This essay explores some concerns about the quality of informed consent in patients whose autonomy is diminished by fatal illness. It argues that patients with diminished autonomy cannot give free and voluntary consent, and that recruitment of such patients as subjects in human experimentation exploits their vulnerability in a morally objectionable way. Two options are given to overcome this objection: (i) recruit only those patients who desire to contribute to medical knowledge, rather than gain access to experimental treatment, or (ii) (...) provide prospective subjects the choice to participate in standard doubleblind study or receive the experimental treatment. Either option would guarantee that patients in desperate conditions are given a more meaningful choice and a richer freedom, and thus a higher quality of informed consent, than under standard randomized trials. Just war morality draws an important distinction between soldiers and civilians. Unlike soldiers, civilians may never be intentionally killed because they are innocent. But the prohibition on intentionally killing civilians cannot be adequately explained by the wrongness of killing the innocent. This paper examines several views on the meaning of innocence in war, exposes difficulties with each that warrant their rejection, and proposes an alternative view on the wrongness of killing civilians that is independent of the wrongness of killing the (...) innocent. It concludes by noting some concerns with the proposed alternative. (shrink)

This essay discusses four recent books on the Western, and one book on the classical Chinese, traditions of just war. It concentrates on the jus ad bellum moral criteria, giving attention to the centrality of the state in just war morality, to some challenges in reconceptualizing the jus ad bellum in the context of non-state agents, and to controversies over a “presumption against war.”.

This volume consists of fourteen chapters selected from papers presented at the conference 'Ethics, Medicine and Health Care: An Appraisal of the Thought of H. Tristram Engelhardt, Jr.' along with a response to those chapters by Engelhardt and a Foreword by Laurence B. McCullough. The chapters direct primary attention to various aspects of Engelhardt's philosophy of medicine and bioethics as presented in The Foundations of Bioethics and Bioethics and Secular Humanism: The Search for a Common Morality. Among the topics treated (...) are the economics of health care and the medical profession, the libertarian and communitarian aspects of Engelhardt's thought, the moral status of children, abortion, the moral foundations for a health care system, feminism and clinical epistemology, and the relation between secular and religious moralities. In response to the various challenges posed by the authors, Engelhardt considers the implications of the failure of the modern philosophical project, the role of reason in ethics, and the resolution of conflict among communities that do not share the same moral vision. The book will be of interest to professionals in medicine, philosophy, theology, health policy, and law, and to graduate students in those disciplines. (shrink)

The Baire algebra of a topological space X is the quotient of the algebra of all subsets of X modulo the meager sets. We show that this Boolean algebra can be endowed with a natural closure operator, resulting in a closure algebra which we denote $\mathbf {Baire}(X)$. We identify the modal logic of such algebras to be the well-known system $\mathsf {S5}$, and prove soundness and strong completeness for the cases where X is crowded and either completely metrizable and continuum-sized (...) or locally compact Hausdorff. We also show that every extension of $\mathsf {S5}$ is the modal logic of a subalgebra of $\mathbf {Baire}(X)$, and that soundness and strong completeness also holds in the language with the universal modality. G.A. Cohen has produced an influential criticism of libertarian‐ism that posits joint ownership of everything in the world other than labor, with each joint owner having a veto right over any potential use of the world. According to Cohen, in that world rationality would require that wealth be divided equally, with no differential accorded to talent, ability, or effort. A closer examination shows that Cohen's argument rests on two central errors of reasoning and does not support his egalitarian conclusions, even (...) granting his assumption of joint ownership. That assumption was rejected by Locke, Pufendorf and other writers on property for reasons that Cohen does not rebut. (shrink)

The feeling of error (FOE) is the subjective experience that something went wrong during a reasoning or calculation task. The main goal of the present study was to assess the accuracy of the FOE in the context of mental mathematical calculation. We used the number bisection task (NBT) to evoke this metacognitive feeling and assessed it by asking participants if they felt they have committed an error after solving the task. In the NBT participants have to determine whether the number (...) presented in the middle of a triplet corresponds to the arithmetic mean of the two outer numbers (e.g., 07_16_25) with a Yes/No answer. Our results show that FOE reports were strongly correlated with arithmetic errors and numerical properties of the NBT, suggesting that the FOE accurately represents the error. This finding indicates that even very fast metacognitive feelings are reliable when it comes to evaluating one’s own mental performance. Moreover, our results suggest that the occurrence of FOEs is determined by the fluency with which each triplet was solved and the post-decision evaluation processes that occurred after the NBT was solved. Additionally, we asked participants to report their confidence in the given answer for the cases where they did not report FOEs. Participants reported less confidence for the (objectively) incorrect answers than for the (objectively) correct ones, suggesting that in cases where they did not have a conscious FOE they still were able to implicitly detect their errors. Remarkably, confidence was also determined by the fluency of the NBT. (shrink)

Community-based healthcare organisations manage competing, and often conflicting, priorities. These conflicts can arise from the multiple roles these organisations take up, and from the diverse range of stakeholders to whom they must be responsive. Often such conflicts may be titled conflicts of interest; however, what precisely constitutes such conflicts and what should be done about them is not always clear. Clarity about the duties owed by organisations and the roles they assume can help identify and manage some of these conflicts. (...) Taking divisions of general practice in Australia as an example, this paper sets out to distinguish two main types of conflicts of interest, so that they may be more clearly identified and more effectively managed. Abstract In his critique of modern libertarian thinking, Jeffrey Friedman (1997) argues that libertarian moral theory makes social science irrelevant. However, if its moral claims are hypothetical rather than categorical imperatives, then economics, history, sociology, and other disciplines play a central role in libertarian thought. Limitations on human knowledge necessitate abstractly formulated rules, among which are claims of rights. Further, Friedman's remarks on freedom rest on an erroneous understanding of the role of definitions in philosophy, and his characterization of the (...) ?right to do wrong? as a ?logical contradiction? reveals a misunderstanding of logic. This paper presents two formation tracking control strategies for a combined set of single and double integrator agents with an arbitrary undirected communication topology. The first approach is based on the design of distance-based potential functions with interagent collision avoidance using local information about the distance and orientation between agents and the desired trajectory. The second approach adds signed area constraints to the desired formation specification and a control strategy that uses distance as well as area terms is designed to (...) achieve tracking convergence. In this work, on the one hand, we examined the relationship between emotional intelligence (EI) and empathy and, on the other, the relationship between emotional intelligence and nonverbal sensitivity, through two independent studies. The first study analyzed the relationship between dimensions of emotional intelligence and aspects of empathy, in a sample of 856 participants who completed two measures of EI, the Trait Meta-Mood Scale (TMMS) and the Trait Emotional Intelligence Questionnaire (TEIQue), and a measure of empathy, The Interpersonal Reactivity Index (...) (IRI). The results showed a similar pattern of significant positive relations in all the EI domains with empathic Perspective-taking, and significant negative relationships with empathic Personal Distress, except for the EI domain of Attention, which had a positive relationship. Stepwise multiple regression analyses showed that the dimension that best predicted empathic Perspective-taking and Empathic Concern was the Emotionality Factor; whereas Attention best predicted empathic Fantasy; and the Self-Control Factor best predicted Personal Distress, although negatively. Gender emerged as a predictor of three empathic aspects, Fantasy, Empathic Concern, and Personal Distress, with women obtaining higher scores than men in all of them. Age was the only predictor of Fantasy, with a negative relationship. The second study involved 646 people who completed the same measures of EI as the participants of the first study and the Mini-Profile of Nonverbal Sensitivity (Mini-PONS). The results showed some significant relationships between EI dimensions and the channels and quadrants of the MiniPONS. Stepwise multiple regression analyses showed that very few EI dimensions predicted nonverbal sensitivity, with Attention obtaining the best result. Both gender and age emerged as predictors, some in unique cases, of channels, quadrants and of the total score of nonverbal sensitivity; age had a negative relationship, and women obtained higher scores than men.
