from wrongdoing is consonant with Grotius’ approach to the topic in De Jure Belli ac Pacis, these discrete points of dissimilarity serve as a reminder of the limits of theoretical accounts of private law. This Experian Corporate Social Responsibility (CSR) report case study was informed by the 3Ps of sustainability along with legal, ethical, economic, and philanthropic CSR practices. Text network analysis yielded keywords, an overall theme, and 15 sub-themes. In its CSR report, Experian described and emphasised how its services can help consumers develop and protect their financial identity, which lead to greater choices, opportunities, and a sustainable quality life. At the same time, some of Experian's business practices suggest a misalignment with stated (...) strategic goals and practices. This research is unique in that it examines CSR reporting of an organisation in which its key stakeholders are both customers and the product at the same time, making them vital to the company's existence. Results suggest how legitimacy theory and lack of disclosing negative events are deployed to maintain credibility between the organisation and these essential stakeholders. (shrink)

Objectives—To assess the process involved in obtaining ethical approval for a single-centre study involving geographically dispersed subjects with an uncommon genetic disorder. Design—Observational data of the application process to 53 local research ethics committees (LRECs) throughout Wales, England and Scotland. The Multicentre Research Ethics Committee (MREC) for Wales had already granted approval. Results—Application to the 53 LRECs required 24,552 sheets of paper and took two months of the researcher's time. The median time taken for approval was 39 days with only (...) seven (13%) of committees responding within the recommended 21 days. In at least nineteen cases (36%) a subcommittee considered the application. Thirty-three committees (62%) accepted the proposal without amendments but, of the remainder, four (8%) requested changes outside of the remit of LRECs. Discussion—Difficulties still exist with the system for obtaining ethical approval for studies involving a single centre but with patients at multiple sites, as is often required for genetic observational research. As such studies differ from true multicentre studies, it may be advantageous to develop a separate and specific process of application to ensure that resources are not unnecessarily expended in the quest for ethical approval. We are printing in its entirety the discussion document which sets out a code of professional conduct for nurses published by the Royal College of Nursing in November 1976 together with commentaries by the Assistant Secretary of the British Medical Association, a professor of nursing studies, student nurses and a lawyer. The image of the nurse is still that of one of Florence Nightingale's young ladies or of a member of a religious order who is wholly dedicated to caring for (...) the sick. Today, as this document and the comments upon it show, 'dedication' is still part of the motive which leads a man or woman to become a nurse but in addition, and this is where the public may be ignorant or choose to be ignorant, nursing offers a career where intellectual achievement and the satisfaction of a demanding job bring their proper financial reward and place in the professional community. "A Dissertation: On the Evidence from the Light of Nature of a Future Retribution" is a religious treatise that laid the groundwork for his aesthetic theory; the "Oration on Genius" is a vibrant speech which is probably America's earliest Romantic manifesto; "Observations on the Growth of the Mind" reflects the aesthetic theory embraced by Ralph Waldo Emerson and the New England transcendentalists; and Reed's preface (...) to the 1838 edition of "Observations," which showed his growing disenchantment with the transcendentalist movement he helped to inspire. In this paper I respond to Mathias Risse's objections to my critique of his views on racial profiling in Philosophy and Public Affairs. I draw on the work of Richard Sampson and others on racial disadvantage in the USA to show that racial profiling likely aggravates racial injustices that are already there. However, I maintain, clarify and defend my original claim against Risse that racial profiling itself is likely to cause racial injustice, even if we abstract from unfair background (...) conditions. I then respond to Levin's claims that there is no serious racial injustice in the contemporary USA and differentiate between Risse's attempt - albeit unsuccessful - to provide an egalitarian justification for racial profiling from the frankly inegalitarian assumptions that underpin the claims of Michael Levin. Responding to Open Philosophy’s call ‘Does public art have to be bad art?’, in this paper we argue that this discussion should pay attention to the consequences of structural transformations that guide the production and presentation of public art in today’s increasingly private city. While entrepreneurial governance and corporate branding strategies generate new opportunities, they might also result in increased risk averseness and control over the content of public art, thus putting its critical potential at risk. That observation ushers in (...) urgent questions about control, complicity and criticality. We aim to reflect on those questions through two public art projects in Hong Kong: Antony Gormley’s Event Horizon (2015) and Our 60-second friendship begins now (2016) by Sampson Wong Yu-hin and Jason Lam Chi-fai. After drawing conclusions on the justification of public funding for co-productions, the legitimacy for artists to sometimes not ‘follow the rules’, and the problematic nature of a narrow definition of professionalism as a means to discredit artists, our analysis underlines the urgent need to develop a framework that can guide discussions on the consequences of control and complicity for the critical potential of public art. In several recent publications (Sampson [1978], [1980a]) Geoffrey Sampson has argued that an essentially Popperian language acquisition device could learn language much as a human child does. The device Sampson envisions would freely (or perhaps randomly) generate hypotheses about the grammar the child seeks to learn, and test these hypotheses against the data available to the child. If the data are incompatible with an hypothesis, the hypothesis is rejected and another one tried. If any hypothesis does not (...) conflict with the data, it is retained for further testing. Sampson's language acquisition device exhibits a Popperian proclivity for strong, simple hypotheses, but when it sets out on its acquisition task it has no a priori information about the nature of the grammar it seeks to acquire. If Sampson is right, then there is no need to postulate rationalist learning mechanisms of the sort advocated by Noam Chomsky (in Chomsky [1975] and many other publications) to account for the child's ability to learn language. However, it is my view that Sampson's argument is fatally flawed. He has not shown that a Popperian learning mechanism could duplicate the child's feat. Indeed, I think it can be shown that Sampson's Popperian learner could not possibly match the language learning achievement of the normal child, save by miraculous accident. (shrink)

Notice that this paper has not claimed that all natural languages are CFL's. What it has shown is that every published argument purporting to demonstrate the non-context-freeness of some natural language is invalid, either formally or empirically or both.18 Whether non-context-free characteristics can be found in the stringset of some natural language remains an open question, just as it was a quarter century ago.Whether the question is ultimately answered in the negative or the affirmative, there will be interesting further questions (...) to ask. If it turns out that natural languages are indeed always CFL's, it will be reasonable to ask whether this helps to explain why speakers apparently recognize so quickly whether a presented utterance corresponds to a grammatical sentence or not, and to associate structural and semantic details with it. It might also be reasonable to speculate about the explanation for the universally context-free character of the languages used by humans, and to wonder whether evolutionary biological factors are implicated in some way (Sampson (1979) could be read in this light). And naturally, it will be reasonable to pursue the program put forward by Gazdar (1981, in press) to see to what extent CFL-inducing grammatical devices can be exploited to yield insightful descriptions of natural languages that capture generalizations in revealing ways.If a human language that is not a CFL is proved to exist, on the other hand, a different question will be raised: give the non-context-free character of human languages in general, why has this property been so hard to demonstrate that it has taken over twenty-five years to bring it to light since the issue was first explicitly posed? If human languages do not have to be CFL's, why do so many (most?) of them come so close to having the property of context-freeness? And, since the CFL's certainly constitute a very broad class of mathematically natural and computationally tractable languages, what property of human beings or their communicative or cognitive needs is it that has caused some linguistic communities to reach beyond the boundaries of this class in the course of evolving a linguistic system?Either way, we shall be interested to see our initial question resolved, and further questions raised. One cautionary word should be said, however, about the implications (or lack of them) that the answer will have for grammatical studies. Chomsky has repeatedly stated that he does not see weak generative capacity as a theme of central importance in the theory of grammar, and we agree. It is very far from being the case that the recent resurgence of interest in exploring the potential of CF-PSG or equivalent systems will, or should, be halted dead in its tracks by the discovery (if it is ever forthcoming) that some natural language is not a CFL. In the area of parsing, for instance, it seems possible that natural languages are not only parsed on the basis of constituent structure such as a CF-PSG would assign, but are parsed as if they were finite state languages (see Langendoen (1975) and Church (1980) for discussion along these lines). That is, precisely those construction-types that figure in the various proofs that English is not an FSL appear to cause massive difficulty in the human processing system; the sentences crucial to the proofs are for the most part unprocessable unless they are extremely short (yet the arguments for English not being and FSL only go through if length is not an issue). This means that in practice properties of finite state grammars are still of great potential importance to linguistic theory despite the fact that they do not provide the framework for defining the total class of grammatical sentences. The same would almost certannly be true of CF-PSG's if they were shown to be inadequate in a similar sense. It is highly unlikely that the advances made so far in far in phrase structure description could be nullified by a discovery about weak generative capacity. Moreover, there are known to be numerous ways in which the power of CF-PSG's can be marginally enhanced to permit, for example, xx languages to be generated without allowing anything like the full class of recursively enumerable or even context-sensitive languages (see Hopcroft and Ullmann (1979), Chapter 14) for an introduction to this topic, noting especially Figure 14.7 on p. 393. The obvious thing to do if natural languages were ever shown not to be CFL's in the general case would be to start exploring such minimal enhancements of expressive power to determine exactly what natural languages call for in this regard and how it could be effectively but parsimoniously provided in a way that closely modelled human linguistic capacities.In the meantime, it seems reasonable to assume that the natural languages are a proper subset of the infinite-cardinality CFL's until such time as they are validly shown not to be. So read a tweet sent from a hacked Associated Press Twitter account @AP, which affected financial markets, wiping out $136.5 billion of the Standard & Poor’s 500 Index’s value. While the speed of the Associated Press hack crash event and the proprietary nature of the algorithms involved make it difficult to make causal claims about the relationship between social media and trading algorithms, we argue that it helps (...) us to critically examine the volatile connections between social media, financial markets, and third parties offering human and algorithmic analysis. By analyzing the commentaries of this event, we highlight two particular currents: one formed by computational processes that mine and analyze Twitter data, and the other being financial algorithms that make automated trades and steer the stock market. We build on sociology of finance together with media theory and focus on the work of Christian Marazzi, Gabriel Tarde and Tony Sampson to analyze the relationship between social media and financial markets. We argue that Twitter and social media are becoming more powerful forces, not just because they connect people or generate new modes of participation, but because they are connecting human communicative spaces to automated computational spaces in ways that are affectively contagious and highly volatile. “I would prefer not”HERMAN MELVILLE, BARTLEBY THE SCRIVENER: A STORY OF WALL STREET (1853), reprinted in THE PIAZZA TALES 32, 48 (London, Sampson Low, Son & Co. 1856). Scholars have recently challenged the claim in classical deterrence theory that law influences behavior only through the expected sanction imposed. Some go further and argue that law may also “shape preferences,” changing people’s wants and values. In this Article, we analyze existing claims that criminal and civil law alter preferences and conclude (...) that none suggest that the law shapes preferences. We first clarify this preference-shaping claim by elaborating the structure of rational choice theory generally and “preference” in particular. We then investigate three mechanisms of legal influence suggested by the preference-shaping literature: (1) the “serious harm” mechanism; (2) the “social norm” mechanism; and (3) the “self-improvement” mechanism. We then show that each of these mechanisms operates by changing the agent’s beliefs about the attributes or consequences of her choice options rather than by changing her preferences. (shrink)
