Background Dynamic consent has been proposed as a process through which participants and patients can gain more control over how their data and samples, donated for biomedical research, are used, resulting in greater trust in researchers. It is also a way to respond to evolving data protection frameworks and new legislation. Others argue that the broad consent currently used in biobank research is ethically robust. Little empirical research with cohort study participants has been published. This research investigated the participants’ opinions (...) of adding a dynamic consent interface to their existing study. Methods Adult participants in the Extended Cohort for E-health, Environment and DNA longitudinal cohort study who are members of the EXCEED Public and Participant Engagement Group were recruited. Four focus groups were conducted and analysed for thematic content. Discussion topics were derived from a review of the current literature on dynamic consent. Results Participants were in favour of many aspects of a dynamic consent interface, such as being able to update their information, add additional data to their records and choose withdrawal options. They were supportive provided it was simple to use and not intrusive. Participants expressed a markedly high level of trust in the study and its investigators and were unanimously happy with their current participation. No strong support was found for adding a dynamic consent interface to EXCEED. Conclusions Trust in the study researchers was the strongest theme found. Openness and good data security were needed to retain their trust. While happy to discuss dynamic consent, participants were satisfied with the current study arrangements. There were indications that changing the study might unnecessarily disturb their trust. This raised the question of whether there are contexts where dynamic consent is more appropriate than others. This study was limited by the small number of participants who were committed to the study and biased towards it. More research is needed to fully understand the potential impact of adding a dynamic consent interface to an existing cohort study. (shrink)

As the General Medical Council (GMC) is currently in the process of reviewing its ethical guidance on confidentiality, it is a prescient time to consider the legal and ethical issues inherent in it. This paper examines the question of anonymized data, and highlights the fact that the legal position regarding whether it should be classed as confidential is unclear, with the possibility of a change in the law being very real. Indeed, the article argues that the notion that anonymized data (...) is not confidential can be challenged on both legal and ethical grounds, and thus that the GMC should take this into account in its new guidance. Although identifying the fact that this might have implications for epidemiological research, the article highlights an alternative approach that would allow the conduct of such research while not infringing patients' legally protected human rights. In the United Kingdom, the question of how much information is required to be given to patients about the benefits and risks of proposed treatment remains extant. Issues about whether healthcare resources can accommodate extended shared decision-making processes are yet to be resolved. COVID-19 has now stepped into this arena of uncertainty, adding more complexity. U.K. public health responses to the pandemic raise important questions about professional standards regarding how the obtaining and recording of consent might change or be maintained (...) in such emergency conditions, particularly in settings where equipment, medicines, and appropriately trained or specialized staff are in short supply. Such conditions have important implications for the professional capacity and knowledge available to discuss the risks and benefits of and alternatives to proposed treatment with patients. The government’s drive to expedite the recruitment to wards of medical students nearing the end of their studies, as well as inviting retired practitioners back into practice, raises questions about the ability of such healthcare providers to engage fully in shared decision-making.This article explores whether the legal duty on healthcare practitioners to disclose the material risks of a proposed medical treatment to a patient should be upheld during pandemic conditions or whether the pre-eminence of patient autonomy should be partly sacrificed in such exceptional circumstances. We argue that measures to protect public health and to respect autonomous decision-making are not mutually exclusive and that there are good reasons to maintain professional standards in obtaining consent to treatment even during acute pressures on public health systems. Hard cases make bad law. In a matter of months, two such cases involving assisted reproduction have appeared before the U.K. High Court and legislation has been enacted. The common threads between them are consent and fatherhood. The first case concerns a ‘mistake’ resulting in sperm from the wrong man being used to create an embryo for a couple and the second the revocation of consent by a man to his former partner being allowed to use an embryo they created (...) together. Furthermore, Parliament has intervened, passing legislation which sets out when sperm from a dead man may be used by his former partner to generate an embryo. This note argues that the three developments cannot be reconciled with one another and that the cases in particular, decided on a narrow legal basis, convey contradictory messages, leading in at least one instance to a gross injustice. In 2014, Lord Saatchi launched his ultimately unsuccessful Medical Innovation Bill in the UK. Its laudable aim was to free doctors from the shackles that prevented them from providing responsible innovative treatment. Lord Saatchi’s principal contention was that current law was the unsurmountable barrier that prevented clinicians from delivering innovative treatments to cancer patients when conventional options had failed. This was because doctors feared that they might be sued or tried and convicted of gross negligence manslaughter if they deviated from (...) standard practice. Concerns about fear of the law and potential negative effects on medical practice are not new. Fear of litigation has been suggested as the reason for doctors practising “defensive medicine,” by opting for treatments regarded as “grievance-resistant,” rather than clinically indicated, for example, by ordering diagnostic tests or performing certain procedures, which are not strictly medically necessary. Whilst this claim is plausible and apparently accepted by the courts, there is limited empirical evidence in support of it so far as practitioners in the UK are concerned. In this paper, we report on our empirical research which provides a snapshot of medical opinion to begin to rectify this gap. We ran focus groups of different medical specialties, asking what these medical practitioners thought the barriers to medical innovation to be. We found that fear of the law was not the principal barrier to be lowered, and that the answer was far more multifaceted. (shrink)

Philosophers have often argued that ascriptions of content are appropriate only to the personal level states of folk psychology. Against this, this paper defends the view that the familiar propositional attitudes and states defined over them are part of a larger set of cognitive proceses that do not make constitutive reference to concept possession. It does this by showing that states with nonconceptual content exist both in perceptual experience and in subpersonal information-processing systems. What makes these states content-involving is their (...) satisfaction of certain basic conditions deriving from a general account of representation-driven behaviour that is neutral on the question of concept possession. Education is essential to life, and the epidemic affected everything. Parents want to get their kids the most important teaching. However, since COVID-19 has affected schools and other institutions, providing education has become the most significant issue. Online learning pedagogy uses technology to provide high-quality learning environments for student-centered learning. Further, this study explores the experiences and challenges faced by Filipino tertiary students regarding the lack of gadgets amidst online learning. Employing the Interpretative Phenomenological Analysis, the findings of this study (...) were: Some college students still have difficulty with online learning. Attending online classes is difficult, especially for students with limited resources. Smartphones, other gadgets, and internet connections play a significant role in online classrooms because they are the ones that students utilize while learning online, which is essential for successful participation in online higher education as well as for solving a variety of other difficulties in the new normal. Further, College students face similar health challenges. Having an online learning setup is not just about students' struggles with learning resources but also about their health issues. When our respondents used their smartphones for an extended period, they reported eye aches and blurred vision. They also said that some of their body parts, such as their legs and back, are aching, and feel pressured because they tend to overthink things in their surroundings, which causes them incredible difficulty in performing their best in attending online classes. Even though college students continue to suffer from a lack of learning resources during online sessions, they do their best to manage their needs and the scarcity of learning resources. Students have unique coping methods for dealing with difficulties in online classes. (shrink)

Evolutionary game theory and public goods games offer an important framework to understand cooperation during pandemics. From this perspective, the COVID-19 situation can be conceptualized as a dilemma where people who neglect safety precautions act as free riders, because they get to enjoy the benefits of decreased health risk from others’ compliance with policies despite not contributing to or even undermining public safety themselves. At the same time, humans appear to carry a suite of evolved psychological mechanisms aimed at curbing (...) free riding in order to ensure the continued provision of public goods, which can be leveraged to develop more effective measures to promote compliance with regulations. We also highlight factors beyond free riding that reduce compliance rates, such as the emergence of conspiratorial thinking, which seriously undermine the effectiveness of measures to suppress free riding. Together, the current paper outlines the social dynamics that occur in public goods dilemmas involving the spread of infectious disease, highlights the utility and limits of evolutionary game-theoretic approaches for COVID-19 management, and suggests novel directions based on emerging challenges to cooperation. What information do corporations disclose on their websites? This paper investigates the environmental management policies and practices of the 200 largest corporations in the world. The author challenges the view that birth cannot be a morally relevant fact in the process of development from zygote to child. He reviews specific arguments against giving any moral significance to the fact of birth. Drawing on recent work in developmental psychology, he contends that the lives of neonates can have a level of self-consciousness that confers moral significance but can only be possessed after birth. He shows that the position he has argued for provides a framework within which (...) the move from the moral validity of aborting sentient fetuses to the moral validity of infanticide might be resisted. I discuss the account of logical consequence advanced in Wittgenstein's Tractatus. I argue that the role that elementary propositions are meant to play in this account can be used to explain two remarkable features that Wittgenstein ascribes to them: that they are logically independent from one another and that their components refer to simple objects. I end with a proposal as to how to understand Wittgenstein's claim that all propositions can be analysed as truth functions of elementary propositions.

This paper aims to deepen our understanding of so-called covert dogwhistles. I discuss whether a covert dogwhistle is a specific sort of mechanism of manipulation or whether, on the contrary, it draws on other already familiar linguistic mechanisms such as implicatures or presuppositions. I put forward a series of arguments aimed at illustrating that implicatures and presuppositions, on the one hand, and covert dogwhistles, on the other, differ in their linguistic behaviour concerning plausible deniability, cancellability, calculability and mutual acceptance. Scholars have long debated whether leader's integrity affects managerial decision making with respect to social responsibility. In this paper, we propose a model in which transformational leadership mediates integrity and corporate social responsibility and examine the relationship between these concepts. A survey of 170 senior managers from 50 organizations was conducted. Results indicate that integrity is a predictor of transformational leadership behavior and that transformational leaders’ behaviors are linked to CSR practices. It was also found that leaders rated with higher (...) integrity are engaged in CSR because they exhibit more transformational leadership behaviors. These findings add to the extant literature by demonstrating that integrity is important as transformational leaders engage more actively on ‘responsible’ behaviors. Practical implications call for an understanding among corporate leaders of the benefits of integrity and how it relates to transformational leadership. Organizations can improve their selection and leadership development processes by focusing on these two dimensions. (shrink)

Each science has its own domain of investigation, but one and the same science can be formalized in different languages with different universes of discourse. The concept of the domain of a science and the concept of the universe of discourse of a formalization of a science are distinct, although they often coincide in extension. In order to analyse the presuppositions and implications of choices of domain and universe, this article discusses the treatment of omega arguments in three very different (...) formalizations of arithmetic. In Peano's formalization the domain is a restricted class of individuals, while the universe of discourse is the unrestricted class of all individuals. In Gödel's formalization the domain is a restricted class of individuals as in Peano's formalization, but the universe of discourse coincides with the domain. In Whitehead-Russell's formalization the domain is a class of logical notions in Tarski's sense, that are necessarily not individuals, whereas the universe of discourse is the unrestricted class of individuals as in Peano's formalization. The present approach emphasizes the viewpoint that the universe of discourse of a given discourse is important in determining which propositions are expressed by which sentences. (shrink)

This article analyses the nature of mental imagery in metaphoric thought as envisaged by the contemporary theory of metaphor in Cognitive Linguistics (Lakoff, Cambridge University Press, 1993). Our study of metaphor in the field of marine biology draws on two crucial aspects of mental imagery, namely dynamicity and pervasiveness. Image metaphors and behaviour-based metaphors have generally been regarded as two different types of resemblance metaphor. In our view, the dynamicity of certain mental images highlights inherent similarities between these two types (...) of metaphor, and makes the differences between them more apparent than real. For this reason, we propose a more refined description of resemblance metaphors in terms of the static or dynamic nature of the mental images underlying them. Our study also underlines the fact that mental images permeate all classes of metaphor, and that the pervasiveness and dynamicity of mental images affords insights into both resemblance metaphors and non-resemblance metaphors. Como ponto de partida, é apresentada a crítica de Schopenhauer à compreensão empírica da morte como passagem ao não-ser. Passa-se, então às considerações do filósofo sobre a indestrutibilidade do nosso ser com a morte, por meio do destaque às suas considerações sobre o caráter de coisa, vinculado à sua intepretação das (...) ideias como formas eternas. Após discorrer pontualmente a respeito do sentido desta noção na filosofia platônica, são apresentados os principais elementos que configuram a apropriação schopenhaueriana da teoria platônica das ideias tendo em vista exclusivamente o problema elegido, qual seja, a morte e a indestrutibilidade do nosso ser. This article discusses two coextensive concepts of logical consequence that are implicit in the two fundamental logical practices of establishing validity and invalidity for premise-conclusion arguments. The premises and conclusion of an argument have information content (they ?say? something), and they have subject matter (they are ?about? something). The asymmetry between establishing validity and establishing invalidity has long been noted: validity is established through an information-processing procedure exhibiting a step-by-step deduction of the conclusion from the premise-set. Invalidity is established by (...) exhibiting a countermodel satisfying the premises but not the conclusion. The process of establishing validity focuses on information content; the process of establishing invalidity focuses on subject matter. Corcoran's information-theoretic concept of logical consequence corresponds to the former. Tarski's model-theoretic concept of logical consequence formulated in his famous 1936 no-countermodels definition corresponds to the latter. Both are found to be indispensable for understanding the rationale of the deductive method and each complements the other. This study discusses the ontic question of the nature of logical consequence and the epistemic question of the human capabilities presupposed by practical applications of these two concepts as they make validity and invalidity accessible to human knowledge.
