In the context of psychiatric diagnosis, operationists claim that mental disorders are nothing more than the satisfying of objective diagnostic criteria, whereas realists claim that mental disorders are latent entities that are detected by applying those criteria. The implications of this distinction are substantial in actual clinical situations, such as in the co-occurrence of disorders that may interfere with one another's detection, or when patients falsify their symptoms. Realist and operationist conceptions of diagnosis may lead to different clinical decisions in (...) these situations, affecting treatment efficacy and ultimate patient outcomes. (shrink)

We report on the development and initial validation of the Moralization of Everyday Life Scale, designed to measure variations in people's assignment of moral weight to commonplace behaviors. In Study 1, participants reported their judgments for a large number of potential moral infractions in everyday life; principal components analysis revealed 6 main dimensions of these judgments. In Study 2, scores on the 30-item MELS showed high reliability and distinctness from the Big 5 personality traits. In Study 3, scores on the (...) Cramer et al.'s account of comorbidity comes with a substantive philosophical view concerning the nature of psychological disorders. Although the network account is responsive to problems with extant approaches, it faces several practical and conceptual challenges of its own, especially in cases where the individual differences in network structures require the analysis of intra-individual time-series data.

Lies are typically defined as believed falsehoods asserted with the intention of deceiving the hearer. A particularly problematic case for this definition is that of false implicatures. These are prototypically cases where the proposition expressed by the speaker's utterance is true, yet an implicature conveyed by this proposition in context is false. However, implicature is a diverse category and whether a blanket statement such as “false implicatures are lies,” as some have argued can account for all of them is open (...) to investigation. We present an experimental investigation of whether naïve participants define different types of implicatures as lies. Our results show that only a couple of types of implicatures were strongly rated as lies by participants. These results suggest that participants distinguish between different types of communicated meanings on linguistic grounds, contributing both to the literature on lying, as well as to theoretical discussions of how different types of meaning are communicated. Strict libertarianism, as one of us has defined it elsewhere, is “a radical political view which holds that individual liberty, understood as the absence of interference with a person’s body and rightfully acquired property, is a moral absolute or near-absolute, and that the only governmental activities consistent with that liberty are (if any) those necessary to protect individuals from aggression by others.” Strict libertarianism is a radicalized form of classical liberalism that is, characteristically, rationalistic, monistic, and (relatively) absolutist in its (...) approach to political principles. One advantage of bringing so many well-informed proponents and critics of libertarianism together in the same volume is that it makes clear the tremendous diversity of libertarian thought. Libertarians are a methodologically, normatively, and even politically diverse group. The chapter also provides an overview of the key concepts discussed in this book. (shrink)

Many philosophers and legal theorists worry about punishing the socially disadvantaged as severely as their advantaged counterparts. One philosophically popular explanation of this concern is couched in terms of moral standing: seriously unjust states are said to lack standing to condemn disadvantaged offenders. If this is the case, institutional condemnation of disadvantaged offenders (especially via hard treatment) will often be unjust. I describe two problems with canonical versions of this view. First, its proponents groundlessly claim that disadvantaged offenders may be (...) punished as severely as advantaged ones, even though such punishment is unjust in light of the state’s loss of standing. Second, and more importantly, moral standing arguments prohibit states from blaming advantaged as well as disadvantaged offenders. This unwelcome outcome suggests that standing approaches incorrectly analyze the source of moral misgivings about punishing the disadvantaged. I conclude that those who share such concerns should put standing accounts aside. (shrink)

Objectives To determine the role played by law in medical specialists9 decision-making about withholding and withdrawing life-sustaining treatment from adults who lack capacity, and the extent to which legal knowledge affects whether law is followed. Design Cross-sectional postal survey of medical specialists. Setting The two largest Australian states by population. Participants 649 medical specialists from seven specialties most likely to be involved in end-of-life decision-making in the acute setting. Main outcome measures Compliance with law and the impact of legal knowledge (...) on compliance. Results 649 medical specialists (of 2104 potential participants) completed the survey (response rate 31%). Responses to a hypothetical scenario found a potential low rate of legal compliance, 32% (95% CI 28% to 36%). Knowledge of the law and legal compliance were associated: within compliers, 86% (95% CI 83% to 91%) had specific knowledge of the relevant aspect of the law, compared with 60% (95% CI 55% to 65%) within non-compliers. However, the reasons medical specialists gave for making decisions did not vary according to legal knowledge. Conclusions Medical specialists prioritise patient-related clinical factors over law when confronted with a scenario where legal compliance is inconsistent with what they believe is clinically indicated. Although legally knowledgeable specialists were more likely to comply with the law, compliance in the scenario was not motivated by an intention to follow law. Ethical considerations (which are different from, but often align with, law) are suggested as a more important influence in clinical decision-making. More education and training of doctors is needed to demonstrate the role, relevance and utility of law in end-of-life care. (shrink)

This book presents a contextual study of the life and work of the Cambridge Platonist Ralph Cudworth (1617-1688). Focusing on the theological basis of Cudworth's ethical philosophy, this book unlocks the hitherto ignored political aspect to Cudworth's ethical philosophy. Through a detailed examination of Cudworth's published works - particularly his voluminous "True intellectual system of the Universe" -, his posthumously published writings, and his 'freewill' manuscripts Benjamin Carter argues that the ethical and political arguments in Cudworth's philosophy develop out (...) of Cudworth's Trinitarian theology. Carter traces the link between Cudworth's trinitarianism and his ethical and political ideas by placing Cudworth's work in the turbulent religious and intellectual context of seventeenth-century England, and the University of Cambridge in particular. Philosophy of Medicine has for a long time been preoccupied with analyzing the concepts of health, disease and illness. Relatively speaking, the concept of medicine itself has received very little attention. This paper is a contribution to the relatively neglected debate about the nature of medicine. Building on the work of Alex Broadbent (Broadbent, 2018a, b), Chadwin Harris (Harris, 2018) and Thaddeus Metz (Metz, 2018), in this paper I question the persuasiveness of Broadbent’s account of the “core business” of medicine, (...) The Inquiry Thesis, and propose an alternative: a revised version of The Curative Thesis, which I coin The Best Available Intervention Thesis. Crudely, this suggests that Medicine is the sustained and organised effort to determine and prescribe the best available treatment (curative or preventative) for patients. (shrink)

Regulation must target the financial sector, which often funds and profits from environmentally unsustainable development. In an era of global financial markets, the financial sector has a crucial impact on the state of the environment. The long-standing movement for ethically and socially responsible investment (SRI) has recently begun to advocate environmental standards for financiers. While this movement is gaining more adherents, it has increasingly justified responsible financing as a path to be prosperous, rather than virtuous. This trend partly owes to (...) how financial institutions view their legal responsibilities. The business case motivations that now predominantly drive SRI are not sufficient to make the financial sector a means to sustainable development. Some modest legal reforms to improve the quality and extent of SRI have yet to make a tangible difference. A more ambitious strategy to promote SRI for environmental sustainability is possible, based on reforming the fiduciary duties of financial institutions. Such duties, tied to concrete performance standards, could make financiers invest in more ethically responsible ways. Other collateral reforms to financial markets, including improved corporate environmental reporting, are required to promote sustainability. (shrink)

Adolescence is a crucial time for social development, especially for helping and compassionate behaviors; yet brain networks involved in adolescent prosociality and compassion currently remain underexplored. Here, we sought to evaluate a recently proposed domain-general developmental network model of prosocial cognition by relating adolescent functional and structural brain networks with prosocial and compassionate disposition. We acquired resting state fMRI and diffusion MRI from 95 adolescents along with self-report questionnaires assessing prosociality and compassion. We then applied the Network-Based Statistic to inductively (...) investigate whether there is a significant subnetwork related to prosociality and compassion while controlling for age and sex. Based on the Do-GooD model, we expected that this subnetwork would involve connectivity to the ventromedial prefrontal cortex from three domain-general networks, the default mode network, the salience network, and the control network, as well as from the DMN to the mirror neuron systems. NBS revealed a significant functional subnetwork related to prosociality and compassion connecting 31 regions, showing DMN and DLPFC connectivity to the VMPFC; DMN connectivity to mirror neuron systems; and connectivity between the DMN and cerebellum. These findings largely support and extend the Do-GooD model of prosocial cognition in adolescents by further illuminating network-based relationships that have the potential to advance our understanding of brain mechanisms of prosociality. Slowly, we are gaining a deeper understanding of the persisting psychological trauma experienced by students at colonial universities, and beginning to recognize that the Eurocentric curricula and pedagogies must change if students such as the “born-frees” in post-Apartheid South Africa are to flourish. In this article, I present a sub-Saharan African concept of “the ethical teacher,” and use this to ground a “ubiquitous action-reaction” teaching model. I use these concepts to develop a decolonized pedagogy – a teaching methodology that avoids (...) a number of harmful colonial teaching practices in philosophy. I suggest a number of novel ways of accommodating a “decolonized education” with a view to inspiring teachers of philosophy in colonial countries globally. I propose a new, malleable pedagogical model that is particularly useful in the colonial context, since its uniqueness lies in the African ethical framework that grounds it. However, I contend that philosophy educators globally will benefit from taking the principles proposed in this article seriously. (shrink)

This article examines Grotius’s use of a Roman tradition to establish his notion of a natural and international law in his early treatise De iure praedae. It is argued that De iure praedae, on a methodological level, constituted an attempt to introduce a new doctrine of sources of law by making use of the method of classical rhetoric. On a substantive level, the treatise must be seen as growing out of a Ciceronian tradition of natural law arguments in favor of (...) just war, a tradition further enriched by Grotius with concepts taken from the property law of the Digest. These concepts afforded Grotius with the substantive framework to develop his doctrine of subjective natural rights as sketched in the hitherto unpublished early manuscript Theses LVI. An implication of this investigation of the Roman foundations of Grotius’s theory of natural law is that it challenges widespread assumptions about the “positive” character of ancient liberty. Roman property law and Roman contract law as well as the property centered Roman ethics put forth by Cicero in several of his works were the traditions Grotius drew upon in developing his natural rights system. While both the medieval just war tradition and Grotius's immediate political context deserve scholarly attention and constitute important influences on Grotius's natural law tenets, it is a Roman tradition of subjective legal remedies and of just war which lays claim to a foundational role with (...) regard to his conception of subjective natural rights. Grotius made use of Roman law and Roman ethics in order to submit a normative case for a rights-based just war in the East Indies. His conception of a law of nature was originally conceived to apply a theory of compensatory justice to the high seas of Southeast Asia, envisaged as a natural state lacking political authority. Eventually, however, this argument was to reveal its anti-absolutist implications, and contributed—by virtue of its applicability to individuals, private entities and commonwealths alike—to the emergence of a rights-based constitutionalism. This article discusses Grotius's early treatise De iure praedae commentarius and its offshoot Mare liberum, which already contained an inchoate version of subjective natural rights, as well as the elaborate natural rights doctrine which can be found in Grotius's early Theses LVI and in the Defensio capitis quinti maris liberi, a defense of the fifth chapter of Mare liberum, written around 1615 and directed against the Scottish jurist William Welwod's attack on Mare liberum. Le problème posé est le suivant : que signifie l’idée de chercher à mieux entendre quand, comme dans cet ouvrage, et contrairement à la pratique traditionnelle des classes de solfège, les sons que l’on écoute échappent à tout langage musical établi d’avance, et qu’on ne sait donc pas ce qu’il est bon (...) d’entendre en eux? L’article répond à ce problème en expliquant le but des recherches présentées dans le Traité, et en montrant comment la pratique collective de l’exercice y devient une méthode de recherche expérimentale des valeurs musicales. Cette réponse est ensuite mise en relation avec l’idée que Schaeffer se fait de l’art comme exercice spirituel, ce qui suggère que l’exercice n’est pas seulement un moyen, mais peut-être une fin en soi. This article seeks to develop a concept I term surveillant citizenship, referring to a historically-emergent civic national and moral discourse that prescribes citizen participation in surveillance, policing, and law enforcement. Drawing on philosophy of race, surveillance studies, critical prison studies, and cultural theory, I argue that the ideological projects attached to the ‘War on Crime’ and the ‘War on Drugs’ sought to choreograph white social life around surveillant citizenship—manufacturing consent to police militarization, prison expansion, and mass incarceration, with consequences relevant (...) to the future of antiracist strategy. Although previous research has shown that there exist individual and cross-linguistic differences in planning strategies during language production, little is known about how such individual differences might vary depending on which language a speaker is planning. The present series of studies examines individual differences in planning strategies exhibited by speakers of American English, French, and German. Participants were asked to describe images on a computer monitor while their eye movements were monitored. In addition, we measured participants' working memory capacity and (...) speed of processing. The results indicate that in the present study, English and German were planned less incrementally prior to speech onset compared to French, which was planned more incrementally. Crucially, speed of processing predicted the scope of planning for French speakers, but not for English or German speakers. These results suggest that the different planning strategies that are invoked by syntactic choices available in different languages are associated with the tendency for speakers to rely on different cognitive support systems as they plan sentences. This paper provides evidence for an ambiguity of bare VPs in the English conditional conjunction construction. This ambiguity, undetected by previous researchers, provides a key to the development of a compositional semantic analysis of conditional conjunction with imperative first conjuncts. The analysis combines existing semantic theories of imperatives, the future tense, modal subordination, and speech act conjunction to yield the correct semantics without further stipulation.

Metaphors shape the sensibility of an era and define its core ideas and style of thinking. This volume compiles essays from linguistics, literary studies, and philosophy in order to understand the genesis, structure, and function of metaphors typical of an epoch.

As the Hungarian Marxist Georg Lukács noted, class has both an objective and a subjective quality: workers are reified as alienated commodities while at the same time they perceive their interests as qualitatively different from those of the capitalist who purchases their labour-power. This essay will argue that one of the most complex theorisations of the material production of working-class subjectivity emerges from Richard Wright’s 12 Million Black Voices, a second-person collective narrative of the African-American Great Migration. Wright locates African-American (...) subjectivity in the contradiction of its formation, at once trapped in the neo-feudal relations of the Jim Crow South, and brutally thrust into the matrix of Northern racialised and ghettoised industrial production. This produces for Wright acute misery, but also a proletarian revision of Du Bois’s Hegelian concept of ‘double consciousness’, as Black workers have a unique insight into the totality of the capitalist world-system. Enmity, War, Intensity Norberto Bobbio once gave a minimal definition of politics, characterizing it as the activity of aggregating and defending our friends, and dispersing and fighting our enemies.1 We know that the instigator of this definition is Carl Schmitt, although his critics have often misunderstood the reference to enmity. What resonates most is the claim that friend-enemy oppositions constitute the basic code of the political and that such oppositions can lead to the extreme case of war.
