This essay explores the philosophical sources of the modern prohibition of torture by tracing different systematic steps in the difficult moral struggle against torture. It will be shown that the reluctance to embrace an outright ban on torture does not originate only from ancient convictions but also from the internal tensions between sovereignty and freedom in the context of the legitimation of the modern state. Starting with the universally empathic approach of 16th century’s humanists the moral condemnation of torture shifted (...) its focus successively from matters such as pity or the protection of bodily integrity to the recognition of human self-determination. During the Age of Enlightenment, the ambiguity of the modern concept of the state is even more clearly revealed. Political arguments against torture are put forward by utilitarians only stressing, again, the futility of bodily pain. Kant and Hegel, however, though developing human dignity as a matter of principle stick to retribution and the strict enforcement of the rule of law. Their approach overemphasizes certain notions of sovereignty and leads to perplexing consequences. This can be shown also with regard to the actual debate concerning exceptions from the general prohibition of torture. (shrink)

Die Arbeit verfolgt Entwicklungslinien eines auf praktische Vernunft gestützten Republikmodells an Hand der exemplarischen Bedeutung der aristotelischen Politik und ihrer Rezeption durch Thomas von Aquin. Diesen werden auch entscheidende Weichenstellungen für die Ausbildung des modernen Staatsbegriffs und seines begrifflichen Instrumentariums politischer Vernünftigkeit zugerechnet. Teil 1 stellt das aristotelische Modell der auf den Begriff des Menschen als Menschen gegründeten "bürgerlichen Gesellschaft" vor, in der sich ein gegenüber der Beliebigkeit tatsächlicher Herrschaftsan-massungen kritischer ursprünglicher Zusammenhang zwischen dem Verständnis "politischer Herr-schaft" und der wechselseitigen (...) "Anerkennung" konkret freier und gleicher Bürger präsent hält. Dieser ruht jedoch auf einschränkenden Voraussetzungen politischer Subjektivität und deren unmittelbarer Bindung an institutionelle Rahmenbedingungen auf, wie sie aus einem spezifisch antiken Verständnishorizont, näherhin aus dem aristotelischen Konzept entelechialer Teleologie, erläutert werden. Der Versuch einer Einordnung in Grundlinien des umfassenden systematischen Kontexts in Metaphysik, Physik und praktischer Philosophie soll gerade durch den gegenüber der unbestrittenen aktuellen Relevanz neuzeitlichen Freiheitsethos differenzierenden und nicht ungeschichtlich-planen Zugang zu diesem Politikmodell auch aktualisierende Perspektiven eröffnen. So soll etwa durch die Erläuterung der aristotelischen Teleologiekonzeption, die anhand des Paradigmas der Naturbewegung eingeführt wird, sowie des dazu korrespondierenden Ethos "vernünftigen Strebens" das etwaige Verständnis einer vorgängigen materialen Zweckbindung der Politik, im Sinne etwa einer herkömmlichen "Werteethik", distanziert werden. Das Verhältnis Naturteleologie - Praxis wird nicht deduktiv, sondern als ein solches der Strukturanalogie bei gleichzeitiger methodischer Abgrenzung verstanden. Teil 2 widmet sich der Herausarbeitung systematischer Akzentverschiebungen und Umformungen im Spannungsfeld der Konfrontation von aristotelischer Teleologie bzw. praktischer Vernunft mit einer von der Perspektive der Geschichtlichkeit geprägten Offenbarungsreligion bei Thomas von Aquin. Im Zeichen eines vorläufig theologisch gewonnenen universalen Freiheitsverständnisses vollzieht sich auch ein Strukturwandel politischer Öffentlichkeit, der zunächst eine institutionelle Verdünnung des republikanischen Ideals herbeiführt. Durch die Rücknahme des Ziels der Politik vom konkreten Bürger-ethos in die Universalität und den nunmehr transzendentalen Anspruch des Begriffs des "bonum commune" wird gleichzeitig aber auch ein Prozess der Pluralisierung und Dynamisierung gesellschaft-licher und individueller Zielsetzungen und Praxisformen freigesetzt. Entscheidende Bedeutung kommt dabei dem Stellenwert des thomasischen "Gesetzes" zu, in dem - jenseits einer material-deduktiven oder imperialistischen Konzeption - ein dezidiert praktisch-handlungsleitendes Gesetzesverständnis zum Vorschein kommt. Dieses führt die sittlich-politische Anerkennung stiftende Funktion der "koinonia politike" weiter und leitet in seinem Anspruch gesteigerter "Allgemeinheit"--Dies sowohl im Rückgang auf ein transzendentales Prinzip seiner Begründung wie auch in der Ausweitung seines Adressaten-kreises - zur Neuzeit über. This essay is meant to draw the principle outlines of the development of a specific modern issue of penalty. Deriving from an erosion of Augustine's dominating paradigm of retribution as a balance of two equivalent “evils” the legitimation of modern punishment was not sought in ef ficient deterrence only – as utilitarian philosophers suggested. More deeply, a modern justification of punishment was developed within the political philosophy of Kant, Fichte and Hegel by successively unfolding its close relation to the concept (...) of freedom. This does not only stress the criminal's own responsibility but also relies on the condition of a developed rule of law. As a result punishment was not only meant to restore sovereignty, often based on a social contract, but also the fundamental relation of mutual recognition between individuals. Adhering to a substantial understanding of the modern state under the rule of law this concept of penal law draws a marked distinction between “punishment” and “war” and also sets a clear limit to tendencies of expanding criminality beyond the rule of law. Regarding its philosophical impact it predominantly must be put forward against all measures which negate or extinguish the criminal's personality as a whole, such as torture, death penalty or life imprisonment. Socially responsible business and ethical behaviour of companies have been of interest to academia and practice for decades. But the focus has almost exclusively been on large corporations while small- and medium-sized enterprises (SME) have not received as much attention. Thus, this paper focuses on socially responsible business practices of SME entrepreneurs or owner–managers in Germany. Based on the assumption that decision-makers in SMEs are the central point where all business activities start, members of a German entrepreneurs association were approached (...) in the course of a qualitative and quantitative survey. They were asked to assess in what way their social responsibility is expressed in specific management practices towards selected stakeholder groups. These practices in turn were assumed to result in perceived positive reactions of the respective stakeholders and subsequently to positively influence the firm's financial performance, i.e. cost reductions and increase in profits. In the paper, a research model is presented that elaborates the relationship between an SME executive's social responsibility and the value creation of a firm, i.e. whether (personal) values create (economic) value. It was found that socially responsible management practices towards employees, customers and to a lesser extent society have a positive impact on the firm and its performance. Breast milk and the placenta are phenomena of female human embodiment that challenge the philosophical notion of separate, sovereign subjects independent of other human be­ings and an objective world “out there.” A feminist phenomenological analysis, indebted to Merleau-Ponty and Irigaray, reveals placenta and milk to be intercorporeal, “chiasmic” forms of shared organic existence. This analysis is a philosophical and psychological exploration of “matrotopy,” i.e., the fact that humans eat their mothers through breast milk and placenta. This exploration, however, requires an (...) understanding of the larger environmental field which sustains the female body and its offspring. Environmental degradation, particularly through estrogen mimicking substances in plastics and pesticides, targets the endocrine system of developing fetuses and endangers the future of the human species from the inside. Invisible organo-chemical technologies pose a new and immediate danger and ethical challenge to women and men in the twenty-first century. A “placental ethics” respects the insertion of the human being into the dynamic field of nature; it calls for an awareness that, unless we develop a changed attitude toward technology, the gradual extinction of our species continues to happen in female bodies today. Infants who suffer severe neglect fail to thrive emotionally as well as bodily. The absence of early coexistential structures that provide well-being leads to a narrowing of the child's perceptual and social developmental horizon. What is the nature of these early structures? In this essay, an ontology of well-being or housedness is elaborated through phenomenological reflections on breast-feeding and infant perception. Merleau-Ponty's ontology of the flesh makes a contribution to the ontology of well-being: it gives us a conceptual and evocative (...) language to describe human existence in its pre-verbal, syncretic, and non-dualistic manifestations. It also allows for a re-evaluation and re-interpretation of the results of current research in infant perception. Through the structures of infant perception we perceive the coexistential fit between infants, other human beings, and the world of things. An infant's fundamental housedness in the flesh is taken up and cultivated or destroyed by the child's social and cultural environment. (shrink)

Two aspects about meaning and emotion are discussed in this paper. The first, which is the main focus of this paper, addresses the semantic shaping of emotions (semanticization). It will be shown how language acquisition leads to the semantic shaping of emotions. For this purpose I will first introduce the theory of language acquisition that has been developed mainly by Michael Tomasello and also by Donald Davidson. Then I will take basic emotions into account in order to show that language (...) plays a crucial role when it comes to the shaping of emotions and how we feel. The second aspect about meaning and emotion addresses the signification that an emotion might have for a person. One could also say that this aspect addresses the meaning an emotion has for a person. Telepsychiatry has long been discussed as a supplement to or substitute for face-to-face therapeutic consultations. The current pandemic crisis has fueled the development in an unprecedented way. More and more psychiatric consultations are now carried out online as video-based consultations. Treatment results appear to be comparable with those of face-to-face care in terms of clinical outcome, acceptance, adherence and patient satisfaction. However, evidence on videoconferencing in a variety of different fields indicates that there are extensive changes in the communication behaviour (...) in online conversations. We hypothesise that this might impact ethically relevant aspects of the therapeutic relationship, which plays a prominent role in psychiatry. In this paper, we review effects of video-based consultations on communication between therapists and patients in psychiatry. Based on a common understanding of video-based consultations as changing the lived experience of communication, we categorise these effects according to sensory, spatial and technical aspects. Departing from a power-based model of therapeutic relationships, we then discuss the ethical significance of this changed communication situation, based on dimensions of respect for autonomy, lucidity, fidelity, justice and humanity. We conclude that there is evidence for ethically relevant changes of the therapeutic relationship in video-based telepsychiatric consultations. These changes need to be more carefully considered in psychiatric practice and future studies. (shrink)

The literature on sensory processing disorders in institutionalized infants highlights the impact of early deprivation on infant perception. Through a Merleau-Pontian, hyperdialectic analysis of the extraordinary development of infant perception under circumstances of severe deprivation the intimate link between environmental affordances and perceptual systems becomes apparent. This paper offers an updated reading of Merleau-Ponty’s late work as a philosophy of systems and outlines some fertile philosophical concepts and methods developed by Merleau-Ponty in The visible and the Invisible. Merleau-Ponty’s concept of (...) the chiasm, understood from a systems perspective, and his method of the hyperdialectic are applied in a child case study of an infant who suffered severe neglect in a Romanian orphanage. Dans ses cours de la Sorbonne, il avait en outre jeté les fondements théoriques d’une confrontation fructueuse entre la linguistique et la psychologie de l’enfant, en ouvrant un dialogue de fond avec la théorie linguistique et avec les recherches psychologiques de (...) son époque sur l’acquisition du langage. Le phénomène de l’acquisition du langage par l’enfant nous fait assister à la transition de l’être pré-langagier à l’être parlant ; nous y trouvons l’occasion d’une mise en relation de l’incarnation perceptive et charnelle avec le corps parlant qui agit dans le champ symbolique.Cette étude reprend le projet de Merleau-Ponty, en s’appuyant sur les résultats récents de la recherche en matière de développement psycho-linguistique afin de mettre à l’épreuve les thèses merleau-pontiennes sur le langage. Artificial intelligence is currently changing many areas of society. Especially in health, where critical decisions are made, questions of control must be renegotiated: who is in control when an automated system makes clinically relevant decisions? Increasingly, the concept of meaningful human control (MHC) is being invoked for this purpose. However, it is unclear exactly how this concept is to be understood in health. Through a systematic review, we present the current state of the concept of MHC in health. The results (...) show that there is not yet a robust MHC concept for health. We propose a broader understanding of MHC along three strands of action: enabling, exercising and evaluating control. Taking into account these strands of action and the established rules and processes in the different health sectors, the MHC concept needs to be further developed to avoid falling into two gaps, which we have described as theoretical and labelling gaps. The French nineteenth century artists Henry Toulouse-Lautrec (1864-1901) is known for his distinctive style and bold character portraits of the theatrical scene of the gaslight era in Paris. The paper examines some of the formative influences of eighteenth century Japanese art on the development of visual characters, with specific focus on a lithograph entitled Divan Japonais. Alluding to the refined representation of Japanese courtesans, subtle nuanced reminiscences to an ideal of elegance create an allusion to highly respected courtesans in the (...) Japanese ‘Green Houses’ of the Asian Yoshiwara the famous “Good Luck Meadow” in Edo, present day Tokyo. I argue that Lautrec draws on techniques in Asian art, effectively creating a visual language that suggests a carefully crafted reevaluation of values. Lautrec’s visual language promotes sensibilities characteristic for a Japanese aesthetic and lifestyle that are also intrinsic to a traditional cultivation of moral virtues in Asia. The argument will be developed in conjunction with an analysis of diverse forms of visual language apparent in two works of Lautrec, a print by the Japanese artist Kitagawa Utamoro (1753-1806), and a photo of the dancer Jane Avril (1868—1943). The relation between seeing, knowledge, and language has concerned philosophers and artists throughout history. The current article examines the relation between word, image, and knowledge in some prominent Renaissance artworks. It is argued that the shift from revelatory truth in the word to evidence in “seeing the real” as Leonardo da Vinci (1452 -1519) argues in his writings, marks a moment in history in which the human being takes center stage as the interpreter of knowledge. In the search for perfect (...) proportionality and beautiful harmony, Renaissance artists, therefore, did not just create an aesthetic dimension yet were central in a process leading to a reevaluation and alternative modes of knowledge about the human being. This article examines the relation between the biblical Word and visuality in one of the surviving early thirteenth century manuscripts of the Bible moraliseé, the codex Vindobonensis 2554 today housed in Vienna. The analysis focuses specifically on the relations between word and visuality. The goal is to investigate the vitality that may set the Word into motion. It is argued that the matrix of textual visuality in the Vienna codex 2554 is used as an effective tool that adds vitality to (...) the biblical passages while simultaneously creating a firm hierarchy of representation and resemblances that enforces not only certain norms but also a particular world order in 13th century French society. Analyzing the ancient Greek point of view concerning anger, shame and justice and a very modern one, one can see, that anger has a regulative function, but shame does as well. Anger puts the other in his place, thereby regulating hierarchies. Shame regulates the social relations of recognition. And both emotions also have an evaluative function, because anger evaluates a situation with regard to a humiliation; shame, with regard to a misdemeanor. In addition, attention has to be paid to the (...) correct molding of these emotions and the correct ways of using them in rearing to be good or just (i.e., in personality formation. (shrink)

This paper works out which conceptual and theoretical preconditions have to be met, among others, in order for a living creature to be able to have a feeling of being alive beyond the mere capacity for sensation. For the emergence of such a feeling, which can be equated with a rudimentary phenomenal consciousness (1.), it is not enough for the organism to be alive (2. a.). Rather it has to be able to conceive its body as a unit and to (...) relate its sensations to this unit (2. b.). Moreover mobility (2. c.), a basic sense of possibility (2. d.) and a rudimentary sense of time (2. e.) are also necessary. The analysis of these preconditions relies primarily on Aristotelian theoretical approaches, encompassing both historical interpretation (3. a.), and systematic work, which includes a look at the current debates in the analytic philosophical tradition (3. b.). The “Crisis” itself is an attempt of enlightenment by examining origins. Husserl knows three philosophical origins of evidence and justification: (1) consciousness; (2) the life-world; (3) european philosophy and the history of the sciences. There is a tension of historicity and ahistoricity in all of these origins. I will show in how far all three origins are under this tension. Because even concerning the notion of absolute consciousness one can show, that it is linked to historicity. The exact sciences are, (...) as Husserl says, the accomplishments of the consciousness of knowing subjects. Subjectivity and the accomplishments of consciousness are for Husserl therefore the immanent reason (die immanente Vernunft) without which the objectivity of the sciences becomes absurd (widersinnig). As they are not domains of a priori truths, they derive their inherent reason from subjectivity. Subjectivity and consciousness are therefore prior conditions for the sciences and for the life world. The immanent reason that subjectivity and consciousness is for the sciences and the life-world is also part of the ground that enables critique on the sciences. But does it make sense to try to reconstruct historical anonymous subjective phenomena as the immanent reason of scientific developments as Husserl demands? The reduction to a pure intention or absolute ego is a process, which is dependant on a historical development. Therefore even if we conceded that the epoché was feasible it would still depend on a historical evolved concept. An absolute ego is only conceivable for those who live in a culture that allows such an abstraction. But as Husserl does not adopt a history of philosophy like Hegel that explains how the absolute ego comes to itself in time, the tensions between ahistoricity or non-historicity and historicity are not resolved in the “Crisis”. Maurice Merleau-Ponty beschreibt die Phänomenologie als einen erkennbaren, praktischen Denkstil, der als Bewegung schon bestand bevor er sich als Philosophie bewusst war. Im Folgenden wird gezeigt, wie Goethe’s naturwissenschaftliches Denken in diesen erkennbaren, praktischen Denkstil der phänomenologischen Bewegung hineinpaßt. Diese Studie über Goethe und die Phänomenologie ist auf drei Themenkreise beschränkt: die phänomenologische Weltanschauung, die von Husserl’s Werk geprägt wurde; die phänomenologische Methode, die ihren Ursprung in Husserl, aber ihre Ausarbeitung in neueren Phänomenologen hat; und letztlich die phänomenologische Naturphilosophie, die (...) ihre Ansätze im Spätwerk Merleau-Ponty’s findet.
