Fire safety expertise was in great demand following the Grenfell Tower fire in London in June 2017. The government established a review of building regulations and an expert panel to inform its responses to Grenfell, and many other relevant organisations also formed their own expert panels. However, expert knowledge in fire safety is a highly contested domain, with knowledge claims based on differing sources. Fire fighters can claim expertise based on their experience of fighting fires, scientists and science-based engineers can (...) claim expertise from experimentation, and those who create and enact regulations can claim expertise in what can termed ’codespeak’—the language of regulation. Although distanced from fundamental empirical experience of fire, codespeak is powerful because of its relative clarity and certainty, and legal status. Building users also bring their own form of ‘local’ expertise—they have first-hand experience of the practicalities of the solutions wrought by the other experts. Policy-makers thus face many competing forms of expert advice on fire safety, and their ability to judge what is most relevant in any particular case rests on the existence of a sufficient range and depth of in-house government expertise. Patient outcome after serious brain injury is highly variable. Following a period of coma, some patients recover while others progress into a vegetative state (unresponsive wakefulness syndrome) or minimally conscious state. In both cases, assessment is difficult and misdiagnosis may be as high as 43%. Recent advances in neuroimaging suggest a solution. Both functional magnetic resonance imaging and electroencephalography have been used to detect residual cognitive function in vegetative and minimally conscious patients. Neuroimaging may improve diagnosis and prognostication. These techniques (...) are beginning to be applied to comatose patients soon after injury. Evidence of preserved cognitive function may predict recovery, and this information would help families and health providers. Complex ethical issues arise due to the vulnerability of patients and families, difficulties interpreting negative results, restriction of communication to “yes” or “no” answers, and cost. We seek to investigate ethical issues in the use of neuroimaging in behaviorally nonresponsive patients who have suffered serious brain injury. The objectives of this research are to: (1) create an approach to capacity assessment using neuroimaging; (2) develop an ethics of welfare framework to guide considerations of quality of life; (3) explore the impact of neuroimaging on families; and, (4) analyze the ethics of the use of neuroimaging in comatose patients. We present a probabilistic extension to active path analyses of token causation. The extension uses the generalized notion of intervention presented in : we allow an intervention to set any probability distribution over the intervention variables, not just a single value. The resulting account can handle a wide range of examples. We do not claim the account is complete --- only that it fills an obvious gap in previous active-path approaches. It still succumbs to recent counterexamples by Hiddleston, because it (...) does not explicitly consider causal processes. We claim three benefits: a detailed comparison of three active-path approaches, a probabilistic extension for each, and an algorithmic formulation. (shrink)

Functional MRI shows promise as a candidate prognostication method in acutely comatose patients following severe brain injury. However, further research is needed before this technique becomes appropriate for clinical practice. Drawing on a clinical case, we investigate the process of obtaining informed consent for this kind of research and identify four ethical issues. After describing each issue, we propose potential solutions which would make a patient’s participation in research compatible with her rights and interests. First, we defend the need for (...) traditional proxy consent against two alternative approaches. Second, we examine the impact of the intensive care unit environment on the informed consent process. Third, we discuss the therapeutic misconception and its potential influence on informed consent. Finally, we deal with issues of timing in recruiting participants and related factors which may affect the risks of participation. (shrink)

This paper presents an attempt to integrate theories of causal processes—of the kind developed by Wesley Salmon and Phil Dowe—into a theory of causal models using Bayesian networks. We suggest that arcs in causal models must correspond to possible causal processes. Moreover, we suggest that when processes are rendered physically impossible by what occurs on distinct paths, the original model must be restricted by removing the relevant arc. These two techniques suffice to explain cases of late preëmption and other cases (...) that have proved problematic for causal models. (shrink)

Alan Montefiore offers preliminary analyses of the family of concepts most often invoked in discussions of these problems, taking the central dispute to be between those who hold a 'liberal' view of the university and those who regard this notion as illusory, dishonest (...) or undesirable. Randomized controlled trial trial designs exist on an explanatory-pragmatic spectrum, depending on the degree to which a study aims to address a question of efficacy or effectiveness. As conceptualized by Schwartz and Lellouch in 1967, an explanatory approach to trial design emphasizes hypothesis testing about the mechanisms of action of treatments under ideal conditions, whereas a pragmatic approach emphasizes testing effectiveness of two or more available treatments in real-world conditions. Interest in, and the number of, pragmatic trials has grown substantially (...) in recent years, with increased recognition by funders and stakeholders worldwide of the need for credible evidence to inform clinical decision-making. This increase has been accompanied by the onset of learning healthcare systems, as well as an increasing focus on patient-oriented research. However, pragmatic trials have ethical challenges that have not yet been identified or adequately characterized. The present study aims to explore the views of key stakeholders with respect to ethical issues raised by the design and conduct of pragmatic trials. It is embedded within a large, four-year project that seeks to develop guidance for the ethical design and conduct of pragmatic trials. As a first step, this study will address important gaps in the current empirical literature with respect to identifying a comprehensive range of ethical issues arising from the design and conduct of pragmatic trials. By opening up a broad range of topics for consideration within our parallel ethical analysis, we will extend the current debate, which has largely emphasized issues of consent, to the range of ethical considerations that may flow from specific design choices. Semi-structured interviews with key stakeholders, across multiple jurisdictions, identified based on their known experience and/or expertise with pragmatic trials. We expect that the study outputs will be of interest to a wide range of knowledge users including trialists, ethicists, research ethics committees, journal editors, regulators, healthcare policymakers, research funders and patient groups. Objectives: The objective of this post hoc exploratory analysis was to examine the relationship between age and measures of cortical excitability and inhibition. Methods: Forty-six participants (24 with major depressive disorder and 22 healthy controls) completed MT, SICI, ICF, and CSP testing in a cross-sectional protocol. Of these 46 participants, 33 completed LICI testing. Multiple linear robust regression and Spearman partial correlation coefficient were used to examine the relationship between age and the TMS measures. Results: In the overall sample of (...) 46 participants, age had a significant negative relationship with motor threshold in both the right (rs = -0.49, adjusted p =.007; β= -0.08, adjusted p=.001) and left (rs = -0.42, adjusted p =.029; β= -0.05, adjusted p=.004) hemispheres. This significant negative relationship of age with motor threshold was also observed in the sample of depressed youth in both the right (rs = -0.70, adjusted p =.002; β= -0.09, adjusted p=.001) and left (rs = -0.54, adjusted p =.034; β= -0.05, adjusted p=.017) hemispheres, but not in healthy controls. In the sample of the 33 participants who completed LICI testing, age had a significant negative relationship with LICI (200 millisecond interval) in both the right (rs = -0.48, adjusted p =.05; β= -0.24, adjusted p=.007) and left (rs = -0.64, adjusted p =.002; β= -0.23, adjusted p=.001) hemispheres. This negative relationship between age and LICI (200 millisecond interval) was also observed in depressed youth in both the right (rs = -0.76, adjusted p =.034; β= -0.35, adjusted p=.004) and left (rs = -0.92, adjusted p =.002; β= -0.25, adjusted p=.001) hemispheres. Conclusion: These findings suggest that younger children have higher motor thresholds. This is more pronounced in depressed youth than healthy controls. LICI inhibition may also increase with age in youth. (shrink)

This principle states that a person is psychologically healthy and well only if she or he acts in critical situations on preferences and desires that are responsibly in her or him rather than being (...) merely in her or him. Various analyses have been proposed of what it means for a desire or preference to be responsibly in a person—namely, that he or she identify with it or that the desire or preference be part of his or her wholehearted or decisive identity as a person. Harry Frankfurt (1988) has formulated a version of the principle in his accounts of personal caring and freedom of will. Charles Taylor (1976) has deployed a version of the principle in his account of self-assessment and personal redefinition. In this issue of Philosophy, Psychiatry, & Psychology, Mark Rego with deference to Frankfurt suggests how a responsible innerness principle (Rego does not name the principle as such, of course, because the neologism is my own) might be deployed in a therapeutic setting. In this brief commentary I explore an obvious commitment of the principle, namely that there is a difference between the responsible psychological inside of a person and both the mere (nonresponsible) inside and the outside. In connection with the presupposition I include some comments on Rego's thoughtful and suggestive paper.Individuating MeWhat individuates a person? What makes a person one person or individual as opposed to another person or individual?One hypothesis is that an individual person is individuated by their being a particular living human animal (see Olson 2003; Van Inwagen 1990). Mark Rego (the name) refers to one particular living human animal. George Graham (the name) refers to another. In my case an animalist (someone who holds that an individual human person is a particular living human animal) would say that I am nothing other than the six-foot tall living human animal whose photograph you would take if you were to take a picture of me writing this brief commentary. I am not an immaterial substance nor am I a composite made out of any such substance and this animal body (or some part of it). I am, instead, a biological being, made of biological parts—the organs, cells, and so forth of which living human animals are made.Although one might worry about just how animals themselves are individuated, it is not too hard to appreciate what philosophers (like Eric Olson and others) who favor animalism must be attracted to. The attraction of animalism is this: individuation requires limits or boundaries and, for animalism, whatever is in the animal as a proper part of its being alive therein is in the person, whereas whatever is outside of the animal therein is outside of the person. So, if I am a particular living human animal, and if something is in or out of me, this means it is inside or [End Page 323] outside, respectively, my living body. Various neurons are in me; the heavenly stars are out of me. Various information processes are in me; the athletic dispositions of the Boston Red Sox are out of me.Suppose animalism is true. Suppose I am nothing other than this particular six-foot tall living human animal. Suppose also that I have a mental health problem. Suppose I am a pathological gambler. Suppose, in addition, that I am under the care of a therapist. With her help I have learned various facts about my addiction: that it thrives on a variable ratio schedule of reinforcement, that it is strengthened by my quasi-prayerful invocations of a mythic figure I call "Lady Luck," and that it relieves albeit severely imprudently assorted stresses and strains in my professional career. Beginning from an earlier claim of mine that there was really no such area of study as the philosophy of sport, Part One of the paper reconsiders the place previously given to David Best’s distinction between purposive sports and aesthetic sports. In light of a famous cricketing event in the 1977 contest between England and Australia (‘The Ashes’), in which Derek Randall turned a cartwheel after taking the winning catch, the paper clarifies that not all aesthetically-pleasing events taking place in (...) sporting competitions can be understood as the aesthetic in sport. Then, in Part Two, the force of the claim that philosophy is one subject is explored. The conclusion is that a focus just on the philosophy of sport is necessarily inappropriate, since it will present the student with only cases from sport to then apply to sport. Rather, one’s understanding must be informed by (much of) the breadth of philosophy. Charles Travis’s view of occasion-sensitivity provides a clear example of appropriately contextual appeal. Part Three of the paper returns to the need for an institutional account of sport, one recognizing that there is no one occasion on which a particular sport is played; and hence no single set of conditions which can uniquely identify that sport. Thus, soccer played with one’s children typically differs from elite soccer: but both are (genuinely) soccer. When one turns to the appreciation of sport (in the light of Stephen Mumford’s excellent Watching Sport: Aesthetics, Ethics and Emotion [2012a]), one recognizes that, in order to genuinely appreciate sport, one cannot detach oneself from the outcome as completely as Mumford’s extreme purist seems to. But reflection on that case may also return us to contextualism by moving us away from attachments to the complete or the exceptionless in our accounts of spectating as of sport: maybe there is no one thing that occurs in all the relevant cases. Convinced that people shape their meanings from the meanings available to them, Graham Hughes inquires into liturgical constructions of meaning within the larger cultural context of late twentieth-century meaning theory. Major theories of meaning are examined in terms of their contribution or hindrance to this meaning making: analytic philosophy, phenomenology, structuralism and deconstruction. Charles Mills’s philosophical work provides a standpoint from which white philosophers can engage philosophical questions about race by demonstrating that the concept of race is relevant to the study of Western political philosophy, by developing the critical concept of white supremacy, and by critiquing the failure of liberal political philosophy to address the history of race-based chattel slavery in the US and the British empire. Nonetheless, the social contractarian methodology of Mills’s philosophical work is flawed because of its individualistic (...) social ontology, its reliance on structured ignorance rather than situated knowledge to attain objective knowledge about society, and its inability to fulfill its promise to generate a generalized account of race-related injustice that applies to all societies at all times.
