Die Beitrage dieses Bandes gingen aus der interdisziplinaren Fachtagung -Was sind Regeln und was leisten sie?- hervor, die im Herbst 2009 im Alfried Krupp Wissenschaftskolleg Greifswald stattfand. Ziel der Tagung war es, die Begriffe Regel, Norm und Gesetz und verwandte Konzepte zu klaren und eine Ubersicht uber die unterschiedlichen Rollen und Funktionen dieser Begriffe in den verschiedenen Wissenschaftsdisziplinen zu gewinnen. Die unterschiedlichen Perspektiven der beteiligten Disziplinen auf das Thema -Regeln- - Philosophie, Psychologie, Soziologie, Wissenschaftstheorie, Entscheidungsforschung, Rechts-, Sozial-, Sprach- und Musikwissenschaft (...) - konnen dazu beitragen, traditionell festgefahrene Einseitigkeiten innerhalb der Disziplinen durch wechselseitige Korrektur und Inspiration zu uberwinden. Wie sich zeigt, ist Interdisziplinaritat dem Thema angemessen: Keine Disziplin vermag im Alleingang, der Vielfalt unterschiedlicher Regelarten und Regelfunktionen Herr zu werden.". (shrink)

Thomas Hobbes is held to be a radical critic of Aristotelian anthropology and social and political theory. This paper aims to refute this claim. Though there are some significant differences between Aristotle's and Hobbes' point of view, it is not true that Hobbes established a new paradigm of political thought.

"Nicht nur der Historische Materialismus ist uns insgeheim in Fleisch und Blut übergegangen, wie ich bereits behauptet habe. Wir sind durchaus auch latente Anhänger der guten alten Theorie vom Klassenkampf..." Mit diesem Buch liegt eine beachtenswerte Neuinterpretation zentraler Teile des Marxismus - der Marx'schen Geschichts- und Gesellschaftstheorie - vor. In einem ersten Schritt lässt Iorio Widersprüche und Mehrdeutigkeiten im Denken von Marx sichtbar werden. Es gelingt dem Autor jedoch, diese Widersprüche im Rahmen einer einheitlichen Theorie der Gesellschaft und des (...) gesellschaftlichen Wandels zu überwinden, die vor allem darum bemüht ist, eine tief greifende Spannung zwischen dem Historischen Materialismus und dem marxistischen Konzept des Klassenkampfes aufzulösen. Diese Auflösung zeigt, wie die über-individualistisch strukturalistischen Aspekte des Historischen Materialismus mit Marxens Überzeugung zu versöhnen sind, dass menschliche Individuen Gesellschaften konstituieren und selbst ihre Geschichte machen. Die Arbeit umfasst drei Teile. Im ersten Teil wird unter Bezug auf Edward McClennens Darstellung ein mutmaßliches Dilemma diskutiert, das einige Autoren im Fall des regelgeleiteten Handelns zu erkennen glauben. Dabei kommen zwar Ansätze zur Sprache, dieses Dilemma aufzuheben. Diese Lösungsansätze können jedoch nicht überzeugen. Im zweiten Teil wird eine Reihe unterschiedlicher Typen von Handlungs- und Entscheidungssituationen vor Augen geführt, in denen Regeln in verschiedenen Rollen von Bedeutung sind. Diese Rollen legen ein Verständnis vom Konzept der praktischen Regel nahe, das (...) mit demjenigen nicht harmoniert, das im ersten Teil die Diskussion bestimmte. Regeln dienen nicht der Funktion, Handelnde zu binden bzw. auf ein bestimmtes Tun hin zu verpflichten. Regeln haben vielmehr eine selektierende und die Akteure orientierende Funktion. In Anbetracht dieses Ergebnisses wird im dritten Teil gezeigt, dass das besagte Dilemma in der Realität nicht besteht und die Ansicht, dass es besteht, auf einem fragwürdigen Bild praktischer Regeln beruht. This paper contains four parts. Part one gives a general introduction to Marx′s philosophy, concentrating on his views concerning history, society and economy. Part two discusses some minor criticisms Marx puts forward against the capitalist system at several places in his work. Part three and four analyze Marx′s main line of attack against capitalism, which figures prominently in chapter one of his uncompleted study Capital. As can be shown, this main line of attack is as unconvincing as the minor criticisms (...) that are discussed in part two. Capitalist society may have many bad features. Capitalism, however, cannot be condemned for the reasons Marx thought to have found for condemnation. (shrink)

This paper discusses the claim found in several existentialist philosophers according to which agents are identical with their actions. First, I clarify the claim by pointing to some possible misunderstandings. Secondly, some consequences of this claim are spelled out which are important not only for existentialism but for contemporary theory of action. This discussion brings to light a severe inconsistency in the existentialist project. I argue that the claim can nevertheless serve as a starting point for an independent theory of (...) action. In this paper a distinction is made between the concept of social power and the more basic concept of power. Because the more basic concept is not a social or sociological notion, it is analysed with the tools of action theory. In light of this analysis the concept of social power can be seen in a new and revealing light. Additionally, a special version of social power comes into view. I dub this phaenomenon ‘meta-power’.

In a recently published book Peter Stemmers introduces an impressive theory of normativity, norms, conventions, and practical reasons that stands in the tradition of legal positivism. This paper recapitulates and discusses the main features of Stemmer’s theory. On the basis of this discussion an alternative account to Stemmer’s point of view is developed and defended. This account claims to be more systematic than the rival theory and, of course, more true to the facts.

ZusammenfassungDie bestehende Praxis der Allokation postmortaler Organspenden ist in mehrfacher Hinsicht ethisch bedenklich. Vor dem Hintergrund einer Kritik dieser Praxis fragt der Artikel, wie eine moralisch akzeptablere Verteilungspraxis aussehen könnte. Dabei wird herausgestellt, dass es sich bei der Verteilungsproblematik um ein Gerechtigkeitsproblem handelt, das keine allgemein konsensfähige Lösung zuzulassen scheint. Dies wird anhand der Gerechtigkeitstheorie von Rawls erläutert, deren Mängel zum Projekt einer realistischen Theorie der Politik führen. This essay argues that there is no obvious reason not to make money doing philosophy. Whether philosophical counselling is justified, however, dependson the practitioners of this service defining the benefit of that service.

After a short survey of some discussions in modern action theory and in the theory of explanation an alternative account of reasons for action is presented and explained. According to this alternative, not mental states of the agent but non-mental facts constitute reasons for action. Some ramifications of this view are discussed with special regard to the question of how to overcome the established dichotomy of subjective and objective rationality.

A study of the reasons why people act and the rules they follow in their actions shows what reasons and rules are: very different things. A rule per se is not a reason to follow the rule. From this assertion, social, moral and legal-philosophical and normative-theoretical conclusions can be drawn, which to a great extent give a new structure to practical philosophy. A conception of morality based on reasons and a conception of law based on rules fit into this structure.

BackgroundData processing of health research databases often requires a Data Protection Impact Assessment to evaluate the severity of the risk and the appropriateness of measures taken to comply with the European Union General Data Protection Regulation. We aimed to define and apply a comprehensive method for the evaluation of privacy, data governance and ethics among research networks involved in the EU Project Bridge Health.MethodsComputerised survey among associated partners of main EU Consortia, using a targeted instrument designed by the principal investigator (...) and progressively refined in collaboration with an international advisory panel. Descriptive measures using the percentage of adoption of privacy, data governance and ethical principles as main endpoints were used for the analysis and interpretation of the results.ResultsA total of 15 centres provided relevant information on the processing of sensitive data from 10 European countries. Major areas of concern were noted for: data linkage, access and accuracy of personal data and anonymisation procedures. A high variability was noted in the application of privacy principles.ConclusionsA comprehensive methodology of Privacy and Ethics Impact and Performance Assessment was successfully applied at international level. The method can help implementing the GDPR and expanding the scope of Data Protection Impact Assessment, so that the public benefit of the secondary use of health data could be well balanced with the respect of personal privacy. Through the whole history of mankind philosophers have taken pride in being reasonable agents. During the last decades Rüdiger Bittner, one of the internationally best renown german philosophers and winner of the Gottlob Frege award 2011, has developed a surprisingly different picture: We are much more part than master of the universe. The articles in the volume address this challenging view, illuminating and discussing it from various angles of practical philosophy including the aesthetics of film and theatre.

Aging is characterized by the decline and deterioration of functional cells and results in a wide variety of molecular damages and reduced physical and mental capacity. The knowledge on aging process is important because life expectancy is expected to rise until 2050. Aging cannot be considered a homogeneous process and includes different trajectories characterized by states of fitness, frailty, and disability. Frailty is a dynamic condition put between a normal functional state and disability, with reduced capacity to cope with stressors. (...) This geriatric syndrome affects physical, neuropsychological, and social domains and is driven by emotional and spiritual components. Sarcopenia is considered one of the determinants and the biological substrates of physical frailty. Physical and cognitive frailty are separately approached during daily clinical practice. The concept of motoric cognitive syndrome has partially changed this scenario, opening interesting windows toward future approaches. Thus, the purpose of this manuscript is to provide an excursus on current clinical practice, enforced by aneddoctical cases. The analysis of the current state of the art seems to support the urgent need of comprehensive organizational model incorporating physical and cognitive spheres in the same umbrella. (shrink)

‘One thing, however, seems certain: the manuscripts should be completely deciphered and transcribed, and studied as a group, as an individual manuscript, as an individual page (in many cases!), and then put in chronological order.For example: yesterday I carefully examined the results of the page by page transcription of the manuscripts of Daybreak. I drew a sort of diagram of all the aphorisms in Daybreak following their appearance in the different manuscripts. Neste artigo, propõe-se uma leitura das categorias no tratado aristotélico homônimo como um primeiro esboço de uma ontologia regional, centrada nas substâncias sensíveis. Tendo por foco substância, quantidade, qualidade, relativo, agir e sofrer, este trabalho busca expor as duas estratégias principais que Aristóteles parece empregar para chegar a uma lista das categorias: (a) características básicas, cuja satisfação ou não satisfação de cada uma determina a natureza categorial de cada item e (b) a propriedade única que caracteriza cada categoria em contraste (...) com todas as outras. São, então, feitas considerações para vincular esse primeiro esboço ontológico a temas discutidos nos livros Lambda e Zeta da Metafísica, de modo a sugerir as direções principais que a sua ontologia nova (e geral) seguirá ao evoluir para uma teoria unificada da substância. Two of the most well-known belief contraction operators are partial meet contractions (PMCs) and kernel contractions (KCs). In this paper we propose two new classes of contraction operators, namely the class of generalized partial meet contractions (GPMC) and the class of generalized kernel contractions (GKC), which strictly contain the classes of PMCs and of KCs, respectively. We identify some extra conditions that can be added to the definitions of GPMCs and of GKCs, which give rise to some interesting subclasses of (...) those classes of functions, namely the classes of extensional and of uniform GPMCs/GKCs. In the context of contractions on belief sets the classes of partial meet contractions, uniform GPMCs and extensional GPMCs are all identical. Nevertheless, when considered as operations on belief bases, the class of uniform GPMCs coincides with the class of partial meet contractions, but the extensional GPMCs constitute a new kind of belief base contraction functions whose characterizing postulate of irrelevance of syntax is extensionality—the same postulate of irrelevance of syntax which occurs in the classical axiomatic characterization of partial meet contractions for belief sets—rather than the postulate of uniformity—which is the irrelevance of syntax postulate used in the axiomatic characterization for partial meet contractions on belief bases. Analogous results are obtained regarding the classes of extensional and of uniform GKCs. We present the interrelations in the sense of inclusion among all the new classes of operators presented in this paper and several well known classes of PMCs and of KCs. (shrink)

Der Band verzeichnet erstmals sämtliche Werke und Noten aus Nietzsches persönlicher Bibliothek (BN) bis Anfang Januar 1889. Er listet sowohl die Bestände der Herzogin Anna Amalia Bibliothek als auch die des Goethe- und Schiller-Archivs in Weimar auf. Die kritische Analyse anderer Bestandslisten ermittelte zudem zahlreiche heute nicht mehr vorhandene Titel. Ferner wurden sämtliche Bücherrechnungen und -quittungen von Buchhändlern und Buchbindern ausgewertet, die im Goethe- und Schiller-Archiv aufbewahrt werden. Neben den ca. 2.200 Titeln aus Nietzsches rekonstruierter Bibliothek enthält der Band auch (...) ein Verzeichnis sämtlicher 'Lesespuren' Nietzsches (ca. 20.000), z.B. Anmerkungen, Unterstreichungen und Eselsohren. Ergänzt durch zahlreiche Faksimile-Reproduktionen sowie durch philosophische, historische und bibliographische Einführungen, stellt der Band ein unverzichtbares Arbeitsinstrument jeder zukünftigen Nietzsche-Forschung dar. O objetivo central deste estudo é fazer ressaltar as características dos conceitos de animismo, magia e feitiçaria a partir das perspectivas de Sigmund Freud e Bronislaw Malinowski. Em um primeiro momento, analisaremos o animismo. Em seguida, uma vez que as observações etnográficas de Malinowski divergem daquelas de Freud, examinaremos a magia e a feitiçaria com a finalidade de verificar não somente as divergências, mas também as convergências e as aproximações possíveis que existem entres estes dois pensadores e os próprios conceitos (...) entre si. Por fim, mostraremos o que está no centro dessas análises e quais são as razões que fundamentam esses métodos e as resistências que eles podem suscitar. (shrink)

Popper’s theory of World 3 is often regarded as incongruent with his defense of methodological individualism. This article criticizes this widespread view. Methodological individualism is said to be at odds with three crucial assumptions of the theory of World 3: the impossibility of reducing World 3 to subjective mental states because it exists objectively, the view that the mental functions cannot be explained by assuming that individuals are isolated atoms, and the idea that World 3 has causal power and influences (...) both individual minds and actions. This article demonstrates that the inconsistency thesis stems from a confusion between methodological individualism as understood by Popper and reductionism. The reasons for this confusion are analyzed and clarified. It is argued that two variants of methodological individualism can be distinguished, and that unlike psychologistic individualism, Popper’s nonatomistic individualism is fully consistent with his theory of World 3. Why are mistaken beliefs about COVID-19 so prevalent? Political identity, education and other demographic variables explain only part of the differences between people in their susceptibility to COVID-19 misinformation. This paper focuses on another explanation: epistemic vice. Epistemic vices are character traits that interfere with acquiring, maintaining, and transmitting knowledge. If the basic assumption of vice epistemology is right, then people with epistemic vices such as indifference to the truth or rigidity in their belief structures will tend to be more (...) susceptible to believing COVID-19 misinformation. We carried out an observational study (US adult sample, n = 998) in which we measured the level of epistemic vice of participants using a novel Epistemic Vice Scale that captures features of the current competing analyses of epistemic vice in the literature. We also asked participants questions eliciting the extent to which they subscribe to myths and misinformation about COVID-19. We find overwhelming evidence to the effect that epistemic vice is associated with susceptibility to COVID-19 misinformation. In fact, the association turns out to be stronger than with political identity, educational attainment, scores on the Cognitive Reflection Test, personality, dogmatism, and need for closure. We conclude that this offers evidence in favor of the empirical presuppositions of vice epistemology. (shrink)

Dare una risposta univoca e coerente è assai difficile; il Buddhismo infatti si concretizza in una molteplicità di scuole e dottrine caratterizzate da complesse logiche e metafisiche. Ci sono tuttavia delle indicazioni minimali che fungono da denominator comune per chi si accosta alla meditazione. Esse riguardano soprattutto l’assenza di punti di vista determinati, l’esperienza del tempo e la relazione di dipendenza reciproca di ogni cosa con ogni altra. Utilizzando gli strumenti della (...) filosofia analitica, questo libro propone una interpretazione dei princìpi basilari che guidano la meditazione buddhista, facendo leva sulle potenzialità del senso comune, inteso non semplicemente come l’opinione generica della maggioranza – troppo spesso già infarcita di presupposti metafisici discutibili - bensì come insieme di credenze che tutti noi possediamo, ma di cui non sempre siamo consapevoli. Part of this process will be carried out with the discussion of communicative action, as a space for dialogue between people seeking understanding. The process of new forms of understanding and construction of knowledge is possible through the integrative structure of the lifeworld, such as semantic dimension, social space, and historical time. However, there is the other side, the (...) Systems, where the manifestations of crisis and disturbances, the pathologies of society, which in cultural reproduction appear as a loss of meaning of culture, loss of legitimacy of society and in personality, there is a crisis of belonging. The Oscar Wilde trials (1895) have usually been interpreted either as a historical document which gives insight into the regulation of sexuality in the late nineteenth century, or as literary biography explicating the playwright's life and works. Taking its cue from recent scholarship in ‘law and literature’, and also from Wilde's own conception of the relationship between art and life, this article proposes a reading of the trials which blurs the distinction between legal history and literary criticism by considering them (...) as a form of literature. It argues that the trial transcripts enact and reflect Wilde's vision of what literature is and how it should be read, and as such should be given a place amongst his literary works, alongside such aesthetic manifestos as ‘The Decay of Lying’ and ‘The Critic as Artist’.
