Recently, John Doe, an undocumented immigrant who was detained by United States Immigration and Customs Enforcement, was admitted to a hospital off-site from a detention facility. Custodial officers accompanied Mr. Doe into the exam room and refused to leave as physicians examined him. In this analysis, we examine the ethical dilemmas this case brings to light concerning the treatment of patients in immigration detention and their rights to privacy. We analyze what US law and immigration detention standards allow regarding immigration (...) enforcement or custodial officers’ presence in medical exams and documentation of detainee health information. We describe the ethical implications of the presence of officers in medical exam rooms, including its effects on the quality of the patient-provider relationship, patient privacy and confidentiality, and provider's ability to provide ethical care. We conclude that the presence of immigration enforcement or custodial officers during medical examination of detainees is a breach of the right to privacy of detainees who are not an obvious threat to the public. We urge ICE and the US Department of Homeland Security to clarify standards for and tighten enforcement around when officers are legally allowed to be stationed in medical exam rooms and document detainees’ information. In this volume, Engeström's work is used as a springboard to reflect on the question of the use, appropriation, and further development of the classic heritage within activity theory.

Is the societal-level of analysis sufficient today to understand the values of those in the global workforce? Or are individual-level analyses more appropriate for assessing the influence of values on ethical behaviors across country workforces? Using multi-level analyses for a 48-society sample, we test the utility of both the societal-level and individual-level dimensions of collectivism and individualism values for predicting ethical behaviors of business professionals. Our values-based behavioral analysis indicates that values at the individual-level make a more significant contribution to (...) explaining variance in ethical behaviors than do values at the societal-level. Implicitly, our findings question the soundness of using societal-level values measures. Implications for international business research are discussed. (shrink)

The return of genetic research results after death in the pediatric setting comes with unique complexities. Researchers must determine which results and through which processes results are returned. This paper discusses the experience over 15 years in pediatric cancer genetics research of returning research results after the death of a child and proposes a preventive ethics approach to protocol development in order to improve the quality of return of results in pediatric genomic settings.

Five different Latin American experiences help us to understand the impacts of corporate social responsibility on communities. We focus on communities composed of low-income populations to compare types of interventions, their main characteristics, spaces for community participation, and some results and impacts. Some of the findings indicate that (a) a company’s enlightened self-interest in its CSR program ensures its commitment to the program and the program’s sustainability; (b) community involvement from the outset in defining a project increases the probability of (...) success, since corporations cannot assume they understand the needs of a community by taking them at face value; (c) projects do not create untenable expectations in local communities when they consider the whole life cycle and the sustainability of the investment after an appropriate exit strategy is executed; and (d) financial resources are only part of the equation because corporations can have enormous impacts with limited financing if programs are well defined and supported. The -trees allow a compact representation for negation normal forms as well as for a number of reduction strategies in order to consider only those occurrences of literals which are relevant for the satisfiability of the input formula. These reduction strategies are divided into two subsets (meaning- and satisfiability-preserving transformations) and can be used to decrease the size of a negation normal form A (...) at (at most) quadratic cost. The reduction strategies are aimed at decreasing the number of required branchings and, therefore, these strategies allow to limit the size of the search space for the SAT problem. (shrink)

Rationale, aims and objectives Given the increasing prevalence of cataract and demand for cataract extraction surgery, patients must often wait to undergo this procedure. We validated a previously developed priority scoring system in terms of clinical variables, pre-intervention health status, appropriateness of surgery and gain in visual acuity (VA) and health-related quality of life (HRQoL).Methods Explicit prioritization criteria for cataract extraction created by a variation of the Research and Development (RAND) and University of California Los Angeles appropriateness methodology were retrospectively (...) applied to a prospective cohort of 5257 patients on waiting lists to undergo cataract by phacoemulsification at 17 hospitals in Spain. Demographic data, clinical data and data related to surgical technique were collected by trained ophthalmologists. Patients were evaluated by their ophthalmologist before the intervention and 6 weeks afterward. They also completed, by mail, the Visual Function Index (VF-14) before the intervention and 3 months afterward.Results High-priority patients experienced greater improvement in VA and HRQoL than those classified as intermediate or low-priority (P < 0.0001), even after adjusting by VA and the VF-14 score at baseline. The time to intervention was the same for high-priority patients as it was for intermediate and low-priority patients.Conclusions The priority score we developed identified patients most likely to experience the greatest improvements from cataract extraction. Use of this tool could provide a fairer and more rational way to prioritize patients for cataract extraction. (shrink)

This paper is a response to Haze’s brief argument for the falsity of the theory that instantial terms refer arbitrarily, proposed by Breckenridge and Magidor in 2012. In this paper, I characterise instantial terms and outline the theory of arbitrary reference; then I reconstruct Haze’s argument and contend that it fails in its purpose. Haze’s argument is supposed to be a _reductio ad absurdum:_ according to Haze, it proves that a contradiction follows from the most basic tenets of the theory (...) of arbitrary reference. I will argue, however, that the contradiction in question follows not from these tenets, but from the surreptitious use that Haze makes of a self-referential expression. I conclude, consequently, that Haze’s argument is nothing more than an illustration of the well-known fact that self-referential expressions produce paradoxical results. (shrink)

There are compelling reasons to believe that musical works are abstract. However, this hypothesis conflicts with the platitude that musical works are appreciated by means of audition: the things that enter our ear canals and make our eardrums vibrate must be concrete, so how can musical works be listened to if they are abstract? This question constitutes the audibility problem. In this paper, I assess Julian Dodd’s elaborate attempt to solve it, and contend that Dodd’s attempt is unsuccessful. Then I (...) discuss what I take to be the ideal response to the audibility problem, and show that it ultimately fails. I contend, consequently, that the project of construing musical works as audible is disheartening. Accordingly, in my last section, I will argue the audibility problem may be satisfactorily resolved without ascribing audibility to musical works. (shrink)

In this paper I suggest that in order to avoid some of the difficulties to which the contemporary discussion on the transcendental arguments has led we must discriminate different ways of understanding the sceptic’s challenge that Kant faces in the Critique of Pure Reason. In the first part, I expound a dilemma into which the Kantian epistemology could fall if we accept the characterization of the transcendental arguments as anti-sceptic arguments. This chapter explores the debate between contemporary projectivists or expressivists, and the advocates of sensibility theory. Both positions are best viewed as forms of sentimentalism — the theory that evaluative concepts must be explicated by appeal to the sentiments. It argues that the sophisticated interpretation of such notions as “true” and “objective” that are offered by defenders of these competing views ultimately undermines the significance of their meta-ethical disputes over “cognitivism” and “realism” about value. Aunque una filosofía de la esperanza pareciera ser una propuesta del todo contemporánea (Bloch, Fromm, Husserl, Laín, Marcel, Heidegger, Patočka, Stein), sus esbozos tuvieron lugar en el siglo VI a.n.e. El objetivo principal de esta investigación es exponer los ejercicios preliminares en torno a una filosofía de la esperanza en el marco de la controversia de Heráclito con Pitágoras. Desde un enfoque cualitativo, mediante el método histórico hermenéutico, se hizo un análisis de datos. Como muestra tomamos fuentes primarias sobre los (...) Versos dorados de Pitágoras y los Fragmentos de Heráclito y como secundarias las traducciones y comentarios más reconocidos. El instrumento utilizado fue las fichas de trabajo mixtas. Como resultado, se observa que la esperanza es un problema para el pueblo griego, que en los vv. 52-53 de los Versos dorados y en el fragmento 22B 18 DK se encuentra esbozada como problema filosófico, que este se comprende mejor a partir de la crítica de Heráclito a Pitágoras y en relación con otros fragmentos clave del pensamiento del Efesio. La investigación permite concluir que la esperanza no es un tema exclusivo de la teología ni propiamente contemporáneo, sino inicialmente de la filosofía, que encuentra en el debate de Heráclito con Pitágoras sus formulaciones preliminares y un contexto propicio para problematizarla en su comprensión habitual, repensarla a la luz del espíritu del tiempo y resignificarla como forma-de-vida. In this article, we outline a simple and intuitively appealing procedure to derive default priors. The main idea is to regard the choice of such a prior as a formal Bayesian decision problem. We also discuss Jeffreys prior and more generally the reference prior of Bernardo (J R Stat Soc B 41:113–147, 1979) from this standpoint.

Este artículo explora desde una perspectiva filosófica la forma como la rostricidad está asociada al deseo y producción de subjetividad. De ahí que el campo de interés se centre en cómo dichas categorías tensionan la constitución subjetiva de los sujetos, a tal punto que inciden en la proyección de su propio trayecto biográfico.
