This paper attempts to respond to a call to find an ontological basis for establishing African legal theory. The African world of my choice is the Igbo world of South-east Nigeria. It is a world I want to examine to see how its material and theoretical structures help articulate a philosophy of law in terms of projecting a consistent understanding of law subjects and the foundations of their rights. Background:Caring for a partner with primary malignant brain tumour can be a dramatic life-changing event. Primary malignant brain tumour is known to give poor life expectancy and severe neurological and cognitive symptoms, such as changed behaviour and personality, which demand greater caring responsibilities from spouses.Aim:The aim of the study is to explore ethical dilemmas spouses experience in the everyday care of a partner in treatment for primary malignant brain tumour.Research design, participants and research context:A phenomenological and hermeneutic qualitative descriptive design (...) was adopted as a method for collecting and analysing data. Ten spouses were interviewed twice using an in-depth, semi-structured interview guide. The interviews took place at the spouses’ homes or at the hospital.Ethical consideration:Ethical matters were considered throughout the research process. Permission from The National Committee on Health Research Ethics and the Danish Data Protection Agency was obtained.Findings:The analysis showed that the spouses perceived daily ethical dilemmas in caring for a partner with primary malignant brain tumour. Their life as well as their partner’s life had changed considerably. The main theme that emerged therefore was ‘oscillating in a changing relationship’. This theme was further elaborated in three subthemes that in more detail demonstrated the dilemmas: ‘doing the right thing in unpredictable daily situations’; ‘torn between patience and guilt’; and ‘living in a time of uncertainty, hope and despair’.Conclusion:Caring for a partner with changed behaviour and personality due to primary malignant brain tumour may involve exhausting ethical caring dilemmas. Spouses’ married life may change to a semi-professional asymmetrical relationship, which is challenged by the oscillation between acting responsibly for their partners’ well-being and caring dilemmas with no answer for what the right thing to do is. Mixed feelings of right and wrong, patience and guilt, hope and despair seem to be spousal companions through their partners’ progressing illness. (shrink)

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Conférences du Colloque de Millau (29 septembre-3 octobre 1993). Ed. "Les amis de sainte Claire aujourd'hui." Millau: Maury, 1994. 220 pp. During the eighth centenary of the birth of St. Clare, many symposiums were planned in France: Millau, Béziers, Montpellier, Perpignan and Paris. Sainte Claire en Rouergue presents most of the conferences from the symposium of Millau, September (...) 29 to October 3, 1993. This symposium celebrated the Franciscan presence in the region of Rouergue, France, during the last eight hundred years as well as the history and spirituality of St. Clare. Although the presentations were focused on a clearer history of the Poor Clares, they provided much information about the First Order as well as the Third Order Franciscan women of the nineteenth and twentieth centuries. The book presented a clear overview of the Franciscan foundations, devastations, and their re-establishment after the French Revolution and the disappearance of many communities. The first section highlighted the person of Saint Clare and her historical moment. The various articles provided an interesting review of many different dimensions: of Ladies in history in the 11th to the 13th century (Pernoud), the new religious structure begun by Clare (Dejour), her spirituality (Fabre) and the living of the Gospel by Francis and Clare (Dutheil). The direction of the symposium was not only to the past glories of Clare, but examined her place in social communication today (Gritti) and gave practical suggestions so as to concretize her spirituality and her influence in the future of Franciscan life (Miniou, Mercadier, Ghirard). The second section of the book focused on the history of the Franciscan presence in southwestern France. Information was gathered from many sources about the various branches of Franciscan life in Rouergue: Friars Minor, Coletans, Capuchins, Recollects, Cordeliers, Cordelières, Damianites, Minorettes, and Urbanists. The symposium presented different backgrounds and aspects of Franciscan life in Rouergue using archives, iconography, descriptions of artifacts and images, charts and maps. A more detailed 354BOOK REVIEWS description of these various communities was given through the use of obituaries, personal and communal histories, photographs, and listing of dowries. The three Poor Clare communities of Rouergue were: Millau (founded in 1291); Granayrac-(1326-1677) moved to Villefranche-deRouergue (1677-1792); and Mur-de-Barrez (founded in 1653). Villefranche began as a rural contemplative monastery, but later moved to the city where they taught young girls and allowed elderly women to live with them. Through the stormy history of the Calvinist revolt and the French Revolution, the Poor Clare communities were dispersed more than once, but they are re-established in Millau and Mur-deBarrez today. Besides the political struggles, the Poor Clares of Millau had a long history of religious controversy and intrigue as well as glory. Presentations are also given on the Annunciationists, another branch of the Poor Clares founded by Jeanne of France and the Franciscan, Gabriel-Maria. These women came to Rodez in 1519. Third Order religious congregations were the first to return to Rouergue after the dispersion of the French Revolution. Different researchers use "the philosophy of automated theorem p r o v i n g " t o cover d i f f e r e n t concepts, indeed, different levels of concepts. Some w o u l d count such issues as h o w to e f f i c i e n t l y i n d e x databases as part of the philosophy of automated theorem p r o v i n g . (...) Others wonder about whether f o r m u l a s should be represented as strings or as trees or as lists, and call this part of the philosophy of automated theorem p r o v i n g . Yet others concern themselves w i t h what k i n d o f search should b e embodied i n a n y automated theorem prover, or to what degree any automated theorem prover should resemble Prolog. Still others debate whether natural deduction or semantic tableaux or resolution is " b e t t e r " , a n d c a l l t h i s a part of the p h i l o s o p h y of automated theorem p r o v i n g . TisoIn taking on the task of co-editing Buddhist-Christian Studies, it would seem appropriate to provide some background by way of introduction. Being a disciple of Brother David Steindl-Rast, O.S.B., a man who refuses to sign his name with capital letters, since the late 1960s, it goes against my grain to write too much about myself. Therefore, the following comments are meant (...) also to serve as a foreword to the current issue.My own background in Buddhist-Christian studies has its roots in ongoing collaboration with Br. David, who will be remembered for his decades-long study of Zen and his affectionate rapport with the San Francisco Zen Center community, among others. I later studied interreligious dialogue and its theological implications with George Rupp and Harvey Cox at Harvard Divinity School. In order to let my studies sink their roots into contemplative soil, I served as Br. David's assistant at the Benedictine Grange and then went on to edit theological books at the Seabury Press in New York. Thanks to the kindness of the late and revered Alex Wayman, I was able to complete a doctorate in Buddhist Studies at Columbia University and Union Theological Seminary, where I gained some ability to work with Pali, Sanskrit, and Tibetan. I sought additional tutorial guidance from José Pereira of Fordham University, a polymath scholar deeply appreciated for his extraordinary ability to introduce students to the intricacies of Sanskrit literature. Our lengthy conversations about the Baroque Scholastic Catholic theologians formed my eagerness to welcome at least three of the articles in the current issue of BCS. After the doctorate, I continued to pursue study and contemplative practice in Europe and Asia, developing collegial friendships, especially with members of the International Association for Tibetan Studies. In 2003, M. R. John C. Wester, auxiliary bishop of San Francisco, asked me to participate in the Northern California Zen/Ch'an–Catholic Dialogue that had arisen from earlier dialogue programs in various monastic milieux such as Gethsemane and New Camaldoli. In the context of that dialogue, I was asked to serve the United States Conference of Catholic Bishops as associate director of the Secretariat for Ecumencial and Interreligious Affairs in Washington, DC, in 2004.Given this ongoing interplay in my own life between scholarly research and contemplative [End Page iii] practice, it is my hope that BCS will continue to nurture the same interests in its readership. Good scholarship and commitment to the goals of spiritual inquiry should also enrich the dialogue between Buddhists and Christians in various parts of the world. In a recent publication,1 Taigen Dan Leighton describes Dogen's methods with regard to reading: "So in addition to just reading through this material, the student of Zen may likely want to chew slowly at times, find pieces that are especially provocative, stimulating, or unsettlingly challenging, and take a while to consider, reflect, and digest." This is exactly what the Christian contemplative does in lectio divina. Moreover, to persons inclined to this kind of inquiry, even scholarly research gives rise to creative and, at times, truly contemplative insight. Thus even a journal committed to scholarship might find comfort in the "apophatic" methods of Buddhist or Christian contemplatives. Taigen reminds us that Zen sitting practice (zazen) is not the suppression of content. In fact, understanding is expected:Dogen is clearly not recommending zazen as mere blank, mindless sitting. Although he frequently criticizes practice concerned with achievement, or with reaching for particular schematized stages of development, Dogen regularly asks his monks if they thoroughly understand. He is suggesting a practice that is informed by intense inquiry into the ancient teachings, sayings, and dialogues, as well as into our present immediate experience. Throughout formal meditation as well as in our everyday activity, Dogen encourages vivid attention and awareness.In practice, this is nothing less than the interactive application of the principles of the great teachings on emptiness. As a method, the philosophical analysis of emptiness came to have an enormous impact on the Ch'an and Zen traditions; it was a method of "negation" in the sense that it could be... (shrink)

Este estudo objetiva relacionar a felicidade epicurista, particularmente a partir da análise da Carta a Meneceu, de Epicuro (341 a.C.-260 a. C.) ao sofrimento psíquico de pós-graduandos stricto sensu, pertencentes ao atual sistema social capitalista. A pesquisa de campo e de método mistos, utilizou como instrumento para a coleta de dados um survey interseccional, respondido por 76 discentes de um Programa de Pós-Graduação stricto sensu em Educação (PPGE), localizado no estado do Paraná-PR. A análise dos resultados ocorreu a partir do (...) conceito de felicidade expresso por Epicuro de Samos, além de pesquisadores contemporâneos que dissertam sobre o conceito de felicidade na contemporaneidade. Os resultados indicam que há uma ascendência nos casos de sofrimento psíquico dentro do ambiente acadêmico da pós-graduação, o que gera descontentamento, ansiedade e, consequentemente, infelicidade. Observou-se também que o sistema social capitalista, nos distancia da temperança, da ética e da moralidade, não obstante, também da felicidade enquanto conceito epicuriano. (shrink)

From its very beginning, Pope Francis’s Petrine ministry has been full of surprises and he has been a man of contradictions. He has given hope to many, Christians, other believers, and secular humanists, especially with his pastoral approach of mercy, but he has also met with fierce opposition, even among the upper echelon of the hierarchy, some of whom have publicly attacked his orthodoxy and called for his resignation. In his teachings on evangelization, marriage and sexuality, ecology, and social (...) friendship, Francis has opened new paths and challenged the church to make visible the merciful face of God to the world.On interreligious dialogue, the pope, as to be expected, has largely reiterated the teachings of Vatican II and so far has not issued an apostolic exhortation or encyclical on the subject. Consistent with his pastoral outlook he has emphasized the socio-political and cultural aspects of interreligious dialogue and has largely avoided still controverted doctrinal issues. On the other hand, his friendship with many non-Christian leaders and his several obiter dicta have enlarged the interreligious horizon and opened the door for further explorations in the theology of religion and the scope of the interreligious encounter. His explicit acknowledgment of non-Christian religions as “channels” of the Holy Spirit hints at their role as ways of salvation not only for their adherents but also in certain ways for Christians. Furthermore, the four principles of Francisian metaphysics suggest novel and effective ways of conducting interreligious dialogue. (shrink)

Within evolutionary biology a distinction is frequently made between proximate and ultimate causes. One apparently plausible interpretation of this dichotomy is that proximate causes concern processes occurring during the life of an organism while ultimate causes refer to those processes (particularly natural selection) that shaped its genome. But ultimate causes are not sought through historical investigations of an organisms lineage. Rather, explanations referring to ultimate causes typically emerge from functional analyses. But these functional analyses do not identify causes of any (...) kind, much less ultimate ones. So-called ultimate explanations are not about causes in any sense resembling those of proximate explanations. The attitude, implicit in the term ultimate cause, that these functional analyses are somehow superordinate to those involving proximate causes is unfounded. Responsibility and accountability of CEOs has been a major ethical concern over the past 10 years. Major ethical dilemmas at Enron, Worldcom, AIG, as well as other well-known organizations have been at least partially blamed on CEO malfeasance. Interviews with Ken Lay, CEO of Enron, after his 2006 fraud convictions provides an opportunity to document his perceived role in the demise of Enron. Possibly no other CEO has had as much impact on the scrutiny and legalization of business ethics as (...) Ken Lay. This analysis is timely because of many information sources now available and the recent Supreme Court decisions on Enron conviction appeals. Using Ken Lay as the focal point, a review of literature provides the background for research questions to explore the role of the CEO in developing an ethical corporate culture. (shrink)

This study explores consumer expectations and attitudes related to gender-based price discrimination. Although much research has focused on pay inequalities and gender diversity, considerably less attention has been focused on situations in which men and women are charged different prices based on gender. In two studies, expectations and attitudes toward gender-based price discrimination are examined. In Study 1, two scenarios related to prices at hair salon and dry cleaning services were manipulated to measure expectations and attitudes toward gender-based price discrimination. (...) We found that the nature of the service results in expectations of price differences between men and women. We also found men expect gender-based pricing more than women. In Study 2, qualitative research was conducted to reveal the cognitions that men and women experience when exposed to gender-based price discrimination. (shrink)

Sarbanes–Oxley Section 406 requires a code of ethics for top financial and accounting officers in public companies. The objective of this research is to discover the impact of a financial code of ethics on firm behavior. We performed a longitudinal tracking of firm adoption of a financial code of ethics starting in 2005. We checked these companies’ codes again in 2011 to confirm their continued implementation. Financial restatements were used as a dependent variable to measure improved financial reporting after the (...) adoption of the financial codes. The results confirm that the adoption of a financial code of ethics improves the integrity of financial reporting. (shrink)

Based on an extensive review of the literature and field surveys, the paper proposes a conceptualization and operationalization of corporate citizenship meaningful in two countries: the United States and France. A survey of 210 American and 120 French managers provides support for the proposed definition of corporate citizenship as a construct including the four correlated factors of economic, legal, ethical, and discretionary citizenship. The managerial implications of the research and directions for future research are discussed.

The following article analyzes the process of conception, elaboration, and adoption of the Universal Declaration of Bioethics and Human Rights, and reflects on the lessons it might hold for public bioethics on the international level. The author was involved in the process at a variety of levels: he provided advice to the IBC on behalf of the President's Council of Bioethics; he served as the U.S. representative to UNESCO's Intergovernmental Bioethics Committee; and led the U.S. Delegation in the multilateral negotiation (...) of Government experts that culminated in the adoption of the declaration in its final form. Most professions find ethical standards of conduct are necessary to codify acceptable behavior to develop public trust, reliability, and consistency in their performance. The proposed AMS Code of Ethics for Marketing Educators is the first step in developing communication, debate, and hopefully, agreement about the social responsibility of the marekting (...) discipline. It is important to note that the AMS code was not developed to punish wrongdoers but to provide a positive guide to help marketing educators understand how their actions may be viewed by society. After years of debate over the importance of ethical conduct in organizations, the federal government has decided to institutionalize ethics as a buffer to prevent legal violations in organizations. The key requirements of the Federal Sentencing Guidelines (FSG) are outlined, and suggested actions managers should adopt to improve ethical compliance are presented. An effective compliance program is more a process and commitment than a specific blueprint for conduct. The organization has the responsibility to create an organizational climate to reduce misconduct. (...) The adoption of a FSG compliance program has the potential to substantially lessen organizational penalties if there is due diligence to prevent misconduct.
