Diverses prescriptions juridiques et habitudes spécifiquement genrées pèsent en effet sur le port du nom : dans les sources historiques les hommes juifs sont repérés aussi bien par leur nom « sacré » hébreu que par leur prénom usuel, et éventuellement par (...) un surnom, alors qu’on ne repère le plus souvent les femmes que par leur prénom usuel. Selon le droit juif, les hommes produisent dans leur nom hébreu le nom de leur père ; les matronymes ne sont que rarement donnés, et tout au plus avec le prénom usuel. In Concepts, Kinds, and Cognitive Development, Frank C. Keil provides a coherent account of how concepts and word meanings develop in children, adding to our understanding of the representational nature of concepts and word meanings at all ages. Keil argues that it is impossible to adequately understand the nature of conceptual representation without also considering the issue of learning. Weaving together issues in cognitive development, philosophy, and cognitive psychology, he reconciles numerous theories, backed by empirical evidence from nominal (...) kinds studies, natural-kinds studies, and studies of fundamental categorical distinctions. He shows that all this evidence, when put together, leads to a better understanding of semantic and conceptual development. The book opens with an analysis of the problems of modeling qualitative changes in conceptual development, investigating how concepts of natural kinds, nominal kinds, and artifacts evolve. The studies on nominal kinds document a powerful and unambiguous developmental pattern indicating a shift from a reliance on global tabulations of characteristic features to what appears to be a small set of defining ones. The studies on natural kinds document an analogous shift toward a core theory instead of simple definition. Both sets of studies are strongly supported by cross cultural data. While these patterns seem to suggest that the young child organizes concepts according to characteristic features, Keil argues that there is a framework of conceptual categories and causal beliefs that enables even very young children to understand kinds at a deeper, theoretically guided, level. This account suggests a new way of understanding qualitative change and carries strong implications for how concepts are represented at any point in development. A Bradford Book. (shrink)

The Special Focus on invitation policy at universities contains a target article by Romy Jaster and Geert Keil, five commentaries, and a response. The question under discussion is what disqualifies a person from being invited to speak at a university. On liberal, Millian approaches, the epistemic benefits of free speech preclude no-platforming policies. More restrictive approaches demand the exclusion of speakers who are considered racist or otherwise hostile against marginalized groups. Jaster and Keil take a virtue-based approach to (...) invitation policy: A person is ineligible as a speaker if she exhibits specific intellectual vices that are detrimental to the pursuit of truth, the university’s raison d’être. The five critics raise various concerns. Birgit Recki deems the virtue-based approach too restrictive: It is prone to exclude some speakers who make intellectually stimulating contributions. Eva von Redecker and Daniel Loick deem the criterion too permissive: It allows for contributions that should have no place on campus. Dieter Schönecker and Maria-Sibylla Lotter object that the approach is silent on all recent actual cases of ‘cancelling’ at universities. Nun waren die Kardinäle, so bemerkt Keil frech, selbst keineswegs Träger der päpstlichen Unfehlbarkeit. »Woher wussten sie dann, dass der Papst unfehlbar ist?« Niemand weiß vorher, wann und wo er sich irren wird. Viele Philosophen haben daraus geschlossen, dass Menschen nichts wissen, sondern immer nur vermuten. Das ist aber ein Irrtum, den dieser kluge und kurzweilige Essay aufklärt.

The short paper continues a debate on free will, causation and laws of nature between the author and the German philosopher Peter Rohs (opened in a previous issue of the same journal). Both Keil and Rohs are libertarians, but they disagree on a number of metaphysical issues. Keil maintains that causation is a relation between changes, i.e. time-consuming events, not between instantaneous states. Against Davidson’s “principle of the nomological character of causality”, Keil holds that no exceptionless laws (...) subsuming cause-effect pairs exist. He further claims that the primary task of a philosophical theory of causality is to give truth conditions for uncontroversial instances of singular causal statements. This is an exercise in descriptive metaphysics. Causality’s place in advanced physics, by contrast, remains precarious. The paper closes with the incompatibilist claim that deterministic causality, unlike real-world causality, cannot be reconciled with free will. (shrink)

Although the field of surgical ethics focuses primarily on informed consent, surgical decision‐making, and research ethics, some surgeons have started to consider ethical questions regarding justice and solidarity with poor and minoritized populations. To date, those calling for social justice in surgical care have emphasized increased diversity within the ranks of the surgical profession. This article, in contrast, foregrounds the agency of those most affected by injustice by bringing to bear an ethic of accompaniment. The ethic of accompaniment is born (...) from a theological tradition that has motivated work to improve health outcomes in those at the margins through its emphasis on listening, solidarity against systemic drivers of disease, and proximity to individuals and communities. Through a review of surgical ethics and exploration of a central patient case, we argue for applying an ethic of accompaniment to the care of surgical patients and their communities. (shrink)

Adherence to professional ethics in nursing is fundamental for high-quality ethical care. However, analysis of the use and impact of nurses’ codes of ethics as a part of professional ethics is limited. To fill this gap in knowledge, the aim of our review was to describe the use and impact of the Code of Ethics for Nurses with Interpretive Statements published by the American Nurses Association as an example of one of the earliest and most extensive codes of ethics for (...) nurses with their interpretative statements and constituting a strong basis for the International Council of Nurses’ Code of Ethics for Nurses. We based our review on previous literature using a scoping review method. We included both non-scientific and scientific publications to provide an analysis of codes of ethics which can be utilized in development and revision of other nurses’ codes of ethics. In the searches, we used CINAHL and PubMed databases limiting publications to texts with a connection to the Code of Ethics for Nurses published from January 2001 to November 2022 and written in English. Searches yielded 1739 references, from which 785 non-scientific and 71 scientific publications were included for analysis of the data. Although non-scientific and scientific publications addressed different number of categories, the results indicated that in the both groups the use and impact focused on professional ethics, nursing practice, and work environment and less on education, research, or social health issues. Nurses’ ethical standards were not addressed in non-scientific publications, and clinical issues and leadership were not in focus in scientific publications. To increase evidence-based knowledge of the impact of codes of ethics additional research is needed. Good scientific conduct was followed. (shrink)

This book surveys recent debates on freedom of will, incorporating the implications of modern brain research. The author develops an original, capability-based conception of freedom of will. Geert Keil proposes that the well-understood capability for deciding one way or another is reconcilable with the findings of empirical science, but not with the metaphysical doctrine of determinism.

Können Personen im Wortsinne die Ursache von etwas sein? Wer die Frage bejaht, möge ein Akteurskausalist heißen. Ereigniskausalisten hingegen lassen als Relata der Kausalrelation allein Ereignisse zu. Manche Akteurskausalisten, allen voran Kant und Chisholm, fassen die Verursachung durch Handelnde als eine Kausalität sui generis auf, die der gewöhnlichen Ereigniskausalität gleichberechtigt zur Seite zu stellen sei. Andere Akteurskausalisten, beispielsweise Aristoteles, scheinen lediglich eine liberalere Auffassung möglicher kausaler Relata zu haben, ohne für Akteure eine besondere Verursachungsart vorzusehen. Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

If folk science means individuals having well worked out mechanistic theories of the workings of the world, then it is not feasible. Laypeople’s explanatory understandings are remarkably coarse, full of gaps, and often full of inconsistencies. Even worse, most people overestimate their own understandings. Yet recent views suggest that formal scientists may not be so different. In spite of these limitations, science somehow works and its success offers hope for the feasibility of folk science as well. The success of science (...) arises from the ways in which scientists learn to leverage understandings in other minds and to outsource explanatory work through sophisticated methods of deference and simplification of complex systems. Three studies ask whether analogous processes might be present not only in laypeople but also in young children and thereby form a foundation for supplementing explanatory understandings almost from the start of our first attempts to make sense of the world. With Amartya Sen she developed the capabilities approach to human well-being, which helped shape the UN’s Human Development Index. She is Ernst Freund Distinguished Service Professor of Law and Ethics at the University of Chicago.

Several current theories have essences as primary drivers of inductive potential: e.g., people infer dogs share properties because they share essences. We investigated the possibility that people take occupational roles as having robust inductive potential because of a different source: their position in stable social institutions. In Studies 1–4, participants learned a novel property about a target, and then decided whether two new individuals had the property (one with the same occupation, one without). Participants used occupational roles to robustly generalize (...) rights and obligations, functional behaviors, personality traits, and skills. In Studies 5–6, we contrasted occupational roles (via label) with race/gender (via visual face cues). Participants reliably favored occupational roles over race/gender for generalizing rights and obligations, functional behaviors, personality traits, and skills (they favored race/gender for inferring leisure behaviors and physiological properties). Occupational roles supported inferences to the same extent as animal categories (Studies 4 and 6). In Study 7, we examined why members of occupational roles share properties. Participants did not attribute the inductive potential of occupational roles to essences, they attributed it to social institutions. In combination, these seven studies demonstrate that any theory of inductive potential must pluralistically allow for both essences and social institutions to form the basis of inductive potential. Philoctetes was a good man and a good soldier. When he was on his way to Troy to fight alongside the Greeks, he had a terrible misfortune. By sheer accident he trespassed in a sacred precinct on the island of Lemnos. As punishment he was bitten on the foot by the serpent who guarded the shrine. His foot began to ooze with foul-smelling pus, and the pain made him cry out curses that spoiled the other soldiers' religious observances. They therefore (...) left him alone on the island, a lame man with no resources but his bow and arrows, no friends but the animals who were also his food. Ten years later, according to Sophocles' version of the story, they come to bring him back: for they have learned that they cannot win the war without him. The leaders of the expedition think of Philoctetes as a tool of their purposes; they plan to trick him into returning, with no empathy for his plight. The Chorus of soldiers, however, has a different response. Even before they see the man, they imagine vividly what it is like to be him– and they enter a protest against the callousness of the commanders: For my part, I pity him– thinking of how, with no living soul to care for him, seeing no friendly face, wretched, always alone, he suffers with a fierce affliction, and has no resources to meet his daily needs. Vague expressions are omnipresent in natural language. As such, their use in legal texts is virtually inevitable. If a law contains vague terms, the question whether it applies to a particular case often lacks a clear answer. One of the fundamental pillars of the rule of law is legal certainty. The determinacy of the law enables people to use it as a guide and places judges in the position to decide impartially. Vagueness poses a threat to these ideals. In borderline (...) cases, the law seems to be indeterminate and thus incapable of serving its core rule of law value. -/- In the philosophy of language, vagueness has become one of the hottest topics of the last two decades. Linguists and philosophers have investigated what distinguishes "soritical " vagueness from other kinds of linguistic indeterminacy, such as ambiguity, generality, open texture, and family resemblance concepts. There is a vast literature that discusses the logical, semantic, pragmatic, and epistemic aspects of these phenomena. Legal theory has hitherto paid little attention to the differences between the various kinds of linguistic indeterminacy that are grouped under the heading of "vagueness ", let alone to the various theories that try to account for these phenomena. -/- The paper is an introduction to a book of the same title. Bringing together leading scholars working on the topic of vagueness in philosophy and in law, the book fosters a dialogue between philosophers and legal scholars by examining how philosophers conceive legal ambiguity from their theoretical perspective and how legal theorists make use of philosophical theories of vagueness. In this critique, Martha Nussbaum argues that our dominant theories of development have given us policies that ignore our most basic human needs for dignity and self-respect.

Tanto la filosofía como la literatura, en cuanto búsquedas de la verdad, de respuestas frente a un núcleo de preguntas vitales, recurren a una estructura formal que necesariamente es la expresión de una actitud frente a la vida. Se plantea que la forma literaria no puede separarse del contenido filosófico, pues es el resultado de una indagación que intenta dar respuestas a asuntos particulares sobre la vida humana, así como el contenido filosófico halla expresión en una estructura formal que transmite (...) un sentido de la vida. La forma y el contenido no pueden separarse sin fracturar la visión de la vida que ofrecen tanto el texto literario como el texto filosófico. Sin embargo ¿cómo escribir, qué formas, qué estructuras, qué lenguaje utilizar para hablar de asuntos tan particulares como el amor? ¿Hasta dónde es posible escribir filosóficamente sobre la vida y sus interrogantes particulares? ¿Cuáles han sido los aportes de la literatura en la búsqueda de visiones alternativas frente a la experiencia humana? Tal es el punto de partida en la elaboración de este ensayo que intenta, por lo demás, concederle a la literatura y a sus formas de expresión, un lugar más central en el campo de la reflexión sobre el sentido de la vida y otros interrogantes importantes acerca de los asuntos humanos. In this major book Martha Nussbaum, one of the most innovative and influential philosophical voices of our time, proposes a kind of feminism that is genuinely international, argues for an ethical underpinning to all thought about development planning and public policy, and dramatically moves beyond the abstractions of economists and philosophers to embed thought about justice in the concrete reality of the struggles of poor women. Nussbaum argues that international political and economic thought must be sensitive to gender difference (...) as a problem of justice, and that feminist thought must begin to focus on the problems of women in the third world. Taking as her point of departure the predicament of poor women in India, she shows how philosophy should undergird basic constitutional principles that should be respected and implemented by all governments, and used as a comparative measure of quality of life across nations. El presente trabajo busca generar en el lector la inquietud acerca de la relevancia, actualidad y necesidad material respecto a políticas públicas que profundicen y hagan realidad el Estado social de derecho, establecido por el constituyente en la Constitución de 1991 en Colombia. A pesar de los treinta años de su promulgación y frente a los aún no resueltos problemas de inequidad y de amplios cinturones de pobreza que viven algunos sectores del país (situación que impacta en la convivencia y (...) equilibrio social), se hace necesario establecer políticas públicas que afiancen los postulados constitucionales de convivencia pacífica, de prosperidad general, entre otros; es necesario establecerlas hoy más que nunca, toda vez que la crisis sobreviniente, generada por el covid-19, ha llevado el país a unos niveles inusitados de desempleo y pobreza. Se considera que las directrices que emanan del Estado social de derecho, adoptado por la Constitución de 1991, son una buena herramienta para combatir tanto los problemas propios de la crisis como los históricos flagelos que todavía experimenta la nación y lo ponen al borde del inicio de otra crisis institucional. Theories of social justice are necessarily abstract, reaching beyond the particular and the immediate to the general and the timeless. Yet such theories, addressing the world and its problems, must respond to the real and changing dilemmas of the day. A brilliant work of practical philosophy, Frontiers of Justice is dedicated to this proposition. Taking up three urgent problems of social justice neglected by current theories and thus harder to tackle in practical terms and everyday life, Martha Nussbaum seeks (...) a theory of social justice that can guide us to a richer, more responsive approach to social cooperation. The idea of the social contract--especially as developed in the work of John Rawls--is one of the most powerful approaches to social justice in the Western tradition. But as Nussbaum demonstrates, even Rawls's theory, suggesting a contract for mutual advantage among approximate equals, cannot address questions of social justice posed by unequal parties. How, for instance, can we extend the equal rights of citizenship--education, health care, political rights and liberties--to those with physical and mental disabilities? How can we extend justice and dignified life conditions to all citizens of the world? And how, finally, can we bring our treatment of nonhuman animals into our notions of social justice? Emotions shape the landscape of our mental and social lives. Like geological upheavals in a landscape, they mark our lives as uneven, uncertain and prone to reversal. Are they simply, as some have claimed, animal energies or impulses with no connection to our thoughts? Or are they rather suffused with intelligence and discernment, and thus a source of deep awareness and understanding? In this compelling book, Martha C. Nussbaum presents a powerful argument for treating emotions not as alien forces (...) but as highly discriminating responses to what is of value and importance.
