Medieval literature is argumentative, since it argues for an idealized vision of reality acceptable to a proposed audience. Its narrative mode is description, performed according to the principles of the art of topical invention, derived from Cicero's De Inventione. The topoi or loci are features (circumstantiae) of a person or thing that are common to it as a class, such as tempus or locus for things. When filled out, according to the point of view desired by the author, public, context, (...) etc., they become the attributes (argumenta) of a particular human being or action.According to the author, all descriptions should be interpreted by reference to such a technique of topical invention, a method which will allow new explanations of the texts. The examples of the locus amoenus in various Latin and French works show how traditional and conventional models were adapted and specialized, by various devices, to fit new formal or conceptual intentions and new contexts. The examples and models proposed to the student learning composition by Masters such as Matthew of Vendôme, were given not to be copied, but to be imitated through topical invention, that is adaptation to a particular intention, through specializing devices. This essay addresses what is at the foundation of the US’s seemingly inherent “resistance” to racial justice and hence to Martin Luther King Jr.’s dream. This resistance is rooted in a moral imaginary corrupted by an epistemological gaze defined by whiteness and informed by anti-Blackness. For religious scholars, this means that we must adopt a preferential option for the knowledge and voices of those who historically have been granted little or no epistemic authority within our disciplines.

J. L. Schellenberg’s Divine Hiddenness and Human Reason claims that the existence of reflective persons who long to solve the problem of God’s existencebut cannot do so constitutes an evil rendering God’s existence improbable. In this essay, I present Schellenberg’s argument and argue that the kind of reasonable nonbelief Schellenberg needs for his argument to succeed is unlikely to exist. Since Schellenberg’s argument is an inductive-style version of the problem of evil, the empirical improbability of the premise I challenge renders (...) the conclusions derived from it empirically improbable as well. Due to the prevalence, severity, and costs associated with autism spectrum disorders, it has become a public health issue. In response, state governments have adopted ASD-specific private insurance mandates requiring coverage of ASD screening, diagnosis, and treatment. Despite rapid uptake of these laws, differences exist in the type and levels of coverage, especially for allied health services including occupational therapy. We piloted a structured legal research methodology to code ASD insurance mandates that impact allied health service provisions. State private insurance (...) mandates were obtained from WestlawNext. A coding methodology was piloted on 14 states and included variables for age and service limits, treatments covered, and medical necessity. Coding methods were feasible and highly reliable among raters. Ten of 12 states had a coverage mandate, many with specific provisions for allied health providers. A full analysis of all 50 states is warranted to identify provisions affecting allied health providers serving individuals with ASD. (shrink)

In Divine Hiddenness and Human Reason, J. L. Schellenberg argues that the phenomenon of “reasonable nonbelief” constitutes sufficient reason to doubtthe existence of God. In this essay I assert the reasonableness of entertaining doubts about the kind of reasonable nonbelief that Schellenberg needs for a cogent argument. Treating his latest set of arguments in this journal, I dispute his claims about the scope and status of “unreflective nonbelief,” his assertion that God would prevent reasonable nonbelief “of any kind and duration,” (...) and his confidence that we can know that some doubters are not self-deceived. This paper studies the modelling of legal reasoning about evidence within general theories of defeasible reasoning and argumentation. In particular, Wigmore's method for charting evidence and its use by modern legal evidence scholars is studied in order to give a formal underpinning in terms of logics for defeasible argumentation. Two notions turn out to be crucial, viz. argumentation schemes and empirical generalisations.

Plato provocatively characterizes truth $$ in terms of harmony $$ at various points throughout his dialogues. While limited attention has been directed toward the role of musical concepts in Plato's general cosmology, not any attention has been directed toward how musical concepts function in relation to Plato's characterization of truth. In fact, this issue has had little occasion for consideration. Almost every contemporary translator empties terms such as $\grave\alpha\rho\mu o\nu\acute\iota\alpha,$ when co-incidental with $\acute\alpha\lambda\acute\eta\theta\varepsilon\iota\alpha,$ of their musical content. As a consequence, (...) I argue, Plato's characterization of truth is made readily amenable to contemporary conceptions of truth-not necessarily a good thing since it robs us of the original richness of Plato's thought. The dissertation explores how retaining the aural meaning latent within $\grave\alpha\rho\mu o\nu\acute\iota\alpha$ and other terms of musical import serves to elucidate the rich complexion of Plato's notion of $\acute\alpha\lambda\acute\eta\theta\varepsilon\iota\alpha.$ Ultimately, I show how Plato's use of musical terminology to characterize truth informs other features of his philosophical outlook, illustrate the cohesiveness and consistency of key texts believed problematic by other commentators, and underscore significant differences between Plato's $\acute\alpha\lambda\acute\eta\theta\varepsilon\iota\alpha$ and ideas of truth prevalent today. ;For Plato, I argue $\acute\alpha\lambda\acute\eta\theta\varepsilon\iota\alpha$ bears a meaning different from its primitive sense of oracular unconcealment and its later sense of correctness $,$ and a meaning also different from other terminological alternatives $.$ Truth, accordingly, turns out for Plato to be neither mysterious and groundless nor a matter of simple correspondence to an objective reality. The value of Plato's conception of truth as harmony consists in its ability to avoid the polarity of contemporary conceptions of truth as either objectively determinate or subjectively determinate . Truth is neither arbitrarily imposed upon the world by us, nor artificially imposed upon us by an antecedently structured and independent reality. The dissertation concludes by articulating reasons for favoring Plato's theory of truth, while noting a few underlying assumptions likely problematic for some contemporary philosophers. (shrink)

We present a formal, mathematical model of argument structure and evaluation, taking seriously the procedural and dialogical aspects of argumentation. The model applies proof standards to determine the acceptability of statements on an issue-by-issue basis. The model uses different types of premises (ordinary premises, assumptions and exceptions) and information about the dialectical status of statements (stated, questioned, accepted or rejected) to allow the burden of proof to be allocated to the proponent or the respondent, as appropriate, for each premise separately. Our approach allows the burden of proof for a premise to be assigned to a different party than the one who has the burden of proving the conclusion of the argument, and also to change the burden of proof or applicable proof standard as the dialogue progresses from stage to stage. Useful for modeling legal dialogues, the burden of production and burden of persuasion can be handled separately, with a different responsible party and applicable proof standard for each. Carneades enables critical questions of argumentation schemes to be modeled as additional premises, using premise types to capture the varying effect on the burden of proof of different kinds of questions. Timely, unbiased scientific advice is essential for effective public policy, but the system now operating in the United States is in a state of dangerous disrepair. The danger takes two forms. First, we are missing critical benefits in health, education, economic productivity, national security, and many other areas that more effective management of science could deliver. Second, we risk being overtaken by dangers that could have been avoided or for which we could have been much better prepared, given stronger support (...) for analysis. It is easy to say that all of these problems could be easily corrected with a few elections. But in fact the difficulties are deep and structural. It will not be easy to rebuild the apparatus of science and technical advice in a way that can serve the needs of twenty-first century America. The discussion that follows will review the history of science and technology policy advice and use the lessons learned to propose a practical path forward. Indeed, there are a number of practical paths forward that build on strategies that have proved to be effective in the past and structures already in place. (shrink)

Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Immunology researchers are beginning to explore the possibilities of reproducibility, reuse and secondary analyses of immunology data. Open-access datasets are being applied in the validation of the methods used in the original studies, leveraging studies for meta-analysis, or generating new hypotheses. To promote these goals, the ImmPort data repository was created for the broader research community to explore the wide spectrum of clinical and basic research data and associated findings. The ImmPort ecosystem consists of four components–Private Data, Shared Data, Data (...) Analysis, and Resources—for data archiving, dissemination, analyses, and reuse. To date, more than 300 studies have been made freely available through the ImmPort Shared Data portal , which allows research data to be repurposed to accelerate the translation of new insights into discoveries.
