Millones de personas en el mundo no disponen de otra alternativa para huir de la pobreza más extrema que trabajar en condiciones de explotación en una sweatshop. A través de la non worseness-claim y el argumento de la elección, Powell y Zwolinski sostienen que, aunque dicha explotación sea moralmente problemática, proporciona beneficios a dichas personas que impediría considerarla gravemente injusta y justificar así la prohibición o regulación de las sweatshops. En este trabajo se analizan las claves de este discurso, así (...) como los principales intentos de rebatirlo basados en la idea de que dichas fábricas se aprovechan de injusticias de trasfondo de las que los empresarios son, de algún modo, responsables. El éxito de este argumento exige asignar a los empresarios responsabilidades distributivas adicionales a las generales que resulta, sin embargo, cuestionable. De ahí que, en la parte final del trabajo, ofrezca algunas razones alternativas para considerar que la explotación en las sweatshops es una injusticia grave que justifica su regulación. (shrink)

Plato's political thought gave rise to a number of concepts and issues - such as the idea of a normative theory, the philosophical foundation of politics, the philosopher-kings, the standard of utopian theory - which have played a significant role on Western political and philosophical thought. -/- This volume aspires to bring out Plato's concept of efficacy in a normative theory. -/- By efficacy, the author means the way in which the theory conceives of its practical realization. If in the (...) Republic this issue is particularly problematic, in the Laws, instead, the claim of realizability becomes the main concern. -/- By defining the concept of efficacy and going through the main works of Plato, this conceptual and textual analysis aims to shed a new light on Plato's political thought, which is neither a utopia, nor a short term political program, but the first normative theory encompassing a theory of efficacy. Intuitively, we can conceive of the existence of a conscious state as a pure activity that does not necessarily require a body (or even a brain). This idea has found new support in certain recent theories that present the possibility of a totally disconnected and disembodied consciousness. Against this hypothesis, I argue that human experience is intrinsically embodied and embedded, though in a specific way. Using Sartre’s phenomenology of the body, I first analyze the concept of consciousness as intentionality and (...) a world-disclosing activity, thus explaining how conscious activity can only be expressed through a body that is spatiotemporally related to the world. Then, I argue that bodily consciousness does not necessarily imply the actual presence of an anatomical body but, rather, a process of spatialization and temporalization (hodological space and temporal synthesis) through the “spatiotemporal body”. Finally, I test my thesis by critiquing some cases of apparent disembodied/disconnected consciousness, i.e., dreams, out-of-body experiences, and the brain-in-a-vat scenario. (shrink)

We argue that moral judgment studies currently conducted utilizing virtual reality (VR) devices must confront a dilemma due to how virtual environments are designed and how those environments are experienced. We begin by first describing the contexts present in paradigmatic cases of naturalistic moral judgments. We then compare these contexts to current traditional (vignette-based) and VR-based moral judgment research. We show that, contra to paradigmatic cases, vignette-based and VR-based moral judgment research often fails to accurately model the situational features of (...) paradigmatic moral judgments. In particular, we compare and contrast six recent VR studies to support our view that only simulations high in context-realism and perspectival-fidelity can produce ‘virtually real experiences.’ After analyzing the constituents of a virtually-real experience, we go on to propose guidelines for the creation of VR studies. These guidelines serve two purposes. First, we aim to increase the ecological validity of such studies in order to advance our understanding of moral judgments. Second, we believe that such guidelines should inform how Institutional Review Boards assess VR research. We show that our guidelines are urgently needed given the current lax review standards in place. (shrink)

In this paper, I accomplish a conceptual task and a historical task. The conceptual task is to argue that (1) Einstein’s Principle of Separability (henceforth “separability”) is not a supervenience principle and that (2) separability and entanglement are compatible. I support (1) by showing that the conclusion of Einstein’s incompleteness argument would still follow even if one assumes that the state of a composite system does not supervene on the states of the subsystems, and by showing that what Einstein says (...) in “Quantum Mechanics and Reality” (1948) strongly suggests that separability is not a principle about how subsystem states relate to the state of composite systems. I support (2) by showing that if separability was incompatible with entanglement, then Einstein’s argument would be incoherent in a trivial way. Thus, by arguing for (1) and (2) I directly challenge what has been, and still is, a very common reading of separability. The historical task is to offer the first detailed review of the different ways in which separability has been defined by physicists and philosophers in the last 60 years. Among other things, such a review distinguishes three different definitions of the principle, and shows that since the 1990s and up until the present date, it became standard to take separability (as presented by Einstein) to be a supervenience principle. It is often said in physics that if two models of a theory are related by a symmetry, then the two models provide (or could provide) two different representations of the very same situation, alike the case of two maps of different color for the very same city. It is also said that the situations represented by two models of a theory are indiscernible in some ways when the models in question are related by a symmetry of the theory, just (...) like the situation in the interior of the cabin of a train when the train is at rest in the station is empirically indiscernible from the situation in the interior when the train is moving uniformly (in classical mechanics, these two situations are represented by two models related by a boost). In recent years, philosophers of physics have focused a lot of attention in developing various principles that aim to elucidate these and similar remarks on symmetries, models, physical equivalence, and representation that are widespread in physics practice. The goal of the current article is to provide a critical review of these principles, and suggest a new framework for thinking about these kinds of questions. One important upshot of the paper is that questions of indiscernibility, and questions of the representational capacity of models, must be distinguished from one another. (shrink)

Imagine that we are on a train playing with some mechanical systems. Why can’t we detect any differences in their behavior when the train is parked versus when it is moving uniformly? The standard answer is that boosts are symmetries of Newtonian systems. In this paper, I use the case of a spring to argue that this answer is problematic because symmetries are neither sufficient nor necessary for preserving its behavior. I also develop a new answer according to which boosts (...) preserve the relational properties on which the behavior of a system depends, even when they are not symmetries. (shrink)

I argue that patients who suffer genital surgery to ‘disambiguate’ their sexual anatomy, a practice labelled ‘intersex genital mutilation’ (IGM) by intersex advocates, can be understood as victims of hermeneutical injustice in the sense elaborated by Miranda Fricker. This claim is clarified and defended from two objections. I further argue that a particular subset of cases of IGM-based hermeneutical injustice instantiate a novel form of hermeneutical injustice, which I call deception-based hermeneutical injustice. I highlight how this differs from central types (...) of hermeneutical injustice in the literature and trace its harms. (shrink)

Consensus in the contemporary philosophical literature has it that conserved quantity theories of causation such as that of Dowe [2000]—according to which causation is to be analysed in terms of the exchange of conserved quantities (e.g., energy)—face damning problems when confronted with contemporary physics, where the notion of conservation becomes delicate. In particular, in general relativity it is often claimed that there simply are no conservation laws for (say) total-stress energy. If this claim is correct, it is difficult to see (...) how conserved quantity theories of causation could survive. In this article, we resist the above consensus and defend conserved quantity theories from this conclusion, at least when focusing on the apparent problems posed by general relativity. We argue that this approach to causation can continue to be defended in general relativity, once one appreciates (a) the availability of approximate symmetries in generic general relativistic spacetimes, and (b) the role of modelling and idealisation in that theory. Given these points, conserved quantity theories of causation must stand or fall on other grounds. (shrink)

In this text, I consider two examples in the history of emancipation and manumission of enslaved, Black populations in the Caribbean and South America in order to theorize a colonial mode of conceiving of freedom at play in the first half of the nineteenth century. This mode is marked by the figure of the promise, enacting a notion of freedom as a constantly deferred, external compensation. Indeed, instead of an immediate decision deeming the practice of enslavement and trade of human (...) beings unacceptable, and an effective liberation of the enslaved Black populations in these different emancipation proclamations, the various histories of manumission in Latin America and the Caribbean show a long series of political and legal attempts to reduce and limit the extent of the slave trade that deferred the process of liberation for decades. Moreover, in many of these territories the practice did not end with the official proclamation of emancipation but was continued by illegal practices and mutations into legal forms of exploitation and oppression that are still operative today. After outlining this first trajectory, reconstructing the promise of manumission in the historical examples of Martinique (as read by Édouard Glissant) and La Gran Colombia and the Republic of Nueva Granada (contemporary Panamá, Colombia, Venezuela, and Ecuador), I analyze a second mode of investigation in examples of individual and collective strategies of liberation coming from the enslaved themselves, as reconstructed by contemporary feminist scholars in South America. These strategies appropriate liberation not as a promise, but as a negotiation and calculation that begins with the enslaved’s resistance to their oppressive conditions and that ultimately depends on the external concession by juridical authorities. In the third section of the chapter, I read these practices not as marronage, as they are sometimes approached, but as a different mode of turning back to these glimpses of freedom that more effectively challenge the narrative of emancipation and, with it, the promise of manumission in our present. -/- . Human cerebral organoids are three-dimensional biological cultures grown in the laboratory to mimic as closely as possible the cellular composition, structure, and function of the corresponding organ, the brain. For now, cerebral organoids lack blood vessels and other characteristics of the human brain, but are also capable of having coordinated electrical activity. They have been usefully employed for the study of several diseases and the development of the nervous system in unprecedented ways. Research on human cerebral organoids is proceeding at (...) a very fast pace and their complexity is bound to improve. This raises the question of whether cerebral organoids will also be able to develop the unique feature of the human brain, consciousness. If this is the case, some ethical issues would arise. In this article, we discuss the necessary neural correlates and constraints for the emergence of consciousness according to some of the most debated neuroscientific theories. Based on this, we consider what the moral status of a potentially conscious brain organoid might be, in light of ethical and ontological arguments. We conclude by proposing a precautionary principle and some leads for further investigation. In particular, we consider the outcomes of some very recent experiments as entities of a potential new kind. (shrink)

The recent debate about whether gauge symmetries can be empirically significant has focused on the possibility of 'Galileo's ship' types of scenarios, where the symmetries effect relational differences between a subsystem and the environment. However, it has gone largely unremarked that apart from such Galileo's ship scenarios, Greaves and Wallace (2014) proposed that gauge transformations can also be empirically significant in a 'non-relational' manner that is analogous to a Faraday-cage scenario, where the subsystem symmetry is related to a change in (...) a charged boundary state. In this paper, we investigate the question of whether such non-relational scenarios are possible for gauge theories. Remarkably, the answer to this question turns out to be closely related to a foundational puzzle that has driven a host of recent developments at the frontiers of theoretical physics. By drawing on these recent developments, we show that a very natural way of elaborating on Greaves and Wallace's claim of non-relational empirical significance for gauge symmetry is incoherent. However, we also argue that much of what they suggest is correct in spirit: one can indeed construct non-relational models of the kind they sketch, albeit ones where the empirical significance is not witnessed by a gauge symmetry but instead by a superficially similar boundary symmetry. Furthermore, the latter casts doubt on whether one really abandons Galileo's ship in such scenarios. (shrink)

For many, it was anxiety and uncertainty that “knock[ed] at the door”; for others, however, those same feelings of unease prompted one of hopefulness: reflecting on the possibilities for resilience and regeneration in the process of changing our vision of the world.1 The Knock at the Door conference brought contemporary utopianism to the forefront of thinking about how to respond to global crises while remaining attentive to other adversities of daily life. Scholars and artists answered the knock in an attempt to examine paths toward utopia, and to take advantage of the regenerative and resilient potential of the present.The conference was the culmination of author/activist Larissa Lai’s fellowship period at the University of Huelva. The 2022–23 María Zambrano Fellowship for the academic year2 allowed Lai to complete the project “Utopian Dreams for Post-Covid Times,” carried out in collaboration with the Huelva research group led by Professor Pilar Cuder-Domínguez, who hosted a number of online and in-person seminars on speculative fiction with Lai. The Knock at the Door conference, marking the end of Lai’s fellowship, created yet another space for scholars, artists, and critics to discuss the potential of utopian narratives. Lai asks: “What does our cultural moment require, and how can we get where we need to go from where we are? How can literature, especially speculative fiction literature, help us get from here to there?”3 [End Page 641] The intention of the conference was to encourage others to continue Lai’s work on how to imagine futures where human and posthuman beings need to remain vigilant to adversities. Utopian scholars, among others, might find the complications of “getting there from here” closely related to Lai’s conception of “insurgent utopias,” or “emergent insurgency.” They could find Lai’s concept of “insurgent utopianism” interesting as it lays the foundations of futurity in terms of crisis responses.The aim of the conference was to explore the imagination of better futures through utopian thinking and practice. In addition, it focused on “the knock at the door,” which is “a moment of contingent arrival... open to cooptation, destruction, bastardization, incorporation, death, or defusal.” Yet, it presents “the powerful possibility of critique—narratively or discursively, in its very materiality.”4 One way of doing this might be to look back at the past century of utopianism and ask who or what has been missing. The conference took up Lai’s idea of insurgent utopianism as a method of paving a path toward a multitude of dreams and actions, all shaped by the unique circumstances of one’s positionality.After the COVID-19 pandemic, the need for utopian thinking has become more pressing than ever. New horizons of hope must be created in the face of emerging anxieties. Panelists Benjamin Ghan and Marc Lynch reflected on how creative writers envision ideal worlds and temporalities. In Ghan’s view, utopian narratives create a symphony of voices historically excluded from the category of “the human”: women; LGBTQ+ people; Indigenous peoples. In a similar vein, Lynch described his own novel, A Wasp’s Waist, as highlighting the impossibility of imagining utopias within the capitalist paradigm—and thus the necessity of imagining futures beyond capitalism, and beyond... In this article, the authors bring two personal journeys together: one author’s liberationist journey, sparked by a search for justice and liberation in the slums of Guatemala City, and the other’s lifelong commitment to practical theology and spatial justice in South Africa. A practical theology of liberation is the result of life experiences in countries of the Global South amidst the search for justice and liberation. The worlds that come together in this article are René Girard’s mimetic theory, liberation theology (...) and practical theology. This article raises the question of the cross-contextuality of practical theology and the theological application of mimetic theory to develop innovative theological methodologies that respond to the collective woundedness of the urban context in the Global South.Contribution: The main contribution of this article is the use of three seemingly different theological approaches in conjunction. We prove a soundness and completeness result for Aschieri and Berardiʼs learning based realizability for Heyting Arithmetic plus Excluded Middle over semi-decidable statements with respect to 1-Backtracking Coquand game semantics. First, we prove that learning based realizability is sound with respect to 1-Backtracking Coquand game semantics. In particular, any realizer of an implication-and-negation-free arithmetical formula embodies a winning recursive strategy for the 1-Backtracking version of Tarski games. We also give examples of realizers and winning strategy extraction for some classical proofs. (...) In previous works, an ontology of properties for quantum mechanics has been proposed, according to which quantum systems are bundles of properties with no principle of individuality. The aim of the present article is to show that, since quasi-set theory is particularly suited for dealing with aggregates of items that do not belong to the traditional category of individual, it supplies an adequate meta-language to speak of the proposed ontology of properties and its structure.

Personalmente, considero que este libro es una lectura imprescindible para cualquier lector de habla hispana que quiera introducirse en las temáticas más contemporáneamente discutidas en esa disciplina. En este marco, en el presente artículo me propongo realizar un análisis crítico de cuatro de los artículos de la compilación que (...) trabajan la temática de las emisiones evaluativas, i.e., emisiones cuya extensión depende de parámetros contextuales semánticamente no estándares. En esta disciplina, la bibliografía sobre discurso de odio ha centrado su análisis en los efectos que este produce en los grupos oprimidos. La idea central del presente trabajo será presentar una nueva noción, el discurso influenciado, que permita explicar lo que el grupo opresor es llevado a afirmar en base a la opresión sistemática. Así, el discurso influenciado permitirá tanto explicar la reproducción social (...) de los discursos de odio como enmarcar teóricamente las afirmaciones discriminatorias realizadas por los programas informáticos previamente mencionados. The study of pragmatic competence has gained increasing importance within second language assessment over the last three decades. However, its study in L2 language testing is still scarce. The aim of this paper is to research the extent to which pragmatic competence as defined by the Common European Framework of Reference for Languages (CEFR) has been accommodated in the task descriptions and rating scales of two of the most popular Oral Proficiency Interviews (OPIs) at a C1 level: Cambridge’s Certificate in (...) Advanced English (CAE) and Trinity’s Integrated Skills in English (ISE) III. To carry out this research, OPI tests are first defined, highlighting their differences from L2 pragmatic tests. After pragmatic competence in the CEFR is examined, focusing on the updates in the new descriptors, CAE and ISE III formats, structure and task characteristics are compared, showing that, while the formats and some characteristics are found to differ, the structures and task types are comparable. Finally, we systematically analyse CEFR pragmatic competence in the task skills and rating scale descriptors of both OPIs. The findings show that the task descriptions incorporate mostly aspects of discourse and design competence. Additionally, we find that each OPI is seen to prioritise different aspects of pragmatic competence within their rating scale, with CAE focusing mostly on discourse competence and fluency, and ISE III on functional competence. Our study shows that the tests fail to fully accommodate all aspects of pragmatic competence in the task skills and rating scales, although the aspects they do incorporate follow the CEFR descriptors on pragmatic competence. It also reveals a mismatch between the task competences being tested and the rating scale. To conclude, some research lines are proposed. (shrink)

This article addresses the question raised by the Anthropocene of rethinking the concept of autonomy which, in the conditions of the new geological epoch, is subject to a crisis of legitimation. It explores the ‘strong hypothesis’ according to which nature is a necessary condition of our qualitative experience of the world and a constitutive relation of autonomy defined as the self-realisation of individual identity. With this aim in mind, the article attempts to rethink the concept of recognition in order to (...) conceive a recognising attitude of nature in the form of love of nature as a form of adequate recognition. Rethinking recognition can serve as foundation of an ‘objective’ theory of autonomy, that is, a theory that explains how nature can be defined as a condition and constitutive relation of autonomy. The article, therefore, proposes to reformulate the concept of autonomy as the self-realisation of an ecological or environmental identity in the form of the self-realisation of an ecological ethos, that is, an attitude of respect and care for nature. This enquiry, ultimately, is a contribution to the task of rethinking the basis of our conceptions of autonomy and freedom in the Anthropocene, so that the idea of autonomy can legitimately constitute the central value of the social transformation that is needed to face the ecological crisis. Extending the growing literature on the role of grit in different life domains, this research explores the relationship between grit and involvement in entrepreneurship. The research highlights the role of personal income and satisfaction with one’s current financial situation as moderators of the relationship between grit and entrepreneurial behavior. Using a large representative sample of Spanish young adults and controlling for a number of potential confounding variables, we find that grit is modestly negatively related to the probability of involvement in (...) entrepreneurship. As predicted, however, this relationship is qualified by both income and satisfaction with current financial situation, though in opposite directions and more weakly for satisfaction with financial status. Gritty individuals with higher levels of income are more prone to become entrepreneurs than gritty individuals with lower levels of income. Gritty individuals with lower levels of satisfaction with their financial situation are more likely to set up a business or become self-employed. (shrink)

Although the idea of dignity has always been applied to human beings and although its role is far from being uncontroversial, some recent works in animal ethics have tried to apply the idea of dignity to animals. The aim of this paper is to discuss critically whether these attempts are convincing and sensible. In order to assess these proposals, I put forward two formal conditions that any conception of dignity must meet and outline three main approaches which might justify the (...) application of dignity to animals: the species-based approach, moral individualism and the relational approach. Discussing in particular works by Martha Nussbaum and Michael Meyer I argue that no approach can convincingly justify the extension of dignity to animals because all fail to meet the formal conditions and do not provide an appropriate basis for animal dignity. I conclude by arguing that the recognition of the moral importance of animals and their defense should appeal to other normative concepts which are more appropriate than dignity. (shrink)

We discuss the mathematical structures that underlie quantum probabilities. More specifically, we explore possible connections between logic, geometry and probability theory. We propose an interpretation that generalizes the method developed by R. T. Cox to the quantum logical approach to physical theories. We stress the relevance of developing a geometrical interpretation of quantum mechanics.

We propose a new interpretation of the equation E=mc² in special relativity by generalizing ideas of ontological emergence to fundamental physics. This allows us to propose that mass, as a property, can be considered to emerge from energy, using a well-known definition of weak ontological emergence. Einstein’s famous equation gains in this way a clearer philosophical interpretation, one that avoids the problems of previous attempts, and is fully consistent with the kinematic properties of special relativity, while yielding fresh insights concerning (...) the nature of mass. Es lugar frecuente en la bibliografía cartesiana hablar de la influencia de la filosofía estoica en su pensamiento, sobre todo en la moral. Si bien la tercera máxima de la moral de provisión constituye un punto de referencia obligado por lo elocuente de sus planteamientos, esta influencia se puede rastrear también en la correspondencia, de manera particular en la que Descartes sostuvo con la Princesa Élisabeth de Bohemia, entre cuyas cartas sobresalen las que el filósofo le dirigió en el año (...) 1645, que delatan la presencia de ideas estoicas, en especial de Epicteto y de Séneca. No obstante, lejos de ser una simple réplica de la filosofía helenista en el filósofo del Siglo XVII, se trata de un proceso de recepción muy complejo, que es tanto asimilación de esa tradición, como posición crítica al respecto. Resumen: La influencia de Schopenhauer en la filosofía de la ciencia del siglo XX ha sido poco estudiada. En este artículo defiendo que la teoría del conocimiento de Schopenhauer impulsó históricamente la idea de que al menos un objetivo de la investigación científica estriba en la exploración tenaz y creativa del potencial heurístico de un sistema teórico, de una matriz disciplinar o de un programa de investigación científica. Sostengo que en ella también se origina una ambigüedad en el significado de (...) los conceptos de descubrimiento objetivo e innovación epistémica.: Little research has been done on Schopenhauer’s influence on twentieth-century philosophy of science. This article defends the thesis that Schopenhauer’s epistemology historically promoted the idea that at least one of the objectives of epistemic research is the tenacious and creative exploration of heuristic potential of a theoretical system, a disciplinary matrix and a scientific research program. I further state that his theory of science leads to ambiguity about the meaning of concepts such as objective discovery and epistemic innovation. (shrink)

La tesis principal que aquí se defiende es que, para Popper, la validez del conocimiento estuvo vinculada siempre a la dimensión pragmática del contexto de descubrimiento (e incluso dependía de ella). Constituye, pues, un error afirmar que, para él, 1) dicha validez estaba ligada a un "empirismo encubierto" (opuesto a la tesis sobre la carga teórica de toda observación), según lo ha planteado Ana Rosa Pérez Ransanz, y que 2) en sus ideas, los factores pragmáticos carecían de importancia epistemológica, como (...) lo ha afirmado Ambrosio Velasco. Para justificar esta tesis, se examinan tres argumentos expuestos en The Logic of Scientific Discovery, enfatizando el que se refiere al carácter disposicional de los términos con los que, para Popper, se formulan los enunciados descriptivos. The main thesis I assert here is that for Popper validity of knowledge was always linked to (and even supported by) the pragmatic dimension of the context of discovery. I hold it's wrong to claim that for this author 1) validity of knowledge was linked to a "hidden empiricism" (opposed to the theory-laden character of observation), such as Ana Rosa Pérez Ransanz had propounded, and 2) pragmatic issues were epistemologically irrelevant in his philosophy, such as Ambrosio Velasco has argued. To justify my thesis I examine three arguments exposed in The Logic of Scientific Discovery, emphasizing especially Popper's argument about the dispositional character of the concepts in which descriptive statements are formulated. Although formal analysis provides us with interesting tools for treating Curry’s paradox, it certainly does not exhaust every possible reading of it. Thus, we suggest that this paradox should be analysed with non-formal tools coming from pragmatics. In this way, using Grice’s logic of conversation, we will see that Curry’s sentence can be reinterpreted as a peculiar conditional sentence implying its own consequent.

La ciencia se sustenta en la veracidad de los datos de investigación, y por ende, en la confianza sobre la integridad moral y profesional de los investigadores. Sin embargo, diversos factores ocasionan que la conducta inapropiada en la investigación sea un problema vigente. Revisamos los problemas éticos en el ensayo _Evaluation of XIENCE versus Coronary Artery Bypass Surgery for Effectiveness of Left Main Revascularization_ (EXCEL), que comparó el intervencionismo coronario percutáneo frente a la cirugía de revascularización en la enfermedad del (...) tronco coronario izquierdo con un SYNTAX score ≤32. Preocupaciones sobre la metodología, actividades asociadas a la veracidad de los datos, y conducta inapropiada durante la investigación son advertidas en este estudio de caso. Se concluye sobre la necesidad de revisar y reconsiderar la vigencia e importancia de los aspectos bioéticos en la investigación clínica, aspectos que no pueden soslayarse. (shrink)

According to the received view in epistemology, inferential knowledge from non-knowledge is impossible – that is, in order for a subject to know the conclusion of their inference, they must know the essential premises from which that conclusion is drawn. In this book, Federico Luzzi critically examines this view, arguing that it is less plausible than intuition suggests and that it can be abandoned without substantial cost. In a discussion that ranges across inference, testimony and memory he analyses the (...) full range of challenges to the view, connecting them to epistemological cases that support those challenges. He then proposes a defeater-based framework which allows the phenomenon of knowledge from non-knowledge across these three epistemic areas to be better understood. Últimamente, la educación se ha visto desafiada por el contexto digital que beneficia a las plataformas virtualesque contienen creaciones de youtubers o influencers, los cuales se enfocan en entretener más que en formar integralmente al estudiante. En este sentido, este artículo considera a las paradojas como recursos didácticos que pueden ayudar al desarrollo del pensamiento crítico del estudiante durante su formación. Esta investigación es documental y se basa en la consulta de fuentes escritas y de internet. Comienza aclarando los conceptos (...) de falacia y reducción al absurdo, pues las paradojas han sido vistas como falacias muy sutiles por algunos estudiosos como Bertrand Russell y, además, hay quienes utilizan las paradojas para realizar deducciones, como ocurre en la reducción al absurdo que se aplica en el argumento ontológico de San Anselmo de Canterbury. Enseguida, se analiza una lista de paradojas, pero con el objetivo de que puedan ser utilizadas en un aula de clase. Así, se trata sobre algunas paradojas como la paradoja de Aquiles y la Tortuga, la de Galileo, la del hotel de Hilbert, la de Tristam Shandy, la de Protágoras, etc. Este trabajo se cierra tratando de explicitar el aspecto afectivo y emocional que un estudiante experimenta cuando trata con esta clase de problemas. The Spinozan theory of belief fixation holds that mentally representing truth-apt propositions leads to immediately believing them. In this paper, I explore how the theory fares as a defence of doxasticism about delusions (the view that they are beliefs). Doxasticism has been criticised on the grounds that delusions typically do not abide by rational standards that we expect beliefs to conform to. If belief fixation is Spinozan, I argue, these deviations from rationality are not just compatible with, but supportive of, (...) their status as beliefs. (shrink)

Ordinary use of empty names encompasses a variety of different phenomena, including issues in semantics, mental content, fiction, pretense, and linguistic practice. In this paper I offer a novel account of empty names, the cognitive theory, and show how it offers a satisfactory account of the phenomena. The virtues of this theory are based on its strength and parsimony. It allows for a fully homogeneous semantic treatment of names coped with ontological frugality and empirical and psychological adequacy.

En el trabajo "El mérito ejecutivo de fa póliifi de seguro y sus implicaciones frente al proceso rjecutivo", se busca responder la siguiente preglli11ta problemática: ¿Cuáles son las condiciones y límites para que la póliza de seguro se constituya en fundamento para la satisfacción de un derecho cierto por vía del proceso ejecutivo? En el desarrollo del ensayo se considera que la póliza de seguro, en los términos dispuestos por el artículo 1053 del Código de Comercio, se constituye en un (...) evento especial por el que se posibilita la ejecución, aunque no se cumplan los requisitos consagrados en el artículo 488 del Código de Procedimiento Civil. En el trabajo se presenta un cuestionamiento crítico frente a la regulación existente sobre el carácter ejecutivo de la póliza de seguro. Se estudian las connotaciones especiales del artículo 1053 del Código de Comercio frente a la regla general de los títulos ejecutivos del artículo 488 del Código de Procedimiento Civil. Adicionalmente, se establecen parámetros para entender cuándo la aseguradora ha objetado de manera seria la reclam.ación, y acerca de los cómputos frente al plazo que se tiene para objetar. Se consideran las ventajas y deficiencias del proceso ejecutivo para.obtener la satisfacción del derecho del asegurado o beneficiario en los eventos del artículo 1053 del Código de Comercio. De otro lado, se analizan las implicaciones surgidas del silencio de los aseguradores que dentro del plazo legal no objetan las reclamaciones realizadas. Finalmente, se delimitan los problemas que surgen en el proceso de ejecución, desde un perfil teórico procesal, teniendo en cuenta el postulado constitucional del debido proceso. (shrink)

El recurso de amparo en España es la principal garantía jurisdiccional para la protección dederechos definidos como fundamentales por la Constitución frente a actos concretos de las autoridades públicas y secundariamente de particulares. En este estudio se reflexiona sobre el referido mecanismo de tutela reforzada y privilegiada existente en el país europeo. El amparo constitucional es una garantía que sólo es posible considerar frente a aquellos derechos que en España se comprenden como fundamentales, no incluyendo numerosos derechos constitucionales o derechos (...) humanos que no se ajustan a la referida categoría conceptual.El Tribunal Constitucional se constituye en la sede básica para la resolución del amparo considerado como un recurso extraordinario, excepcional y subsidiario de protección de derechos fundamentales. Aunque sus sentencias de amparo resuelven casos concretos, sus motivaciones o consideraciones contienen parámetros para la interpretación de los referidos derechos, vinculando los poderes públicos frente a un razonamiento que pasa a tener un valor erga omnes.En este ensayo se busca contribuir, en cuanto a derecho comparado, en el estudio de las vecindades y diferencias del amparo con la acción de tutela en el caso colombiano.
