Background: Informed consent in clinical research is mandated throughout the world. Both patient subjects and investigators are required to understand and accept the distinction between research and treatment.Aim: To document the extent and to identify factors associated with therapeutic misconception in a population of patient subjects or parent proxies recruited from a variety of multicentre trials .Patients and methods: The study comprised two phases: the development of a questionnaire to assess the quality of informed consent and a survey of patient (...) subjects based on this questionnaire.Results: A total of 303 patient subjects or parent proxies were contacted and 279 questionnaires were analysed. The median age was 49.5 years, sex ratio was 1 and 61% of respondents were professionally active. Overall memorisation of the oral or written communication of informed consent was good , and satisfaction with the process was around 70%. Therapeutic misconception was present in 70% of respondents, who expected to receive better care and ignored the consequence of randomisation and treatment comparisons. This was positively associated with the acuteness and severity of the disease.Conclusion: The authors suggest that the risk of therapeutic misconception be specifically addressed in consent forms as an educational tool for both patients and investigators. While not neglecting the fruit of that (...) discussion, his framing of the question under the headings of “Gospel” and “Providence” opens a new vista that is evident in his opening question: “What theology of Providence is needed today for the Gospel of salvation?” (7).Although contemporary theology readily affirms the biblical proclamation of God’s universal offer of salvation, its account of God’s salvific action on behalf of each person has become “uncertain and problematic.” Discussions of divine “kenosis, self-limitation, retreat, and powerlessness” have led many to the conviction God’s action must somehow be “limited” (8). The result is the paradox of a limited God attempting to offer universal salvation. The remedy lies in the recovery of a correct understanding of “the sovereignty of God”—the God who acts not only in the “intimacy of human hearts” but also in and through the “happy and unhappy contingencies” of human life (8-9).Durand begins by placing the question of divine action in the context of contemporary theology and culture, considering first the relationship between divine and human action, then the question of God’s action in history, and finally the understanding of divine action that has surfaced in the dialogue between theology and science (chap. 1). His next task is to clarify the notion of “action” itself. This entails an account of analogy (chap. 2). The discussion then turns to the “creative reappropriation” (10) of three classical theologies of divine providence, those of St. Augustine, St. Thomas Aquinas, and John Henry Newman. This involves a careful consideration of the Confessions of Augustine, the Summa contra gentiles of Aquinas, and the sermons of Newman (chaps. 3-5).The flip side of the question of divine action is of course the problem of evil and why a God who is capable of overcoming evil does not do so. God’s action in the world is thought to diminish as humanity matures historically. The sovereign God gives place to the suffering God, who can act only through the actions of humans. The contemporary notion of history itself poses problems for divine action. It is difficult to affirm God’s saving and directing action in history, when history itself has lost its direction: “The loss of confidence in the intelligibility of history also jeopardizes the representation of God as sovereign, cause, author, director or guarantor of history” (29). Finally, the ability of science to explain natural events has led some to the conviction that there is simply no room for God to act in the world without interfering with the order of scientific laws. This chapter brings a philosophical perspective to the concept of stem cell. Three general questions both clarify the concept of stem cell and emphasize its ambiguities: (1) How should we define stem cells? (2) What makes them different from non-stem cells? (3) What is their ontology? (i.e. what kind of property is “stemness”?) Following this last question, the Chapter distinguishes four conceptions of stem cells and highlights their respective consequences for the cancer stem cell theory. Determining what kind of property (...) stemness is, in what context, is an urgent question, at least for therapeutic strategies against cancers. I hope that this chapter also illustrates how philosophy can be useful to biology. -/- The Chapter starts by clarifying the notions of self-renewal and differentiation. This leads to the question “can we (and if so, how) distinguish stem cells from non-stem cells through these two properties?”. From that will follow an interrogation on whether stem cells belong to a natural kind. On this issue, biologists and philosophers have framed the following alternative: either the concept of stem cell refers to entities (the cells that belong to the stem cell natural kind) or it refers to a transient and reversible cell state. I will argue that four conceptions of stemness should be distinguished rather than two. Finally, I will develop the case of the cancer stem cell (CSC) theory in order to show why it is crucial to answer the ontological question: some therapies might or might not be efficient depending on what stemness is. The data is part of the doctoral thesis which adopted the theory of complexity (Morin), depth psychology (Jung, Campbell, Bachelard), anthropology of the imaginary (Durand) and anthropology of the party (Duvignaud) with their main representatives in dialogue with other authors, as theoretical reference. The mithopoiésis (Ferreira Santos) here is understood as the elaboration of senses given by the Congadeiros to their own lives, guided by the mythical background of Nossa Senhora do Rosário has become the most appropriate methodology for the study. The results allowed the construction of new knowledge about the afro-descendent communities, enlarging our understanding of the Brazilian society, and ourselves. In Matthew 24, Jesus prophesied to his disciples about ‘wars and rumours of wars’ and other eschatological birth-pangs to prepare them in advance on how they are to be responding to eschatological events as they would be unfolding in the interim of his ascension and his promised Parousia. What then does Jesus mean by enlisting ‘wars and rumours of wars’ in this eschatological era to be functioning as ‘the beginning of birth-pangs’ and how should Christians be responding to wars and (...) rumours of wars as eschatological birth-pangs? Employing the redaction exegetical method, this study focuses on interpreting Matthew 24:6−8 to explain what Jesus most probably meant as he enlisted ‘wars and rumours of wars’ as eschatological birth-pangs; and with special reference to the Russia–Ukraine war that broke out on 24 February 2022, recommends from the Olivet prophecy how Christians are to be righteously responding to ‘wars and rumours of wars’ as eschatological birth-pangs. Contribution: This study explored Matthew 24:6−8 to unveil what Jesus means by enlisting wars and rumours of wars as eschatological birth-pangs. With special reference to the Russian military invasion of Ukraine, theological highlights were recommended on how Christians are to be responding to war and war rumours as end-time birth-pains. This essay presents a critique of current views of Hugo Grotius which erroneously see him as a major theorist of natural rights and a formative influence upon the rights theory of Thomas Hobbes. Especially singled out for criticism are the misconceptions due to Richard Tuck in a number of writings that discuss the political ideas of Grotius and Hobbes and the relationship between them. In an examination of Hobbes's conception of natural rights, the essay reaffirms its originality and notes its (...) revolutionary potential contrary to the main intention of Hobbes's own political doctrine. A continuoxis t- norm is a continuous map * from [0, 1]² into [0,1] such that is a commutative totally ordered monoid. Since the natural ordering on [0,1] is a complete lattice ordering, each continuous t-norm induces naturally a residuation → and becomes a commutative naturally ordered residuated monoid, also called a hoop. The variety of basic hoops is precisely the variety generated by all algebras, where * is a continuous t-norm. In this paper we investigate the structure of the (...) variety of basic hoops and some of its subvarieties. In particular we provide a complete description of the finite subdirectly irreducible basic hoops, and we show that the variety of basic hoops is generated as a quasivariety by its finite algebras. We extend these results to Hájek's BL-algebras, and we give an alternative proof of the fact that the variety of BL-algebras is generated by all algebras arising from continuous t-norms on [ 0,1] and their residua. The last part of the paper is devoted to the investigation of the subreducts of BL- algebras, of Gödel algebras and of product algebras. (shrink)

This paper briefly reviews highlights from decades of debates in medicine, law, bioethics, psychology and social research about children’s and parents’ views and consent to medical treatment and research. There appears to have been a rise and later a fall in respect for children’s views, illustrated among many examples by a recent book on the zone of parental discretion, which is reviewed. A return to greater respect for children’s views and consent is advocated.

Justice Stephen J. Field was the champion of a form of liberalism often said to be especially friendly to capitalism, the approach to the Constitution traditionally identified with “Lochnerism,” i.e., a laissez-faire oriented judicial activism. More recently a form of judicial revisionism has arisen, challenging the accepted descriptions of “Lochnerism” and of Field's jurisprudence. This article is an attempt to extend the revisionist approach by arriving at a more satisfactory understanding of the grounding of Field's jurisprudence in the natural rights (...) philosophy. Field, it turns out, orienting around natural rights, was not so unambiguously friendly to capitalism as previous generations of scholars maintained, but his approach is surely friendlier than the constitutional theories that have replaced natural rights since Field's day. An interrogation of the term 'theory' from the perspective of linguistic discourse Zima offers a new definition of theory from a cultural and sociological perspective, with a view to encountering heterogenerous points of view in critical dialogue.

Equipoise is advocated as a means of achieving high scientific and ethical standards in randomised trials. As used in the context of research the word describes a state of uncertainty characterised by the belief that in a trial no arm is known to offer greater harm or benefit than any other arm. Clinicians who lack personal equipoise are advised to accept clinical or communal equipoise, based on current unresolved disagreement among the medical profession. Equipoise is mainly discussed in the literature (...) as an issue for senior doctors and research directors. Limitations of professional equipoise are reviewed, and data on the neglected topic of patients' equipoise are reported using the example of breast cancer trials. In theory, a patient who gives informed and voluntary consent to enter a randomised trial has achieved the equilibrium of equipoise. In practice, equipoise among patients ranges from personal to proxy acceptance. (shrink)

The article is concerned with the question of how legal institutions are structured with the use of constitutive, institutive, consequential, and terminative rules. To that end, the regulation of international treaties as laid down in the Vienna Convention on the Law of Treaties of 1969 is analysed. This leads to the discovery of two additional categories of rules: content rules and invalidating rules. Finally, the special status of unique legal institutions is investigated. Unique legal institutions – for example, heads of (...) state, parliaments, and supreme courts – enjoy validity in a legal system to the exclusion of the validity of any other legal institution of the same category in that system.
