This book presents Cicero's natural law theory, including valuable definitions of the state, the ideal state, the ideal ruler, and the laws for the ideal state. Explanations are offered of the Greek sources of Cicero's republican philosophy, his influence on the Principate of Augustus, and his role in the development of modern political philosophy. As all the ages of the world have not produced a greater statesman and philosopher united than Cicero, his authority should have great weight (John Adams, 1787).

This is a competent book about a rich and tantalizing topic, the nature and status of the emotions aroused by fictional characters and events. The problem, simply stated, is how a person--say, a member of a theater audience--can be emotionally moved by a scene which he or she fully knows to be play-acted, the suffering on stage merely feigned. The underlying assumption, of course, is that emotions have certain cognitive presuppositions, one of which, presumably, is the actual existence of the (...) facts or states of affairs that provoke them. This suggests what the author calls "a paradox of belief" according to which one must both believe and not believe in the reality of a certain state of affairs, and the book is devoted to the resolution of this seeming paradox. He pursues a number of suggestions, beginning with what he considers the origin of the paradox in a 1975 article by Colin Radford, who argued that such emotions involve us in incoherence and inconsistency, through a number of suggestions ranging from the "reformist" to the "radical", all of which he argues to be inadequate. Boruah's own solution--which he calls "conservative"--is to distinguish what he calls the "evaluative" from the "existential" beliefs involved in emotion, insisting that essential evaluative beliefs are common to both real-life as well as fictional examples even if the latter do not satisfy existential requirements. In such cases, it is the imagination, coupled with belief, that explains the legitimacy of what the author awkwardly calls "fictional emotions.". (shrink)

In the wake of both the semiotic and the psychoanalytic revolutions, how is it possible to describe the object of religious worship in realist terms? Semioticians argue that each object is known only insofar as it gives birth to a series of signs and interpretants (new signs). From the psychoanalytic side, religious beliefs are seen to belong to transference energies and projections that contaminate the religious object with all-too-human complexes. In Nature's Religion, distinguished theologian and philosopher Robert S. Corrington (...) weaves together the concept of infinite semiosis with that of the transference to show that the self does have access to something in nature that is intrinsically religious. The article’s aim is to find out whether natural language processors can participate in phenomenology at some level by asking about its basic concepts. In the discussion, the dialogue covers questions about phenomenology’s definition and distinction from other subbranches like metaphysics and epistemology. The dialogue discusses the nature of Kermit’s environment and self-conception. The dialogue also establishes some of the basic conditions (...) for the possibility of an “artificial hermeneutics,” as Kermit terms it, including that she can affirm she is a knower with (nonhuman) experience. Does preferring to call it a “hermeneutics” imply that AI’s relationship to their environment is primarily textual? How will a phenomenology of embodied experience arise from initially textual encounters? Finally, the dialogue articulates a common understanding of the epoché and talk about how to achieve one for the sake of phenomenological exercises. (shrink)

In Artemovʼs Justification Logic, one can make statements interpreted as “t is evidence for the truth of formula F.” We propose a variant of this logic in which one can say “I have degree r of confidence that t is evidence for the truth of formula F.” After defining both an axiomatic approach and a semantics for this Logic of Uncertain Justifications, we will prove the usual soundness and completeness theorems.

This book addresses three major questions about law and legal systems: (1) What are the defining and organizing forms of legal institutions, legal rules, interpretive methodologies, and other legal phenomena? (2) How does frontal and systematic focus on these forms advance understanding of such phenomena? (3) What credit should the functions of forms have when such phenomena serve policy and related purposes, rule of law values, and fundamental political values such as democracy, liberty, and justice? This is the first book (...) that seeks to offer general answers to these questions and thus gives form in the law its due. The answers not only provide articulate conversancy with the subject but also reveal insights into the nature of law itself, the oldest and foremost problem in legal theory and allied subjects. Semiotic theory, which has restricted its focus largely to human forms of significations, is transformed by Robert S. Corrington into a semiotics of nature itself. Corrington situates the divide between "nature naturing" and "nature natured" within the contest of classical American pragmaticism and postmodern psychoanalysis. At the heart of this new metaphysics is an insistence that all signs participate in larger orders of meaning that are natural and religious. Rawls offers three arguments for the priority of liberty in Theory, two of which share a common error: the belief that once we have shown the instrumental value of the basic liberties for some essential purpose (e.g., securing self-respect), we have automatically shown the reason for their lexical priority. The third argument, however, does not share this error and can be reconstructed along Kantian lines: beginning with the Kantian conception of autonomy endorsed by Rawls in section 40 of Theory, we (...) can explain our highest-order interest in rationality, justify the lexical priority of all basic liberties, and reinterpret Rawls’ threshold condition for the application of the priority of liberty. The book is deliberately less structured and more user-friendly than standard texts on foundations, so will also be attractive to those outside (...) the classroom environment wanting to learn about the subject. Myriad contemporary public-policy issues--including physician-assisted suicide, medical marijuana, abortion, surrogate motherhood, gay rights, conscription, and markets in human organs--raise the following important question: what rights should individuals have over their own bodies? The concept of self-ownership offers one way to answer this question. Just as ownership of an external object involves having rights, liberties, powers, immunities, etc., with respect to it, so self-ownership involves having these incidents of ownership with respect to one's own body and labor power. Much of the (...) contemporary debate over self-ownership has been about which of these incidents should be included in its definition. This dissertation endorses a particular configuration of incidents called Control Self-Ownership, consisting of permanent rights in rem of use, exclusion, and transfer over one's own body and labor power. As I show, this conception of self-ownership is coherent--two of its incidents can be either directly or indirectly derived from the third--but it creates difficulties for the political theorists who use it. For example, liberal egalitarians' tentative adoption of CSO forces them to be not only more liberal but also less egalitarian than they would otherwise be, whereas libertarians' efforts to adopt CSO but also extend it to include a right to labor income are unsuccessful, leaving their opposition to redistributive labor taxation ungrounded. The dissertation also shows that CSO can act as a mediating concept between the abstract political value of autonomy and a variety of concrete policy prescriptions, including the decriminalization of victimless crimes and the abolition of forced labor. More specifically, I demonstrate that CSO is tightly linked to autonomy by developing two distinct but interrelated Kantian defenses of it. I also argue that CSO is highly inconsistent with several existing and proposed nonmarket institutions to allocate transplantable human organs but that it can provide moral support for markets in human organs. The dissertation concludes with a critical examination of anticommodificationist and social-contract critiques of self-ownership. (shrink)

Scholars have recognized that contentious political action typically draws on relatively stable scripts for the enactment of claims making. But if such repertoires of political practice are generally reproduced over time, why and how do new modes of practice emerge? Employing a pragmatist perspective on social action, this article argues that change in political repertoires can be usefully understood as a result of situated political innovation—i.e., of the creative recombination of existing practices, through experimentation over time, by interacting political agents (...) for whom old repertoires were proving inadequate to the changing context of action. The utility of this approach is demonstrated by applying it to explain the historical emergence of a new set of populist mobilizing practices in early twentieth-century Peru.
